			 <quote><short-title>Returning Soldiers’ Bill of Rights
			 Act</short-title></quote> .</text>
		</section><title id="H12DE68C3218B49399D3EABC581BFBD39"><enum>I</enum><header>Education</header>
			<section id="H4A8C6582A7CE437B9D463682796E07BD"><enum>101.</enum><header>Educational
			 assistance for members of the Armed Forces who serve in support of a
			 contingency operation after September 11, 2001</header>
				<subsection id="H450F7148ACC64D718D82FCB67472D883"><enum>(a)</enum><header>Educational
			 assistance authorized</header>
					<paragraph id="HB651FBA2FB5E41F1A5818DB3A86CC7A6"><enum>(1)</enum><header>In
			 general</header><text>Part III of title 38, United States Code, is amended by
			 inserting after chapter 32 the following new chapter:</text>

								<subchapter id="HB5AD1DDD4A2C4CD1B4C2A52B8E940031"><enum>I</enum><header>Definitions</header>
									<section id="H0694231814D14C10B729E307151177A0"><enum>3301.</enum><header>Definitions</header><text display-inline="no-display-inline">In this chapter:</text>
										<paragraph id="H43C05A59704B4033BE7FF3F3B4289267"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>active duty</term> has the
				meanings as follows (subject to the limitations specified in sections 3002(6)
				and 3311(b) of this title):</text>
											<subparagraph id="HA7B54D10B12742668472E531FA49F64F"><enum>(A)</enum><text>In the case of
				members of the regular components of the Armed Forces, the meaning given such
				term in section 101(21)(A) of this title.</text>
											</subparagraph><subparagraph id="H695195A598F04A7C8DBDADBFC515E475"><enum>(B)</enum><text>In the case of
				members of the reserve components of the Armed Forces, service on active duty
				under a call or order to active duty under section 688, 12301(a), 12301(d),
				12301(g), 12302, or 12304 of title 10.</text>
											</subparagraph></paragraph><paragraph id="H4C56876E5AA64AE7A238F1C0F3C1613"><enum>(2)</enum><text>The term
				<term>contingency operation</term> has the meaning given such term under
				<external-xref legal-doc="usc" parsable-cite="usc/10/101">section 101(a)(13)</external-xref> of title 10, United States Code.</text>
										</paragraph><paragraph id="HE645B79CCE564DDA919F888DF3A6B899"><enum>(3)</enum><text>The term
				<term>entry level and skill training</term> means the following:</text>
											<subparagraph id="H858BBAE5B89B42DDA8CD9E69565D8C8"><enum>(A)</enum><text>In the case of
				members of the Army, Basic Combat Training and Advanced Individual
				Training.</text>
											</subparagraph><subparagraph id="HC8C69008DADF46BDB1EEA066A95E441F"><enum>(B)</enum><text>In the case of
				members of the Navy, Recruit Training (or Boot Camp) and Skill Training (or
				so-called <quote>A</quote> School).</text>
											</subparagraph><subparagraph id="HAD07A098D2164E9289C2AC628F29ACB5"><enum>(C)</enum><text>In the case of
				members of the Air Force, Basic Military Training and Technical
				Training.</text>
											</subparagraph><subparagraph id="HF892A75F4EDC48918CE9A7B1419BFADD"><enum>(D)</enum><text>In the case of
				members of the Marine Corps, Recruit Training and Marine Corps Training (or
				School of Infantry Training).</text>
											</subparagraph><subparagraph id="HC2E6FEC2303743E500A340029595851B"><enum>(E)</enum><text>In the case of
				members of the Coast Guard, Basic Training.</text>
											</subparagraph></paragraph><paragraph id="H4B4759000F4A440EA1A5CED2FEBC0078"><enum>(4)</enum><text display-inline="yes-display-inline">The terms <term>program of education</term>
				and <term>Secretary of Defense</term> have the meaning given such terms in
				section 3002 of this title.</text>
										</paragraph></section></subchapter><subchapter id="HFB7D06EE4C2C46B6A3B70200A823EBFA"><enum>II</enum><header>Educational
				Assistance</header>
									<section id="H12AA4C883FD44911ACFDB30394E46400"><enum>3311.</enum><header>Educational
				assistance for service in the Armed Forces on or after September 11, 2001:
				entitlement</header>
										<subsection id="HCAD6756FC1E344738F0048C5DCCA7169"><enum>(a)</enum><header>Entitlement</header><text>Subject
				to subsections (d) and (e), each individual described in subsection (b) is
				entitled to educational assistance under this chapter.</text>
										</subsection><subsection id="H725F1A05B4304FDFA0B7B9A58B25B8DF"><enum>(b)</enum><header>Covered
				individuals</header><text>An individual described in this subsection is any
				individual (including an individual as a Reserve) who—</text>
											<paragraph id="HD98DE25B9736445AB373ED8BFB0700D5"><enum>(1)</enum><text>on or after
				September 11, 2001, serves an aggregate of at least 6 months on active duty in
				the Armed Forces in support of a contingency operation; and</text>
											</paragraph><paragraph id="HA8C910E7C4034B96AF44532E50972BA1"><enum>(2)</enum><text>after completion
				of service described in paragraph (1)—</text>
												<subparagraph id="H9377361CA5204782938076A0F410A0EB"><enum>(A)</enum><text>continues on
				active duty; or</text>
												</subparagraph><subparagraph id="H0CD4EAF9AEA54058A0C3AC53FDB16732"><enum>(B)</enum><text>is discharged or
				released from active duty as described in subsection (c).</text>
												</subparagraph></paragraph></subsection><subsection id="H6ACBBDC262CD40CAACCF924CB21B286C"><enum>(c)</enum><header>Covered
				discharges and releases</header><text>A discharge or release from active duty
				of an individual described in this subsection is a discharge or release as
				follows:</text>
											<paragraph id="HBDFB979C414347B79DBF10AFC17972F8"><enum>(1)</enum><text>A discharge from
				active duty in the Armed Forces with an honorable discharge.</text>
											</paragraph><paragraph id="H12AF4DAE1F604607A5BDCD059EAF055D"><enum>(2)</enum><text>A release after
				service on active duty in the Armed Forces characterized by the Secretary
				concerned as honorable service and placement on the retired list, transfer to
				the Fleet Reserve or Fleet Marine Corps Reserve, or placement on the temporary
				disability retired list.</text>
											</paragraph><paragraph id="H5E91C5D9E3C24B798FD75BE4616C4935"><enum>(3)</enum><text>A release from
				active duty in the Armed Forces for further service in a reserve component of
				the Armed Forces after service on active duty characterized by the Secretary
				concerned as honorable service.</text>
											</paragraph><paragraph id="HC2A39352FAF4486DBE77BEC99DAF244"><enum>(4)</enum><text>A discharge or
				release from active duty in the Armed Forces for—</text>
												<subparagraph id="H691D1334F2B4430BA246F8A8409FAE95"><enum>(A)</enum><text>a
				service-connected disability;</text>
