		<official-title>To require the Federal Communications Commission to
		  establish requirements and issue a nationwide public safety broadband license,
		  to establish a grant program to fund administrative and operational costs of
		  the licensee, and for other purposes.</official-title>

		<section id="HE93752AED9B2420590F5CB7D23408216" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Public Safety Broadband Authorization
			 Act of 2008</short-title></quote>.</text>
		</section><section id="H67BA02977FA74950B9E4253D9CF2A0B2" section-type="subsequent-section"><enum>2.</enum><header>Public Safety
			 Broadband License</header>
			<subsection id="HC99DE08152314E22BF3D02A7FEF53F7D"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Federal
			 Communications Commission shall modify the nationwide license issued under the
			 Communications Act of 1934 to the Public Safety Broadband Licensee
			 (<quote>PSBL</quote>) for the use of the broadband segment of the spectrum
			 allocated for public safety services under section 337(a)(1) of such Act (47
			 U.S.C. 337(a)(1)) as required by subsection (b).</text>
			</subsection><subsection id="HBD87B626E71C470E8C00475D77214F00"><enum>(b)</enum><header>License
			 requirements</header><text display-inline="yes-display-inline">The license
			 under subsection (a) shall require, at a minimum, that the PSBL—</text>
				<paragraph id="H5956DBD3EC9D487F95D004180DAA800"><enum>(1)</enum><text>collaborate with a
			 commercial entity to establish a nationwide, interoperable broadband public
			 safety communications network;</text>
				</paragraph><paragraph id="HBEB04B0ABE9B48B1976678BCF320B4C1"><enum>(2)</enum><text>be broadly
			 representative of the public safety community;</text>
				</paragraph><paragraph id="H40B5757612AF4FFAB648ACF4BB73A68F"><enum>(3)</enum><text>operate as a
			 not-for-profit organization;</text>
				</paragraph><paragraph id="H9A69CA4A89874042B0FE00B24548CD51"><enum>(4)</enum><text>have no
			 participation in its management by commercial entities or interests;</text>
				</paragraph><paragraph id="H9A6500CED33D4AF2BC67C6D95379932"><enum>(5)</enum><text>submit an annual
			 budget to the Commission that includes both projected expenditures and income;
			 and</text>
				</paragraph><paragraph id="H3513170044F84506BEF627A9B1EDDB07"><enum>(6)</enum><text>submit a report to
			 the Commission, the Committee on Energy and Commerce of the House of
			 Representatives, and the Committee on Commerce, Science, and Transportation of
			 the Senate not later than 30 days after the end of each fiscal year documenting
			 all income and expenditures made in such fiscal year.</text>
				</paragraph></subsection></section><section id="HA8034897F4A342CCAD2DC5B4762011F4"><enum>3.</enum><header>Grant for
			 administrative and operational costs</header>
			<subsection id="HD9A9285CD7614F5181E6F7CCD92CB7DD"><enum>(a)</enum><header>In
			 General</header><text>The Commission shall make grants, not to exceed
			 $1,000,000 per fiscal year for each of fiscal years 2009 and 2010, to the PSBL
			 to fund administrative and operational costs.</text>
			</subsection><subsection id="HEF99167BFCDB4749975B1BCD51ABED1"><enum>(b)</enum><header>Budget
			 Required</header><text>Prior to making a grant under
			 <internal-xref idref="HD9A9285CD7614F5181E6F7CCD92CB7DD" legis-path="2.(a)">subsection (a)</internal-xref>, the Commission shall review
			 and approve the budget submitted under section (2)(b)(5).</text>
			</subsection><subsection id="HA8A2C091537B4B4B8FA8CE257B21110"><enum>(c)</enum><header>Grant
			 restrictions</header><text>Upon receipt of grant funds under this section, the
			 PSBL shall not—</text>
				<paragraph id="H1521F112CE5A4A2CB07F54532B74BA3B"><enum>(1)</enum><text display-inline="yes-display-inline">receive any payments from any entity in
			 each fiscal year covered by such grant funds; and</text>
				</paragraph><paragraph id="H5ECB7206891F4F1C969B467072BE53EB"><enum>(2)</enum><text display-inline="yes-display-inline">use any grant funds received to pay any
			 debts that the PSBL had incurred before the receipt of such grant funds.</text>
				</paragraph></subsection><subsection id="H169D617C5841488C0095A81552C75C59"><enum>(d)</enum><header>Use of
			 appropriated funds</header><text display-inline="yes-display-inline">Any sums
			 appropriated to the Commission pursuant to this Act for which the Commission
			 does not make grants under this section shall be used by the Commission to
			 promote the establishment of a nationwide, interoperable broadband public
			 safety communications network.</text>
			</subsection></section><section id="HC59E4B61AA1648B68F4B2070456360C9"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act, the following definitions
			 apply:</text>
			<paragraph id="H209F621C0CF64597B4597072F9A9B61F"><enum>(1)</enum><header>Commission</header><text>The
			 term <quote>Commission</quote> refers to the Federal Communications
			 Commission.</text>
			</paragraph><paragraph id="H426F39D2652E4532A017FA949422EB8B"><enum>(2)</enum><header>Public Safety
			 Broadband Licensee</header><text display-inline="yes-display-inline">The term
			 <quote>Public Safety Broadband Licensee</quote> or <quote>PSBL</quote> has the
			 meaning given the term in section 90.7 of the Commission’s rules (47 C.F.R.
			 90.7) as in effect on May 1, 2008.</text>
			</paragraph></section><section id="H29ED73B81D6443508DD0F7172C413978"><enum>5.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">There is
			 authorized to be appropriated to the Commission to carry out this Act
			 $2,000,000 for each of fiscal years 2009 and 2010.</text>
