<section id="HA05CC2A3AE194527AD10B67300454115" section-type="section-one"><enum>1.</enum><header>Relief for surviving spouses</header> 
<subsection id="HDB71FB6D2CD446C1AF63EF6505EC8100"><enum>(a)</enum><header>In general</header><text>The second sentence of section 201(b)(2)(A)(i) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151(b)(2)(A)(i)</external-xref>) is amended by inserting <quote>(or if, married for less than two years at the time of the citizen’s death, an alien who proves by a preponderance of the evidence that the marriage was entered into in good faith and not solely for the purpose of obtaining an immigration benefit)</quote> after <quote>for at least two years at the time of the citizen’s death</quote>.</text> </subsection>
<subsection commented="no" id="H210FE8AF13B342D0B34167BAB983D143"><enum>(b)</enum><header>Applicability</header> 
<paragraph id="HD45F040659EF419BA45340C7109210D7"><enum>(1)</enum><header>In general</header><text>The amendment made by subsection (a) shall apply to all applications and petitions relating to immediate relative status under section 201(b)(2)(A)(i) of the Immigration and Nationality Act pending on or after the date of the enactment of this Act.</text> </paragraph>
<paragraph id="H0808A4262CB541E6B64E9FF11DF7943B"><enum>(2)</enum><header>Other spouses</header><text>In the case of an alien who would be considered, by reason of the amendment made by subsection (a), to remain an immediate relative after the date of their citizen spouse’s death if the alien had filed a petition under section 204(a)(1)(A)(ii) of such Act within 2 years after such date, but who did not file within such period, the alien shall have 2 years after the date of the enactment of this Act to file such petition notwithstanding any other provision of law.</text> </paragraph></subsection></section>

<paragraph id="H7631BFA7C5C64834BD44B46123599798"><enum>(1)</enum><header>In general</header><text>The amendment made by subsection (a) shall apply to all applications and petitions relating to immediate relative status under section 201(b)(2)(A)(i) of the Immigration and Nationality Act pending on or after the date of the enactment of this Act.</text></paragraph>
<paragraph id="HBD375C6660F5463BB9B37BFB56D07745"><enum>(2)</enum><header>Transition cases</header>
<subparagraph id="H75BF92E474714654A81D6D39041C478D"><enum>(A)</enum><header>In general</header><text>In the case of an alien described in subparagraph (B) who seeks immediate relative status pursuant to the amendment made by subsection (a), the alien shall have until the date that is 2 years after the date of the enactment of this Act to file a petition under section 204(a)(1)(A)(ii) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1154">8 U.S.C. 1154(a)(1)(A)(ii)</external-xref>), notwithstanding any other provision of law.</text></subparagraph>
<subparagraph id="H3A051975ABA64BF39284C51162256781"><enum>(B)</enum><header>Aliens described</header><text display-inline="yes-display-inline">An alien is described in this subparagraph if—</text>
<clause id="HC62356F4CAAB46FA8717F12FBEFADA0"><enum>(i)</enum><text>the alien’s United States citizen spouse died before the date of the enactment of this Act;</text></clause>
<clause id="H6706D7CCD4E94736874D8F7D7D6BC6C"><enum>(ii)</enum><text>the alien and the citizen spouse were married for less than 2 years at the time of the citizen spouse’s death; and</text></clause>
<clause id="HDC44745DA0D84A488FC2EB685494E71"><enum>(iii)</enum><text>the alien has not remarried.</text></clause></subparagraph></paragraph></subsection></section>