												</subparagraph><subparagraph id="HB8B9AB2544D543D1AC6E3264D567419"><enum>(B)</enum><text>a medical condition
				which preexisted the service of the individual as described in the applicable
				paragraph of subsection (b) and which the Secretary determines is not
				service-connected;</text>
												</subparagraph><subparagraph id="H2710B4A98B1848CDAF59C871EB766B19"><enum>(C)</enum><text>hardship;
				or</text>
												</subparagraph><subparagraph id="HD9AB565F5B374CDFA081288C5FB4646B"><enum>(D)</enum><text>a physical or
				mental condition that was not characterized as a disability and did not result
				from the individual's own willful misconduct but did interfere with the
				individual's performance of duty, as determined by the Secretary concerned in
				accordance with regulations prescribed by the Secretary of Defense.</text>
												</subparagraph></paragraph></subsection><subsection id="H13FDC8D1657F4E1B8987F4432EDA50AD"><enum>(d)</enum><header>Contribution</header><paragraph commented="no" display-inline="yes-display-inline" id="H247F072C50F9487FA952068BC364BC4"><enum>(1)</enum><text>Except as provided in
				paragraph (2), the basic pay of any individual described in subsection (b) who
				elects to receive educational assistance under this chapter shall be reduced by
				$100 for each of the first 12 months that such individual is entitled to such
				pay.</text>
											</paragraph><paragraph id="HFFE7AA90DD114772A89DD19C838C0313" indent="up1"><enum>(2)</enum><text>In the case of an individual covered
				by paragraph (1) who is a member of the Selected Reserve, the Secretary of
				Defense shall collect from the individual an amount equal to $1,200 not later
				than one year after completion by the individual of the two years of service on
				active duty providing the basis for such entitlement. The Secretary of Defense
				may collect such amount through reductions in basic pay in accordance with
				paragraph (1) or through such other method as the Secretary of Defense
				considers appropriate.</text>
											</paragraph><paragraph id="HEC21A98684FE44AFA7B7A65B8E8D1299" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">Any amount by which the basic pay of an
				individual is reduced under this subsection shall revert to the Treasury and
				shall not, for purposes of any Federal law, be considered to have been received
				by or to be within the control of such individual.</text>
											</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H803B05E1F6464E5FBA3F054D27B3B40"><enum>3312.</enum><header>Educational
				assistance: duration</header>
										<subsection commented="no" display-inline="no-display-inline" id="H3858AC11FF4A4491BFC1E5E07DA06FA3"><enum>(a)</enum><header>In
				general</header><text>Subject to section 3695 of this title and except as
				provided in subsections (b) and (c), an individual entitled to educational
				assistance under this chapter is entitled to a number of months of educational
				assistance under section 3313 of this title equal to 36 months, which is the
				equivalent of four academic years.</text>
										</subsection><subsection id="H20265AF6B9D847569EC6D4E000343F59"><enum>(b)</enum><header>Continuing
				receipt</header><text>The receipt of educational assistance under section 3313
				of this title by an individual entitled to educational assistance under this
				chapter is subject to the provisions of section 3321(b)(2) of this
				title.</text>
										</subsection><subsection id="HC494F660DCCA40E8B4FDF570501E07A9"><enum>(c)</enum><header>Discontinuation
				of education for active duty</header><paragraph commented="no" display-inline="yes-display-inline" id="H47B24DD8EEAA4EE18D00DCA6EE13A66F"><enum>(1)</enum><text>Any payment of
				educational assistance described in paragraph (2) shall not—</text>
												<subparagraph id="H2FE060950F2A403B81791EF274EB5636" indent="up1"><enum>(A)</enum><text>be charged against any entitlement to
				educational assistance of the individual concerned under this chapter;
				or</text>
												</subparagraph><subparagraph id="H045624B71B5C45FC8D00EA13263EC856" indent="up1"><enum>(B)</enum><text>be counted against the aggregate
				period for which section 3695 of this title limits the individual's receipt of
				educational assistance under this chapter.</text>
												</subparagraph></paragraph><paragraph id="H36B4193140DE4DCAA1D1298DAE048D64" indent="up1"><enum>(2)</enum><text>Subject to paragraph (3), the payment
				of educational assistance described in this paragraph is the payment of such
				assistance to an individual for pursuit of a course or courses under this
				chapter if the Secretary finds that the individual—</text>
												<subparagraph id="HA73AAF92A9AE436F881927E92008E006"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="HF68312D1E66B4FB7B2A02F67F4A69E6D"><enum>(i)</enum><text>in the case of an
				individual not serving on active duty, had to discontinue such course pursuit
				as a result of being called or ordered to serve on active duty under section
				688, 12301(a), 12301(d), 12301(g), 12302, or 12304 of title 10; or</text>
													</clause><clause id="H89498829748549EF924783AB00C2292F" indent="up1"><enum>(ii)</enum><text>in the case of an individual serving
				on active duty, had to discontinue such course pursuit as a result of being
				ordered to a new duty location or assignment or to perform an increased amount
				of work; and</text>
													</clause></subparagraph><subparagraph id="H350724E96D0947CC992E101755D900BD"><enum>(B)</enum><text>failed to receive credit or lost
				training time toward completion of the individual's approved education,
				professional, or vocational objective as a result of having to discontinue, as
				described in subparagraph (A), the individual's course pursuit.</text>
												</subparagraph></paragraph><paragraph id="H571D784B54774D93AD178F491181B74D" indent="up1"><enum>(3)</enum><text>The period for which, by reason of
				this subsection, educational assistance is not charged against entitlement or
				counted toward the applicable aggregate period under section 3695 of this title
				shall not exceed the portion of the period of enrollment in the course or
				courses from which the individual failed to receive credit or with respect to
				which the individual lost training time, as determined under paragraph
				(2)(B).</text>
											</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H7D5BF956CFA747C0AC5F007B45FFDF14"><enum>3313.</enum><header>Educational
				assistance: amount; payment</header>
										<subsection commented="no" display-inline="no-display-inline" id="H3ECDB7D0E31D439B95FF656DEDB0E2D"><enum>(a)</enum><header>Payment</header><text>The
				Secretary shall pay to each individual entitled to educational assistance under
