<official-title>To amend title 10, United States Code, to authorize the Secretary of a military department, and the Secretary of Defense with respect to the Defense Agencies, to participate in conservation banking programs and in-lieu-fee mitigation programs.</official-title>

<section id="H784860D2D0C94C6CA77E5B5B3D2DAB82" section-type="section-one"><enum>1. </enum><header>Authorization for Department of Defense participation in conservation banking programs</header> 
<subsection id="H145FDC1CE5664B008736763CC23290D1"><enum>(a)</enum><header>Participation authorized</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/159">Chapter 159</external-xref> of title 10, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/10/2694b">section 2694b</external-xref> the following new section:</text>

<section id="HF4FD1F41F76640669D3E4DB428CA8C36"><enum>2694c.</enum><header>Participation in conservation banking programs</header> 
<subsection id="H30514813CEE143DF95583594FD4EA6CF"><enum>(a)</enum><header>Authority To participate</header><text>The Secretary of a military department, and the Secretary of Defense with respect to a Defense Agency, when engaged or proposing to engage in an activity described in subsection (b) that may or will result in an adverse impact to one or more species protected (or pending protection) under any applicable provision of law, or habitat for such species, may make payments to a conservation banking program or <quote>in-lieu-fee</quote> mitigation sponsor approved in accordance with—</text> 
<paragraph id="HDBF96D79C4D44418A5598519191F65BD"><enum>(1)</enum><text>the Federal Guidance for the Establishment, Use and Operation of Mitigation Banks (60 Fed. Reg. 58605; November 28, 1995);</text></paragraph> 
<paragraph id="H45495E5E27B3445CBAB69F3226010188"><enum>(2)</enum><text display-inline="yes-display-inline">the Guidance for the Establishment, Use, and Operation of Conservation Banks (68 Fed. Reg. 24753; May 2, 2003); or</text></paragraph> 
<paragraph id="H31979B364B7F4B57B6EFDE5BDBB95356"><enum>(3)</enum><text>any successor or related administrative guidance or regulation.</text></paragraph></subsection> 
<subsection id="HE71BFB798F4B47D5AD15268FC2C1A2B5"><enum>(b)</enum><header>Covered activities</header><text display-inline="yes-display-inline">Payments to a conservation banking program or <quote>in-lieu-fee</quote> mitigation sponsor under subsection (a) may be made only for the purpose of facilitating one of the following activities:</text> 
<paragraph id="HB15247EBD1474F0B87D493FF918431F2"><enum>(1)</enum><text display-inline="yes-display-inline">Military testing, operations, training, or other military readiness activity (as defined in section 315(f) of <external-xref legal-doc="public-law" parsable-cite="pl/107/314">Public Law 107–314</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/16/703">16 U.S.C. 703</external-xref> note).</text></paragraph> 
<paragraph id="H856AC592CF3E4DBE8CB7CBA43B903B8C"><enum>(2)</enum><text>Military construction.</text></paragraph></subsection> 
<subsection id="H134253579DC946B8A539E30090D411CF" display-inline="no-display-inline"><enum>(c)</enum><header>Treatment and availability of amounts for conservation banking</header><text>Payments made under subsection (a) to a conservation banking program or <quote>in-lieu-fee</quote> mitigation sponsor for the purpose of facilitating military construction may be treated as eligible costs of the military construction project. Amounts appropriated to carry out the military construction project and intended to be used for such payments shall remain available for obligation without fiscal year limitation.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H113738C24084499891887660D3F3993F"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by inserting after the item relating to section 2694b the following new item:</text>

<subsection id="H6E954660921C41CE8D794163C2DA7760"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on October 1, 2008.</text></subsection></section>
