<section id="HA424DD7AFAB14BBC824620DC7223028" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Lance Corporal Jose Gutierrez Act of 2008</short-title></quote>.</text></section>
<section id="H1CDE3CAAC75849BB9FB11FF188080092" section-type="subsequent-section"><enum>2.</enum><header>Facilitating naturalization for military personnel</header>
<subsection id="H0CB6FBAE43BC4C7895E69CC77F57829C"><enum>(a)</enum><header>In general</header><text>Any person who served honorably as a member of the Armed Forces in support of contingency operations (as defined in <external-xref legal-doc="usc" parsable-cite="usc/10/101">section 101(a)(13)</external-xref> of title 10, United States Code) shall be eligible for naturalization pursuant to section 329 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1440">8 U.S.C. 1440</external-xref>) as if the person had served during a period designated by the President under such section 329.</text></subsection>
<subsection id="HE8782089E3EC4327B1F02F5D15F4A68"><enum>(b)</enum><header>Naturalization through service in the Armed Forces of the United States</header><text>Section 328 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1439">8 U.S.C. 1439</external-xref>) is amended—</text>
<paragraph id="H4F64CCDA5C6C486295A83972FDECA66"><enum>(1)</enum><text>in subsection (a), by striking <quote>six months</quote> and inserting <quote>one year</quote>;</text></paragraph>
<paragraph id="H20DC4DE63E0441F0A20057EAD6DA4BA9"><enum>(2)</enum><text>by striking subsection (c);</text></paragraph>
<paragraph id="H800537B90A4F4B1089A03D7D4C845C6B"><enum>(3)</enum><text>in subsection (d), by striking <quote>six months</quote> and inserting <quote>one year</quote>; and</text></paragraph>
<paragraph id="H2FCF8F351BF74A0D00E9167212484215"><enum>(4)</enum><text>by redesignating subsections (d), (e), and (f) as subsections (c), (d), and (e), respectively.</text></paragraph></subsection></section>
<section id="HF931FF8DEFFE4EA9999C5522853833CD"><enum>3.</enum><header>Facilitating removal of conditional status for military personnel and their families</header>
<subsection id="H02ACA7EF379B40E1ADEB285506632200"><enum>(a)</enum><header>Period for filing petition</header><text display-inline="yes-display-inline">Section 216(d)(2) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1186a">8 U.S.C. 1186a(d)(2)</external-xref>) is amended—</text>
<paragraph id="H2EEF1AF216B84A25AC91B5288BA52C88"><enum>(1)</enum><text>in subparagraph (A), by striking <quote>subparagraph (B),</quote> and inserting <quote>subparagraphs (B) and (D),</quote>; and</text></paragraph>
<paragraph id="H1755544178614484BAD0EB11AD136900"><enum>(2)</enum><text>by adding at the end the following:</text>
<quoted-block style="OLC" id="H927E96FFCEC8443283D30028829F289E" display-inline="no-display-inline">
<subparagraph id="HB17D96FFA30D44EC851FBB4F5300D0BA"><enum>(D)</enum><header>Filing of petitions during military service</header><text display-inline="yes-display-inline">In the case of an alien who is serving as a member of the Selected Reserve of the Ready Reserve or in an active-duty status in the military, air, or naval forces of the United States during the 90-day period described in subparagraph (A), the alien may file the petition under subsection (c)(1)(A) during the 6-month period beginning on the date on which the alien is discharged from such service.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="H6E0E90AD1CA841958F0742A1878470E9"><enum>(b)</enum><header>Requirements of timely petition and interview for removal of condition</header><text display-inline="yes-display-inline">Section 216(c)(1)(B) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1186a">8 U.S.C. 1186a(a)(1)</external-xref>) is amended by inserting <quote>or serving in the Armed Forces at the time of the interview</quote> after <quote>deceased</quote>.</text></subsection></section>
<section id="H3E236FC39C4D4B56A039C4607570BE3D"><enum>4.</enum><header>Factors to consider in initiating removal proceedings against active duty military personnel or veterans</header><text display-inline="no-display-inline">Section 239 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1229a">8 U.S.C. 1229a</external-xref>) is amended by adding at the end the following:</text>

<subsection id="H5477802F962643F2B0901EB6848938DD"><enum>(f)</enum>
