<subparagraph id="H59D7E0D6A5B340B4968F004FD820D655"><enum>(B)</enum><text>the Permanent Select Committee on Intelligence of the House of Representatives.</text></subparagraph></paragraph>

<section id="H1FAEB53137A84C22AA4D54C585F5C9D4"><enum>102.</enum><header>Classified Schedule of Authorizations</header> 
<subsection id="H2B537F5DC0B743668605D72E49AA3176"><enum>(a)</enum><header>Specifications of amounts and personnel levels</header><text display-inline="yes-display-inline">The amounts authorized to be appropriated under section 101 and, subject to section 103, the authorized personnel ceilings as of September 30, 2009, for the conduct of the intelligence activities of the elements listed in paragraphs (1) through (16) of section 101, are those specified in the classified Schedule of Authorizations prepared to accompany the conference report on the bill H.R. 5959 of the One Hundred Tenth Congress.</text></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HC9EEBDFE29C5411298C7DC7662843BCD"><enum>(b)</enum><header>Availability of classified Schedule of Authorizations</header><text>The classified Schedule of Authorizations referred to in subsection (a) shall be made available to the Committee on Appropriations of the Senate, the Committee on Appropriations of the House of Representatives, and to the President. The President shall provide for suitable distribution of the Schedule, or of appropriate portions of the Schedule, within the executive branch.</text></subsection> 
<subsection id="H464E661CD7D4488CB85D00ED3958F2ED"><enum>(c)</enum><header>Earmarks</header> 
<paragraph id="HC8093F7311E24EF39E691000478BA1AA"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Nothing in the classified Schedule of Authorizations, the joint explanatory statement to accompany the conference report on the bill H.R. 5959 of the One Hundred Tenth Congress, or the classified annex to this Act, shall be construed to authorize or require the expenditure of funds for an earmarked purpose.</text></paragraph> 
<paragraph id="H013DC03BA47440E4A739769B8F55DFC4"><enum>(2)</enum><header>Earmarked purpose defined</header><text display-inline="yes-display-inline">In this subsection, the term <quote>earmarked purpose</quote> means a provision or report language included primarily at the request of a Member, Delegate, Resident Commissioner of the House of Representatives or a Senator providing, authorizing, or recommending a specific amount of discretionary budget authority, credit authority, or other spending authority for a contract, loan, loan guarantee, grant, loan authority, or other expenditure with or to an entity, or targeted to a specific State, locality, or Congressional district, other than through a statutory or administrative formula-driven or competitive award process.</text></paragraph></subsection></section> 
<section id="H9D22443D4C45456086E11819FA0064CD"><enum>103.</enum><header>Personnel ceiling adjustments</header> 
<subsection id="HFC529916945C4B8F9DC082D8966BD812"><enum>(a)</enum><header>Authority for increases</header><text display-inline="yes-display-inline">With the approval of the Director of the Office of Management and Budget, the Director of National Intelligence may authorize employment of civilian personnel in excess of the number authorized for fiscal year 2009 by the classified Schedule of Authorizations referred to in section 102(a) if the Director of National Intelligence determines that such action is necessary to the performance of important intelligence functions, except that the number of personnel employed in excess of the number authorized under such section may not, for any element of the intelligence community, exceed 3 percent of the number of civilian personnel authorized under such Schedule for such element.</text></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H64AD6654A77449669927B99ED9D1878"><enum>(b)</enum><header>Notice to congressional intelligence committees</header><text>The Director of National Intelligence shall notify the congressional intelligence committees in writing at least 15 days prior to each exercise of an authority described in subsection (a).</text></subsection></section> 
<section id="H64BB5376DA9C44219387009793BE934"><enum>104.</enum><header>Intelligence Community Management Account</header> 
<subsection id="HC5DA13DD47C4497C86B099DB009FA784"><enum>(a)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated for the Intelligence Community Management Account of the Director of National Intelligence for fiscal year 2009 the sum of $648,842,000. Within such amount, funds identified in the classified Schedule of Authorizations referred to in section 102(a) for advanced research and development shall remain available until September 30, 2010.</text></subsection> 
<subsection id="H3C44AB18C303401CA90607924BE9AF6B"><enum>(b)</enum><header>Authorized personnel levels</header><text display-inline="yes-display-inline">The elements within the Intelligence Community Management Account of the Director of National Intelligence are authorized 772 full-time or full-time equivalent personnel as of September 30, 2009. Personnel serving in such elements may be permanent employees of the Office of the Director of National Intelligence or personnel detailed from other elements of the United States Government.</text></subsection> 
<subsection id="H10D4AD12765C4D77995800243312E0B6"><enum>(c)</enum><header>Construction of Authorities</header><text>The authorities available to the Director of National Intelligence under section 103 are also available to the Director for the adjustment of personnel levels within the Intelligence Community Management Account.</text></subsection> 
<subsection id="H13BC7B4F409A46488DE18DBBB38D74D6"><enum>(d)</enum><header>Classified authorizations</header> 
<paragraph id="H85031D52A8F846FEB942D31E59BD44F"><enum>(1)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">In addition to amounts authorized to be appropriated for the Intelligence Community Management Account by subsection (a), there are authorized to be appropriated for the Community Management Account for fiscal year 2009 such additional amounts as are specified in the classified Schedule of Authorizations referred to in section 102(a). Such additional amounts for advanced research and development shall remain available until September 30, 2010.</text></paragraph> 
<paragraph id="HDFC292BA5B3443DFB5D6F3B3D2009D04"><enum>(2)</enum><header>Authorization of personnel</header><text display-inline="yes-display-inline">In addition to the personnel authorized by subsection (b) for elements of the Intelligence Community Management Account as of September 30, 2009, there are authorized such additional personnel for the Community Management Account as of that date as are specified in the classified Schedule of Authorizations referred to in section 102(a).</text></paragraph></subsection></section> 
<section id="H609C685EB34941B1B6B61F46A4A768C9"><enum>105.</enum><header>Limitation on the use of covert action funds</header> 
<subsection id="HC9206A8F7AA84646A57FB84AF1701AB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not more than 25 percent of the funds authorized to be appropriated by this Act for the National Intelligence Program for covert actions may be obligated or expended until the date on which each member of the congressional intelligence committees has been fully and currently briefed on all authorizations for covert actions in effect on April 24, 2008.</text></subsection> 
<subsection id="H8EDE7363597644D0A76CCC5BEFD1DB3D"><enum>(b)</enum><header>Covert action defined</header><text display-inline="yes-display-inline">In this section, the term <quote>covert action</quote> has the meaning given the term in section 503(g) of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/413b">50 U.S.C. 413b(e)</external-xref>).</text></subsection></section> 
<section id="HD6049490931647A6ADA2800094155802" display-inline="no-display-inline" section-type="subsequent-section"><enum>106.</enum><header>Prohibition on use of funds to implement <quote>5 and out</quote> program of the Federal Bureau of Investigation</header><text display-inline="no-display-inline">None of the funds authorized to be appropriated in this Act may be used to implement the program of the Federal Bureau of Investigation requiring the mandatory reassignment of a supervisor of the Bureau after such supervisor serves in a management position for 5 years (commonly known as the <quote>5 and out</quote> program). </text></section></title> 
<title id="H4FBDC18B527A4245B036A9982DCC5DC"><enum>II</enum><header>CENTRAL INTELLIGENCE AGENCY RETIREMENT AND DISABILITY SYSTEM</header> 
<section commented="no" display-inline="no-display-inline" id="H49F2D566FA994AAD8DD6F42BCFBA0098" section-type="subsequent-section"><enum>201.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated for the Central Intelligence Agency Retirement and Disability Fund for fiscal year 2009 the sum of $279,200,000.</text></section> 
<section id="H51F792F838D04E7900004E9761FDBD50"><enum>202.</enum><header>Technical modification to mandatory retirement provision of the Central Intelligence Agency Retirement Act</header><text display-inline="no-display-inline">Subparagraph (A) of section 235(b)(1) of the Central Intelligence Agency Retirement Act (<external-xref legal-doc="usc" parsable-cite="usc/50/2055">50 U.S.C. 2055(b)(1)</external-xref>) is amended by striking <quote>receiving compensation under the Senior Intelligence Service pay schedule at the rate</quote> and inserting <quote>who is at the Senior Intelligence Service rank</quote>.</text></section></title> 
<title id="H0065629358E744739B4DC190533DB100"><enum>III</enum><header>GENERAL INTELLIGENCE COMMUNITY MATTERS</header> 
<subtitle id="H11962F5714874767ABF4B7162E772187"><enum>A</enum><header>Personnel Matters</header> 
<section id="H12696EAB283144E5B8988568051FB257"><enum>301.</enum><header>Increase in employee compensation and benefits authorized by law</header><text display-inline="no-display-inline">Appropriations authorized by this Act for salary, pay, retirement, and other benefits for Federal employees may be increased by such additional or supplemental amounts as may be necessary for increases in such compensation or benefits authorized by law.</text></section> 
<section id="H4D35A1E1E31E45E3824735E70C751A5"><enum>302.</enum><header>Enhanced flexibility in nonreimbursable details to elements of the intelligence community</header><text display-inline="no-display-inline">Except as provided in section 113 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/404h">50 U.S.C. 404h</external-xref>) and section 904(g)(2) of the Counterintelligence Enhancement Act of 2002 (title IX of <external-xref legal-doc="public-law" parsable-cite="pl/107/306">Public Law 107–306</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/50/402c">50 U.S.C. 402c(g)(2)</external-xref>) and notwithstanding any other provision of law, in any fiscal year after fiscal year 2008 an officer or employee of the United States or member of the Armed Forces may be detailed to the staff of an element of the intelligence community funded through the Community Management Account from another element of the United States Government on a reimbursable or nonreimbursable basis, as jointly agreed to by the Director of National Intelligence and the head of the detailing element (or the designees of such officials), for a period not to exceed 2 years.</text></section> 
<section commented="no" id="H07517BF8C61242F78DC7D90FBEE513C"><enum>303.</enum><header>Multi-level security clearances</header> 
<subsection id="HE3A2C282E13E43CDACAAE2D6D2E4C212"><enum>(a)</enum><header>In general</header><text>Section 102A of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/403-1">50 U.S.C. 403–1</external-xref>) is amended by adding at the end the following new subsection:</text> 
<quoted-block display-inline="no-display-inline" id="H85774D2B28B0477FB669E7FAE12F8C01" style="OLC"> 
<subsection id="HF9A1B97C080146EDA820E300A1AF0098"><enum>(s)</enum><header>Multi-level security clearances</header><text>The Director of National Intelligence shall be responsible for ensuring that the elements of the intelligence community adopt a multi-level security clearance approach in order to enable the intelligence community to make more effective and efficient use of persons proficient in foreign languages or with cultural, linguistic, or other subject matter expertise that is critical to national security.</text></subsection> <after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H1E21B564F9AD4331A2D87402007572D7"><enum>(b)</enum><header>Implementation</header><text>The Director of National Intelligence shall issue guidelines to the intelligence community on the implementation of subsection (s) of section 102A of the National Security Act of 1947, as added by subsection (a), not later than 90 days after the date of the enactment of this Act.</text></subsection></section> 
<section id="H74432B28B2F54BB19499EE3320F6C3DA"><enum>304.</enum><header>Delegation of authority for travel on common carriers for intelligence collection personnel</header> 
<subsection id="H9DC1204723D54AF489E54FDCC8ECE8A1"><enum>(a)</enum><header>Delegation of Authority</header><text>Section 116(b) of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/404k">50 U.S.C. 404k(b)</external-xref>) is amended—</text> 
<paragraph id="HFB2A4915A5A14550B938C46C5E18CBC"><enum>(1)</enum><text>by inserting <quote>(1)</quote> before <quote>The Director</quote>;</text></paragraph> 
<paragraph id="HD1C5F7B3DD0C424CA019167119850646"><enum>(2)</enum><text>in paragraph (1), as designated by paragraph (1) of this subsection, by striking <quote>may only delegate</quote> and all that follows and inserting <quote>may delegate the authority in subsection (a) to the head of any other element of the intelligence community.</quote>; and</text></paragraph> 
<paragraph id="H27A06526EBDF404AAFBBF38C164268D9"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text>