				this chapter who is pursuing an approved program of education (other than a
				program covered by subsections (e) through (i)) the amounts specified in
				subsection (c) to meet the expenses of such individual's subsistence, tuition,
				fees, and other educational costs for pursuit of such program of
				education.</text>
										</subsection><subsection commented="no" display-inline="no-display-inline" id="H4F19BE8D8D38404595737F29A7621300"><enum>(b)</enum><header>Approved
				programs of education</header><text>Except as provided in subsections (g)
				through (i), a program of education is an approved program of education for
				purposes of this chapter if the program of education is approved for purposes
				of chapter 30 of this title.</text>
										</subsection><subsection commented="no" display-inline="no-display-inline" id="HECCA5C688EA3413884A6460051552BE6"><enum>(c)</enum><header>Amount of
				educational assistance</header><text>The amounts payable under this subsection
				for pursuit of an approved program of education are amounts as follows:</text>
											<paragraph commented="no" display-inline="no-display-inline" id="HF54163D898234C73BAA83932B798C0A"><enum>(1)</enum><text>An amount equal to
				the established charges for in-State students for the program of education at
				the most expensive public postsecondary institution of any State.</text>
											</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3CDE75743B8B467C000028E535995E31"><enum>(2)</enum><text>A stipend in the
				amount of $1,000 for each month for room, board, books, supplies, equipment,
				and other educational materials.</text>
											</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HA3A3748613BB4470A84544E372116C44"><enum>(d)</enum><header>Frequency of
				payment</header><paragraph commented="no" display-inline="yes-display-inline" id="H8CD288F7CD894ED2A714E941A9A8871"><enum>(1)</enum><text>Except as provided in
				paragraph (2), payment of the amounts payable under subsections (c)(1) and
				(c)(2) shall be made on a monthly basis.</text>
											</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H02C3DD49AC394269A52834E9C1C7FDFF" indent="up1"><enum>(2)</enum><text>At the request of an individual
				entitled to educational assistance under this chapter, payment of the amounts
				payable under subsections (c)(1) and (c)(2) shall be made in a lump-sum amount
				for the entire quarter, semester, or term, as applicable, before the
				commencement of such quarter, semester, or term.</text>
											</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD14B0A76055A4190AC384E90F01D2C69" indent="up1"><enum>(3)</enum><text>The Secretary shall prescribe in
				regulations methods for determining the number of months (including fractions
				thereof) of entitlement of an individual to educational assistance this
				subsection that are chargeable under this subsection for an advance payment of
				amounts under paragraphs (1) and (2) on a quarter, semester, term, or other
				basis.</text>
											</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H17D9595D451B40E4AB8B8E52A7C746B7"><enum>(e)</enum><header>Programs of
				education pursued on active duty</header><paragraph commented="no" display-inline="yes-display-inline" id="HDE0072191BA644E8A0F8F530CDD65F9F"><enum>(1)</enum><text>Educational assistance
				is payable under this chapter for pursuit of an approved program of education
				while on active duty.</text>
											</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H49EAE5A18C0348F0823EA758D79433EB" indent="up1"><enum>(2)</enum><text>The amount of educational assistance
				payable under this chapter to an individual pursuing a program of education
				while on active duty is the lesser of—</text>
												<subparagraph commented="no" display-inline="no-display-inline" id="HBE4CA60E98E043889B00B3AA7CDE58C8"><enum>(A)</enum><text>the established charges which
				similarly circumstanced nonveterans enrolled in the program of education
				involved would be required to pay; or</text>
												</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3545F949626C4DE2939F1510587612A2"><enum>(B)</enum><text>the amount of the charges of the
				educational institution as elected by the individual in the manner specified in
				section 3014(b)(1) of this title.</text>
												</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE16E4F293213416D9779833EAE28534C" indent="up1"><enum>(3)</enum><text>For each month (as determined
				pursuant to the methods prescribed under subsection (d)(4)) for which amounts
				are paid an individual under this subsection, the entitlement of the individual
				to educational assistance under this chapter shall be charged at the rate of
				one month for each such month.</text>
											</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HD422DC6F07B54A05AF8C9C80398FE1B4"><enum>(f)</enum><header>Programs of
				education pursued on less than half-time basis</header><paragraph commented="no" display-inline="yes-display-inline" id="H4F3231FA47E94E20BCA074573985B6E5"><enum>(1)</enum><text>Educational assistance
				is payable under this chapter for pursuit of an approved program of education
				on less than half-time basis.</text>
											</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDF21E2567E954F81A04300BBA1317FD" indent="up1"><enum>(2)</enum><text>The educational assistance payable
				under this chapter to an individual pursuing a program of education on less
				than half-time basis is the amounts as follows:</text>
												<subparagraph commented="no" display-inline="no-display-inline" id="HC06037FD1ABA4626A008F82B75A33DCE"><enum>(A)</enum><text>The amount equal to the lesser
				of—</text>
													<clause commented="no" display-inline="no-display-inline" id="H76DDE406FD7448978EB29C7389A0098"><enum>(i)</enum><text>the established charges which
				similarly circumstanced nonveterans enrolled in the program of education
				involved would be required to pay; or</text>
													</clause><clause commented="no" display-inline="no-display-inline" id="HDA02A64B20534808B7A6FE61BF251E"><enum>(ii)</enum><text>the maximum amount that would be
				payable to the individual for the program of education under paragraph (1) of
				subsection (c), for the program of education if the individual were entitled to
				amounts for the program of education under subsection (c) rather than this
				subsection.</text>
													</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE94B8FD3BDAD4717B0ABCA5321000023"><enum>(B)</enum><text>A housing stipend in an amount equal
				to the amount of the appropriately reduced amount of monthly stipend for
				housing otherwise payable to the individual under subsection (c).</text>