<paragraph id="H33D3BFBB0A7947DDB3C5D78F48D4AFBF" display-inline="yes-display-inline"><enum>(1)</enum><text>A notice to appear shall not be issued against an alien who served honorably at any time in the Armed Forces of the United States, and who, if separated from such service, separated under honorable conditions, without prior approval from the Director of the United States Citizenship and Immigration Services or the Assistant Secretary of Homeland Security for U.S. Immigration and Customs Enforcement.</text></paragraph>
<paragraph id="H6A5E777536A449ACAC6B00C1A8F2FB6" indent="up1"><enum>(2)</enum><text>In determining whether to issue a notice to appear against such an alien, the Director or the Assistant Secretary shall consider the alien’s eligibility for naturalization under section 328 or 329, as well as the alien’s record of military service, grounds of deportability applicable to the alien, and any hardship to the Armed Services, the alien, and his or her family if the alien were to be placed in removal proceedings.</text></paragraph>
<paragraph id="H85A4DC30DE834A7AB2BB4F9800C679AA" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">An alien who served honorably at any time in the Armed Forces of the United States, and who, if separated from such service, separated under honorable conditions, shall not be removed from the United States under subparagraph (A)(i) or (B)(iii) of section 235(b)(1), section 238, or section 241(a)(5).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section id="H5D306E81EB614C80BDA3F568073FA5F2"><enum>5.</enum><header>Discretionary relief for active duty military personnel, veterans, and family members in removal proceedings</header>
<subsection id="HD0DF9F49AE0D4DB0AE824C3636D7BF98"><enum>(a)</enum><header>Grounds of inadmissibility</header><text>Section 212 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182</external-xref>) is amended by inserting after subsection (b) the following:</text>

<subsection id="HFF29CA393CED4900885F8761E1AA00C1"><enum>(c)</enum><header>Military service personnel and family members</header>
<paragraph id="H80B21B8262934B63998BD8A2AF906984"><enum>(1)</enum><header>In general</header><text>With respect to an alien who served honorably at any time in the Armed Forces of the United States, and who, if separated from such service, separated under honorable conditions, or an alien who is the spouse, child, son, daughter, parent, or minor sibling of a member serving in the Armed Forces of the United States—</text>
<subparagraph id="HFD360E7F05B946EBB5A8729E16E4EF35"><enum>(A)</enum><text>paragraphs (4), (5), (6)(A), (7)(A), and (9)(B) of subsection (a) shall not apply;</text></subparagraph>
<subparagraph id="HC66EA778BBBA482BBC063D7CCF4296CF"><enum>(B)</enum><text display-inline="yes-display-inline">the Secretary of Homeland Security, or the Attorney General, shall not waive—</text>
<clause id="HD2B1507FE1864958B77ED00CF2AEFE"><enum>(i)</enum><text>subsection (a)(2)(B), if the alien actually was incarcerated for 5 years or more for the offenses described in such subsection;</text></clause>
<clause id="H84F595C926A549B09951E83C1CBEBC33"><enum>(ii)</enum><text>subparagraph (C), (D), (G), or (H) of subsection (a)(2);</text></clause>
<clause id="H81365F3088D54E589391A7EDE150BD00"><enum>(iii)</enum><text>subparagraph (A), (B), (C), (E), or (F) of subsection (a)(3);</text></clause>
<clause id="H0FB818D1FBB242A283F51486F86DDE5"><enum>(iv)</enum><text>subsection (a)(6)(E);</text></clause>
<clause id="H58458689DC7D4F0286C8B2C00E4BCD9"><enum>(v)</enum><text>subparagraph (A) or (C) of subsection (a)(10); or</text></clause>
<clause id="H1412D4AD063D46D68DD465383457E0B2"><enum>(vi)</enum><text>subsection (a)(10)(D), if the alien has received a conviction, award, compromise, settlement, or injunction for an offense described in clause (i) of such subsection, and if the court finds that the alien did not reasonably believe at the time such violation that the alien was a citizen; and</text></clause></subparagraph>
<subparagraph id="HABA6E3A5B6984CD78D4D23A89CC572B2" display-inline="no-display-inline"><enum>(C)</enum><text>the Secretary of Homeland Security, or the Attorney General, may waive any other provision of subsection (a).</text></subparagraph></paragraph>
<paragraph id="H4350C5F978924B58A96F3E2C8DA60035"><enum>(2)</enum><header>Waiver factors</header><text>In making a determination under paragraph (1)(C), the following factors may be considered:</text>
<subparagraph id="HA42E1D8B3DFF46B80058C90800A6AA42" commented="no"><enum>(A)</enum><text>The grounds of inadmissibility applicable to the alien.</text></subparagraph>