<subsection id="H0B930A269E6E4C29926CDF9BA8349056"><enum>(b)</enum><header>Submission of guidelines to Congress</header><text>Not later than 6 months after the date of the enactment of this Act, the Director of National Intelligence shall prescribe and submit to the congressional intelligence committees the guidelines referred to in paragraph (2) of section 116(b) of the National Security Act of 1947, as added by subsection (a).</text></subsection></section> 
<section id="H049502C9DD21420B927652A900CEEBF4"><enum>305.</enum><header>Annual personnel level assessments for the intelligence community</header> 
<subsection id="H44A8AF298F0747FA809D41B51BF18C95"><enum>(a)</enum><header>In general</header><text>Title V of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/413">50 U.S.C. 413 et seq.</external-xref>) is amended by inserting after section 506A the following new section:</text> 
<quoted-block display-inline="no-display-inline" id="H38A5349F686B4DBA913E867F5FA1D142" style="traditional"> 
<section id="HDF51EB7ACB2A4DDD9B32BBBB084FF032"><enum>506B.</enum><header>Annual personnel level assessment for the intelligence community</header> 
<subsection id="H92CAFCCCFB264DC18D9CC307B40DCC5" display-inline="yes-display-inline"><enum>(a)</enum><header>Requirement To provide</header><text>The Director of National Intelligence shall, in consultation with the head of the element of the intelligence community concerned, prepare an annual personnel level assessment for such element of the intelligence community that assesses the personnel levels for each such element for the fiscal year following the fiscal year in which the assessment is submitted.</text></subsection> 
<subsection id="HC07DF1DA4D864FCA923CD4329243C06F"><enum>(b)</enum><header>Schedule</header><text>Each assessment required by subsection (a) shall be submitted to the congressional intelligence committees each year along with the budget submitted by the President under <external-xref legal-doc="usc" parsable-cite="usc/31/1105">section 1105</external-xref> of title 31, United States Code.</text></subsection> 
<subsection id="HE65D0FEFB6FF478FB2571728ADF6438"><enum>(c)</enum><header>Contents</header><text>Each assessment required by subsection (a) submitted during a fiscal year shall contain, at a minimum, the following information for the element of the intelligence community concerned:</text> 
<paragraph id="HA437E36072B543CC8F438C5D9C6C9157"><enum>(1)</enum><text>The budget submission for personnel costs for the upcoming fiscal year.</text></paragraph> 
<paragraph id="HDB877D1F0EC04853952778B2B6EDD95C"><enum>(2)</enum><text>The dollar and percentage increase or decrease of such costs as compared to the personnel costs of the current fiscal year.</text></paragraph> 
<paragraph id="H30AA7066D1DD4769875B78424D69BFBF"><enum>(3)</enum><text>The dollar and percentage increase or decrease of such costs as compared to the personnel costs during the prior 5 fiscal years.</text></paragraph> 
<paragraph id="HABC4853F77BB470E8FFF7278B6284EF3"><enum>(4)</enum><text>The number of personnel positions requested for the upcoming fiscal year.</text></paragraph> 
<paragraph id="H39CEA41AE3324B40A73B429676A37069"><enum>(5)</enum><text>The numerical and percentage increase or decrease of such number as compared to the number of personnel positions of the current fiscal year.</text></paragraph> 
<paragraph id="HD2C1FEBC60D74060B657D674BC20F406"><enum>(6)</enum><text>The numerical and percentage increase or decrease of such number as compared to the number of personnel positions during the prior 5 fiscal years.</text></paragraph> 
<paragraph id="H8FEC3B4A847C4108BD9362B700980084"><enum>(7)</enum><text>The best estimate of the number and costs of contractors to be funded by the element for the upcoming fiscal year.</text></paragraph> 
<paragraph id="H35C53342FFF041909727BF261F2E6CBF"><enum>(8)</enum><text>The numerical and percentage increase or decrease of such costs of contractors as compared to the best estimate of the costs of contractors of the current fiscal year.</text></paragraph>

<paragraph id="H3C7C256DD8C8451E9398ECC968D2D5E"><enum>(12)</enum><text>A list of all contractors that have been the subject of an investigation completed by the Inspector General of any element of the intelligence community during the preceding fiscal year, or are or have been the subject of an investigation by such an Inspector General during the current fiscal year.</text></paragraph> 
<paragraph id="H8C7650D44C1A436AB14351006893B7C0"><enum>(13)</enum><text>A statement by the Director of National Intelligence that, based on current and projected funding, the element concerned will have sufficient—</text>

<subsection id="HCC48E2DA05E242678EF2DB394802BBF3"><enum>(a)</enum><header>Requirement for report</header><text>Not later than November 1, 2008, the Director of National Intelligence shall submit to the congressional intelligence committees a report describing the use of personal services contracts across the intelligence community, the impact of such contractors on the intelligence community workforce, plans for conversion of contractor employment into government employment, and the accountability mechanisms that govern the performance of such contractors.</text></subsection> 
<subsection id="H849CD4E924F44C44B1D7D47B23E01313"><enum>(b)</enum><header>Content</header> 
<paragraph id="H021E59B358694F6086E38281BA0079A2"><enum>(1)</enum><header>In general</header><text>The report submitted under subsection (a) shall include—</text> 
<subparagraph id="HABE23864716940379DEFDFB18EFEFB6"><enum>(A)</enum><text>a description of any relevant regulations or guidance issued by the Director of National Intelligence or the head of an element of the intelligence community relating to minimum standards required regarding the hiring, training, security clearance, and assignment of contract personnel and how those standards may differ from those for government employees performing substantially similar functions;</text></subparagraph> 
<subparagraph id="H904304334B4A44F38B9600A8291C12D5"><enum>(B)</enum><text>an identification of contracts where the contractor is performing a substantially similar functions to a government employee;</text></subparagraph> 
<subparagraph id="H202837AFAFC74151BAC3EE3C2D69C37E"><enum>(C)</enum><text>an assessment of costs incurred or savings achieved by awarding contracts for the performance of such functions referred to in subparagraph (B) instead of using full-time employees of the elements of the intelligence community to perform such functions;</text></subparagraph> 
<subparagraph id="H0975CDFB81424B5F90F986F53D51FF64"><enum>(D)</enum><text>an assessment of the appropriateness of using contractors to perform the activities described in paragraph (2);</text></subparagraph> 
<subparagraph id="H63F194961B0A4920A27B8327B3080386"><enum>(E)</enum><text>an estimate of the number of contracts, and the number of personnel working under such contracts, related to the performance of activities described in paragraph (2);</text></subparagraph> 
<subparagraph id="H814C348E2C4A4895BE7BBD843FC5D3BF"><enum>(F)</enum><text>a comparison of the compensation of contract employees and government employees performing substantially similar functions;</text></subparagraph> 
<subparagraph id="HF444F13BFA7C44DC93CCA078334C9898"><enum>(G)</enum><text>an analysis of the attrition of government personnel for contractor positions that provide substantially similar functions;</text></subparagraph> 
<subparagraph id="H4B5BECF16C4142A4BD9C1300B2CDDC2F"><enum>(H)</enum><text>a description of positions that will be converted from contractor employment to government employment; </text></subparagraph> 
<subparagraph id="H239E7F68F6D346C1891060D52DD6518"><enum>(I)</enum><text>an analysis of the oversight and accountability mechanisms applicable to personal services contracts awarded for intelligence activities by each element of the intelligence community during fiscal years 2006 and 2007;</text></subparagraph> 
<subparagraph id="H4060916AEB944617B1EB072C73290056"><enum>(J)</enum><text>an analysis of procedures in use in the intelligence community for conducting oversight of contractors to ensure identification and prosecution of criminal violations, financial waste, fraud, or other abuses committed by contractors or contract personnel; and</text></subparagraph> 
<subparagraph id="H10A06258FA3F46058E4E83040262AC30"><enum>(K)</enum><text>an identification of best practices for oversight and accountability mechanisms applicable to personal services contracts.</text></subparagraph></paragraph> 
<paragraph id="H42B4D02D342240FB91FAEC052C697FA"><enum>(2)</enum><header>Activities</header><text>Activities described in this paragraph are the following:</text> 
<subparagraph id="HFD931009847E4236802B45DE5CE8F81E"><enum>(A)</enum><text>Intelligence collection.</text></subparagraph>

<section id="HD66588BEAF1C4293ABC174176553D3F9" commented="no"><enum>307.</enum><header>Report on proposed pay for performance intelligence community personnel management system</header> 
<subsection id="H0AE4227BC1ED433EADF544FB04FC2BE3" commented="no"><enum>(a)</enum><header>Prohibition on pay for performance until report</header><text>The Director of National Intelligence and the head of an element of the intelligence community may not implement a plan that provides compensation to personnel of that element of the intelligence community based on performance until the date that is 45 days after the date on which the Director of National Intelligence submits a report for that element under subsection (b).</text></subsection> 
<subsection id="H550295B88A574CADBAF4E13372DD7DBA" commented="no"><enum>(b)</enum><header>Report</header><text>The Director of National Intelligence shall submit to Congress a report on performance-based compensation for each element of the intelligence community, including, with respect to each such element—</text> 
<paragraph id="HB31C7DD1BA7442B5A58546979D87006E" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">a description of a proposed employee advisory group to advise management on the implementation and management of a pay for performance system in that element, including the scope of responsibility of the group and the plan for the element for ensuring diversity in the selection of members of the advisory group;</text></paragraph> 
<paragraph id="H55E39160485E4F499614641FE43BECAB" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">a certification that all managers who will participate in setting performance standards and pay pool administration have been trained on the implementing guidance of the system and the criteria upon which the certification is granted; and</text></paragraph> 
<paragraph id="H5CA687E58F4B40D5A4B0095902AC023B" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">a description of an external appeals mechanism for employees who wish to appeal pay decisions to someone outside the management chain of the element employing such employee.</text></paragraph></subsection></section> 
<section id="HDA4AC5BE29F04003A7C22F8409C33CBE"><enum>308.</enum><header>Report on plans to increase diversity within the intelligence community</header> 
<subsection id="H1AB36A1B3DCE4D65B542206B593B7D25"><enum>(a)</enum><header>Requirement for report</header><text>Not later than November 1, 2008, the Director of National Intelligence, in coordination with the heads of the elements of the intelligence community, shall submit to the congressional intelligence committees a report on the plans of each element to increase diversity within the intelligence community.</text></subsection> 
<subsection id="H23B86DEC9C5244178E6D51A8B622FF4B"><enum>(b)</enum><header>Content</header><text>The report required by subsection (a) shall include specific implementation plans to increase diversity within each element of the intelligence community, including—</text> 
<paragraph id="HBB651793704A4B649112668EA2794795"><enum>(1)</enum><text>specific implementation plans for each such element designed to achieve the goals articulated in the strategic plan of the Director of National Intelligence on equal employment opportunity and diversity;</text></paragraph> 
<paragraph id="H7E3E23D759864F7C99F963054FD12CD"><enum>(2)</enum><text>specific plans and initiatives for each such element to increase recruiting and hiring of diverse candidates;</text></paragraph> 
<paragraph id="HCB2939E036DF4DF8B4423230B6DEC2"><enum>(3)</enum><text>specific plans and initiatives for each such element to improve retention of diverse Federal employees at the junior, midgrade, senior, and management levels;</text></paragraph>

<section id="H480C92C7D19D4720A679536BE808EC5E"><enum>309.</enum><header>Report on security clearance determinations</header> 
<subsection id="HC1CF7AE6FC14497D927606A0B9968190"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title V of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/413">50 U.S.C. 413 et seq.</external-xref>) is amended by adding at the end the following new section:</text>

<section id="H1F0F4662A665444C8131317782F8D2A1"><enum>508.</enum><header>Report on security clearance determinations</header><text display-inline="yes-display-inline">Not later than February 1 of each year, the Director of the Office of Management and Budget shall submit to Congress a report on security clearance determinations completed or ongoing during the preceding fiscal year that have taken longer than 1 year to complete. Such report shall include—</text> 
<paragraph id="H51EA498F67CD42F6B38934B7B382B1B9"><enum>(1)</enum><text display-inline="yes-display-inline">the number of security clearance determinations for positions as employees of the Federal Government that required more than 1 year to complete;</text></paragraph> 
<paragraph id="HE884C4AD9E654BE7B3E5B5A32B3B4791"><enum>(2)</enum><text display-inline="yes-display-inline">the number of security clearance determinations for contractors that required more than 1 year to complete;</text></paragraph> 
<paragraph id="HB8A12E860ED24680AECCEAC99B97AD17"><enum>(3)</enum><text>the agencies that investigated and adjudicated such determinations; and</text></paragraph> 
<paragraph id="HCB23C03717C24AA59519FE2C34A74BEA"><enum>(4)</enum><text>the cause of significant delays in such determinations.</text></paragraph></section> <after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H773F058808944C9493DCD7E1711300C8"><enum>(b)</enum><header>Conforming amendment</header><text>The table of contents in the first section of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/401">50 U.S.C. 401 et seq.</external-xref>) is further amended by inserting after the item relating to section 507 the following new item:</text>

<section id="H46730521CF7042CC85F585BECF63D2B2" display-inline="no-display-inline" section-type="subsequent-section"><enum>310.</enum><header>Sense of Congress regarding the need for a robust workforce</header><text display-inline="no-display-inline">It is the sense of Congress that—</text> 
<paragraph id="HD9B0737F94414B0E950045EA56955415"><enum>(1)</enum><text display-inline="yes-display-inline">a robust and highly skilled aerospace industry workforce is critical to the success of intelligence community programs and operations;</text></paragraph> 
<paragraph id="HD210C8AAA08E42DB9CA269B617B10000"><enum>(2)</enum><text display-inline="yes-display-inline">voluntary attrition, the retirement of many senior workers, and difficulties in recruiting could leave the intelligence community without access to the intellectual capital and technical capabilities necessary to identify and respond to potential threats; and</text></paragraph> 
<paragraph id="HA8654D90FAEB45B8935E563C5625B109"><enum>(3)</enum><text display-inline="yes-display-inline">the Director of National Intelligence should work cooperatively with other agencies of the Federal Government responsible for programs related to space and the aerospace industry to develop and implement policies, including those with an emphasis on improving science, technology, engineering, and mathematics education at all levels, to sustain and expand the diverse workforce available to the intelligence community. </text></paragraph></section></subtitle> 
<subtitle id="HADF0C0AFA1364479B739FFE2D19D5367"><enum>B</enum><header>Other matters</header> 
<section id="H110A4163D10044CE9FBCE41800C4B100"><enum>311.</enum><header>Restriction on conduct of intelligence activities</header><text display-inline="no-display-inline">The authorization of appropriations by this Act shall not be deemed to constitute authority for the conduct of any intelligence activity which is not otherwise authorized by the Constitution or the laws of the United States.</text></section> 
<section commented="no" display-inline="no-display-inline" id="H0E2E28DA936149109C0043AC9B447141" section-type="subsequent-section"><enum>312.</enum><header>Clarification of definition of intelligence community under the National Security Act of <enum-in-header>1947</enum-in-header></header><text display-inline="no-display-inline">Subparagraph (L) of section 3(4) of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/401a">50 U.S.C. 401a(4)</external-xref>) is amended by striking <quote>other</quote> the second place it appears.</text></section> 
<section id="HE8F7413C1E534D0AAE07398FBB84C58"><enum>313.</enum><header>Modification of availability of funds for different intelligence activities</header><text display-inline="no-display-inline">Subparagraph (B) of section 504(a)(3) of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/414">50 U.S.C. 414(a)(3)</external-xref>) is amended to read as follows:</text>

