<official-title>To amend title 49, United States Code, to require a motor carrier, broker, or freight forwarder that collects a fuel surcharge to pay an amount equal to the surcharge to the person that bears the cost of the fuel, and for other purposes.</official-title>

<section id="HBD22756C7FB44AD400F71B3535B75E69" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fairness in Trucking Transactions Act</short-title></quote>.</text></section> 
<section id="HAB30D562493346C8ACEDE985005CCDF1" section-type="subsequent-section"><enum>2.</enum><header>Pass through of motor carrier fuel costs</header> 
<subsection id="H911E539DFAB946FEA23770694D3F6801"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/49/14102">Section 14102</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H8712BD93BBE64D26934E2587FA706865" style="OLC"> 
<subsection id="H3C736F9BDA234825B4007E854C18CC20"><enum>(c)</enum><header>Pass through to cost bearer</header><text>A motor carrier, broker, or freight forwarder providing or arranging truckload transportation or service using fuel for which it does not bear the cost shall provide to the person that bears the cost of such fuel a payment in an amount equal to the sums it collects which relate to the cost of the fuel.</text> </subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HDDAF97B58F12451DB5B729C602CF2500"><enum>(b)</enum><header>Billing and collection practices</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/49/13708">Section 13708(b)</external-xref> of title 49, United States Code, is amended to read as follows:</text>

<subsection id="HB2941EC4B54649D38769DB7E000880C9"><enum>(b)</enum><header>False or misleading information</header><text>No person may cause a motor carrier, broker, or freight forwarder to present false or misleading information on a document or in an oral representation about the actual rate, charge, or allowance to any party to the transaction or transportation.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HC42FFF7B041F45D7926F79CC4EF3E8CD"><enum>(c)</enum><header>Enforcement</header> 
<paragraph id="H1AE37C7B953448C9A42FB176B1BE7064"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/147">Chapter 147</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text>

<section id="H237E8029D5A84E8F83567430BB803127"><enum>14712.</enum><header>Enforcement of requirements relating to pass through of motor carrier fuel costs</header> 
<subsection id="H0C72A4274F8B45ED99E912BB66A80090"><enum>(a)</enum><header>Additional civil penalty</header><text display-inline="yes-display-inline">In addition to other civil penalties specified in this chapter, a motor carrier, broker, or freight forwarder violating section 14102(c) by failing to make a payment in the amount specified in section 14102(c) is liable to the United States for a civil penalty in an amount equal to 3 times the amount so specified.</text></subsection> 
<subsection id="H810D2F168557480399D9D6F9FD0002D"><enum>(b)</enum><header>Damages awarded in civil actions brought by injured persons</header><text>In a civil action brought under section 14704 for damages sustained by a person as a result of a violation of section 14102(c), a court may award damages in an amount equal to 3 times the amount of the damages and attorney’s fees in accordance with section 14704(e).</text></subsection> 
<subsection id="H63D7537C8FD945AE9988504883B647A7"><enum>(c)</enum><header>Confidentiality of information</header><text display-inline="yes-display-inline">Information that is obtained by the Secretary or the Board in connection with an investigation of an alleged violation of section 14102(c) and that relates to a confidential matter referred to in <external-xref legal-doc="usc" parsable-cite="usc/18/1905">section 1905</external-xref> of title 18 may be disclosed only to another officer or employee of the United States Government for use in carrying out chapter 141 and this chapter. This subsection does not authorize information to be withheld from a committee of Congress authorized to have the information.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HCBA9C5A52A2C4F5782776649A57BC0EA"><enum>(2)</enum><header>Clerical amendment</header><text>The analysis for such chapter is amended by adding at the end the following:</text>