												</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE9E073C5EDE8499D8209BE6CAEBD4668"><enum>(C)</enum><text>A stipend in an amount equal to the
				amount of the appropriately reduced amount of the yearly stipend for books,
				supplies, equipment, and other educational costs otherwise payable to the
				individual under subsection (c).</text>
												</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA1E286B11CFD41CFB03E862CB3CD5C95" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H5DFA437C8BBD4A8E93C1681052331799"><enum>(A)</enum><text>Except as provided in
				subparagraph (C), payments of the amounts payable to an individual under
				subparagraphs (A) and (B) of paragraph (2) shall be made on a monthly
				basis.</text>
												</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8A5B4D3E652144B18846BCE1EEAE606" indent="up1"><enum>(B)</enum><text>Payment of the amounts payable to an
				individual under subparagraph (C) of paragraph (2) for pursuit of a program of
				education on less than half-time basis shall be made in a lump-sum, and shall
				be made not later than the last day of the month immediately following the
				month in which certification is received from the educational institution
				involved that the individual has enrolled in and is pursuing a program of
				education at the institution.</text>
												</subparagraph><subparagraph id="HD73802A446C14065A45E0058FDF17614" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">At the request of an individual entitled to
				educational assistance under this chapter, payment of the amounts payable under
				subparagraph (A) of paragraph (2) for pursuit of a program of education on less
				than a half-time basis shall be made in a lump-sum amount for the entire
				quarter, semester, or term, as applicable, of the program of education before
				the commencement of such quarter, semester, or term.</text>
												</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA95BE9DB9260441CB23EEC363DCB11C3" indent="up1"><enum>(4)</enum><text>For each month (as determined
				pursuant to the methods prescribed under subsection (d)(4)) for which amounts
				are paid an individual under this subsection, the entitlement of the individual
				to educational assistance under this chapter shall be charged at a percentage
				of a month equal to—</text>
												<subparagraph commented="no" display-inline="no-display-inline" id="H06A21B14E2DE4FCF934DBDD311CA4C2F"><enum>(A)</enum><text>the number of course hours borne by
				the individual in pursuit of the program of education involved, divided
				by</text>
												</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H25191E0F7B35498EB9F5E5C20084203"><enum>(B)</enum><text>the number of course hours for
				full-time pursuit of such program of education.</text>
												</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HFE71E356F2624470BB84F82903A511ED"><enum>(g)</enum><header>Apprenticeship
				or other on-job training</header><paragraph commented="no" display-inline="yes-display-inline" id="HC1A313CE3B6A4A74811E542E9FE00099"><enum>(1)</enum><text>Educational assistance
				is payable under this chapter for full-time pursuit of a program of
				apprenticeship or other on-job training described in paragraphs (1) and (2) of
				section 3687(a) of this title.</text>
											</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE769C5F74E814B93009869FCDD863CE3" indent="up1"><enum>(2)</enum><text>The educational assistance payable
				under this chapter to an individual for pursuit of a program of apprenticeship
				or training referred to in paragraph (1) is the amounts as follows:</text>
												<subparagraph commented="no" display-inline="no-display-inline" id="H91CD9C10A93C497BB4FA00536F4E9344"><enum>(A)</enum><text>The amount equal to the lesser
				of—</text>
													<clause commented="no" display-inline="no-display-inline" id="H066D6D88046747CE82D6C754007D76B8"><enum>(i)</enum><text>the established charge which
				similarly circumstances nonveterans enrolled in the program would be required
				to pay; or</text>
													</clause><clause commented="no" display-inline="no-display-inline" id="H8FC3C6DEA9264A38A7AB01247426F7D5"><enum>(ii)</enum><text>the maximum amount that would be
				payable to the individual for the program of education under paragraph (1) of
				subsection (c) for the program of education if the individual were entitled to
				amounts for the program of education under subsection (c) rather than this
				subsection.</text>
													</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE68EFD5E888F48D8BFA25090EF56B63B"><enum>(B)</enum><text>A housing stipend in an amount equal
				to the amount of the appropriately reduced amount of monthly stipend for
				housing otherwise payable to the individual under subsection (c).</text>
												</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE6772B2D95954A9C8675D096CA473335"><enum>(C)</enum><text>A stipend in an amount equal to the
				amount of the appropriately reduced amount of the yearly stipend for books,
				supplies, equipment, and other educational costs otherwise payable to the
				individual under subsection (c).</text>
												</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H678755149FAB4F1DA95C38A1AA81E3D0" indent="up1"><enum>(3)</enum><text>The nature and amount of the tuition,
				fees, and other expenses constituting the established charge for a program of
				apprenticeship or training under this subsection shall be determined in
				accordance with regulations prescribed by the Secretary.</text>
											</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5642506188D140D48744E24F6DBBBC7D" indent="up1"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H2A7ED275591D468B918C09AEF700D9B1"><enum>(A)</enum><text>Payment of the amounts
				payable under subparagraphs (A) and (C) of paragraph (2) for pursuit of a
				program of apprenticeship or training shall be made, at the election of the
				Secretary—</text>
													<clause commented="no" display-inline="no-display-inline" id="H7CB7C2739D724BDA00BD4C924C003F98" indent="up1"><enum>(i)</enum><text>in a lump sum for such period of the
				program as the Secretary shall determine before the commencement of such period
				of the program; or</text>
													</clause><clause commented="no" display-inline="no-display-inline" id="H46E8050BE5E74961BBED154B65F3EB5" indent="up1"><enum>(ii)</enum><text>on a monthly basis.</text>
													</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8D83138A6A974AC1B6AC3C95829783E5" indent="up1"><enum>(B)</enum><text>Payments of the amounts payable under
				subparagraph (B) of paragraph (2) shall be made on a monthly basis.</text>
