		<section id="H99CB94A190FA4B8DB2AB044F8D2DD3C9" section-type="section-one"><enum>1.</enum><header>Extension of Moving-to-Work
			 program agreements</header>
			<subsection id="HE1B39A6B78E547BFAC2729118C5C9200"><enum>(a)</enum><header>Moving to work
			 demonstration program agreements</header>
				<paragraph id="H900487F956C849A9B23CC0E36DC57EEB"><enum>(1)</enum><header>Extension for
			 agencies with expiring agreements</header><text display-inline="yes-display-inline">Notwithstanding any prior provision of law,
			 upon the request of a public housing agency not described in paragraph (2) and
			 having a Moving to Work agreement under the demonstration authorized by section
			 204 of the Departments of Veterans Affairs and Housing and Urban Development,
			 and Independent Agencies Appropriations Act, 1996 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref> note; Public
			 Law 104–134; 110 Stat. 1321–281), the Secretary of Housing and Urban
			 Development shall extend the Moving to Work agreement of the agency
			 under—</text>
					<subparagraph id="H93FD0E59495148CEB36928C5DCDC0054"><enum>(A)</enum><text>such terms as are
			 or were in effect upon the date of expiration of the agreement, and</text>
					</subparagraph><subparagraph id="HF84CB0FD6E4F41A1932C8E009D67BD4C"><enum>(B)</enum><text>for a 12-month
			 period beginning upon the date of execution of the extension.</text>
					</subparagraph></paragraph><paragraph id="H68F77A9C87314461999FB59174CE47F0"><enum>(2)</enum><header>Extension for
			 agencies with new agreements</header><text>Notwithstanding any prior provision
			 of law, for any public housing agency that previously received an extension of
			 its Moving to Work agreement from the Secretary and entered into a subsequent
			 agreement with the Secretary after January 1, 2008, the Secretary of Housing
			 and Urban Development shall, upon the request of the agency, invalidate such
			 subsequent agreement and extend any agreement that was in effect as of January
			 1, 2008 under—</text>
					<subparagraph id="HFD1D01772856475287483FD9E5196C4E"><enum>(A)</enum><text>such terms as were
			 in effect as of January 1, 2008, and</text>
					</subparagraph><subparagraph id="H8ABA36337E1F461B97DF5B560297E57D"><enum>(B)</enum><text>for a 12-month
			 period beginning upon the date of execution of the extension authorized
			 pursuant to this paragraph.</text>
					</subparagraph></paragraph></subsection><subsection id="HB5F8F8302391480CA9D8D197BC2FAB94"><enum>(b)</enum><header>Requirement for
			 compliance</header>
				<paragraph id="H70230232EED94E9CB0EE9BD2EBAA211B"><enum>(1)</enum><header>Compliance</header><text>Notwithstanding
			 subsection (a), the Secretary of Housing and Urban Development shall not extend
			 a Moving to Work agreement if the Secretary finds that the public housing
			 agency requesting the extension is not in compliance with the terms of its
			 agreement.</text>
				</paragraph><paragraph id="H42F768BCA8F64EE2838E853E927F2F37"><enum>(2)</enum><header>Appeal of
			 findings</header><text>Upon a finding described in paragraph (1), the agency
			 may submit certifications by an independent expert with subject matter
			 experience in the area of the agency’s noncompliance to the Secretary of
			 Housing and Urban Development in order to contest any such finding.</text>
				</paragraph><paragraph id="H7FD3012233214B77A01500D32790EE87"><enum>(3)</enum><header>Resolution</header><text>If
			 the Secretary determines, pursuant to such certifications by the agency, that
			 such agency did not fail to comply with the terms of its agreement, the
			 Secretary shall vacate the finding of such noncompliance and, upon the request
			 of the agency, the Secretary shall extend the term of the agency’s agreement
			 for a 12-month period. The Secretary shall notify the public housing agency of
			 its decision regarding the acceptance or rejection of any such certifications
			 within 30 days after receipt of such certifications.</text>
				</paragraph></subsection><subsection id="H151279A55FDB484DAA08DEE150AE9D28"><enum>(c)</enum><header>Sense of the
			 Congress</header><text>It is the sense of the Congress that the maximum number
			 of public housing agencies authorized to participate in the Moving to Work
			 demonstration program should not be expanded until the demonstration has been
			 reformed and permanently authorized through enactment of a Federal law.</text>
			</subsection><subsection id="H5707BDCA3D864E0799231E70F9DE127B"><enum>(d)</enum><header>Sunset</header><text>This
			 section shall have no force or effect after the expiration of the 18-month
			 period beginning upon the date of the enactment of this Act.</text>