<section id="H0B1595A0489B426AA587C8AB796DD86"><enum>314.</enum><header>Protection of certain national security information</header> 
<subsection id="HC19BA188E4994077892EC64B583156F0"><enum>(a)</enum><header>Increase in penalties for disclosure of undercover intelligence officers and agents</header> 
<paragraph id="H7B34266A5A304FBA85DC58C8A314A04F"><enum>(1)</enum><header>Disclosure of agent after access to information identifying agent</header><text>Subsection (a) of section 601 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/421">50 U.S.C. 421</external-xref>) is amended by striking <quote>ten years</quote> and inserting <quote>15 years</quote>.</text></paragraph> 
<paragraph id="H2427BCC0B1E54512A0D274B397E4491"><enum>(2)</enum><header>Disclosure of agent after access to classified information</header><text>Subsection (b) of such section is amended by striking <quote>five years</quote> and inserting <quote>10 years</quote>.</text></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HB78D246003AB4250A0C7F177BD7D5B5C"><enum>(b)</enum><header>Modifications to annual report on protection of intelligence identities</header><text display-inline="yes-display-inline">The first sentence of section 603(a) of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/423">50 U.S.C. 423(a)</external-xref>) is amended by inserting <quote>including an assessment of the need for any modification of this title for the purpose of improving legal protections for covert agents,</quote> after <quote>measures to protect the identities of covert agents,</quote>.</text></subsection></section> 
<section id="HACD246359EA84DB094C91C09D3FB7221"><enum>315.</enum><header>Extension of authority to delete information about receipt and disposition of foreign gifts and decorations</header><text display-inline="no-display-inline">Paragraph (4) of <external-xref legal-doc="usc" parsable-cite="usc/5/7342">section 7342(f)</external-xref> of title 5, United States Code, is amended to read as follows:</text>

<subparagraph id="HC0C3336F9C5B42CAA921A221663078A3" indent="up1"><enum>(B)</enum><text>Any information not provided to the Secretary of State pursuant to the authority in subparagraph (A) shall be transmitted to the Director of National Intelligence who shall keep a record of such information.</text></subparagraph> 
<subparagraph id="HEA44C3BD1BAC4A5196483E9B35F411B9" indent="up1"><enum>(C)</enum><text>In this paragraph, the term <term>intelligence community</term> has the meaning given the term in section 3(4) of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/401a">50 U.S.C. 401a(4)</external-xref>).</text></subparagraph></paragraph> <after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H2F474A72BA174E6BAA26811E696589F"><enum>316.</enum><header>Report on compliance with the Detainee Treatment Act of <enum-in-header>2005</enum-in-header> and related provisions of the Military Commissions Act of <enum-in-header>2006</enum-in-header></header> 
<subsection id="H151BA43DCBC445A6BA00533B92AA8295"><enum>(a)</enum><header>Report Required</header><text>Not later than November 1, 2008, the Director of National Intelligence shall submit to the congressional intelligence committees a comprehensive report on all measures taken by the Office of the Director of National Intelligence and by each element, if any, of the intelligence community with relevant responsibilities to comply with the provisions of the Detainee Treatment Act of 2005 (title X of division A of <external-xref legal-doc="public-law" parsable-cite="pl/109/148">Public Law 109–148</external-xref>; 119 Stat. 2739) and related provisions of the Military Commissions Act of 2006 (<external-xref legal-doc="public-law" parsable-cite="pl/109/366">Public Law 109–366</external-xref>; 120 Stat. 2600).</text></subsection> 
<subsection id="H576D4BDB202446C7B1778352E7F63B8F"><enum>(b)</enum><header>Elements</header><text>The report required by subsection (a) shall include the following:</text> 
<paragraph id="H7A146A7BB1B64426B6316C6539593D16"><enum>(1)</enum><text>A description of the detention or interrogation methods, if any, that have been determined to comply with section 1003 of the Detainee Treatment Act of 2005 (119 Stat. 2739; <external-xref legal-doc="usc" parsable-cite="usc/42/2000dd">42 U.S.C. 2000dd</external-xref>) and section 6 of the Military Commissions Act of 2006 (120 Stat. 2632; <external-xref legal-doc="usc" parsable-cite="usc/18/2441">18 U.S.C. 2441</external-xref> note) (including the amendments made by such section 6), and, with respect to each such method—</text> 
<subparagraph id="H7DED3221BF134225AFB2CF005D4FE34F"><enum>(A)</enum><text>an identification of the official making such determination; and</text></subparagraph> 
<subparagraph id="H5A5CE34F57EE4256B902E309683DCBE"><enum>(B)</enum><text>a statement of the basis for such determination.</text></subparagraph></paragraph> 
<paragraph id="HED51EC48FC5848E5A4974BD6BAABA50"><enum>(2)</enum><text>A description of the detention or interrogation methods, if any, the use of which has been discontinued pursuant to the Detainee Treatment Act of 2005 or the Military Commission Act of 2006, and, with respect to each such method—</text> 
<subparagraph id="HC905626A155C47188BDC9D1002D8B7B5"><enum>(A)</enum><text>an identification of the official making the determination to discontinue such method; and</text></subparagraph> 
<subparagraph id="HF8555FDB94BB4871BA65E9BA383E93E6"><enum>(B)</enum><text>a statement of the basis for such determination.</text></subparagraph></paragraph> 
<paragraph id="H19BBD90DCDB941E19F281B2C04AB1D61"><enum>(3)</enum><text>A description of any actions that have been taken to implement section 1004 of the Detainee Treatment Act of 2005 (119 Stat. 2740; <external-xref legal-doc="usc" parsable-cite="usc/42/2000dd-1">42 U.S.C. 2000dd–1</external-xref>), and, with respect to each such action—</text> 
<subparagraph id="H3FEE90A081264CEE927F0479A39FD3C"><enum>(A)</enum><text>an identification of the official taking such action; and</text></subparagraph> 
<subparagraph id="H0531038D7CC94481B88EDB4EAFE6E62"><enum>(B)</enum><text>a statement of the basis for such action.</text></subparagraph></paragraph> 
<paragraph id="HC44902330DEF46899C3C4B194639E204"><enum>(4)</enum><text>Any other matters that the Director considers necessary to fully and currently inform the congressional intelligence committees about the implementation of the Detainee Treatment Act of 2005 and related provisions of the Military Commissions Act of 2006.</text></paragraph> 
<paragraph id="H07D4E5D4A7F2463693D274152210B476"><enum>(5)</enum><text>An appendix containing—</text> 
<subparagraph id="HFC71EF53269547EBA969E8C3BC41D781"><enum>(A)</enum><text>all guidelines for the application of the Detainee Treatment Act of 2005 and related provisions of the Military Commissions Act of 2006 to the detention or interrogation activities, if any, of any element of the intelligence community; and</text></subparagraph> 
<subparagraph id="H2030E9921E0A4D97B3C73290C46FC7A3"><enum>(B)</enum><text>all legal justifications of the Department of Justice, including any office thereof, about the meaning or application of the Detainee Treatment Act of 2005 or related provisions of the Military Commissions Act of 2006 with respect to the detention or interrogation activities, if any, of any element of the intelligence community.</text></subparagraph></paragraph></subsection> 
<subsection id="HCFF5B1CF630E4A6C985DDA3141419BF2"><enum>(c)</enum><header>Form</header><text>The report required by subsection (a) shall be submitted in classified form.</text></subsection> 
<subsection id="H3C1546A8D29B4F39A31CC829B5C1F812"><enum>(d)</enum><header>Submission to the congressional armed services committees</header><text>To the extent that the report required by subsection (a) addresses an element of the intelligence community within the Department of Defense, that portion of the report, and any associated material that is necessary to make that portion understandable, shall also be submitted by the Director of National Intelligence to the congressional armed services committees.</text></subsection> 
<subsection id="HB848542088EA4B689865ED4258B94D6C"><enum>(e)</enum><header>Congressional armed services committee defined</header><text>In this section, the term <term>congressional armed services committees</term> means—</text> 
<paragraph id="HE386361599FF4968836D1492FC99467B"><enum>(1)</enum><text>the Committee on Armed Services of the Senate; and</text></paragraph> 
<paragraph id="H5C8A8CD539A947FDAB61559C02DFF628"><enum>(2)</enum><text>the Committee on Armed Services of the House of Representatives.</text></paragraph></subsection></section> 
<section id="HBC9944FACA8B48E29D88A43DB7372B1"><enum>317.</enum><header>Incorporation of reporting requirements</header><text display-inline="no-display-inline">Each requirement to submit a report to the congressional intelligence committees that is included in the classified annex to this Act is hereby incorporated into this Act and is hereby made a requirement in law.</text></section> 
<section id="HB368469AAD384839841DF3A800B2332C"><enum>318.</enum><header>Repeal of certain reporting requirements</header> 
<subsection id="H1F6984178E744B54B761DD05572E8C02"><enum>(a)</enum><header>Annual certification on counterintelligence initiatives</header><text>Section 1102(b) of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/442a">50 U.S.C. 442a(b)</external-xref>) is amended—</text> 
<paragraph id="HF10F52E0CA5B44DCB577A2474953FA00"><enum>(1)</enum><text>by striking <quote>(1)</quote>; and</text></paragraph> 
<paragraph id="H478A93E5C6504C5C8BEAD7006FC66EF4"><enum>(2)</enum><text>by striking paragraph (2).</text></paragraph></subsection> 
<subsection id="H2B08C602988C435B008C5282F094FE71"><enum>(b)</enum><header>Report and certification under terrorist identification classification system</header><text>Section 343 of the Intelligence Authorization Act for Fiscal Year 2003 (<external-xref legal-doc="usc" parsable-cite="usc/50/404n-2">50 U.S.C. 404n–2</external-xref>) is amended—</text> 
<paragraph id="HC4F908B76D7343C8AEEC24887793C34E"><enum>(1)</enum><text>by striking subsection (d); and</text></paragraph>

<paragraph id="HA65695C2EF8844D8007C0500FDF54825"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The National Security Act of 1947 is amended by inserting after section 1021 (<external-xref legal-doc="usc" parsable-cite="usc/50/441m">50 U.S.C. 441m</external-xref>) the following new section:</text>