<subparagraph id="HEB93382B5A5F429BA3E935DEE9BEE5D1" commented="no"><enum>(B)</enum><text>The alien’s service in the United States military, or the degree to which the alien’s removal would affect a close family member who is serving or has served in the Armed Forces.</text></subparagraph>
<subparagraph id="H299A4E949A6C473A8473AB0068E2D410" commented="no"><enum>(C)</enum><text>The length of time the alien has lived in the United States.</text></subparagraph>
<subparagraph id="H18E34CDB43BB444AAD96E52BB57E8E55" commented="no"><enum>(D)</enum><text>The degree to which the alien would be impacted by his or her removal from the United States.</text></subparagraph>
<subparagraph id="HD9EADC8DF69C4CDA93719843E5FC6793" commented="no"><enum>(E)</enum><text>The existence of close family ties within the United States.</text></subparagraph>
<subparagraph id="H8EA1107B380D4E5195FCC35617EE9BE9" commented="no"><enum>(F)</enum><text>The degree to which the alien’s removal would adversely affect the alien’s United States citizen, or lawful permanent resident, parents, spouses, children, sons, daughters, or siblings.</text></subparagraph>
<subparagraph id="HE7B2C876C46A48D5B2D34886C71F9E74" commented="no"><enum>(G)</enum><text>The alien’s history of employment in the United States, including whether the alien has been self-employed or has owned a business.</text></subparagraph>
<subparagraph id="H56208F0A3E5A42BC994DA001652AFEA" commented="no"><enum>(H)</enum><text>The degree to which the alien’s removal would adversely affect the alien’s United States employer or business.</text></subparagraph>
<subparagraph id="HF314898DD4704EC59E5CCB2F029F05A1" commented="no"><enum>(I)</enum><text>The degree to which the alien has ties to the alien’s community in the United States or has contributed to the Nation through community, volunteer, or other activities.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="HF3DA1BB690BD49B7929E98C5627FBEB4"><enum>(b)</enum><header>Grounds of deportability</header><text>Section 237 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1227">8 U.S.C. 1227</external-xref>) is amended by adding at the end the following:</text>

<subsection id="H0FA27C7BAB894BD4936150B29DA3994E"><enum>(d)</enum><header>Military service personnel and family members</header>
<paragraph id="H68A5ACA4F9324098B93CC28F07884D00"><enum>(1)</enum><header>In general</header><text>With respect to an alien who served honorably at any time in the Armed Forces of the United States, and who, if separated from such service, separated under honorable conditions, or an alien who is the spouse, child, son, daughter, parent, or minor sibling of a member serving in the Armed Forces of the United States—</text>
<subparagraph id="H05948B1A453D42E3A82010B396F53451"><enum>(A)</enum><text>paragraphs (1)(D), (3)(A), and (5) of subsection (a) shall not apply;</text></subparagraph>
<subparagraph id="H99D3DF0568D848E98F9DD3123C57B218"><enum>(B)</enum><text display-inline="yes-display-inline">the Secretary of Homeland Security, or the Attorney General, shall not waive—</text>
<clause id="H1CDB42F6A57B429DBD0048AB998C4470"><enum>(i)</enum><text>subsection (a)(1)(E);</text></clause>
<clause id="H30A3014B54A34BFE9E73EC5DE96F008C"><enum>(ii)</enum><text>subsection (a)(2)(A)(ii), if the alien actually was incarcerated for 5 years or more for the offenses described in such subsection;</text></clause>
<clause id="H527FE02F115A4C9E8B404EE9E44D29EB"><enum>(iii)</enum><text>subsection (a)(2)(A)(iii), if the aggravated felony involved was an offense described in subparagraph (A), (B), (C), (D), (E)(i), (H), (I), (K)(i), (K)(ii), (K)(iii), (L)(i), (L)(ii), (L)(iii), (M)(ii), (R), (S), or (U) of section 101(a)(43);</text></clause>
<clause id="HC724987EF8EB4EBD855F3BD881114CFC"><enum>(iv)</enum><text>clause (iv) or (v) of subsection (a)(2)(A);</text></clause>
<clause id="H737A242F53004E0088D527EA04A15C1D"><enum>(v)</enum><text>clause (i) or (ii) of subsection (a)(2)(D);</text></clause>
<clause id="H3006F0835F034ADEBE489D5EA6EFD565"><enum>(vi)</enum><text>subsection (a)(2)(D)(iii), if the offense is a violation of the Trading With the Enemy Act;</text></clause>
<clause id="HA3A4340DA01B4807BDA48D9E16AB1952"><enum>(vii)</enum><text>subsection (a)(2)(D)(iv), if the offense is a violation of section 278;</text></clause>
<clause id="HB617937D32D84EFEB48B3E6DE0C5F4FB"><enum>(viii)</enum><text>subparagraph (A), (B), (C)(i), (D), or (E) of subsection (a)(4); or</text></clause>
