		  address certain discharges incidental to the normal operation of a recreational

		<section id="HF1C387FB13A8478D85A03CEC6EDEFA7F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Clean Boating Act of 2008
			 </short-title></quote>.</text>
		</section><section id="HBA21D2E79BC64DA0AA2C01E26FBA7B16"><enum>2.</enum><header>Discharges
			 incidental to the normal operation of recreational vessels</header><text display-inline="no-display-inline">Section 402 of the Federal Water Pollution
			 Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1342">33 U.S.C. 1342</external-xref>) is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="HE9A00438924E493C0023B44350F5893" style="OLC">
				<subsection id="H5C79130F3E97437D986BDE37C586DD44"><enum>(r)</enum><header>Discharges
				incidental to the normal operation of recreational vessels</header><text>No
				permit shall be required under this Act by the Administrator (or a State, in
				the case of a permit program approved under subsection (b)) for the discharge
				of any graywater, bilge water, cooling water, weather deck runoff, oil water
				separator effluent, or effluent from properly functioning marine engines, or
				any other discharge that is incidental to the normal operation of a vessel, if
				the discharge is from a recreational
				vessel.</text>
				</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HE64E39FD4A00483DB0F42E9A92191DA"><enum>3.</enum><header>Definition</header><text display-inline="no-display-inline">Section 502 of the Federal Water Pollution
			 Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1362">33 U.S.C. 1362</external-xref>) is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="HFE64990195354075A1A424435B2DB1B0" style="OLC">
				<paragraph id="H4AE06E060E324DEAB2BDD528BF896CB3"><enum>(25)</enum><header>Recreational
				vessel</header>
					<subparagraph id="H31DC158C4C0C4D249BAC83733C00D4D1"><enum>(A)</enum><header>In
				general</header><text>The term <term>recreational vessel</term> means any
				vessel that is—</text>
						<clause id="H5BF504FAF6A64356A234EBEE8D98368D"><enum>(i)</enum><text>manufactured or
				used primarily for pleasure; or</text>
						</clause><clause id="H0ED5FB74C74147F08131F983CB41AE71"><enum>(ii)</enum><text>leased, rented,
				or chartered to a person for the pleasure of that person.</text>
						</clause></subparagraph><subparagraph id="H474791D8DB544BDEA14DD8C7BED345C"><enum>(B)</enum><header>Exclusion</header><text>The
				term <term>recreational vessel</term> does not include a vessel that is subject
				to Coast Guard inspection and that—</text>
						<clause id="HAC504C8CD07F4D6B8C112893DB4B26EF"><enum>(i)</enum><text>is
				engaged in commercial use; or</text>
						</clause><clause id="H6621920D5404498E94BB2700DFBB001E"><enum>(ii)</enum><text>carries paying
				passengers.</text>
						</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H75C00B19536441099B64265B3E79D6EF"><enum>4.</enum><header>Management
			 practices for recreational vessels</header><text display-inline="no-display-inline">Section 312 of the Federal Water Pollution
			 Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1322">33 U.S.C. 1322</external-xref>) is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="H3CE92EC243DE43C4852F10C163E5300" style="OLC">
				<subsection id="H21DBFEA35B9F412A83CF4D75C93CFF6F"><enum>(o)</enum><header>Management
				practices for recreational vessels</header>
					<paragraph id="H07DE7749E61C40FFA9C7BD609CA40030"><enum>(1)</enum><header>Applicability</header><text>This
				subsection applies to any discharge, other than a discharge of sewage, from a
				recreational vessel that is—</text>
						<subparagraph id="H3E6F0EEA8BB148FCA845180654C71E7F"><enum>(A)</enum><text>incidental to the
				normal operation of the vessel; and</text>
						</subparagraph><subparagraph id="HD3E6A77273264C5280571B7D9DA08DF0"><enum>(B)</enum><text>exempt from
				permitting requirements under section 402(r).</text>
						</subparagraph></paragraph><paragraph id="H341E3A1C369549DCBE50ECEC10536D33"><enum>(2)</enum><header>Determination of
				discharges subject to management practices</header>
						<subparagraph id="H2AF5304D08434AAFBDF119E7E4B019AD"><enum>(A)</enum><header>Determination</header>
							<clause id="H1C2FDAE1FCE24DE9A19B14A107D39BBC"><enum>(i)</enum><header>In
				general</header><text>The Administrator, in consultation with the Secretary of