												</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7C5AF626BFAE44A7B9B96E61F0E040DD" indent="up1"><enum>(5)</enum><text>For each month (as determined
				pursuant to the methods prescribed under subsection (d)(4)) for which amounts
				are paid an individual under this subsection, the entitlement of the individual
				to educational assistance under this chapter shall be charged at the rate of
				one month for each such month.</text>
											</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H2D81A4E00367473EB2286D57B6D732DF"><enum>(h)</enum><header>Programs of
				education by correspondence</header><paragraph commented="no" display-inline="yes-display-inline" id="HA3E5039D0C5C449AB5B801EDC74CB222"><enum>(1)</enum><text>Educational assistance
				is payable under this chapter for pursuit of a program of education exclusively
				by correspondence.</text>
											</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7F0964922C49400993BA81567F44C3A1" indent="up1"><enum>(2)</enum><text>The educational assistance payable
				under this chapter to an individual who is pursuing a program of education
				exclusively by correspondence is the amounts as follows:</text>
												<subparagraph commented="no" display-inline="no-display-inline" id="HB3B034BD62504072B5A305F3B7EB8219"><enum>(A)</enum><text>An amount equal to 55 percent of
				amount that would be payable to the individual for the program of education
				under paragraph (1) of subsection (c) for the program of education if the
				individual were entitled to amounts for the program of education under
				subsection (c) rather than this subsection.</text>
												</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC91CDFF0F51143DD8D54EE1233FDEF8D"><enum>(B)</enum><text>A stipend in an amount equal to the
				equivalent of 55 percent of the appropriately reduced amount of the yearly
				stipend for books, supplies, equipment, and other educational costs otherwise
				payable to the individual under subsection (c).</text>
												</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0610D59AF2CB42E3B49000423CEC51DE" indent="up1"><enum>(3)</enum><text>Payment of the amounts payable under
				paragraph (2) for pursuit of a program of education by correspondence shall be
				made quarterly on a pro rata basis for the lessons completed by the individual
				and serviced by the institution involved.</text>
											</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H82B4526010AC41AE84E5D86BAE00EF30" indent="up1"><enum>(4)</enum><text>For each month (as determined
				pursuant to the methods prescribed under subsection (d)(4)) for which amounts
				are paid an individual under this subsection, the entitlement of the individual
				to educational assistance under this chapter shall be charged at the rate of
				one month for each such month.</text>
											</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H048D8A25DB0646F7B6325B3FB44B5826"><enum>(i)</enum><header>Flight
				training</header><paragraph commented="no" display-inline="yes-display-inline" id="H8C676713AD1F4082007E9800B4097CC0"><enum>(1)</enum><text>Educational assistance
				is payable under this chapter for a program of education consisting of flight
				training as follows:</text>
												<subparagraph commented="no" display-inline="no-display-inline" id="H97997FF394764A6181A5367FCE7FD84F" indent="up1"><enum>(A)</enum><text>Courses of flight training approved
				under section 3860A(b) of this title.</text>
												</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7C5BE93CAEDA4FE086E14546005500E7" indent="up1"><enum>(B)</enum><text>Flight training meeting the
				requirements of section 3034(d) of this title.</text>
												</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H88C38D3DF5974D2BBA00D0F300AA9EBF" indent="up1"><enum>(2)</enum><text>Paragraphs (2) and (4) of section
				3032(e) of this title shall apply with respect to the availability of
				educational assistance under this chapter for pursuit of flight training
				covered by paragraph (1).</text>
											</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE9B517C150A946CEBF587EB31DBA1205" indent="up1"><enum>(3)</enum><text>The educational assistance payable
				under this chapter to an individual for pursuit of a program of education
				consisting of flight training covered by paragraph (1) is the amounts as
				follows:</text>
												<subparagraph commented="no" display-inline="no-display-inline" id="H18BB91521D2A43FAA34427031BB27295"><enum>(A)</enum><text>The amount equal to the lesser
				of—</text>
													<clause commented="no" display-inline="no-display-inline" id="HBB23FCC414594C1BBA90CC3BA8DF2C89"><enum>(i)</enum><text>the established charge which
				similarly circumstances nonveterans enrolled in the program would be required
				to pay; or</text>
													</clause><clause commented="no" display-inline="no-display-inline" id="HA736599FA8ED4A2CA184F103E55C3014"><enum>(ii)</enum><text>the maximum amount that would be
				payable to the individual for the program of education under paragraph (1) of
				subsection (c) for the program of education if the individual were entitled to
				amounts for the program of education under subsection (c) rather than this
				subsection.</text>
													</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD929114F9C9D491780E1D5B68F7435A"><enum>(B)</enum><text>A housing stipend in an amount equal
				to the amount of the appropriately reduced amount of monthly stipend for
				housing otherwise payable to the individual under subsection (c).</text>
												</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H15896602C759414AAB8B68DE71549CBE"><enum>(C)</enum><text>A monthly stipend in an amount equal
				to the monthly equivalent of the appropriately reduced amount of the yearly
				stipend for books, supplies, equipment, and other educational costs otherwise
				payable to the individual under subsection (c).</text>
												</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H77077C754BA14FAFB31EA21C039B00CC" indent="up1"><enum>(4)</enum><text>The nature and amount of the tuition,
				fees, and other expenses constituting the established charge for a program of
				flight training under this subsection shall be determined in accordance with
				regulations prescribed by the Secretary.</text>
											</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6A93DE3590314A5BA829AA67B436CC1C" indent="up1"><enum>(5)</enum><text>Payment of the amounts payable under
				paragraph (3) for pursuit of a program of flight training shall be made on a
				monthly basis.</text>
											</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAA624C9215484DD1B91F8535CC664BA0" indent="up1"><enum>(6)</enum><text>For each month for which amounts are