<clause id="HABF67128114C4C94A837B359BC4C2952"><enum>(ix)</enum><text display-inline="yes-display-inline">subsection (a)(6)(A), if the alien has received a conviction, award, compromise, settlement, or injunction for an offense described in such subsection, and if the court finds that the alien did not reasonably believe at the time such violation that the alien was a citizen; and</text></clause></subparagraph>
<subparagraph id="H235D0B99D3DC415FA1005811EF23ACD0" display-inline="no-display-inline"><enum>(C)</enum><text>the Secretary of Homeland Security, or the Attorney General, may waive any other provision of subsection (a).</text></subparagraph></paragraph>
<paragraph id="HC1F59DCA361D4A21872617CC80B46E6C"><enum>(2)</enum><header>Waiver factors</header><text display-inline="yes-display-inline">In making a determination under paragraph (1)(C), the following factors may be considered:</text>
<subparagraph id="HE4B90FCBCADF4C20B8F2BD1369137E7" commented="no"><enum>(A)</enum><text>The grounds of deportability applicable to the alien.</text></subparagraph>
<subparagraph id="HADA19E8E751B443295EAD9688BD01600" commented="no"><enum>(B)</enum><text>The alien’s service in the United States military, or the degree to which the alien’s removal would affect a close family member who is serving or has served in the Armed Forces.</text></subparagraph>
<subparagraph id="H15FBFFF5D636419F9D69144BADDC8ED" commented="no"><enum>(C)</enum><text>The length of time the alien has lived in the United States.</text></subparagraph>
<subparagraph id="H69C9E51C463045C297F9DCEBAF00F9BE" commented="no"><enum>(D)</enum><text>The degree to which the alien would be impacted by his or her removal from the United States.</text></subparagraph>
<subparagraph id="H831E0C6DD3D34B70A805041CDCEC681" commented="no"><enum>(E)</enum><text>The existence of close family ties within the United States.</text></subparagraph>
<subparagraph id="HCC6EA84BA3104E478FFAA1001CD5EF66" commented="no"><enum>(F)</enum><text>The degree to which the alien’s removal would adversely affect the alien’s United States citizen, or lawful permanent resident, parents, spouses, children, sons, daughters, or siblings.</text></subparagraph>
<subparagraph id="H4779B9E35BCC452AA34DF26318D581DD" commented="no"><enum>(G)</enum><text>The alien’s history of employment in the United States, including whether the alien has been self-employed or has owned a business.</text></subparagraph>
<subparagraph id="H05BD7F1502E2410691E09B0385D58CC" commented="no"><enum>(H)</enum><text>The degree to which the alien’s removal would adversely affect the aliens United States employer or business.</text></subparagraph>
<subparagraph id="H8BA3E473F6ED4093B273C4402101F446" commented="no"><enum>(I)</enum><text>The degree to which the alien has ties to the alien’s community in the United States or has contributed to the Nation through community, volunteer, or other activities.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
<section id="H4E4C20DFD40C47BC92FD8FCF60157C00"><enum>6.</enum><header>Timely reunification of military personnel and their nuclear families</header><text display-inline="no-display-inline">Section 201(b)(1) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151(b)(1)</external-xref>) is amended by adding at the end the following:</text>
<quoted-block id="HFFFC8C9F2FB74CF5A3BA499E1173234E" style="OLC">
<subparagraph id="H2FCDC84F3D374A309DCF73EBFCFE1B" indent="up1"><enum>(F)</enum><text>Aliens who are eligible for an immigrant visa under paragraph (2)(A) of section 203(a) and are either the spouse or child of an alien who is serving in the Armed Forces of the United States.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section id="H3D559F9D90D446DCA35054CE453200C1"><enum>7.</enum><header>Relief for immediate family members of active duty personnel</header>
<subsection id="H4917EA988BFF41EF9D5257A54EA31A0"><enum>(a)</enum><header>In general</header><text>The Secretary of Homeland Security shall adjust the status of an alien described in subsection (b) to that of an alien lawfully admitted for permanent residence if the alien—</text>
<paragraph id="HD8E671AB418F4272B6D88116E73DC8EF"><enum>(1)</enum><text>applies for such adjustment, and is physically present in the United States on the date the application is filed;</text></paragraph>
<paragraph id="H93421696F07148CD8BD1A63A0AD6400"><enum>(2)</enum><text>is admissible to the United States as an immigrant, except as provided in subsection (d); and</text></paragraph>
<paragraph id="H049B934DAB294D33BAD835BC497943A5"><enum>(3)</enum><text>pays a fee, as determined by the Secretary, for the processing of such application.</text></paragraph></subsection>
<subsection id="H881887C5A74840C6852EC696641D30F9"><enum>(b)</enum><header>Eligible aliens</header>
