		<section id="H6199CCF70D6B488F903DF06610AA1580" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>DNA Expansion and Improvement Act of
			 2008</short-title></quote>.</text>
		</section><section id="HF3EDE04D37E247E096A386A0DDD65C09"><enum>2.</enum><header>DNA technology
			 enhancement grants</header>
			<subsection id="HE1D9A21809AD4C66AA66A00511808C2"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Attorney General
			 shall establish a grant program under which the Attorney General may make
			 grants to States and units of local government to purchase forensic DNA
			 technology or to improve such technology.</text>
			</subsection><subsection id="HEAA60C7956994ED7B499DA6BD700A37"><enum>(b)</enum><header>Authorization of
			 appropriations</header><text>There is authorized to be appropriated $50,000,000
			 for each of the fiscal years 2009 through 2013 to carry out subsection
			 (a).</text>
			</subsection></section><section id="H5250C2BE7B544DFDBDEE8EF187C700C7"><enum>3.</enum><header>Reauthorization
			 and improvement of Debbie Smith DNA Backlog Grant Program; priority to
			 applications for use of funds by certain crime laboratories</header>
			<subsection id="HA7E2931B70BC4C90B0B74B64ACAB20FE"><enum>(a)</enum><header>Reauthorization
			 and improvement</header><text display-inline="yes-display-inline">Section 2 of
			 the DNA Analysis Backlog Elimination Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/14135">42 U.S.C. 14135</external-xref>) is
			 amended—</text>
				<paragraph id="HDBA33B06E3BC40C384B283BFDFE43D7"><enum>(1)</enum><text>in
			 subsection (a), by adding at the end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="H39BD7DB1B852442393E69F43CEC5EE90" style="OLC">
						<paragraph id="H16022FCD305C4C28B6337D7E90A78139"><enum>(6)</enum><text display-inline="yes-display-inline">To pay the salaries of employees of DNA
				criminal laboratories.</text>
						</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HF3008FB50E1E49C98CAFF1A08FAF32C2"><enum>(2)</enum><text>in subsection
			 (b)—</text>
					<subparagraph id="H8375B4EC131A47928637B16530004D57"><enum>(A)</enum><text>in paragraph (6),
			 by striking at the end <quote>and</quote>;</text>
					</subparagraph><subparagraph id="H3C5916C12AC9417EBC4BBBBE6452C1D"><enum>(B)</enum><text>in paragraph (7),
			 by striking the period and inserting <quote>; and</quote>; and</text>
					</subparagraph><subparagraph id="HFA92060922894B3DB0747EE8D1D9D9BC"><enum>(C)</enum><text>by adding at the
			 end the following new paragraph:</text>
						<quoted-block display-inline="no-display-inline" id="HDAC1E58137924F83BB937C2000CEC099" style="OLC">
							<paragraph id="H20E2C83BAD584E2388D725DFD91D0585"><enum>(8)</enum><text display-inline="yes-display-inline">provide assurances that the State or unit
				of local government has implemented, or will implement not later than 180 days
				after the date of such application, a process under which the State or unit,
				respectively, provides for the collection for purposes of inclusion in the
				Combined DNA Index System of the Federal Bureau of Investigation of DNA samples
				from all felons who are imprisoned in a prison of such State or unit,
				respectively (including all felons imprisoned in such prison or unit,
				respectively, as of the date of the enactment of the DNA Expansion and
				Improvement Act of
				2008).</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H9C2144B92BC9463EA2CB087B54A81525"><enum>(3)</enum><text>by amending
			 subsection (j) to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="HEA6EE7C7A39E4B1B9414DAD4B3BEDAA7" style="OLC">
						<subsection id="H340DA49146AF49FFBA3C1E10D060007B"><enum>(j)</enum><header>Authorization of
				appropriations</header><text display-inline="yes-display-inline">There is
				authorized to be appropriated to the Attorney General for grants under
				subsection (a)—</text>
							<paragraph id="H393152B752C44C2786073068A2C40064"><enum>(1)</enum><text>$151,000,000 for