				paid an individual under this subsection, the entitlement of the individual to
				educational assistance under this chapter shall be charged at the rate of one
				month for each such month.</text>
											</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H8C48B17F26BC4ECBAA001217B8A61981"><enum>(j)</enum><header>Payment of
				certain amounts by voucher</header><text>Amounts payable under subsections
				(c)(1), (e)(2)(A), (f)(2)(A), (g)(2)(A), (h)(2)(A), and (i)(3)(A) shall be paid
				to the individual concerned in the form of a voucher, or other form of credit
				specified by the Secretary for purposes of this subsection, that is redeemable
				by the educational institution concerned in such manner as the Secretary shall
				prescribe.</text>
										</subsection><subsection commented="no" display-inline="no-display-inline" id="H581FBC18788D4224A95EE6896F9CE95E"><enum>(k)</enum><header>Established
				charges defined</header><paragraph commented="no" display-inline="yes-display-inline" id="HC42007338EC74CED96E6C9D23D68548"><enum>(1)</enum><text>In subsections (c), (e),
				and (f), the term <term>established charges</term>, in the case of a program of
				education, means the actual charges (as determined pursuant to regulations
				prescribed by the Secretary) for tuition and fees which similarly circumstanced
				nonveterans enrolled in the program of education would be required to
				pay.</text>
											</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H401F090438C843289EBBE487798F07F" indent="up1"><enum>(2)</enum><text>Established charges shall be
				determined for purposes of this subsection on the following basis:</text>
												<subparagraph commented="no" display-inline="no-display-inline" id="HC02BA923F1804952AC337437F605ED00"><enum>(A)</enum><text>In the case of an individual enrolled
				in a program of education offered on a term, quarter, or semester basis, the
				tuition and fees charged the individual for the term, quarter, or
				semester.</text>
												</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6A58378220AD4B1E812D0753D4B7E000"><enum>(B)</enum><text>In the case of an individual enrolled
				in a program of education not offered on a term, quarter, or semester basis,
				the tuition and fees charged the individual for the entire program of
				education.</text>
												</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="HF249751EC58444E0B48B82FB40B9F137"><enum>3314.</enum><header>Tutorial
				assistance</header>
										<subsection commented="no" display-inline="no-display-inline" id="H7AFD9AA97BCB4432A61100FADFD52538"><enum>(a)</enum><header>In
				general</header><text>Subject to subsection (b), an individual entitled to
				educational assistance under this chapter shall also be entitled to benefits
				provided an eligible veteran under section 3492 of this title.</text>
										</subsection><subsection commented="no" display-inline="no-display-inline" id="HEB6E7A71F79B4523916F155135F0A415"><enum>(b)</enum><header>Conditions</header><paragraph commented="no" display-inline="yes-display-inline" id="H945D4E0D185B45DD934CFA644069DCC5"><enum>(1)</enum><text>The provision of
				benefits under subsection (a) shall be subject to the conditions applicable to
				an eligible veteran under section 3492 of this title.</text>
											</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE09AB62353C9443DA61415A158830353" indent="up1"><enum>(2)</enum><text>In addition to the conditions
				specified in paragraph (1), benefits may not be provided to an individual under
				subsection (a) unless the professor or other individual teaching, leading, or
				giving the course for which such benefits are provided certifies that—</text>
												<subparagraph commented="no" display-inline="no-display-inline" id="H98BD4D57868C4D11BECE5300A3D0175E"><enum>(A)</enum><text>such benefits are essential to correct
				a deficiency of the individual in such course; and</text>
												</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H695305D68C5C474CA79D82F102786EC"><enum>(B)</enum><text>such course is required as a part of,
				or is prerequisite or indispensable to the satisfactory pursuit of, an approved
				program of education.</text>
												</subparagraph></paragraph></subsection><subsection id="H7F972072F7BC4D719100AC9556186BFF"><enum>(c)</enum><header>Amount</header><paragraph commented="no" display-inline="yes-display-inline" id="H40B7EAD1B338453FA7B524C20074CDDF"><enum>(1)</enum><text>The amount of benefits
				described in subsection (a) that are payable under this section may not exceed
				$100 per month, for a maximum of 12 months, or until a maximum of $1,200 is
				utilized.</text>
											</paragraph><paragraph id="H6DADFDAF013749BCA1D9FDC345C799C3" indent="up1"><enum>(2)</enum><text>The amount provided an individual
				under this subsection is in addition to the amounts of educational assistance
				paid the individual under section 3313 of this title.</text>
											</paragraph></subsection><subsection id="HBF719EB6E084426C8FDEB20037D9D9F6"><enum>(d)</enum><header>No charge
				against entitlement</header><text>Any benefits provided an individual under
				subsection (a) are in addition to any other educational assistance benefits
				provided the individual under this chapter.</text>
										</subsection></section><section id="HB662BFE89D98430C8921D5C310F12762"><enum>3315.</enum><header>Licensure and
				certification tests</header>
										<subsection id="H7B9184E0C42A4EBA84A688D0DBF71BF5"><enum>(a)</enum><header>In
				general</header><text>An individual entitled to educational assistance under
				this chapter shall also be entitled to payment for one licensing or
				certification test described in section 3452(b) of this title.</text>
										</subsection><subsection id="H0A245EC5330143DAB8E3073BA0E41BD5"><enum>(b)</enum><header>Limitation on
				amount</header><text>The amount payable under subsection (a) for a licensing or
				certification test may not exceed the lesser of—</text>
											<paragraph id="H7301F971BF2649BD8500A6E768A6DAD2"><enum>(1)</enum><text>$2,000; or</text>
											</paragraph><paragraph id="HECFAB4F43C2249D48BF55BC0007F00F8"><enum>(2)</enum><text>the fee charged
				for the test.</text>
											</paragraph></subsection><subsection id="H576E2AE0F3EC4DAFBF49E85C64CCE73"><enum>(c)</enum><header>No charge against
				entitlement</header><text>Any amount paid an individual under subsection (a) is
				in addition to any other educational assistance benefits provided the
				individual under this chapter.</text>
										</subsection></section><section id="H9664C02943994897B32DBBB5A59D8E63"><enum>3316.</enum><header>Supplemental
				educational assistance for additional service</header>