<paragraph id="HDFE3A65B09F74BC1B74BC21402009540"><enum>(1)</enum><header>In general</header><text>The benefits provided in subsection (a) shall apply only to an alien who is a parent, spouse, child, son or daughter, or minor sibling of an eligible member of the Armed Forces, as defined in subsection (c).</text></paragraph>
<paragraph id="HFB3BA63CF88841428F3E4E6D0361693F"><enum>(2)</enum><header>Posthumous benefits</header><text>An alien described in paragraph (1) shall continue to be eligible for adjustment under this section for 2 years after the death of an eligible member of the Armed Forces whose death was the result of injury or disease incurred in or aggravated by his or her service in the Armed Forces.</text></paragraph></subsection>
<subsection id="H20D2F8370CE84B30BE636FF33DA1C08" display-inline="no-display-inline"><enum>(c)</enum><header>Eligible members of the Armed Forces</header><text display-inline="yes-display-inline">In this section, <quote>eligible member of the Armed Forces</quote> means any person who—</text>
<paragraph id="H273CE258060B4B93AA93DE1D07200800"><enum>(1)</enum><text display-inline="yes-display-inline">is serving or has served honorably as a member of the Selected Reserve of the Ready Reserve or in an active-duty status in the military, air, or naval forces of the United States during a period beginning February 28, 1961, and ending on a date designated by the President by Executive order as of the date of termination of the Vietnam hostilities, or thereafter during any other period which the President by Executive order shall designate as a period in which Armed Forces of the United States are or were engaged in military operations involving armed conflict with a hostile foreign force; and</text></paragraph>
<paragraph id="HCABEC67276E94F68A988DEAB421F8412"><enum>(2)</enum><text display-inline="yes-display-inline">if separated from the service described in paragraph (1), was separated under honorable conditions.</text></paragraph></subsection>
<subsection id="H4A4BAC292CAD456AB73F3155A683B42" display-inline="no-display-inline"><enum>(d)</enum><header>Waiver of certain grounds of inadmissibility</header><text display-inline="yes-display-inline">For the purpose of adjustment of status under this section:</text>
<paragraph id="H5C3ED78AA0634F489FBD46BBE100A6B8"><enum>(1)</enum><text display-inline="yes-display-inline">Paragraphs (4), (5), (6)(A), (7)(A), and (9)(B) of section 212(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)</external-xref>) shall not apply.</text></paragraph>
<paragraph id="HFA6CBE0443C14AEC92EBA21FA2FC64E2"><enum>(2)</enum><text display-inline="yes-display-inline">The Secretary of Homeland Security, or the Attorney General, shall not waive the following provisions of section 212 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182</external-xref>):</text>
<subparagraph id="H598099A0BED046099B3072171B3B9B49"><enum>(A)</enum><text>Subsection (a)(2)(B), if the alien actually was incarcerated for 5 years or more for the offenses described in such subsection.</text></subparagraph>
<subparagraph id="H50122A6ED4DE4C4D952FAA76169CEA00"><enum>(B)</enum><text>Subparagraph (C), (D), (G), or (H) of subsection (a)(2).</text></subparagraph>
<subparagraph id="H3B9C3497E3DB4AE8A9BB006C2090FEDE"><enum>(C)</enum><text>Subparagraph (A), (B), (C), (E), or (F) of subsection (a)(3).</text></subparagraph>
<subparagraph id="HB5CFFC1B57344EA6ADFF45B6FE8B75B"><enum>(D)</enum><text>Subsection (a)(6)(E).</text></subparagraph>
<subparagraph id="H7AB7F071FE064818894080C5629E28F0"><enum>(E)</enum><text>Subparagraph (A) or (C) of subsection (a)(10).</text></subparagraph>
<subparagraph id="H8908D00C2FFA4CD6B46C1383A475AB9D"><enum>(F)</enum><text display-inline="yes-display-inline">Subsection (a)(10)(D), if the alien has received a conviction, award, compromise, settlement, or injunction for an offense described in clause (i) of such subsection, and if the court finds that the alien did not reasonably believe at the time such violation that the alien was a citizen.</text></subparagraph></paragraph>
<paragraph id="H069FC84021DF4305A41CE1EEE9814C5"><enum>(3)</enum><text display-inline="yes-display-inline">The Secretary of Homeland Security, or the Attorney General, may waive any other provision of section 212(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)</external-xref>) for humanitarian purposes, to assure family unity, or when it is otherwise in the public interest.</text></paragraph></subsection></section>