<section id="HEF46968427BA44FCB6D65191AEBCFB57"><enum>1022.</enum><header>Intelligence community acquisition of critical skills</header> 
<subsection id="HF8F0768EA60642A5A07F101B48FEEEAB" display-inline="yes-display-inline"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The head of an appropriate department may assign civilian employees of an element of the intelligence community that is a component of such appropriate department as students at accredited professional, technical, and other institutions of higher learning for training at the undergraduate level in skills critical to effective performance of the mission of such element of the intelligence community.</text></subsection> 
<subsection id="H7F2AB7571C61416E837FE0A07587982F"><enum>(b)</enum><header>Payment of expenses</header><text>The head of an appropriate department may pay, directly or by reimbursement to employees, expenses incident to assignments under subsection (a), in any fiscal year only to the extent that appropriated funds are available for such purpose.</text></subsection> 
<subsection id="H544E2D0C18AA49E7A719A16940517F57"><enum>(c)</enum><header>Eligibility</header> 
<paragraph display-inline="no-display-inline" id="H81B3D1F59F1E4F0FB99057BE9E02EE50"><enum>(1)</enum><header>In general</header><text>To be eligible for assignment under subsection (a), an employee of an element of the intelligence community must agree in writing—</text> 
<subparagraph id="H11C04A4DC0074E5D8C38735B581C12BF" display-inline="no-display-inline"><enum>(A)</enum><text>to continue in the service of such element for the period of the assignment and to complete the educational course of training for which the employee is assigned;</text></subparagraph> 
<subparagraph id="HDFFF0372CFCD4D379503B50758940000" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">to continue in the service of such element following completion of the assignment for a period of one-and-a-half years for each year of the assignment or part thereof;</text></subparagraph> 
<subparagraph id="H2D532814BB27463D831C5C572F46CDF1" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">to reimburse the United States for the total cost of education (excluding the employee's pay and allowances) provided under this section to the employee if, prior to the employee's completing the educational course of training for which the employee is assigned, the assignment or the employee's employment with such element is terminated either by such element due to misconduct by the employee or by the employee voluntarily; and</text></subparagraph> 
<subparagraph id="HB3157F485C3D4C89A1697955293FB8ED" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">to reimburse the United States if, after completing the educational course of training for which the employee is assigned, the employee's employment with such element is terminated either by such element due to misconduct by the employee or by the employee voluntarily, prior to the employee's completion of the service obligation period described in subparagraph (B), in an amount that bears the same ratio to the total cost of the education (excluding the employee's pay and allowances) provided to the employee as the unserved portion of the service obligation period described in subparagraph (B) bears to the total period of the service obligation described in subparagraph (B).</text></subparagraph></paragraph> 
<paragraph id="H971E4C8727364BD693E86317722B0081" display-inline="no-display-inline"><enum>(2)</enum><header>Debt owing the United States</header><text>Subject to paragraph (3), the obligation to reimburse the United States under an agreement described in paragraph (1), including interest due on such obligation, is for all purposes a debt owing the United States.</text></paragraph> 
<paragraph id="H40BCDDCF40A84F56A759C6385C20210" display-inline="no-display-inline"><enum>(3)</enum><header>Reimbursement</header> 
<subparagraph display-inline="no-display-inline" id="HD181175458E34A198E766FA545F00BC"><enum>(A)</enum><header>Bankruptcy</header><text>A discharge in bankruptcy under title 11, United States Code, shall not release a person from an obligation to reimburse the United States required under an agreement described in paragraph (1) if the final decree of the discharge in bankruptcy is issued within five years after the last day of the combined period of service obligation described in subparagraphs (A) and (B) of paragraph (1).</text></subparagraph> 
<subparagraph id="HB53619069F1A48E796E0A95277E99F25" display-inline="no-display-inline"><enum>(B)</enum><header>Release</header><text>The head of an appropriate department may release a person, in whole or in part, from the obligation to reimburse the United States under an agreement described in paragraph (1) when, in the discretion of such head of an appropriate department, such head of an appropriate department determines that equity or the interests of the United States so require.</text></subparagraph> 
<subparagraph id="H1692CCC7371846BE920041007F4E78F1" display-inline="no-display-inline"><enum>(C)</enum><header>Monthly payments</header><text display-inline="yes-display-inline">The head of an appropriate department shall permit an employee assigned under this section who, prior to commencing a second academic year of such assignment, voluntarily terminates the assignment or the employee's employment with the element of the intelligence community that is a component of such appropriate department, to satisfy the employee’s obligation under an agreement described in paragraph (1) to reimburse the United States by reimbursement according to a schedule of monthly payments which results in completion of reimbursement by a date five years after the date of termination of the assignment or employment or earlier at the option of the employee.</text></subparagraph></paragraph></subsection> 
<subsection id="H855254642D3F43639DF24E2D8D827805" display-inline="no-display-inline"><enum>(d)</enum><header>Recruitment</header><text>Efforts by an element of the intelligence community to recruit individuals at educational institutions for participation in the undergraduate training program established by this section shall be made openly and according to the common practices of universities and employers recruiting at such institutions.</text></subsection> 
<subsection id="H824F935C0EF44911947776CDFB8F7861"><enum>(e)</enum><header>Inapplication of provisions on training</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/41">Chapter 41</external-xref> of title 5 and subsections (a) and (b) of <external-xref legal-doc="usc" parsable-cite="usc/31/3324">section 3324</external-xref> of title 31, United States Code, shall not apply with respect to this section.</text></subsection> 
<subsection id="H6CBCCACD0DD541D300BA1EA8C8A064E8"><enum>(f)</enum><header>Regulations</header><text>A head of the appropriate department assigning employees in accordance with this section may issue such regulations as such head of the appropriate department considers necessary to carry out this section.</text></subsection> 
<subsection id="H22C9FEA3620A44C200BBA5265DB281EA"><enum>(g)</enum><header>Rules of construction</header> 
<paragraph id="H4586BAA508424D8EA0B810C107B10617"><enum>(1)</enum><header>Component</header><text>For purposes of this section—</text> 
<subparagraph id="H368F8B9491254816BD808806678C745C"><enum>(A)</enum><text>the Office of the Director of National Intelligence shall be considered a component of such Office; and</text></subparagraph> 
<subparagraph id="H6FBFECB09D924717B529D41569830091"><enum>(B)</enum><text>the Central Intelligence Agency shall be considered a component of such Agency.</text></subparagraph></paragraph> 
<paragraph id="H33921EF008F7467C84D64926F46FD607" commented="no"><enum>(2)</enum><header>Required education programs</header><text>Nothing in this section shall be construed to modify, affect, or supercede any provision of law requiring or otherwise authorizing or providing for a training program described in this section.</text></paragraph></subsection> 
<subsection id="HC0ED4C38683443078E3D365400BF769C"><enum>(h)</enum><header>Appropriate department defined</header><text>In this section, the term <quote>appropriate department</quote> means—</text>

<paragraph id="H04C51D64A5944104B4B6BA64BFFEA386"><enum>(4)</enum><text>other matters related to paragraphs (1) through (3) as the President considers appropriate.</text></paragraph></section>

<paragraph id="H2D583922B09D4BA682986541E7650604"><enum>(2)</enum><text>an evaluation, consistent with existing reporting standards and practices, of the sources upon which the intelligence used to prepare the assessment described in paragraph (1) is based, including the number of such sources and an assessment of the reliability of each such source;</text></paragraph> 
<paragraph id="HA360359CD4584A1287917DC7CB32D6CB"><enum>(3)</enum><text>a summary of any intelligence related to any such program gathered or developed since the previous report was submitted under subsection (a), including intelligence collected from both open and clandestine sources for each such country; and</text></paragraph> 
<paragraph id="H9C1AB50FBE934C4DA1839CD1C74FB849"><enum>(4)</enum><text>a discussion of any dissents, caveats, gaps in knowledge, or other information that would reduce confidence in the assessment described in paragraph (1).</text></paragraph></subsection> 
<subsection id="H87B3C873B64B47AEB796258611F29DB1"><enum>(c)</enum><header>National Intelligence Estimate</header><text>The Director of National Intelligence may submit a National Intelligence Estimate on the intentions and capabilities of the Islamic Republic of Iran, the Syrian Arab Republic, or the Democratic People's Republic of Korea in lieu of a report required by subsection (a) for that country.</text></subsection>