				fiscal year 2009; and</text>
							</paragraph><paragraph id="H45F4DABB418540FE00C1C7D287D21926"><enum>(2)</enum><text>$200,000,000 for
				each of the fiscal years 2010 through
				2014.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H04BFE3E384F747DE99DE01F7A5690061"><enum>(b)</enum><header>Priority
			 established</header><text>Such section is further amended by adding at the end
			 the following:</text>
				<quoted-block display-inline="no-display-inline" id="H74DF65015AC9437D956121B33B93D76C" style="OLC">
					<subsection id="H838D41298CB243779546D659F09622D4"><enum>(n)</enum><header>Priority</header><text display-inline="yes-display-inline">In making grants under subsection (a), the
				Attorney General shall give priority to applications submitted under subsection
				(b) that demonstrate funds from such a grant will be used for crime
				laboratories with demonstrated training and personnel
				needs.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HD28B923201954B098132CD9DAA219201"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by paragraphs (1) and (2) of subsection
			 (a) and by subsection (b) shall apply to grants made on or after January 1,
			 2009.</text>
			</subsection></section><section id="HE8745DE1399E419CA26434220866D640"><enum>4.</enum><header>Clarification
			 relating to incentive grants</header><text display-inline="no-display-inline">Section 413 of the DNA Analysis Backlog
			 Elimination Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/14136">42 U.S.C. 14136</external-xref> note) is amended by adding at the end
			 the following:</text>
			<quoted-block display-inline="no-display-inline" id="H53ADA1E12B7C48298F5B8DC0D8543F76" style="OLC">
				<quoted-block-continuation-text quoted-block-continuation-text-level="section">Nothing in
				this section shall be construed as requiring the Attorney General of a State
				(or other Chief Legal Officer of the State) to approve an application of an
				eligible entity in order for such entity to receive funds as described in the
				previous
				sentence.</quoted-block-continuation-text><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HC21B0E72C6794207B0AD3F27843D3E9B"><enum>5.</enum><header>Reauthorizations
			 of certain DNA-related grant programs</header>
			<subsection id="H64E99C30922745E8B8350044CE94E6BD"><enum>(a)</enum><header>DNA training and
			 education for law enforcement, correctional personnel, and court
			 officers</header><text display-inline="yes-display-inline">Section 303(b) of
			 the Justice For All Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/42/14136">42 U.S.C. 14136(b)</external-xref>) is amended by striking
			 <quote>2009</quote> and inserting <quote>2014</quote>.</text>
			</subsection><subsection id="H7CA10E3D5A0842D9BE00EE34FB861F15"><enum>(b)</enum><header>Sexual assault
			 forensic exam program grants</header><text>Section 304(c) of such Act (42
			 U.S.C. 14136a(c)) is amended by striking <quote>2009</quote> and inserting
			 <quote>2014</quote>.</text>
			</subsection><subsection id="H2BC3A101EEA04DF59F487460CDD12F29"><enum>(c)</enum><header>DNA research and
			 development</header><text>Section 305(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/14136b">42 U.S.C. 14136b(c)</external-xref>) is
			 amended by striking <quote>2009</quote> and inserting
			 <quote>2014</quote>.</text>
			</subsection><subsection id="H1CAD0C78958844D0913EC3435EA41700"><enum>(d)</enum><header>Kirk Bloodsworth
			 Post-Conviction DNA Testing Grant Program</header><text>Section 412(b) of such
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/42/14136e">42 U.S.C. 14136e(b)</external-xref>) is amended by striking <quote>2009</quote> and
			 inserting <quote>2014</quote>.</text>
			</subsection><subsection id="H556D6240C8D946D2904C62007B729BBC"><enum>(e)</enum><header>DNA
			 identification of missing persons</header><text>Section 308(c) of such Act (42
			 U.S.C. 14136d(c)) is amended by striking <quote>2009</quote> and inserting
			 <quote>2014</quote>.</text>
