		<official-title>To make permanent the increases made by the Economic
		  Stimulus Act of 2008 in the loan limits for the Federal National Mortgage
		  Association, the Federal Home Loan Mortgage Corporation, and the
		  FHA.</official-title>

		<section id="H79CA9F90853C45E2B07BD4AD14FFCF75" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Homeowner Opportunity Act of
			 2008</short-title></quote>.</text>
		</section><section id="HB70DD597ABC1442188E02B882B2560" section-type="subsequent-section"><enum>2.</enum><header>Permanent conforming
			 loan limit increase for high-cost areas for Fannie Mae and Freddie Mac</header>
			<subsection id="HB124992238434000A2FFC5E49187B0CF"><enum>(a)</enum><header>Fannie
			 Mae</header><text>Section 302(b)(2) of the Federal National Mortgage
			 Association Charter Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1717">12 U.S.C. 1717(b)(2)</external-xref>) is amended—</text>
				<paragraph display-inline="no-display-inline" id="HAEACD14A812947D18DC8E6DA67752369"><enum>(1)</enum><text>in the second
			 sentence, by redesignating clause (A) through (C) as clauses (i) through (iii),
			 respectively;</text>
				</paragraph><paragraph id="HEC69FF37211343FAA01D3D9C67A4EF94"><enum>(2)</enum><text>in the third
			 sentence, by striking <quote>clause (A)</quote> and inserting <quote>clause
			 (i)</quote>;</text>
				</paragraph><paragraph id="H9B522FAE54404C18BBDFD564D5BDB4EE"><enum>(3)</enum><text>by inserting
			 <quote>(A)</quote> after <quote>(2)</quote>; and</text>
				</paragraph><paragraph id="HD3912F02F34440E4942D7959DEC63BBF"><enum>(4)</enum><text display-inline="yes-display-inline">by adding at the end the following new
			 subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="H2A2B05C3922B488891F6E57BD1F49E14" style="OLC">
						<subparagraph id="HBF7371ED61C142FCB4A9EBB9C05B8C11" indent="up2"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="H3CB0D495CC39487581D65485B4C5DB25"><enum>(i)</enum><text>Notwithstanding
				subparagraph (A), for mortgages originated on or after January 1, 2009, the
				limitation on the maximum original principal obligation of a mortgage that may
				be purchased by the corporation shall be the higher of—</text>
								<subclause id="HAA7A66A796B542E1BFD38DD616B8008E" indent="up1"><enum>(I)</enum><text>the limitation determined under
				subparagraph (A) for a residence of the applicable size; or</text>
								</subclause><subclause id="H9EB830BDEB51474CBB399223184F9242" indent="up1"><enum>(II)</enum><text>125 percent of the area median price
				for a residence of the applicable size, but in no case to exceed 175 percent of
				the limitation determined under subparagraph (A) for a residence of the
				applicable size.</text>
								</subclause></clause><clause id="H59AB828C5D3F4D7B92DF03123B97BBE" indent="up1"><enum>(ii)</enum><text>The areas and area median prices
				used for purposes of the determination under this subparagraph shall be the
				areas and area median prices used by the Secretary of Housing and Urban
				Development in determining the applicable limits under section 203(b)(2) of the
				National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1709">12 U.S.C. 1709(b)(2)</external-xref>). A mortgage that is eligible for
				purchase by the corporation at the time the mortgage is originated under this
				subparagraph shall be eligible for such purchase for the duration of the term
				of the
				mortgage.</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HD34DF1D4C513409FAE6F437B9907E21B"><enum>(b)</enum><header>Freddie
			 Mac</header><text>Section 305(a)(2) of the Federal Home Loan Mortgage
			 Corporation Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1454">12 U.S.C. 1454(a)(2)</external-xref>) is amended—</text>
				<paragraph display-inline="no-display-inline" id="H3A939666C8EB4E4AA32C18C56C93B6F7"><enum>(1)</enum><text>in the first
			 sentence, by redesignating clause (A) through (C) as clauses (i) through (iii),
			 respectively;</text>
				</paragraph><paragraph id="H827EDF1E22E8490AADDAF99F07CCC041"><enum>(2)</enum><text>in the second
			 sentence, by striking <quote>clause (A)</quote> and inserting <quote>clause
			 (i)</quote>;</text>
				</paragraph><paragraph id="H82467B10DE6A4270AA8721B2510000B5"><enum>(3)</enum><text>by inserting
			 <quote>(A)</quote> after <quote>(2)</quote>; and</text>
				</paragraph><paragraph id="HD38DB66385224C738FCDB2EDCBE1A241"><enum>(4)</enum><text display-inline="yes-display-inline">by adding at the end the following new
			 subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="H49C46CA4EA384958B0597DB6DF534124" style="OLC">
						<subparagraph id="H5FA7879A64914C6A99264FC0735760CD" indent="up2"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="H7BDF084BFBE04E1186EE98F64ADCD9"><enum>(i)</enum><text>Notwithstanding
				subparagraph (A), for mortgages originated on or after January 1, 2009, the
				limitation on the maximum original principal obligation of a mortgage that may
				be purchased by the Corporation shall be the higher of—</text>
								<subclause id="HBD7B8CF678B94E8FBFAB424947ED34ED" indent="up1"><enum>(I)</enum><text>the limitation determined under
				subparagraph (A) for a residence of the applicable size; or</text>
								</subclause><subclause id="HB2CF7A1AC2B04A708092F3867F8018E1" indent="up1"><enum>(II)</enum><text>125 percent of the area median price
				for a residence of the applicable size, but in no case to exceed 175 percent of
				the limitation determined under subparagraph (A) for a residence of the
				applicable size.</text>
								</subclause></clause><clause id="H93C917223B11447EA6C284417F555BA1" indent="up1"><enum>(ii)</enum><text>The areas and area median prices
				used for purposes of the determination under this subparagraph shall be the
				areas and area median prices used by the Secretary of Housing and Urban
				Development in determining the applicable limits under section 203(b)(2) of the
				National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1709">12 U.S.C. 1709(b)(2)</external-xref>). A mortgage that is eligible for
				purchase by the Corporation at the time the mortgage is originated under this
				subparagraph shall be eligible for such purchase for the duration of the term
				of the
				mortgage.</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H62578006C0C5467B9D21807BA878B34"><enum>(c)</enum><header>Sense of
			 congress</header><text display-inline="yes-display-inline">It is the sense of
			 the Congress that the securitization of mortgages by the Federal National
			 Mortgage Association and the Federal Home Loan Mortgage Corporation plays an
			 important role in providing liquidity to the United States housing markets.
