		<official-title>To amend part B of title XVIII of the Social Security Act
		  to make a technical correction to ensure that all physicians, as defined for
		  purposes of the Medicare Program, are permitted to perform required
		  face-to-face examinations and prescribe Medicare covered durable medical
		  equipment, prosthetics, orthotics, and supplies.</official-title>

		<section id="H02918FDA08BD498494DDC2BB29B8900" section-type="section-one"><enum>1.</enum><header>Permitting all physicians, as
			 defined for purposes of the Medicare program, to perform required face-to-face
			 examinations and prescribe Medicare covered durable medical equipment,
			 prosthetics, orthotics, and supplies</header>
			<subsection id="H255E0196A270496BA5F28EA7AA1396F9"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Clauses (ii) and (iv)
			 of section 1834(a)(1)(E) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(a)(1)(E)</external-xref>)
			 are each amended by striking <quote>section 1861(r)(1)</quote> and inserting
			 <quote>section 1861(r)</quote>.</text>
			</subsection><subsection id="HD9542C9860CA4756002CFBF262AF838"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by subsection (a) shall apply to
			 face-to-face examinations and prescriptions made on or after January 1,
			 2009.</text>