				the department in which the Coast Guard is operating, the Secretary of
				Commerce, and interested States, shall determine the discharges incidental to
				the normal operation of a recreational vessel for which it is reasonable and
				practicable to develop management practices to mitigate adverse impacts on the
				waters of the United States.</text>
							</clause><clause id="H4BD73CCFBEE048089CAE83F3F78AE96"><enum>(ii)</enum><header>Promulgation</header><text>The
				Administrator shall promulgate the determinations under clause (i) in
				accordance with <external-xref legal-doc="usc" parsable-cite="usc/5/553">section 553</external-xref> of title 5, United States Code.</text>
							</clause><clause id="H1E65BBEA2DAD469D99D66E24C952C954"><enum>(iii)</enum><header>Management
				practices</header><text>The Administrator shall develop management practices
				for recreational vessels in any case in which the Administrator determines that
				the use of those practices is reasonable and practicable.</text>
							</clause></subparagraph><subparagraph id="H0F82EF23E9D84FC8B8FC1926BE97EC4"><enum>(B)</enum><header>Considerations</header><text>In
				making a determination under subparagraph (A), the Administrator shall
				consider—</text>
							<clause id="H54BDA33D9C894D01BFBE2E007404B39B"><enum>(i)</enum><text>the nature of the
				discharge;</text>
							</clause><clause id="HD0D83462A51D4C77947812B5E8797822"><enum>(ii)</enum><text>the environmental
				effects of the discharge;</text>
							</clause><clause id="HD8CAB5162320459283066500832E89D2"><enum>(iii)</enum><text>the
				practicability of using a management practice;</text>
							</clause><clause id="HE34030FEEA574169A71E00AED6C6832C"><enum>(iv)</enum><text>the effect that
				the use of a management practice would have on the operation, operational
				capability, or safety of the vessel;</text>
							</clause><clause id="H868F798BFE4A40E5983171F2E43B5FA8"><enum>(v)</enum><text>applicable Federal
				and State law;</text>
							</clause><clause id="H5B2EE243ACA648DA87D7D017B585709"><enum>(vi)</enum><text>applicable
				international standards; and</text>
							</clause><clause id="H7F8CF2C1C4F641EB005019FC00539239"><enum>(vii)</enum><text>the economic
				costs of the use of the management practice.</text>
							</clause></subparagraph><subparagraph id="HB8631094B9064DCD8CA4A829CEAA6CD"><enum>(C)</enum><header>Timing</header><text>The
				Administrator shall—</text>
							<clause id="HB4114400BE25443C9BBAE7893CD4DD41"><enum>(i)</enum><text>make the initial
				determinations under subparagraph (A) not later than 1 year after the date of
				enactment of this subsection; and</text>
							</clause><clause id="HFD2470045C934D77931138CAB67D6F00"><enum>(ii)</enum><text>every 5 years
				thereafter—</text>
								<subclause id="H03454F66BAA7448099DF66694D7DE135"><enum>(I)</enum><text>review the
				determinations; and</text>
								</subclause><subclause id="H94E12BD2C8FD4CD3A21B67FBD2D635E"><enum>(II)</enum><text>if necessary,
				revise the determinations based on any new information available to the
				Administrator.</text>
								</subclause></clause></subparagraph></paragraph><paragraph id="H2730FD73550D4663B5B4A466F3C85002"><enum>(3)</enum><header>Performance
				standards for management practices</header>
						<subparagraph id="H638BB737F8A440CD892B1C9C101F768F"><enum>(A)</enum><header>In
				general</header><text>For each discharge for which a management practice is
				developed under paragraph (2), the Administrator, in consultation with the
				Secretary of the department in which the Coast Guard is operating, the
				Secretary of Commerce, other interested Federal agencies, and interested
				States, shall promulgate, in accordance with <external-xref legal-doc="usc" parsable-cite="usc/5/553">section 553</external-xref> of title 5, United
				States Code, Federal standards of performance for each management practice
				required with respect to the discharge.</text>
						</subparagraph><subparagraph id="H0768A533BA184964BE5E287C600307BA"><enum>(B)</enum><header>Considerations</header><text>In
				promulgating standards under this paragraph, the Administrator shall take into
				account the considerations described in paragraph (2)(B).</text>
						</subparagraph><subparagraph id="H852BB34655EE49DBABD63DC06D9DFF51"><enum>(C)</enum><header>Classes, types,