			 Therefore, the Congress encourages the Federal National Mortgage Association
			 and the Federal Home Loan Mortgage Corporation to securitize mortgages acquired
			 under the increased conforming loan limits established by the amendments made
			 by this section, to the extent that such securitizations can be effected in a
			 timely and efficient manner that does not impose additional costs for mortgages
			 originated, purchased, or securitized under the existing limits or interfere
			 with the goal of adding liquidity to the market.</text>
			</subsection></section><section id="HD4555A8541F243E7BE4244DE244D19E9"><enum>3.</enum><header>Permanent loan
			 limit increase for high-cost areas for FHA</header>
			<subsection id="H7BC377071C604BA78F79F523CB33D83"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 203(b)(2) of
			 the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1709">12 U.S.C. 1709(b)(2)</external-xref>) is amended by striking
			 subparagraph (A) and inserting the following new subparagraph:</text>
				<quoted-block display-inline="no-display-inline" id="H6D6B91A04E574EFCA9166EC804E91B76" style="OLC">
					<subparagraph id="H2985321077EF49D0A93F44E57B13A5EF"><enum>(A)</enum><text display-inline="yes-display-inline">that does not exceed the lesser of—</text>
						<clause id="H8B2FD656BCFC41E58649B55514349285"><enum>(i)</enum><text display-inline="yes-display-inline">in the case of a 1-family residence, 125
				percent of the median 1-family house price in the area, as determined by the
				Secretary; and in the case of a 2-,<linebreak></linebreak> 3-, or 4-family residence, the
				percentage of such median price that bears the same ratio to such median price
				as the dollar amount limitation determined under section 305(a)(2) of the
				Federal Home Loan Mortgage Corporation Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1454">12 U.S.C. 1454(a)(2)</external-xref>) for a 2-, 3-,
				or 4-family residence, respectively, bears to the dollar amount limitation
				determined under such section for a 1-family residence; or</text>
						</clause><clause id="H5C1090A233F44C9491C82255E8544300"><enum>(ii)</enum><text>175 percent of
				the dollar amount limitation determined under such section 305(a)(2)(A) for a
				residence of the applicable size (without regard to any authority to increase
				such limitation with respect to properties located in Alaska, Guam, Hawaii, or
				the Virgin Islands and without regard to the high-cost area limitation under
				such section 305(a)(2)(B)); except that the dollar amount limitation in effect
				under this subsection for any size residence for any area shall not be less
				than the greater of—</text>
							<subclause id="H357A3F40BF73482D8282E09125002976"><enum>(I)</enum><text>the dollar amount
				limitation in effect under this paragraph for the area on October 21, 1998;
				or</text>
							</subclause><subclause id="H683BED69BCE4479699F8B7B3A59F32A1"><enum>(II)</enum><text>65 percent of the
				dollar amount limitation determined under such section 305(a)(2)(A) for a
				residence of the applicable size;
				and</text>
							</subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H23ABA45B69084C589C0035A44F2FE326"><enum>(b)</enum><header>Publication of
			 area median prices and loan limits</header><text display-inline="yes-display-inline">Section 203(b) of the National Housing Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/12/1709">12 U.S.C. 1709(b)(2)(A)</external-xref>) is amended by adding after and below paragraph (9)
			 the following:</text>
				<quoted-block display-inline="no-display-inline" id="H5DECB8D42BEE41A0BEF0A7D94818221B" style="OLC">
					<quoted-block-continuation-text quoted-block-continuation-text-level="section">The
				Secretary of Housing and Urban Development shall publish the median house
				prices and mortgage principal obligation limits for all areas each year, not
				less than 45 days before the time of determining the annual adjustments to the
				dollar amount limitations under section 305(a)(2)(A) of the Federal Home Loan
				Mortgage Corporation Act (12 U.S.C.
				1454(a)(2)(A))</quoted-block-continuation-text><after-quoted-block>.</after-quoted-block></quoted-block>