<subparagraph id="H1C43585CFA6B43C8B59D51E11492FC8D"><enum>(A)</enum><text>to promote economy, efficiency, and effectiveness in the administration and implementation of matters within the responsibility and authority of the Director of National Intelligence; and</text></subparagraph> 
<subparagraph id="H594147C4A2E4407FAA9C522D00E219B8"><enum>(B)</enum><text>to prevent and detect fraud and abuse in such matters;</text></subparagraph></paragraph> 
<paragraph id="HD39F0FB7133C447A86E86CA79800D907"><enum>(3)</enum><text>provide a means for keeping the Director of National Intelligence fully and currently informed about—</text> 
<subparagraph id="HB621AC3684494A3BB7E2815120001CFD"><enum>(A)</enum><text>problems and deficiencies relating to matters within the responsibility and authority of the Director of National Intelligence; and</text></subparagraph> 
<subparagraph id="HC30975626CF74E98BFB17D452B80D7B1"><enum>(B)</enum><text>the necessity for, and the progress of, corrective actions; and</text></subparagraph></paragraph> 
<paragraph id="HCBCD660F1DD7483F81E2E752D1B86871"><enum>(4)</enum><text>in the manner prescribed by this section, ensure that the congressional intelligence committees are kept similarly informed of—</text> 
<subparagraph id="H51FC34A55E5F470B8DE0DD2F16CCD"><enum>(A)</enum><text>significant problems and deficiencies relating to matters within the responsibility and authority of the Director of National Intelligence; and</text></subparagraph> 
<subparagraph id="HD228B887879F4D7B82429E28E01BE88B"><enum>(B)</enum><text>the necessity for, and the progress of, corrective actions.</text></subparagraph></paragraph></subsection> 
<subsection id="H3188A08AEE27462686065FD66CA89EE0"><enum>(c)</enum><header>Inspector General of Intelligence Community</header> 
<paragraph commented="no" display-inline="yes-display-inline" id="H0952A02354F34BDCB3F16693EE73FFDA"><enum>(1)</enum><text>There is an Inspector General of the Intelligence Community, who shall be the head of the Office of the Inspector General of the Intelligence Community, who shall be appointed by the President, by and with the advice and consent of the Senate.</text></paragraph> 
<paragraph id="HF9BC060073F64303AB15B2D300C71E58" indent="up1"><enum>(2)</enum><text>The nomination of an individual for appointment as Inspector General shall be made—</text> 
<subparagraph id="H59FDA189314E44579590218407045D90"><enum>(A)</enum><text>without regard to political affiliation;</text></subparagraph> 
<subparagraph id="H25C360D29C3142CB821737D44F1DB05F"><enum>(B)</enum><text>solely on the basis of integrity, compliance with the security standards of the intelligence community, and prior experience in the field of intelligence or national security; and</text></subparagraph> 
<subparagraph id="HA7A4D2BF9F024F51A31E7364C9E1DCB7"><enum>(C)</enum><text>on the basis of demonstrated ability in accounting, financial analysis, law, management analysis, public administration, or auditing.</text></subparagraph></paragraph> 
<paragraph id="HF78DEF84D52E4F34ADC681782B00FCD3" indent="up1"><enum>(3)</enum><text>The Inspector General shall report directly to and be under the general supervision of the Director of National Intelligence.</text></paragraph> 
<paragraph id="HA1417F9C737F4A64B8F147934FA7F0B8" indent="up1"><enum>(4)</enum><text>The Inspector General may be removed from office only by the President. The President shall immediately communicate in writing to the congressional intelligence committees the reasons for the removal of any individual from the position of Inspector General.</text></paragraph></subsection> 
<subsection id="H98F440857A3844C9858FA64F69BB8F2E"><enum>(d)</enum><header>Duties and Responsibilities</header><text>Subject to subsections (g) and (h), it shall be the duty and responsibility of the Inspector General of the Intelligence Community—</text> 
<paragraph id="H33C15F1C967741C18EFAFD9E18D62911"><enum>(1)</enum><text>to provide policy direction for, and to plan, conduct, supervise, and coordinate independently, the investigations, inspections, and audits relating to matters within the responsibility and authority of the Director of National Intelligence to ensure they are conducted efficiently and in accordance with applicable law and regulations;</text></paragraph> 
<paragraph id="HFA62806B9EF043BBB250ABF4F8D2B09"><enum>(2)</enum><text>to keep the Director of National Intelligence fully and currently informed concerning violations of law and regulations, violations of civil liberties and privacy, fraud and other serious problems, abuses, and deficiencies that may occur in matters within the responsibility and authority of the Director, and to report the progress made in implementing corrective action;</text></paragraph> 
<paragraph id="H6521E38BB5DE4E7DB5D237AD683248B7"><enum>(3)</enum><text>to take due regard for the protection of intelligence sources and methods in the preparation of all reports issued by the Inspector General, and, to the extent consistent with the purpose and objective of such reports, take such measures as may be appropriate to minimize the disclosure of intelligence sources and methods described in such reports; and</text></paragraph> 
<paragraph id="HD8EDF6E4F819496A855569F3BAB69C3E"><enum>(4)</enum><text>in the execution of the duties and responsibilities under this section, to comply with generally accepted government auditing standards.</text></paragraph></subsection> 
<subsection id="H4941A2474F9041CE83DD00B773DC1DC0"><enum>(e)</enum><header>Limitations on Activities</header> 
<paragraph commented="no" display-inline="yes-display-inline" id="H30853A814A5441C8BF2D29C72E22B792"><enum>(1)</enum><text>The Director of National Intelligence may prohibit the Inspector General of the Intelligence Community from initiating, carrying out, or completing any investigation, inspection, or audit if the Director determines that such prohibition is necessary to protect vital national security interests of the United States.</text></paragraph> 
<paragraph id="HF971FE8502F74167BDA966174541DD37" indent="up1"><enum>(2)</enum><text>If the Director exercises the authority under paragraph (1), the Director shall submit an appropriately classified statement of the reasons for the exercise of such authority within 7 days to the congressional intelligence committees.</text></paragraph> 
<paragraph id="HD9437BE5150245C9977207251082E6A1" indent="up1"><enum>(3)</enum><text>The Director shall advise the Inspector General at the time a report under paragraph (2) is submitted, and, to the extent consistent with the protection of intelligence sources and methods, provide the Inspector General with a copy of such report.</text></paragraph> 
<paragraph id="H093042B910DA4F39006CA9AFEE1CF35C" indent="up1"><enum>(4)</enum><text>The Inspector General may submit to the congressional intelligence committees any comments on a report of which the Inspector General has notice under paragraph (3) that the Inspector General considers appropriate.</text></paragraph></subsection> 
<subsection id="HCDE89BE2F273425FBFD4F14149C6027E"><enum>(f)</enum><header>Authorities</header> 
<paragraph commented="no" display-inline="yes-display-inline" id="HA9DE3B74CA40490592A40029C2ECD41D"><enum>(1)</enum><text>The Inspector General of the Intelligence Community shall have direct and prompt access to the Director of National Intelligence when necessary for any purpose pertaining to the performance of the duties of the Inspector General.</text></paragraph> 
<paragraph id="HD5E8D3E4AB764F0DBB1638FA70AEC539" indent="up1"><enum>(2)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="H8AB86AA324FB46BEB620E23414D4567"><enum>(A)</enum><text>The Inspector General shall have access to any employee, or any employee of a contractor, of any element of the intelligence community whose testimony is needed for the performance of the duties of the Inspector General.</text></subparagraph> 
<subparagraph id="H4E70213D2BA04857B272A6A72DBC61A4" indent="up1"><enum>(B)</enum><text>The Inspector General shall have direct access to all records, reports, audits, reviews, documents, papers, recommendations, or other material which relate to the programs and operations with respect to which the Inspector General has responsibilities under this section.</text></subparagraph> 
<subparagraph id="HE32462650B334912B96EFC00A670FB00" indent="up1"><enum>(C)</enum><text>The level of classification or compartmentation of information shall not, in and of itself, provide a sufficient rationale for denying the Inspector General access to any materials under subparagraph (B).</text></subparagraph> 
<subparagraph id="H2A5F821AF26D4F1294C8970000F502F6" indent="up1"><enum>(D)</enum><text>Failure on the part of any employee, or any employee of a contractor, of any element of the intelligence community to cooperate with the Inspector General shall be grounds for appropriate administrative actions by the Director or, on the recommendation of the Director, other appropriate officials of the intelligence community, including loss of employment or the termination of an existing contractual relationship.</text></subparagraph></paragraph> 
<paragraph id="H7E6261A6B2C7465D80D356E99BB01493" indent="up1"><enum>(3)</enum><text>The Inspector General is authorized to receive and investigate complaints or information from any person concerning the existence of an activity constituting a violation of laws, rules, or regulations, or mismanagement, gross waste of funds, abuse of authority, or a substantial and specific danger to the public health and safety. Once such complaint or information has been received from an employee of the Federal Government—</text> 
<subparagraph id="HF54A5B6E1B9B4ABDAA40DDA6C7B86896"><enum>(A)</enum><text>the Inspector General shall not disclose the identity of the employee without the consent of the employee, unless the Inspector General determines that such disclosure is unavoidable during the course of the investigation or the disclosure is made to an official of the Department of Justice responsible for determining whether a prosecution should be undertaken; and</text></subparagraph> 
<subparagraph id="HD5A3800456EF4E74B6D042BCB3DDABDD"><enum>(B)</enum><text>no action constituting a reprisal, or threat of reprisal, for making such complaint may be taken by any employee in a position to take such actions, unless the complaint was made or the information was disclosed with the knowledge that it was false or with willful disregard for its truth or falsity.</text></subparagraph></paragraph> 
<paragraph id="HD89C639CA0C14BD900A30775E8FCE7C" indent="up1"><enum>(4)</enum><text>The Inspector General shall have authority to administer to or take from any person an oath, affirmation, or affidavit, whenever necessary in the performance of the duties of the Inspector General, which oath, affirmation, or affidavit when administered or taken by or before an employee of the Office of the Inspector General of the Intelligence Community designated by the Inspector General shall have the same force and effect as if administered or taken by, or before, an officer having a seal.</text></paragraph> 
<paragraph id="HA383C245488B45128600F8CD845D8197" indent="up1"><enum>(5)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="H9AFC5CEEA6354D7CA9AFBF4820D7008E"><enum>(A)</enum><text>Except as provided in subparagraph (B), the Inspector General is authorized to require by subpoena the production of all information, documents, reports, answers, records, accounts, papers, and other data and documentary evidence necessary in the performance of the duties and responsibilities of the Inspector General.</text></subparagraph> 
<subparagraph id="H3145F16FC8CD4855BF24FFE28B1D98A3" indent="up1"><enum>(B)</enum><text>In the case of departments, agencies, and other elements of the United States Government, the Inspector General shall obtain information, documents, reports, answers, records, accounts, papers, and other data and evidence for the purpose specified in subparagraph (A) using procedures other than by subpoenas.</text></subparagraph> 
<subparagraph id="HF3A5F1CD59344FA1A78BBF59BB72066" indent="up1"><enum>(C)</enum><text>The Inspector General may not issue a subpoena for, or on behalf of, any other element of the intelligence community, including the Office of the Director of National Intelligence.</text></subparagraph> 
<subparagraph id="HF5448FB5F0BB40AEAD673E928B46C082" indent="up1"><enum>(D)</enum><text>In the case of contumacy or refusal to obey a subpoena issued under this paragraph, the subpoena shall be enforceable by order of any appropriate district court of the United States.</text></subparagraph></paragraph></subsection> 
<subsection id="HAB0F9B4548774977A133E1DCE90032EB"><enum>(g)</enum><header>Coordination Among Inspectors General of Intelligence Community</header> 
<paragraph commented="no" display-inline="yes-display-inline" id="HB6E3DA01E82843F8B8F6D978A32FD886"><enum>(1)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="HEA54DF18AFB34E42ADEE6428D3A20044"><enum>(A)</enum><text>In the event of a matter within the jurisdiction of the Inspector General of the Intelligence Community that may be subject to an investigation, inspection, or audit by both the Inspector General of the Intelligence Community and an Inspector General, whether statutory or administrative, with oversight responsibility for an element or elements of the intelligence community, the Inspector General of the Intelligence Community and such other Inspector or Inspectors General shall expeditiously resolve the question of which Inspector General shall conduct such investigation, inspection, or audit.</text></subparagraph> 
<subparagraph id="HC897E2D3C6184E0C9CA6879875DC8593" indent="up2"><enum>(B)</enum><text>In attempting to resolve a question under subparagraph (A), the Inspectors General concerned may request the assistance of the Intelligence Community Inspectors General Forum established under subparagraph (C). In the event of a dispute between an Inspector General within an agency or department of the United States Government and the Inspector General of the Intelligence Community that has not been resolved with the assistance of the Forum, the Inspectors General shall submit the question to the Director of National Intelligence and the head of the agency or department for resolution.</text></subparagraph> 
<subparagraph id="H1987BBF0293247CBAFF300001CF6596B" indent="up2"><enum>(C)</enum><text>There is established the Intelligence Community Inspectors General Forum which shall consist of all statutory or administrative Inspectors General with oversight responsibility for an element or elements of the intelligence community. The Inspector General of the Intelligence Community shall serve as the chair of the Forum. The Forum shall have no administrative authority over any Inspector General, but shall serve as a mechanism for informing its members of the work of individual members of the Forum that may be of common interest and discussing questions about jurisdiction or access to employees, employees of a contractor, records, audits, reviews, documents, recommendations, or other materials that may involve or be of assistance to more than one of its members.</text></subparagraph></paragraph> 
<paragraph id="H7BB361E7412C42FB90F89304F8579618" indent="up1"><enum>(2)</enum><text>The Inspector General conducting an investigation, inspection, or audit covered by paragraph (1) shall submit the results of such investigation, inspection, or audit to any other Inspector General, including the Inspector General of the Intelligence Community, with jurisdiction to conduct such investigation, inspection, or audit who did not conduct such investigation, inspection, or audit.</text></paragraph></subsection> 
<subsection id="H63C78B14535A4E95A5D40349C1D3F3AF"><enum>(h)</enum><header>Staff and Other Support</header> 
<paragraph commented="no" display-inline="yes-display-inline" id="H673BF8C19DB14FCA82ECA55388B5C2C3"><enum>(1)</enum><text>The Inspector General of the Intelligence Community shall be provided with appropriate and adequate office space at central and field office locations, together with such equipment, office supplies, maintenance services, and communications facilities and services as may be necessary for the operation of such offices.</text></paragraph> 
<paragraph id="HAE93AD106C324794BCE0E442A42BEAF" indent="up1"><enum>(2)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="H8871AEBAB52B45DCA77FABFA583B7C93"><enum>(A)</enum><text>Subject to applicable law and the policies of the Director of National Intelligence, the Inspector General shall select, appoint, and employ such officers and employees as may be necessary to carry out the functions of the Inspector General. The Inspector General shall ensure that any officer or employee so selected, appointed, or employed has security clearances appropriate for the assigned duties of such officer or employee.</text></subparagraph> 
<subparagraph id="H8EA85E104DAB467B952584A8877F4031" indent="up1"><enum>(B)</enum><text>In making selections under subparagraph (A), the Inspector General shall ensure that such officers and employees have the requisite training and experience to enable the Inspector General to carry out the duties of the Inspector General effectively.</text></subparagraph> 
<subparagraph id="H2B10E3E3767D41D8B5FA204C69007FF4" indent="up1"><enum>(C)</enum><text>In meeting the requirements of this paragraph, the Inspector General shall create within the Office of the Inspector General of the Intelligence Community a career cadre of sufficient size to provide appropriate continuity and objectivity needed for the effective performance of the duties of the Inspector General.</text></subparagraph></paragraph> 
<paragraph id="H5F0611DD01574E2DA818BE00447974B4" indent="up1"><enum>(3)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="HB50E8D8BE05C4AD8865CD55C3944131B"><enum>(A)</enum><text>Subject to the concurrence of the Director, the Inspector General may request such information or assistance as may be necessary for carrying out the duties and responsibilities of the Inspector General from any department, agency, or other element of the United States Government.</text></subparagraph> 
<subparagraph id="H83E6A40F198342F9B915402748F2405B" indent="up1"><enum>(B)</enum><text>Upon request of the Inspector General for information or assistance under subparagraph (A), the head of the department, agency, or element concerned shall, insofar as is practicable and not in contravention of any existing statutory restriction or regulation of the department, agency, or element, furnish to the Inspector General, or to an authorized designee, such information or assistance.</text></subparagraph> 
<subparagraph id="H5BBBAA0F63D74044BE8D5878148B00FC" indent="up1"><enum>(C)</enum><text>The Inspector General of the Intelligence Community may, upon reasonable notice to the head of any element of the intelligence community, conduct, as authorized by this section, an investigation, inspection, or audit of such element and may enter into any place occupied by such element for purposes of the performance of the duties of the Inspector General.</text></subparagraph></paragraph></subsection> 
<subsection id="H08273C3030A94C9C97DD37511DFE3975"><enum>(i)</enum><header>Reports</header> 
<paragraph commented="no" display-inline="yes-display-inline" id="H29251F1F6B614F16A669EAE041608094"><enum>(1)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="H7D2860E10060439682E2CC9E3E4E038B"><enum>(A)</enum><text>The Inspector General of the Intelligence Community shall, not later than January 31 and July 31 of each year, prepare and submit to the Director of National Intelligence a classified, and, as appropriate, unclassified semiannual report summarizing the activities of the Office of the Inspector General of the Intelligence Community during the immediately preceding 6-month period ending December 31 (of the preceding year) and June 30, respectively. The Inspector General of the Intelligence Community shall provide any portion of the report involving a component of a department of the United States Government to the head of that department simultaneously with submission of the report to the Director of National Intelligence.</text></subparagraph> 
<subparagraph id="H15ACD462C9444B76B23EC95C38006E42" indent="up2"><enum>(B)</enum><text>Each report under this paragraph shall include, at a minimum, the following:</text> 
<clause id="H0DD46B94B4564908BB6F920523BD2C50"><enum>(i)</enum><text>A list of the title or subject of each investigation, inspection, or audit conducted during the period covered by such report, including a summary of the progress of each particular investigation, inspection, or audit since the preceding report of the Inspector General under this paragraph.</text></clause> 
<clause id="HB1DD36A164FB425CB88C678DB500C497"><enum>(ii)</enum><text>A description of significant problems, abuses, and deficiencies relating to the administration and implementation of programs and operations of the intelligence community, and in the relationships between elements of the intelligence community, identified by the Inspector General during the period covered by such report.</text></clause> 
<clause id="HFDB558C24A104857BF81CC242761975D"><enum>(iii)</enum><text>A description of the recommendations for corrective or disciplinary action made by the Inspector General during the period covered by such report with respect to significant problems, abuses, or deficiencies identified in clause (ii).</text></clause> 
<clause id="H8025CC971DD248898CF36E91B9A020CD"><enum>(iv)</enum><text>A statement whether or not corrective or disciplinary action has been completed on each significant recommendation described in previous semiannual reports, and, in a case where corrective action has been completed, a description of such corrective action.</text></clause> 
<clause id="HB7456AFBC72C4DCBBDD546C1C9D6E3FC"><enum>(v)</enum><text>A certification whether or not the Inspector General has had full and direct access to all information relevant to the performance of the functions of the Inspector General.</text></clause> 
<clause id="H60AC9365E6884192BA3B9D845B8E2C8D"><enum>(vi)</enum><text>A description of the exercise of the subpoena authority under subsection (f)(5) by the Inspector General during the period covered by such report.</text></clause> 
<clause id="HE36D5FC4A9F344CCB84337DED6E500DC"><enum>(vii)</enum><text>Such recommendations as the Inspector General considers appropriate for legislation to promote economy, efficiency, and effectiveness in the administration and implementation of matters within the responsibility and authority of the Director of National Intelligence, and to detect and eliminate fraud and abuse in such matters.</text></clause></subparagraph> 
<subparagraph id="HD08132B9F45045D1B66698565BA862E2" indent="up2"><enum>(C)</enum><text>Not later than the 30 days after the date of receipt of a report under subparagraph (A), the Director shall transmit the report to the congressional intelligence committees together with any comments the Director considers appropriate. The Director shall transmit to the committees of the Senate and of the House of Representatives with jurisdiction over a department of the United States Government any portion of the report involving a component of such department simultaneously with submission of the report to the congressional intelligence committees.</text></subparagraph></paragraph> 
<paragraph id="H574F4AE806004850B500D5790610088" indent="up1"><enum>(2)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="HB1A2E6189D2F4C2FA96B03B72DC6ED07"><enum>(A)</enum><text>The Inspector General shall report immediately to the Director whenever the Inspector General becomes aware of particularly serious or flagrant problems, abuses, or deficiencies relating to matters within the responsibility and authority of the Director of National Intelligence.</text></subparagraph> 
<subparagraph id="H4C61F8C2982C476D003611655358584F" indent="up1"><enum>(B)</enum><text>The Director shall transmit to the congressional intelligence committees each report under subparagraph (A) within 7 calendar days of receipt of such report, together with such comments as the Director considers appropriate. The Director shall transmit to the committees of the Senate and of the House of Representatives with jurisdiction over a department of the United States Government any portion of each report under subparagraph (A) that involves a problem, abuse, or deficiency related to a component of such department simultaneously with transmission of the report to the congressional intelligence committees.</text></subparagraph></paragraph> 
<paragraph id="H5C3A6A1201E8445193B2F7FA046C81D5" indent="up1"><enum>(3)</enum><text>In the event that—</text> 
<subparagraph id="HCFB09D6908574C38A000CD973368F3F7"><enum>(A)</enum><text>the Inspector General is unable to resolve any differences with the Director affecting the execution of the duties or responsibilities of the Inspector General;</text></subparagraph> 
<subparagraph id="HF16782BA75044A0F9EEA6BD8B3A32E74"><enum>(B)</enum><text>an investigation, inspection, or audit carried out by the Inspector General focuses on any current or former intelligence community official who—</text> 
<clause id="H12DF3DDF51E0448BB135723946A600A1"><enum>(i)</enum><text>holds or held a position in an element of the intelligence community that is subject to appointment by the President, whether or not by and with the advice and consent of the Senate, including such a position held on an acting basis;</text></clause> 
<clause id="H2D3466A6E8DC4C50B9968230CC346D9F"><enum>(ii)</enum><text>holds or held a position in an element of the intelligence community, including a position held on an acting basis, that is appointed by the Director of National Intelligence; or</text></clause> 
<clause id="HDB234C6713C845A0B3420000E5CA87F8"><enum>(iii)</enum><text>holds or held a position as head of an element of the intelligence community or a position covered by subsection (b) or (c) of section 106;</text></clause></subparagraph> 
<subparagraph id="H1BCFC95D2815431DBCC4CE35216CB916"><enum>(C)</enum><text>a matter requires a report by the Inspector General to the Department of Justice on possible criminal conduct by a current or former official described in subparagraph (B);</text></subparagraph> 
<subparagraph id="HB898711A49354407B210709CF04B786E"><enum>(D)</enum><text>the Inspector General receives notice from the Department of Justice declining or approving prosecution of possible criminal conduct of any current or former official described in subparagraph (B); or</text></subparagraph> 
<subparagraph id="H998403B695DE432DADA85650507D64CF"><enum>(E)</enum><text>the Inspector General, after exhausting all possible alternatives, is unable to obtain significant documentary information in the course of an investigation, inspection, or audit,</text></subparagraph></paragraph><continuation-text continuation-text-level="subsection">the Inspector General shall immediately notify and submit a report on such matter to the congressional intelligence committees.</continuation-text> 
<paragraph id="HBC0E242F837F4195BA19BDFDD3B4A5C3" indent="up1"><enum>(4)</enum><text>Pursuant to title V, the Director shall submit to the congressional intelligence committees any report or findings and recommendations of an investigation, inspection, or audit conducted by the office which has been requested by the Chairman or Vice Chairman or Ranking Minority Member of either committee.</text></paragraph> 
<paragraph id="HDBF34FF8F69F430DADCCD1927721FD4D" indent="up1"><enum>(5)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="H5530FD6DDD6B43AEBF7C53F2557E8093"><enum>(A)</enum><text>An employee of an element of the intelligence community, an employee assigned or detailed to an element of the intelligence community, or an employee of a contractor to the intelligence community who intends to report to Congress a complaint or information with respect to an urgent concern may report such complaint or information to the Inspector General.</text></subparagraph> 
<subparagraph id="H7A51A6A7E1CF46DB90CBCAFF8FC9F48" indent="up1"><enum>(B)</enum><text>Not later than the end of the 14-calendar day period beginning on the date of receipt from an employee of a complaint or information under subparagraph (A), the Inspector General shall determine whether the complaint or information appears credible. Upon making such a determination, the Inspector General shall transmit to the Director a notice of that determination, together with the complaint or information.</text></subparagraph> 
<subparagraph id="H2E40AB47E86B447580A2928842D790F7" indent="up1"><enum>(C)</enum><text>Upon receipt of a transmittal from the Inspector General under subparagraph (B), the Director shall, within 7 calendar days of such receipt, forward such transmittal to the congressional intelligence committees, together with any comments the Director considers appropriate.</text></subparagraph> 
<subparagraph id="HD122B9D325AA4A37BAA88856EDD7DD1B" indent="up1"><enum>(D)</enum> 
<clause commented="no" display-inline="yes-display-inline" id="H7AFACC401ABE43BE86FADE4D4EB0A28E"><enum>(i)</enum><text>If the Inspector General does not find credible under subparagraph (B) a complaint or information submitted under subparagraph (A), or does not transmit the complaint or information to the Director in accurate form under subparagraph (B), the employee (subject to clause (ii)) may submit the complaint or information to Congress by contacting either or both of the congressional intelligence committees directly.</text></clause> 
<clause id="H3CA564B96F8841A2B6832F802CDC1243" indent="up1"><enum>(ii)</enum><text>An employee may contact the intelligence committees directly as described in clause (i) only if the employee—</text> 
<subclause id="H4652CF0429A64835AC5342CA58B4ABFD"><enum>(I)</enum><text>before making such a contact, furnishes to the Director, through the Inspector General, a statement of the employee’s complaint or information and notice of the employee’s intent to contact the congressional intelligence committees directly; and</text></subclause> 
<subclause id="H7193CCF8B0D442A19511DDECAFB62547"><enum>(II)</enum><text>obtains and follows from the Director, through the Inspector General, direction on how to contact the intelligence committees in accordance with appropriate security practices.</text></subclause></clause> 
<clause id="H48BC7F4183F04CF6B55527B93F16CF80" indent="up1"><enum>(iii)</enum><text>A member or employee of 1 of the congressional intelligence committees who receives a complaint or information under clause (i) does so in that member or employee’s official capacity as a member or employee of such committee.</text></clause></subparagraph> 
<subparagraph id="H6AB333BC33944B41BAE3D8DD714CC800" indent="up1"><enum>(E)</enum><text>The Inspector General shall notify an employee who reports a complaint or information to the Inspector General under this paragraph of each action taken under this paragraph with respect to the complaint or information. Such notice shall be provided not later than 3 days after any such action is taken.</text></subparagraph> 
<subparagraph id="H8D4B04EC88A443309874DC41216B4D10" indent="up1"><enum>(F)</enum><text>An action taken by the Director or the Inspector General under this paragraph shall not be subject to judicial review.</text></subparagraph> 
<subparagraph id="H5B65FC13A2AB4DBC84492FCF58CCD539" indent="up1"><enum>(G)</enum><text>In this paragraph, the term <term>urgent concern</term> means any of the following:</text> 
<clause id="HC2DF46D929A64BD58EA6A1C927B10097"><enum>(i)</enum><text>A serious or flagrant problem, abuse, violation of law or Executive order, or deficiency relating to the funding, administration, or operation of an intelligence activity involving classified information, but does not include differences of opinions concerning public policy matters.</text></clause> 
<clause id="HF43ABDA57DEF46498B8495EB1BC6FAAD"><enum>(ii)</enum><text>A false statement to Congress, or a willful withholding from Congress, on an issue of material fact relating to the funding, administration, or operation of an intelligence activity.</text></clause> 
<clause id="HB1741A7983564ED092B464E62492391"><enum>(iii)</enum><text>An action, including a personnel action described in <external-xref legal-doc="usc" parsable-cite="usc/5/2302">section 2302(a)(2)(A)</external-xref> of title 5, United States Code, constituting reprisal or threat of reprisal prohibited under subsection (f)(3)(B) of this section in response to an employee’s reporting an urgent concern in accordance with this paragraph.</text></clause></subparagraph> 
<subparagraph id="H4AF1D4B393F4462F8FF4D3855FC68488" indent="up1"><enum>(H)</enum><text>In support of this paragraph, Congress makes the findings set forth in paragraphs (1) through (6) of section 701(b) of the Intelligence Community Whistleblower Protection Act of 1998 (title VII of <external-xref legal-doc="public-law" parsable-cite="pl/105/272">Public Law 105–272</external-xref>; 5 U.S.C. App. 8H note).</text></subparagraph></paragraph> 
<paragraph id="HF46C817BF12D4249B06EA661467B6572" indent="up1"><enum>(6)</enum><text>In accordance with <external-xref legal-doc="usc" parsable-cite="usc/28/535">section 535</external-xref> of title 28, United States Code, the Inspector General shall report to the Attorney General any information, allegation, or complaint received by the Inspector General relating to violations of Federal criminal law that involves a program or operation of an element of the intelligence community, or in the relationships between the elements of the intelligence community, consistent with such guidelines as may be issued by the Attorney General pursuant to subsection (b)(2) of such section. A copy of each such report shall be furnished to the Director.</text></paragraph></subsection> 
<subsection id="H8461C932D3E64DD59BBB16DBF87CD84B"><enum>(j)</enum><header>Separate budget account</header><text>The Director of National Intelligence shall, in accordance with procedures to be issued by the Director in consultation with the congressional intelligence committees, include in the National Intelligence Program budget a separate account for the Office of Inspector General of the Intelligence Community.</text></subsection> 
<subsection id="H514C9AA5B0B543AE9EFCA01C0644F1CF"><enum>(k)</enum><header>Construction of duties regarding elements of intelligence community</header><text>Except as resolved pursuant to subsection (g), the performance by the Inspector General of the Intelligence Community of any duty, responsibility, or function regarding an element of the intelligence community shall not be construed to modify or effect the duties and responsibilities of any other Inspector General, whether statutory or administrative, having duties and responsibilities relating to such element.</text></subsection></section> <after-quoted-block>.</after-quoted-block></quoted-block></paragraph>