										<subsection id="HD5A535ADF2884B689F788EC31900CF23"><enum>(a)</enum><header>In
				general</header><text>Under such regulations as the Secretary of Defense shall
				prescribe, an individual entitled to educational assistance under this chapter
				shall be eligible for supplemental educational assistance for additional
				service as authorized by the provisions of subchapter III of chapter 30 of this
				title.</text>
										</subsection><subsection id="HB08317E5CB2848A18EE1D8E64D4620D2"><enum>(b)</enum><header>Administration</header><text>The
				qualification for entitlement, amount, and payment of supplemental educational
				assistance under this section shall be in accordance with the provisions of
				subchapter III of chapter 30 of this title, except that any reference in such
				provisions to eligibility for basic educational assistance under a provision of
				subchapter II of chapter 30 of this title shall be treated as a reference to
				eligibility for educational assistance under the appropriate provision of this
				chapter.</text>
										</subsection></section><section display-inline="no-display-inline" id="HEB007104FAAB4DE18D88DBF68435C35C" section-type="subsequent-section"><enum>3317.</enum><header>Transfer of
				entitlement to basic educational assistance</header>
										<subsection display-inline="no-display-inline" id="HDEDC89CFD2D24124A8D7E2C48B074DB2"><enum>(a)</enum><header>In
				general</header><text>Subject to the provisions of this section, an individual
				who is entitled to basic educational assistance under this subchapter to elect
				to transfer to one or more of the dependents specified in subsection (b) a
				portion of such individual's entitlement to such assistance.</text>
										</subsection><subsection id="H006642EFE35340E0835E1DE991F0CE39"><enum>(b)</enum><header>Eligible
				Dependents</header><text>An individual approved to transfer an entitlement to
				basic educational assistance under this section may transfer the individual’s
				entitlement as follows:</text>
											<paragraph id="HC3AD399F8F6B49C09DD48C3D41E7561"><enum>(1)</enum><text>To the individual’s
				spouse.</text>
											</paragraph><paragraph id="HA2D86C89060C46C38B89DEBE82EC537"><enum>(2)</enum><text>To one or more of
				the individual’s children.</text>
											</paragraph><paragraph id="HA32C038D0E2348CE9191FE76E1692E00"><enum>(3)</enum><text>To a combination
				of the individuals referred to in paragraphs (1) and (2).</text>
											</paragraph></subsection><subsection id="H4374E024BC864EC79161141EE175A6D0"><enum>(c)</enum><header>Designation of
				Transferee</header><text>An individual transferring an entitlement to basic
				educational assistance under this section shall—</text>
											<paragraph id="H638249854D9F46EC93B9271075E45785"><enum>(1)</enum><text>designate the
				dependent or dependents to whom such entitlement is being transferred;</text>
											</paragraph><paragraph id="H77483BF144FE42D98558DDE5D113A767"><enum>(2)</enum><text>designate the
				number of months of such entitlement to be transferred to each such dependent;
				and</text>
											</paragraph><paragraph id="H51394A867FE143CC8CCC6DEB8579B07F"><enum>(3)</enum><text>specify the period
				for which the transfer shall be effective for each dependent designated under
				paragraph (1).</text>
											</paragraph></subsection></section><section display-inline="no-display-inline" id="HEC6680B5F6B2474EA82B14A8C6E513EC" section-type="subsequent-section"><enum>3318.</enum><header>Use of educational
				assistance benefits for the repayment of Federal student loans for certain
				courses of education</header>
										<subsection id="HC60DCD8F606E44DDA97C03BF870024D2"><enum>(a)</enum><header>Use of
				benefits</header><text>Notwithstanding any other provision of this chapter, an
				individual who is entitled to educational assistance under this subchapter may
				apply amounts of such educational assistance otherwise available to the
				individual to repay some or all of any Federal student loan balance owed by the
				individual for a course of education.</text>
										</subsection><subsection id="H922DFD918A484D40878B932BE335DBFA"><enum>(b)</enum><header>Amount of
				payments</header><text>The Secretary shall make monthly payments under this
				section in such amounts as the individual may elect for the repayment of a
				Federal student loan of such an individual.</text>
										</subsection><subsection id="H122E15D5A8224E11AA4EEA90A18509C"><enum>(c)</enum><header>Arrangements To
				make payments</header><text>The Secretary shall enter into such arrangements,
				and shall prescribe such regulations, as may be necessary to carry out this
				section.</text>
										</subsection><subsection id="H46AB9846623B49539C58EF59C598CEA8"><enum>(d)</enum><header>Federal student
				loan defined</header><text>In this section, the term <term>Federal student
				loan</term> means any loan made under title IV of the Higher Education Act of
				1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070">20 U.S.C. 1070 et seq.</external-xref>).</text>
										</subsection></section></subchapter><subchapter id="HA007029A9DB34162AFCA5471F5C216E4"><enum>III</enum><header>Administrative
				Provisions</header>
									<section id="HF992965E70834BE3B56B6F86AD4E643E"><enum>3321.</enum><header>Time
				limitation for use of and eligibility for entitlement</header>
										<subsection id="H37165B9C53FA4A88A5697DFFE07BCC26"><enum>(a)</enum><header>In
				general</header><text>Except as provided in this section, the period during
				which an individual entitled to educational assistance under this chapter may
				use such individual's entitlement expires at the end of the 20-year period
				beginning on the date of such individual's last discharge or release from
				active duty.</text>
										</subsection><subsection id="HC366FE5F43CB4FB39C02CB2DBF29702D"><enum>(b)</enum><header>Exceptions</header><paragraph commented="no" display-inline="yes-display-inline" id="H128829E23B85434BA900859C00E5875F"><enum>(1)</enum><text>Subsections (b), (c),
				and (d) of section 3031 of this title shall apply with respect to the running
				of the 20-year period described in subsection (a) of this section in the same
				manner as such subsections apply under section 3031 of this title with respect
				to the running of the 10-year period described in section 3031(a) of this
				title.</text>
											</paragraph><paragraph id="H6FC9672CBA0B4F4282164C3728DAF79F" indent="up1"><enum>(2)</enum><text>Section 3031(f) of this title shall
				apply with respect to the termination of an individual's entitlement to
				educational assistance under this chapter in the same manner as such section
