		<official-title>To amend the Fair Credit Reporting Act to prohibit the
		  use of consumer reports and consumer information in making any determination
		  involving personal lines of insurance with respect to a consumer, and for other
		  purposes.</official-title>

		<section id="H2466247DEBA14A258F56C22254BDBE44" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Personal Lines of Insurance Fairness
			 Act of 2008</short-title></quote>.</text>
		</section><section id="HA9B766E91C1C4632A2D97FD52C5039D4"><enum>2.</enum><header>Use of consumer
			 reports and consumer information for certain insurance purposes
			 prohibited</header>
			<subsection id="H32712B408F234CCD9C471709BC30B463"><enum>(a)</enum><header>In
			 general</header><text>Section 604(a)(3)(C) of the Fair Credit Reporting Act (15
			 U.S.C. 1681b(a)(3)(C)) is amended by inserting <quote>, except personal lines
			 of insurance</quote> before the semicolon.</text>
			</subsection><subsection id="H2BD96E6136A34ECDBA1F61367298CD0"><enum>(b)</enum><header>Rule of
			 construction</header><text display-inline="yes-display-inline">Section 604 of
			 the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681">15 U.S.C. 1681(b)</external-xref>) is amended by adding at the
			 end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="HA7EAA1D3B34F44D9B42FDC00D3E3AC5F" style="OLC">
					<subsection id="HD5F63F44914B4DCAA11D25D4C86C6500"><enum>(h)</enum><header>Certain lines of
				insurance not an authorized business purpose</header>
						<paragraph id="H4000D1D633EF4BCD9D134BC8F669BED"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">No consumer reporting
				agency may furnish a consumer report or consumer information with respect to
				any consumer to any person for use in making any decision to underwrite or rate
				any personal lines of insurance, and no person shall use or obtain a consumer
				report or consumer information with respect to any consumer in connection with
				the underwriting or rating of any consumer in connection with a transaction
				involving personal lines of insurance.</text>
						</paragraph><paragraph id="H7B5D200E3D244580B4004B43EBC11028"><enum>(2)</enum><header>Insurance
				information not included</header><text display-inline="yes-display-inline">Information derived from the following
				databases shall not be treated as a consumer report or consumer information for
				purposes of paragraph (1):</text>
							<subparagraph id="H170C85EAC72C426FBB83B5AC7775DEF8"><enum>(A)</enum><text display-inline="yes-display-inline">Databases that contain information on
				property loss data regarding personal lines of insurance, such as the
				Comprehensive Loss Underwriting Exchange (CLUE) and Automobile Property Loss
				Underwriting System (A–PLUS).</text>
							</subparagraph><subparagraph id="H24FF3AB6253C448C80B874E395F7C9D4"><enum>(B)</enum><text>Databases that
				contain information on driver history, such as accidents or moving violations,
				typically maintained at State departments of motor vehicles.</text>
							</subparagraph><subparagraph id="H8FF92B6875C84B6E8300E8D272881F02"><enum>(C)</enum><text display-inline="yes-display-inline">Databases that contain information on a
				consumer’s medical history, to the extent such access and use for purposes
				described in paragraph (1) is consistent with the requirements of section
				604(g).</text>
							</subparagraph></paragraph><paragraph id="HADEC78796EFA4E699B418B0023CD37F4"><enum>(3)</enum><header>Definitions</header><text><?xm-replace_text "?>For
				purposes of this subsection, the following definitions shall apply:</text>
							<subparagraph id="H3C97724E837C4F209CE8E990D1655D6"><enum>(A)</enum><header>Consumer
				information</header><text display-inline="yes-display-inline">The term
				‘consumer information’ means any information from the file of any consumer at a
				consumer reporting agency, or any product derived from any such information
				such as consumer credit reports or credit scores or other risk score or
				predictor on any consumer.</text>
							</subparagraph><subparagraph id="H519B2484661449D7A6145FA5000032C2"><enum>(B)</enum><header>Personal line of
				insurance</header><text display-inline="yes-display-inline">The term ‘personal
				line of insurance’ means any personal automobile or homeowners line of
				insurance, as defined in the Uniform Property and Casualty Product Coding
				Matrix established and maintained by the National Association of Insurance
				Commissioners or any successor document.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