<paragraph id="H6A10E32922084DBFAC32C46DAEB0DF75"><enum>(7)</enum><text>a description of such element’s efforts to recruit, hire, train, and retain personnel that are proficient in a foreign language;</text></paragraph> 
<paragraph id="H8083FCBE924145F78F97801667CFBA5"><enum>(8)</enum><text>an assessment of methods and models for basic, advanced, and intensive foreign language training;</text></paragraph> 
<paragraph id="H298303B01378469500711399C7C4405E"><enum>(9)</enum><text>for each foreign language and, where appropriate, dialect of a foreign language—</text> 
<subparagraph id="HD58DDAB7372A4F4AA72B53DA490017B0"><enum>(A)</enum><text>the number of positions of such element that require proficiency in the foreign language or dialect;</text></subparagraph> 
<subparagraph id="H29433E1FC8C747A1A91CD3D50400F413"><enum>(B)</enum><text>the number of personnel of such element that are serving in a position that requires proficiency in the foreign language or dialect to perform the primary duty of the position;</text></subparagraph>

<subparagraph id="H6625F81CB58D43D4AB3640AD607DFE2C"><enum>(F)</enum><text>the number of personnel serving or hired to serve as linguists for such element that are not qualified as linguists under the standards of the Interagency Language Roundtable;</text></subparagraph> 
<subparagraph id="H310CDD430E984D469B7C78B5013FCC79"><enum>(G)</enum><text>the number of personnel hired to serve as linguists for such element during the preceding calendar year;</text></subparagraph> 
<subparagraph id="HA92DD190F41C408580D1556B655D90CE"><enum>(H)</enum><text>the number of personnel serving as linguists that discontinued serving such element during the preceding calendar year;</text></subparagraph> 
<subparagraph id="H278F7335625E48DBB56CCBBC94A1472F"><enum>(I)</enum><text>the percentage of work requiring linguistic skills that is fulfilled by an ally of the United States; and</text></subparagraph> 
<subparagraph id="HEE5EF7144DE74029A0047DF170448EE6"><enum>(J)</enum><text>the percentage of work requiring linguistic skills that is fulfilled by contractors;</text></subparagraph></paragraph> 
<paragraph id="H11530E3EE8B54751B0F4FEDFD400AE76"><enum>(10)</enum><text>an assessment of the foreign language capacity and capabilities of the intelligence community as a whole; </text></paragraph> 
<paragraph id="H71B71DDE5FDE45CC81B5ABA3FDC824B3"><enum>(11)</enum><text display-inline="yes-display-inline">recommendations for eliminating required reports relating to foreign-language proficiency that the Director of National Intelligence considers outdated or no longer relevant; and</text></paragraph> 
<paragraph id="HDEEB4141A3464A67B6B61331A3885F26"><enum>(12)</enum><text>an assessment of the feasibility of employing foreign nationals lawfully present in the United States who have previously worked as translators or interpreters for the Armed Forces or another department or agency of the Federal Government in Iraq or Afghanistan to meet the critical language needs of such element.</text></paragraph></section> <after-quoted-block>.</after-quoted-block></quoted-block></paragraph>

<subsection id="H1214EF9C188D4B27B9548C1D5293668B"><enum>(b)</enum><header>Form</header><text>The National Intelligence Estimate required under subsection (a) may be submitted in classified form.</text></subsection></section> 
<section id="H2A39F467D03D4906842FC1EEA10015D7" display-inline="no-display-inline" section-type="subsequent-section"><enum>412.</enum><header>Report on intelligence resources dedicated to Iraq and Afghanistan</header><text display-inline="no-display-inline">Not later than 120 days after the date of the enactment of this Act, the Director of National Intelligence shall submit to the congressional intelligence committees a report on intelligence collection and analysis resources dedicated to Iraq and Afghanistan during fiscal years 2007 and 2008. Such report shall include detailed information on fiscal, human, technical, and other intelligence collection and analysis resources.</text></section> 
<section id="HA4167580E9934416849100C0CBCC51FE"><enum>413.</enum><header>Ombudsman for intelligence community security clearances</header> 
<subsection id="HE724A513342248BA97CBD1005FA5D820"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title I of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/402">50 U.S.C. 402 et seq.</external-xref>) is amended by inserting after section 103H, as added by section 409 of this Act, the following new section:</text>

