<section id="H511F2DE631194CCC833472ABB5FD12B0" section-type="section-one"><enum>1.</enum><header>Port of Guam Improvement Enterprise Program</header> 
<subsection id="H5302A87D44474596B9D0D60300ADEE9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Transportation, acting through the Administrator of the Maritime Administration (in this section referred to as the <quote>Administrator</quote>), may establish a Port of Guam Improvement Enterprise Program (in this section referred to as the <quote>Program</quote>) to provide for the planning, design, and construction of projects for the Port of Guam to improve port facilities, relieve port congestion, increase port security, and provide greater access to port facilities.</text></subsection> 
<subsection id="H9629BAABF7D74EE3ABEDA83BF09F925F"><enum>(b)</enum><header>Authorities of the Administrator</header><text>In carrying out the Program, the Administrator may—</text> 
<paragraph id="H72BF85A6B63042BFB2248BFF27F9E800"><enum>(1)</enum><text>receive funds provided for the Program from non-Federal entities, including private entities, that have entered into a specific contract or agreement with the Administrator;</text> </paragraph> 
<paragraph id="H94C0C21B134C4FED86E01DEC61DE6C45"><enum>(2)</enum><text>provide for coordination among appropriate governmental agencies to expedite the review process under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) for projects carried out under the Program;</text></paragraph> 
<paragraph id="HFC8438FC01A14E2A8300004D98D51FE7"><enum>(3)</enum><text>provide for coordination among appropriate governmental agencies in connection with other reviews and requirements applicable to projects carried out under the Program;</text></paragraph> 
<paragraph id="H10B010EADBEA43A60014E1DF012D5EFC"><enum>(4)</enum><text>provide technical assistance to the Port Authority of Guam (and its agents) as needed for projects carried out under the Program; and</text></paragraph> 
<paragraph id="HD004CF1C71BD4C7BBFABA4FF9204A4A2"><enum>(5)</enum><text>encourage partnerships between public and private entities for the development and financial support of projects carried out under the Program, to the extent that the Administrator considers necessary and in accordance with the guidelines established in a memorandum of understanding between the Government of Guam and the Administrator.</text></paragraph></subsection> 
<subsection id="HCDD345C0CFBD4B9EA99300984E94A3D"><enum>(c)</enum><header>Intermodal surface freight transfer facility eligibility</header><text>Notwithstanding any other provision of law, an intermodal or marine facility comprising a component of the Program is deemed to be eligible to be an intermodal surface freight transfer facility for the purposes of <external-xref legal-doc="usc" parsable-cite="usc/23/601">section 601(8)(D)</external-xref> of title 23, United States Code.</text></subsection> 
<subsection id="H662E0A061CB24CA0A3FC7272D92BAE80"><enum>(d)</enum><header>Port of Guam Improvement Enterprise Fund</header> 
<paragraph id="H43757E04CE43429EA8FABAA183F702A4"><enum>(1)</enum><header>Establishment</header><text>There is established in the Treasury of the United States a separate account to be known as the <quote>Port of Guam Improvement Enterprise Fund</quote> (in this section referred to as the <quote>Fund</quote>).</text></paragraph> 
<paragraph id="HBDED80D015924D018C4F5E7C94D3178E"><enum>(2)</enum><header>Deposits</header><text>There shall be deposited into the Fund—</text> 
<subparagraph id="HCA8C650B38F4425CACB603A640006B32"><enum>(A)</enum><text>amounts received by the Administrator from non-Federal sources under subsection (b)(1);</text></subparagraph> 
<subparagraph id="H9DF12476C45445AEBC71CE30008D75C9"><enum>(B)</enum><text>amounts transferred to the Administrator under subsection (e); and</text></subparagraph> 
<subparagraph id="H0625FABD33A5425BB977242CA5E51CA8"><enum>(C)</enum><text>amounts appropriated to carry out this section under subsection (f).</text> </subparagraph> </paragraph> 
<paragraph id="HAFB305B622AC4324892F02359600D300"><enum>(3)</enum><header>Use of amounts</header><text>Amounts in the Fund shall be available to the Administrator to carry out the Program.</text></paragraph> 
<paragraph id="H9F48F448C89C4DA48BDED500E241246D" commented="no"><enum>(4)</enum><header>Administrative expenses</header><text>Not to exceed 3 percent of the amounts appropriated to the Fund for a fiscal year may be used for administrative expenses of the Administrator.</text></paragraph> 
<paragraph id="H65FF6BB689F0497DB6A8CF6900D625A9"><enum>(5)</enum><header>Availability of amounts</header><text>Amounts in the Fund shall remain available until expended.</text></paragraph> </subsection> 
<subsection id="HA7C1124F03E8419EA4A27282E1DE6924"><enum>(e)</enum><header>Transfers of amounts</header><text>Amounts appropriated or otherwise made available for any fiscal year for an intermodal or marine facility comprising a component of the Program shall be transferred to and administered by the Administrator.</text></subsection> 
<subsection id="H6A1949209B8E4D1BBB99124F00B3BB36"><enum>(f)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Fund such sums as may be necessary to carry out this section.</text></subsection> </section>
