<official-title>To amend title 39, United States Code, to require post offices to have running water and sanitation facilities and prohibiting the closure of post offices based on a lack of running water and sanitation facilities.</official-title>

<section id="H7F152F53A3864494B773F3904403DAB9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Post Office Modernization Act of 2008</short-title></quote>.</text></section> 
<section id="H39C6D2F52D8341EF877FD4BA618165CC"><enum>2.</enum><header>Water and sanitation requirements</header> 
<subsection id="H709666DE59304CDBB2F5C5EB85321184"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/39/4">Chapter 4</external-xref> of title 39, United States Code, is amended by adding at the end the following new section:</text> 
<quoted-block style="USC" id="H28FC713713CD4EF08386DC57B9B291CD" display-inline="no-display-inline"> 
<section id="H63842FC9DA294BDFAFCB154806CE0060"><enum>417.</enum><header>Water and sanitation requirements</header> <text display-inline="no-display-inline">The Postal Service shall ensure that every post office has access to running water and to bathroom facilities connected to either a sewer system or a septic tank.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HE150B0FA6B9F47EC919E3E8CCFF77722"><enum>(b)</enum><header>Non-conforming post offices</header><text display-inline="yes-display-inline">Not later than 30 days after the date of the enactment of this Act, the Postal Service shall begin upgrades to ensure compliance with the requirements of section 417, United States Code (as added by subsection (a)).</text></subsection></section> 
<section id="HA05C14B3B7CA4740B5FD4F68BDE16E8F"><enum>3.</enum><header>Prohibition of closure based on lacking facilities</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/39/404">Section 404(b)(2)(B)</external-xref> of title 39, United States Code, is amended to read as follows:</text> 
<quoted-block style="OLC" id="HCAAD9DFBFE024686A1B5C29A3AB350" display-inline="no-display-inline"> 
<subparagraph id="HA0C4C401ED764E1B915E35C3A68FBE22"><enum>(B)</enum><text display-inline="yes-display-inline">may not consider—</text> 
<clause id="H03F54D224474452CB43F51C8604C1E80"><enum>(i)</enum><text>compliance with any provision of the Occupational Safety and Health Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/651">29 U.S.C. 651 et seq.</external-xref>); or</text></clause> 
<clause id="HD751D54ED09C47528D44463F060032DF"><enum>(ii)</enum><text>whether the requirements of section 417 are met in connection with the post office.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </section>