<subsection id="HD6AB2908640C4C479236A853DF14103B"><enum>(b)</enum><header>Provision of information</header><text>The head of an element of the intelligence community shall provide a person applying for a security clearance through or in coordination with such element with contact information for the ombudsman appointed under subsection (a).</text></subsection> 
<subsection id="H7AD974D32FB64AEAAFD041A13EE1D00"><enum>(c)</enum><header>Report</header><text>Not later than November 1 of each year, the ombudsman appointed under subsection (a) shall submit to the congressional intelligence committees a report containing—</text> 
<paragraph id="H43EDB3B3119A4FA7A1519BE298E65318"><enum>(1)</enum><text>the number of persons applying for a security clearance who have contacted the ombudsman during the preceding 12 months; and</text></paragraph> 
<paragraph id="H8268047613954DEEA7662C5308B712C8"><enum>(2)</enum><text>a summary of the concerns, complaints, and questions received by the ombudsman from persons applying for security clearances.</text></paragraph></subsection></section> <after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HD2D769EE148141CEA200C102E02C75AC"><enum>(b)</enum><header>Appointment date</header><text>The Director of National Intelligence shall appoint an ombudsman for intelligence community security clearances under section 103I(a) of the National Security Act of 1947, as added by subsection (a), not later than 60 days after the date of the enactment of this Act.</text></subsection>

<subsection id="H9B3D110939D24B6DB7D89D2159861DC9"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 60 days after the date of the enactment of this Act, the Inspector General of the Intelligence Community shall submit to the congressional intelligence committees a report containing the results of the audit conducted under subsection (a). Such report shall include an assessment of the time required to obtain a reciprocal security clearance for—</text> 
<paragraph id="H4258CAD5E5C147928CD62E4DE0D45E03"><enum>(1)</enum><text>an employee of an element of the intelligence community detailed to another element of the intelligence community;</text></paragraph> 
<paragraph id="H11CB520C59734EFDA13564003127E727"><enum>(2)</enum><text>an employee of an element of the intelligence community seeking permanent employment with another element of the intelligence community; and</text></paragraph> 
<paragraph id="H3812AB2BE106471F852DC068001BD200"><enum>(3)</enum><text>a contractor seeking permanent employment with an element of the intelligence community.</text></paragraph></subsection></section> 
<section id="HED1D6A2779324030BFFB192529199F62"><enum>415.</enum><header>Report on international traffic in arms regulations</header> 
<subsection id="HE1A8047046894F049E2390C0FFED4F4"><enum>(a)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than February 1, 2009, the Director of National Intelligence shall submit to the congressional intelligence committees a report assessing—</text> 
<paragraph id="HDBD14B28A63345B58629E7C91403CE2F"><enum>(1)</enum><text>the threat to national security presented by the efforts of foreign countries to acquire, through espionage, diversion, or other means, sensitive equipment and technology, and the degree to which United States export controls (including the International Traffic in Arms Regulations) are adequate to defeat such efforts; and</text></paragraph> 
<paragraph id="H8AFE48A600F84773862611A0010FA72"><enum>(2)</enum><text>the extent to which United States export controls are well matched to the scope of the foreign threat such controls are designed to defeat and whether other means could more successfully defeat such threats.</text></paragraph></subsection> 
<subsection id="H403B8A1CD8DF466D94A967516F3BE2B0"><enum>(b)</enum><header>Form</header><text>The report under subsection (a) shall be submitted in unclassified form, but may include a classified annex.</text></subsection> 
<subsection id="H87687A35C02544698E86EC93D9590219"><enum>(c)</enum><header>International Traffic in Arms Regulations defined</header><text display-inline="yes-display-inline">The term <term>International Traffic in Arms Regulations</term> means those regulations contained in parts 120 through 130 of title 22, Code of Federal Regulations (or successor regulations).</text></subsection></section> 
<section id="HCB251C1B1FAB40C1873D1E17B900BF4D"><enum>416.</enum><header>Report on nuclear trafficking</header> 
<subsection id="H4BF19CA08C944F73B525F981A9CE6772" display-inline="no-display-inline"><enum>(a)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than February 1, 2009, the Director of National Intelligence shall submit to the congressional intelligence committees, the Committee on Armed Services and the Committee on Foreign Affairs of the House of Representatives, and the Committee on Armed Services and the Committee on Foreign Relations of the Senate a report on the illicit trade of nuclear and radiological material and equipment.</text></subsection> 
<subsection id="HE474A168B20C4E76A8E53CA7BC3D1F01"><enum>(b)</enum><header>Contents</header><text display-inline="yes-display-inline">The report submitted under subsection (a) shall include, for a period of time including at least the preceding three years—</text> 
<paragraph id="H3F6B54000E6F426DBF41DF4BE259ED00"><enum>(1)</enum><text display-inline="yes-display-inline">details of all known or suspected cases of the illicit sale, transfer, brokering, or transport of nuclear or radiological material or equipment useful for the production of nuclear or radiological material or nuclear explosive devices;</text></paragraph> 
<paragraph id="HC724776A2F4E4750B61559FB47B30034"><enum>(2)</enum><text display-inline="yes-display-inline">an assessment of the countries that represent the greatest risk of nuclear trafficking activities; and</text></paragraph> 
<paragraph id="H23313DE1D08944239821F55045D0A400"><enum>(3)</enum><text display-inline="yes-display-inline">a discussion of any dissents, caveats, gaps in knowledge, or other information that would reduce confidence in the assessment referred to in paragraph (2).</text></paragraph></subsection> 
<subsection id="HE983B1DE56514D5B8EB9BD1D83FFC2B5"><enum>(c)</enum><header>Form</header><text>The report under subsection (a) may be submitted in classified form, but shall include an unclassified summary.</text></subsection></section> 
<section id="H95782943EA9949EEBE3E43A2172EC7B" display-inline="no-display-inline" section-type="subsequent-section"><enum>417.</enum><header>Study on revoking pensions of persons who commit unauthorized disclosures of classified information</header> 
<subsection id="H933AD118BC734376A093DAF3000256FD"><enum>(a)</enum><header>Study</header><text>The Director of National Intelligence shall conduct a study on the feasibility of revoking the pensions of personnel in the intelligence community who commit unauthorized disclosures of classified information, including whether revoking such pensions is feasible under existing law or under the administrative authority of the Director of National Intelligence or any other head of an element of the intelligence community.</text></subsection> 
<subsection id="HD2909754F983449A8FFFC2C3BBA3BC17"><enum>(b)</enum><header>Report</header><text>Not later than 90 days after the date of the enactment of this Act, the Director of National Intelligence shall submit to the congressional intelligence committees a report containing the results of the study conducted under subsection (a).</text></subsection></section> 
<section id="HD0771E8A6563427190DC3318F02E91C" display-inline="no-display-inline" section-type="subsequent-section"><enum>418.</enum><header>Memorandum to holders of National Intelligence Estimate on Iran</header><text display-inline="no-display-inline">Not later than 90 days after the date of the enactment of this Act, the Director of National Intelligence shall issue a memorandum to holders of the National Intelligence Estimate entitled <quote>Iran: Nuclear Intentions and Capabilities</quote> regarding any intelligence on the nuclear program of Iran that has been gathered or emerged since the publication of such National Intelligence Estimate in October 2007.</text></section> 
<section id="H7FF0140CC84247AFAAFFFFC997FCDF1C"><enum>419.</enum><header>National Intelligence Estimate on production and sale of narcotics in support of international terrorism</header><text display-inline="no-display-inline">Not later than 1 year after the date of the enactment of this Act, the Director of National Intelligence shall submit to Congress a National Intelligence Estimate on the production and sale of narcotics in support of international terrorism, including the support the Taliban and al Qaeda receive from the sale of narcotics (particularly heroin) and the shift in production from opium to hashish in Afghanistan.</text></section></subtitle> 
<subtitle id="H390823ED5E4A48B5859216FA8514213C"><enum>B</enum><header>Central Intelligence Agency</header> 
<section id="HF557DB5845A64121A1588D4B97720017"><enum>421.</enum><header>Review of covert action programs by Inspector General of the Central Intelligence Agency</header> 
<subsection id="H80BF7EBE9FA44DDA8E6845518123B56C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 503 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/413b">50 U.S.C. 413b</external-xref>) is amended by—</text> 
<paragraph id="HCA3B505DD1F041D58F8360787E6D6922"><enum>(1)</enum><text>redesignating subsection (e) as subsection (g) and transferring such subsection to the end; and</text></paragraph> 
<paragraph id="H521096D06E194A32A26F6157B9573506"><enum>(2)</enum><text>by inserting after subsection (d) the following new subsection:</text>

<subsection id="H79866FDC6A7540B9A7AEEF18CB465BA4"><enum>(e)</enum><header>Inspector general audits of covert actions</header> 
<paragraph id="H27EDB6A5A302497A93751B92E9EA97A8"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), the Inspector General of the Central Intelligence Agency shall conduct an audit of each covert action at least every 3 years. Such audits shall be conducted subject to the provisions of paragraphs (3) and (4) of subsection (b) of section 17 of the Central Intelligence Agency Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/50/403q">50 U.S.C. 403q</external-xref>).</text></paragraph> 
<paragraph commented="no" id="H51484575FF2C423DAA0000005E0449CB"><enum>(2)</enum><header>Terminated, suspended programs</header><text>The Inspector General of the Central Intelligence Agency is not required to conduct an audit under paragraph (1) of a covert action that has been terminated or suspended if such covert action was terminated or suspended prior to the last audit of such covert action conducted by the Inspector General and has not been restarted after the date on which such audit was completed.</text></paragraph> 
<paragraph id="H061D6A455F1748F791176CDD630029E9"><enum>(3)</enum><header>Report</header><text>Not later than 60 days after the completion of an audit conducted pursuant to paragraph (1), the Inspector General of the Central Intelligence Agency shall submit to the congressional intelligence committees a report containing the results of such audit.</text></paragraph></subsection> <after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H125686FCBAAF4BE2ADB560ED9EBB4EA5"><enum>(b)</enum><header>Conforming amendments</header><text>Title V of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/413">50 U.S.C. 413 et seq.</external-xref>) is amended—</text>

<section id="H1EDAF46C4C5540CBBCB0A94D9593E162" display-inline="no-display-inline" section-type="subsequent-section"><enum>425.</enum><header>Prohibition on the use of private contractors for interrogations involving persons in the custody or control of the Central Intelligence Agency</header> 
<subsection id="HFAF59945DB2D48858FE8AB6FA2B576EC"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the Director of the Central Intelligence Agency shall not expend or obligate funds for payment to any contractor to conduct the interrogation of a detainee or prisoner in custody or under the effective control of the Central Intelligence Agency.</text></subsection> 
<subsection id="HE3D41C5F12144B0D89AFD500DE40A1C8"><enum>(b)</enum><header>Exception</header> 
<paragraph id="H402D88DB46F947F8919CA9BC796EC600"><enum>(1)</enum><header>In general</header><text>The Director of the Central Intelligence Agency may request, and the Director of National Intelligence may grant, a written waiver of the requirement under subsection (a) if the Director of the Central Intelligence Agency determines that—</text> 
<subparagraph id="H91A13550E7F94436803BA88B835824A5"><enum>(A)</enum><text>no employee of the Federal Government is—</text> 
<clause id="HB7432C8FDCD6456DAEE4ADFD7F92F108"><enum>(i)</enum><text>capable of performing such interrogation; and</text></clause> 
<clause id="H08C9CC2731BB44ADB809D9046F39C0B8"><enum>(ii)</enum><text>available to perform such interrogation; and</text></clause></subparagraph> 
<subparagraph id="HD04638E10B07499E9F16FCC8C6E9EF66"><enum>(B)</enum><text>such interrogation is in the national interest of the United States and requires the use of a contractor.</text></subparagraph></paragraph> 
<paragraph id="HF04C0D60EA2A46D3BEDDC5E2E722885F" display-inline="no-display-inline"><enum>(2)</enum><header>Clarification of applicability of certain laws</header><text display-inline="yes-display-inline">Any contractor conducting an interrogation pursuant to a waiver under paragraph (1) shall be subject to all laws on the conduct of interrogations that would apply if an employee of the Federal Government were conducting the interrogation.</text></paragraph> </subsection></section> 
<section id="HE2BAB2EA172F42A5BA8B992C151E84DC" display-inline="no-display-inline" section-type="subsequent-section"><enum>426.</enum><header>Report on activities of the Central Intelligence Agency in Argentina</header> 
<subsection id="H3541110862C041FB927FE3CDFF6714A3"><enum>(a)</enum><header>In general</header><text>Not later than 270 days after the date of the enactment of this Act, the Director of the Central Intelligence Agency shall submit to the appropriate congressional committees a report containing the following:</text> 
<paragraph id="H88D7DAA0D60A4B21A5DDD9F67E9B00CD"><enum>(1)</enum><text>A description of any information in the possession of the intelligence community with respect to the following events in the Republic of Argentina:</text> 
<subparagraph id="H0FAF8D23BAE149F58B009D3EC275643B"><enum>(A)</enum><text>The accession to power by the Military of the Republic of Argentina in 1976.</text></subparagraph> 
<subparagraph id="HC65EA95EB9FF4A0AA5005BCF6300FC9C"><enum>(B)</enum><text>Violations of human rights committed by officers or agents of the Argentine military and security forces.</text></subparagraph> 
<subparagraph id="H3B9FDE25906742140034D55D1D009C15"><enum>(C)</enum><text>Operation Condor and the fate of Argentine people targeted, abducted, or killed during such Operation, including Argentine children born in captivity whose status remains unknown.</text></subparagraph></paragraph> 
<paragraph id="HED8E2E0A512F4D3EA695AA909416E1A9"><enum>(2)</enum><text>All information that may lead to the discovery of the Argentine children born in captivity whose status remains unknown.</text></paragraph> 
<paragraph id="HADE7A3694E2648C094B5E03B68EC17AC"><enum>(3)</enum><text>A compilation of information referred to in paragraphs (1) and (2) that has been declassified.</text></paragraph></subsection> 
<subsection id="H8C2544FABC5F4B0C9200CB79D1AF6336"><enum>(b)</enum><header>Update of compilation</header><text>Not later than 1 year after the date on which the report required under subsection (a) is submitted, and annually thereafter for three years, the Director of the Central Intelligence Agency shall submit to the appropriate congressional committees an update of the compilation referred to in subsection (a)(3).</text></subsection>

