		<section id="H324D972EC56E486397F1BC49C3406730" section-type="section-one"><enum>1.</enum><header>Health care benefits for
			 certain nuclear facility workers</header>
			<subsection id="H1F8A37E8B6134E049C47DC700002112"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>
				<paragraph id="H7BF82731FEB8485CA4DA51418FE33700"><enum>(1)</enum><header>Accelerated
			 closure</header><text display-inline="yes-display-inline">The term
			 <term>accelerated closure</term> means closure of a site on an accelerated
			 schedule, as compared with the schedule of the Department for closure of the
			 site specified in plans of the Department that were in effect on January 1,
			 2000.</text>
				</paragraph><paragraph id="H9E7F01AB00AF455293F57FD81C987737"><enum>(2)</enum><header>Department</header><text>The
			 term <term>Department</term> means the Department of Energy.</text>
				</paragraph><paragraph id="H4981317A39624DDDA100F448FB93AF48"><enum>(3)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Energy.</text>
				</paragraph></subsection><subsection id="HCADC54CA9CE54D118D61DB3D1970DCFA"><enum>(b)</enum><header>Program</header><text>The
			 Secretary, after consultation with collective bargaining representatives of
			 eligible workers described in subsection (c), shall establish a program to
			 provide health care benefits for the eligible workers.</text>
			</subsection><subsection id="HF7F9DF39C9B54A17AB1CEAF471292766"><enum>(c)</enum><header>Eligible
			 workers</header><text>An individual shall be eligible for benefits under the
			 program established under subsection (b) only if the individual—</text>
				<paragraph id="HFF95F098C84740B800A7842210F820B9"><enum>(1)</enum><text display-inline="yes-display-inline">has been employed by a prime contractor of
			 the Department (including a subcontractor of the contractor) to perform duties,
			 under a contract between the prime contractor and the Department for
			 environmental remediation, waste management, decontamination and
			 decommissioning, maintenance, security, and administrative activities, at the
			 Fernald Closure Project (Harrison, Ohio), the Mound Closure Project
			 (Miamisburg, Ohio), or the Rocky Flats Environmental Technology Site (Golden,
			 Colorado); and</text>
				</paragraph><paragraph id="HCB22746587CF435893F26FD686AD0089"><enum>(2)</enum><text display-inline="yes-display-inline">would have qualified for health care
			 benefits available for retirees under the health and welfare benefit plans
			 sponsored by a prime contractor or subcontractor described in paragraph (1) if
			 the employment of the individual had not been terminated as a result of the
			 accelerated closure of the site at which the individual was employed.</text>
				</paragraph></subsection><subsection id="H9A2780F18A3E4720900050F000009DD"><enum>(d)</enum><header>Level of
			 benefits</header><text display-inline="yes-display-inline">To the extent
			 provided in advance in appropriations Acts or otherwise available, medical
			 benefits shall be provided under the program established under subsection (b)
			 at the same level as benefits are provided under the health and welfare benefit
			 plans sponsored by the prime contractors described in subsection (c)(1) to
			 employees who retired on January 1, 2005.</text>
			</subsection><subsection id="H0BAB751435934B13B0AFB27ED0EEB4FD"><enum>(e)</enum><header>Implementation</header><text>Not
			 later than 30 days after the date of enactment of this Act, the Secretary shall
			 take all necessary actions to implement the program under this section through
			 the contractors, subcontractors, or the benefit plan administrators of the
			 Department at the sites described in subsection (c)(1).</text>
			</subsection><subsection id="H92248B9EFAE14999B03772FE00D99D55"><enum>(f)</enum><header>Authorization of
			 appropriations</header><text>There are authorized to be appropriated to the
			 Secretary such sums as are necessary to carry out this section.</text>