				and sizes of vessels</header><text>The standards promulgated under this
				paragraph may—</text>
							<clause id="H785F0F3929EF47329520F7E4B4DEFAC0"><enum>(i)</enum><text>distinguish among
				classes, types, and sizes of vessels;</text>
							</clause><clause id="H54D2FA7AE63F473CA821B91BD790B206"><enum>(ii)</enum><text>distinguish
				between new and existing vessels; and</text>
							</clause><clause id="HB5ECF3CE6F4E4292AD8C44397E0067A3"><enum>(iii)</enum><text>provide for a
				waiver of the applicability of the standards as necessary or appropriate to a
				particular class, type, age, or size of vessel.</text>
							</clause></subparagraph><subparagraph id="H3D82A09BACB346A4BCB65946C5FDA2FE"><enum>(D)</enum><header>Timing</header><text>The
				Administrator shall—</text>
							<clause id="H22FC97D1997341068322D393E382FA31"><enum>(i)</enum><text>promulgate
				standards of performance for a management practice under subparagraph (A) not
				later than 1 year after the date of a determination under paragraph (2) that
				the management practice is reasonable and practicable; and</text>
							</clause><clause id="HD675AA5F274A4F98AB53F86E1DF056BD"><enum>(ii)</enum><text>every 5 years
				thereafter—</text>
								<subclause id="HDD1A6EAE533F4780AF77E0FC983D1573"><enum>(I)</enum><text>review the
				standards; and</text>
								</subclause><subclause id="H5874E73DDE3D46018CD836E9A8A7B509"><enum>(II)</enum><text>if necessary,
				revise the standards, in accordance with subparagraph (B) and based on any new
				information available to the Administrator.</text>
								</subclause></clause></subparagraph></paragraph><paragraph id="H144914ED3F6F4816A8ED343E6BA39971"><enum>(4)</enum><header>Regulations for
				the use of management practices</header>
						<subparagraph id="H25D817F6412E424C89159182E18E5784"><enum>(A)</enum><header>In
				general</header><text>The Secretary of the department in which the Coast Guard
				is operating shall promulgate such regulations governing the design,
				construction, installation, and use of management practices for recreational
				vessels as are necessary to meet the standards of performance promulgated under
				paragraph (3).</text>
						</subparagraph><subparagraph id="HE22AFF9B055D4AD0B2EADA4B8237C717"><enum>(B)</enum><header>Regulations</header>
							<clause id="H53D8BD9EF298443B93D5179E10BAAAA7"><enum>(i)</enum><header>In
				general</header><text>The Secretary shall promulgate the regulations under this
				paragraph as soon as practicable after the Administrator promulgates standards
				with respect to the practice under paragraph (3), but not later than 1 year
				after the date on which the Administrator promulgates the standards.</text>
							</clause><clause id="HFBA9870C28C84F27897CB8C0961214FC"><enum>(ii)</enum><header>Effective
				date</header><text>The regulations promulgated by the Secretary under this
				paragraph shall be effective upon promulgation unless another effective date is
				specified in the regulations.</text>
							</clause><clause id="HAC6A2B1F4BCE4198AB4D912B54429C7E"><enum>(iii)</enum><header>Consideration
				of time</header><text>In determining the effective date of a regulation
				promulgated under this paragraph, the Secretary shall consider the period of
				time necessary to communicate the existence of the regulation to persons
				affected by the regulation.</text>
							</clause></subparagraph></paragraph><paragraph id="HF0785BF81FC34530A518F89EFA9028A1"><enum>(5)</enum><header>Effect of other
				laws</header><text>This subsection shall not affect the application of section
				311 to discharges incidental to the normal operation of a recreational
				vessel.</text>
					</paragraph><paragraph id="H2D501730EC454F13A43502D7E62F116"><enum>(6)</enum><header>Prohibition
				relating to recreational vessels</header><text>After the effective date of the
				regulations promulgated by the Secretary of the department in which the Coast
				Guard is operating under paragraph (4), the owner or operator of a recreational
				vessel shall neither operate in nor discharge any discharge incidental to the
				normal operation of the vessel into, the waters of the United States or the
				waters of the contiguous zone, if the owner or operator of the vessel is not
				using any applicable management practice meeting standards established under
				this
				subsection.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