<subsection id="H4AD08D9296D64F59AA80EEF171E33B2E"><enum>(d)</enum><header>Definition</header><text>In this section, the term <quote>appropriate congressional committees</quote> means the Permanent Select Committee on Intelligence and the Committee on Appropriations of the House of Representatives and the Select Committee on Intelligence and the Committee on Appropriations of the Senate.</text></subsection></section></subtitle> 
<subtitle id="H999D694F6ABA496BA5B201006BF3416"><enum>C</enum><header>Defense Intelligence Components</header> 
<section id="HF0C4B4A66389429D99A35ED0F5D8DF1"><enum>431.</enum><header>Integration of the Counterintelligence Field Activity into the Defense Intelligence Agency</header> 
<subsection id="H490D89A9E50A4B558868DF28A0FF22B9"><enum>(a)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than November 1, 2008, the Under Secretary of Defense for Intelligence shall submit to the congressional intelligence and armed services committees a report outlining the process by which the Counterintelligence Field Activity is to be integrated into the Defense Intelligence Agency. Such report shall include—</text> 
<paragraph id="H8A8F0CC551244A29AD002631C2BC5C25"><enum>(1)</enum><text display-inline="yes-display-inline">a description of the nature of any law enforcement authorities to be delegated to the Defense Intelligence Agency;</text></paragraph> 
<paragraph id="HB67E24843CDE4A3AB8D79FA7FD93D28"><enum>(2)</enum><text display-inline="yes-display-inline">the authority under which the delegation of authority referred to in paragraph (1) would occur; and</text></paragraph> 
<paragraph id="HCE46577E938C4BF4947F41F34BD3371"><enum>(3)</enum><text display-inline="yes-display-inline">the guidelines for the implementation of such law enforcement authorities.</text></paragraph></subsection> 
<subsection id="HFD3EFB72E251415A000198EECB75CE50"><enum>(b)</enum><header>Congressional intelligence and armed services committees</header><text>In this section, the term <quote>congressional intelligence and armed services committees</quote> means—</text> 
<paragraph id="H0BBE0460665B46E6A0A4CBD715E863FC"><enum>(1)</enum><text>the Permanent Select Committee on Intelligence of the House of Representatives;</text></paragraph> 
<paragraph id="HCA4B05CDE98F4E2FB036822466E2E00"><enum>(2)</enum><text>the Select Committee on Intelligence of the Senate; and</text></paragraph> 
<paragraph id="H43A7602F993F449EAF007ED6F4EF5E03"><enum>(3)</enum><text>the Committees on Armed Services of the House of Representatives and the Senate.</text></paragraph></subsection></section></subtitle> 
<subtitle id="H81C6879C22B449A78E566C68E2657C8D"><enum>D</enum><header>Other Elements</header> 
<section id="H53072368192D4F83804515E4AC868371" commented="no"><enum>441.</enum><header>Clarification of inclusion of Coast Guard and Drug Enforcement Administration as elements of the intelligence community</header><text display-inline="no-display-inline">Section 3(4) of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/401a">50 U.S.C. 401a(4)</external-xref>) is amended—</text>

<section id="HA1088DEAA92F45088363BA8649146EB8" display-inline="no-display-inline" section-type="subsequent-section"><enum>442.</enum><header>Report on transformation of the intelligence capabilities of the Federal Bureau of Investigation</header><text display-inline="no-display-inline">Not later than 120 days after the date of the enactment of this Act, the Director of the Federal Bureau of Investigation shall submit to the congressional intelligence committees a report describing the Director’s long term vision for transforming the intelligence capabilities of the Bureau and the progress of the internal reforms of the Bureau intended to achieve that vision. Such report shall include—</text> 
<paragraph id="H4CBB348B8F544777B954427273965367"><enum>(1)</enum><text>the direction, strategy, and goals for transforming the intelligence capabilities of the Bureau;</text></paragraph> 
<paragraph id="H95F0EAF5F60B46319D581E3194DD7352"><enum>(2)</enum><text>a description of what the fully functional intelligence and national security functions of the Bureau should entail;</text></paragraph> 
<paragraph id="H44DB4A84EE854449916EE47264533179"><enum>(3)</enum><text>a candid assessment of the effect of internal reforms at the Bureau and whether such reforms have moved the Bureau towards achieving the goals of the Director for the intelligence and national security functions of the Bureau; and</text></paragraph> 
<paragraph id="H5ACC6CF8116748F2AADEE2EA46C30000"><enum>(4)</enum><text>an assessment of how well the Bureau performs tasks that are critical to the effective functioning of the Bureau as an intelligence agency, including—</text> 
<subparagraph id="HCD0282FB088047C5A51966E53D2E3868"><enum>(A)</enum><text display-inline="yes-display-inline">identifying new intelligence targets within the scope of the national security functions of the Bureau, outside the parameters of an existing case file or ongoing investigation; </text></subparagraph> 
<subparagraph id="H1E3E0A3EDBD145959603ABCB00597908"><enum>(B)</enum><text>collecting intelligence domestically, including collection through human and technical sources; </text></subparagraph> 
<subparagraph id="H803CBB73856C4108A55702AE9136174"><enum>(C)</enum><text>recruiting human sources; </text></subparagraph> 
<subparagraph id="H954EA7AB122641C382F9F00C6BECB4"><enum>(D)</enum><text>training Special Agents to spot, assess, recruit, and handle human sources; </text></subparagraph> 
<subparagraph id="H3AE08C9AC7B44C329E968957545FD9F8"><enum>(E)</enum><text>working collaboratively with other Federal departments and agencies to jointly collect intelligence on domestic counterterrorism and counterintelligence targets; </text></subparagraph> 
<subparagraph id="H4EE3CC01D1DE487E98B7748DC9A56F01"><enum>(F)</enum><text>producing a common intelligence picture of domestic threats to the national security of the United States; </text></subparagraph> 
<subparagraph id="HA6FC725E20BC470FB76600CCE9EA0050"><enum>(G)</enum><text>producing high quality and timely intelligence analysis; </text></subparagraph> 
<subparagraph id="HA9A9E2EC39044DE384BA84BF5DFF81A8"><enum>(H)</enum><text>integrating intelligence analysts into its intelligence collection operations; and </text></subparagraph> 
<subparagraph id="H8B2E8A0DB31C4D249EB5036859599284"><enum>(I)</enum><text>sharing intelligence information with intelligence community partners.</text></subparagraph></paragraph></section></subtitle></title>

<section id="HE3102073F169489DA0289498C878C3D2"><enum>502.</enum><header>Amendments to the National Security Act of 1947</header> 
<subsection id="HF2CFAC4624C4453CAB2F4CC8F1FAFD75"><enum>(a)</enum><header>General congressional oversight</header><text display-inline="yes-display-inline">Section 501(a) of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/413">50 U.S.C. 413(a)</external-xref>) is amended by adding at the end the following new paragraph:</text>

<subparagraph id="HA448EBB5968240A8853FAF7824D1FBB0"><enum>(A)</enum><text display-inline="yes-display-inline">the legal authority under which the intelligence activity is being or was conducted;</text></subparagraph> 
<subparagraph id="HE3F893A775C14A1DACACC6F4690D15F"><enum>(B)</enum><text>any legal issues upon which guidance was sought in carrying out or planning the intelligence activity, including dissenting legal views;</text></subparagraph> 
<subparagraph id="HBEDDEEA1FFFE49C4BFBEBB885289CCE"><enum>(C)</enum><text>any specific operational concerns arising from the intelligence activity, including the risk of disclosing intelligence sources or methods; </text></subparagraph> 
<subparagraph id="HF4955AB0A2D4418998A503DE29AC5231"><enum>(D)</enum><text>the likelihood that the intelligence activity will exceed the planned or authorized expenditure of funds or other resources; and</text></subparagraph> 
<subparagraph id="H03D96CB226294753AED489994743FE39"><enum>(E)</enum><text> the likelihood that the intelligence activity will fail.</text></subparagraph></paragraph> <after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H9A772C8759E94A69B9F1118FCD30F600"><enum>(b)</enum><header>Reporting on activities other than covert actions</header><text>Section 502 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/50/413a">50 U.S.C. 413a</external-xref>) is amended by adding at the end the following new subsection:</text>

<paragraph id="H04DD0209B4894A4D8BDB0076173E055B" display-inline="no-display-inline"><enum>(1)</enum><header>Request</header><text>Information or material provided in accordance with subsection (a) shall be made available to each member of the congressional intelligence committees, unless the President requests that access to the information or material be limited after determining that limiting such access is essential to meet extraordinary circumstances affecting vital interests of the United States. A request under this paragraph and the extraordinary circumstances referred to in this paragraph shall be detailed in writing to the Chair and ranking minority member of the congressional intelligence committees. </text></paragraph> 
<paragraph id="HD3DAE6F274874952A009605DF5A175A4" display-inline="no-display-inline"><enum>(2)</enum><header>Distribution</header><text display-inline="yes-display-inline">If the President submits a request under paragraph (1), the Chair and ranking minority member of each congressional intelligence committee may jointly determine whether and how to limit access to the information or material within such committee. If the Chair and ranking minority member of such committee are unable to agree on whether or how to limit such access, access to the information or material will be limited. Any information or material to which access is limited shall subsequently be made available to each member of the congressional intelligence communities at the earliest possible time and shall include a detailed statement of the reasons for not providing prior access.</text></paragraph></subsection> <after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HF04469A67EA245C68D1BD8DDF9C457D2"><enum>(c)</enum><header>Approval of covert actions</header><text>Section 503(d) of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/413b">50 U.S.C. 413b(d)</external-xref>) is amended—</text>

<subparagraph id="H4366C757D7AB4FEBA1D5A9D75B86DCE"><enum>(E)</enum><text>gives rise to a significant risk of disclosing intelligence sources or methods; or</text></subparagraph> 
<subparagraph id="H12C8039ADF2943DCB45FE7F4CEC5FE3C" commented="no"><enum>(F)</enum><text>could cause serious damage to the diplomatic relations of the United States if such activity were disclosed without authorization.</text></subparagraph></paragraph> <after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section>

<subsection id="H4FB8CEB0F5904C60A96E5662DD0408FC"><enum>(a)</enum><header>Annual reports</header><text display-inline="yes-display-inline">Section 118 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/404m">50 U.S.C. 404m</external-xref>) is amended—</text>

<section id="H44C7AC0D278848088705DDA900682023" display-inline="no-display-inline" section-type="subsequent-section"><enum>505.</enum><header>Sense of Congress regarding use of intelligence resources</header><text display-inline="no-display-inline">It is the sense of Congress that the resources authorized under this Act should not be diverted from human intelligence collection and other intelligence programs designed to combat al Qaeda in order to study global climate change.</text></section> 
<section id="HBF58C1C2901047C4ABC40029CD1B0200"><enum>506.</enum><header>Sense of Congress regarding Colombian paramilitary organizations</header><text display-inline="no-display-inline">It is the sense of Congress that—</text> 
<paragraph id="H7C53509CEAF946A8839B1D4994B09EAC"><enum>(1)</enum><text>the permanent defeat of the Revolutionary Armed Forces of Columbia (FARC), United Self-Defense Forces of Colombia (AUC), National Liberation Army (ELN), and other Colombian paramilitary organizations is in the national interest of the United States;</text></paragraph> 
<paragraph id="HDE7A85FA2E4D4AA49915506E881EDD45"><enum>(2)</enum><text display-inline="yes-display-inline">the Colombian operation that liberated Americans Keith Stansell, Marc Gonsalves, and Thomas Howes and Ingrid Betancourt and 11 other Colombian hostages from the FARC on July 2, 2008, demonstrated the professionalism of Colombian security forces and intelligence operatives;</text></paragraph> 
<paragraph id="H6EBB5AD3063D402ABD798DC23E7145AB"><enum>(3)</enum><text display-inline="yes-display-inline">intelligence and other cooperation by the United States has played a key role in developing and reinforcing the capabilities of the Government of Colombia to address terrorist and narcoterrorist threats;</text></paragraph> 
<paragraph id="H44105170A8974ED5BF95D1E3F54707D7"><enum>(4)</enum><text display-inline="yes-display-inline">intelligence and other cooperation by the United States has significantly contributed to the continued success of the Government of Colombia in impacting the capabilities of terrorist and narcoterrorist groups that have threatened the national security of Colombia and the United States; and</text></paragraph> 
<paragraph id="H1CA2FCD5FABF464FAA548DFB249F2D8B"><enum>(5)</enum><text display-inline="yes-display-inline">it is critical that such assistance continue in order to support the Government of Colombia in its efforts to continue to capitalize on those successes.</text></paragraph></section> 
<section id="HF246CC1DA204446BB5D7740401BE81DC" display-inline="no-display-inline" section-type="subsequent-section"><enum>507.</enum><header>Jihadists</header><text display-inline="no-display-inline">None of the funds authorized to be appropriated by this Act may be used to prohibit or discourage the use of the words or phrases <quote>jihadist</quote>, <quote>jihad</quote>, <quote>Islamo-fascism</quote>, <quote>caliphate</quote>, <quote>Islamist</quote>, or <quote>Islamic terrorist</quote> by or within the intelligence community or the Federal Government. </text></section></subtitle> 
<subtitle id="HA518DFD906DA46BA99EB33091FD57DF3"><enum>B</enum><header>Technical amendments</header>