				applies to the termination of an individual's entitlement to educational
				assistance under chapter 30 of this title, except that, in the administration
				of such section for purposes of this chapter, the reference to section 3013 of
				this title shall be deemed to be a reference to 3312 of this title.</text>
											</paragraph><paragraph id="H402AADE30CF4473999DF5CB01C4D639B" indent="up1"><enum>(3)</enum><text>For purposes of subsection (a), an
				individual's last discharge or release from active duty shall not include any
				discharge or release from a period of active duty of less than 90 days of
				continuous service, unless the individual is discharged or released as
				described in section 3011(c)(4).</text>
											</paragraph></subsection></section><section id="H044CA2337BE842C39CCCD0A34776DF2C"><enum>3322.</enum><header>Bar to
				duplication of educational assistance benefits</header>
										<subsection id="H0BE81C8521034AC3AC1B37B970008B00"><enum>(a)</enum><header>In
				general</header><text>An individual entitled to educational assistance under
				this chapter who is also eligible for educational assistance under chapter 30,
				31, 32, or 35 of this title, chapter 107, 1606, or 1607 of title 10, or the
				provisions of the Hostage Relief Act of 1980 (<external-xref legal-doc="public-law" parsable-cite="pl/96/449">Public Law 96–449</external-xref>; 5 U.S.C. 5561
				note) may not receive assistance under two or more such programs concurrently,
				but shall elect (in such form and manner as the Secretary may prescribe) under
				which chapter or provisions to receive educational assistance.</text>
										</subsection><subsection id="H91A4A4EA2E484E859B1F7DF08B5EE"><enum>(b)</enum><header>Inapplicability of
				service treated under educational loan repayment programs</header><text>A
				period of service counted for purposes of repayment of an education loan under
				<external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/109">chapter 109</external-xref> of title 10 may not be counted as a period of service for
				entitlement to educational assistance under this chapter.</text>
										</subsection><subsection id="H5F298C3D9F4D496485554450F1F5CC79"><enum>(c)</enum><header>Service in
				Selected Reserve</header><text>An individual who serves in the Selected Reserve
				may receive credit for such service under only one of this chapter, chapter 30
				of this title, and chapters 1606 and 1607 of title 10, and shall elect (in such
				form and manner as the Secretary may prescribe) under which chapter such
				service is to be credited.</text>
										</subsection><subsection id="H803086465B6142C7A23BA7BED002000"><enum>(d)</enum><header>Additional
				coordination matters</header><text>In the case of an individual entitled to
				educational assistance under chapter 30, 31, 32, or 35 of this title, chapter
				107, 1606, or 1607 of title 10, or the provisions of the Hostage Relief Act of
				1980, or making contributions toward entitlement to educational assistance
				under chapter 30 of this title, as of the date of the enactment of the
				<short-title>Returning Soldiers’ Bill of Rights
				Act</short-title>, coordination of entitlement to educational assistance under
				this chapter, on the one hand, and such chapters or provisions, on the other,
				shall be governed by the provisions of section 101(c) of the
				<short-title>Returning Soldiers’ Bill of Rights
				Act</short-title>.</text>
										</subsection></section><section id="HC2AE1D9D0D7A40DA93A2CD3BF606EB1"><enum>3323.</enum><header>Administration</header>
										<subsection id="HD82F4D4CC91A4C2DB588B5D3A72747BF"><enum>(a)</enum><header>In
				general</header><paragraph commented="no" display-inline="yes-display-inline" id="HE49120C11E704EDEBD6416D7D0D40028"><enum>(1)</enum><text>Except as otherwise
				provided in this chapter, the provisions specified in section 3034(a)(1) of
				this title shall apply to the provision of educational assistance under this
				chapter.</text>
											</paragraph><paragraph id="H51561CE37E8741E1B315F88C7FCFF0E8" indent="up1"><enum>(2)</enum><text>In applying the provisions referred
				to in paragraph (1) to an individual entitled to educational assistance under
				this chapter for purposes of this section, the reference in such provisions to
				the term <term>eligible veteran</term> shall be deemed to refer to an
				individual entitled to educational assistance under this chapter.</text>
											</paragraph><paragraph id="H7B6DA8BA9C5B4689BDDA3B005D6BBBB" indent="up1"><enum>(3)</enum><text>In applying section 3474 of this
				title to an individual entitled to educational assistance under this chapter
				for purposes of this section, the reference in such section 3474 to the term
				<term>educational assistance allowance</term> shall be deemed to refer to
				educational assistance payable under section 3313 of this title.</text>
											</paragraph><paragraph id="HF6FB06FF34BD4E3095E72A1FD951077" indent="up1"><enum>(4)</enum><text>In applying section 3482(g) of this
				title to an individual entitled to educational assistance under this chapter
				for purposes of this section—</text>
												<subparagraph id="H50AC264860D44BF2B1519E25C6FB00DC"><enum>(A)</enum><text>the first reference to the term
				<term>educational assistance allowance</term> in such section 3482(g) shall be
				deemed to refer to educational assistance payable under section 3313 of this
				title; and</text>
												</subparagraph><subparagraph id="HBDB125BD2F7440F3A844948D20444F15"><enum>(B)</enum><text>the first sentence of paragraph (1) of
				such section 3482(g) shall be applied as if such sentence ended with
				<term>equipment</term>.</text>
												</subparagraph></paragraph></subsection><subsection id="HD9547367F1734DEDAD80973731943439"><enum>(b)</enum><header>Information on
				benefits</header><paragraph commented="no" display-inline="yes-display-inline" id="H60ED7BB76D7D4F1682A8AE0080B94CDC"><enum>(1)</enum><text>The Secretary of
				Veterans Affairs shall provide the information described in paragraph (2) to
				each member of the Armed Forces at such times as the Secretary of Veterans
				Affairs and the Secretary of Defense shall jointly prescribe in
				regulations.</text>
											</paragraph><paragraph id="H08F821B4F6A7477FAD400782B065C46E" indent="up1"><enum>(2)</enum><text>The information described in this
				paragraph is information on benefits, limitations, procedures, eligibility
				requirements (including time-in-service requirements), and other important
				aspects of educational assistance under this chapter, including application
				forms for such assistance under section 5102 of this title.</text>
											</paragraph><paragraph id="H1903F53DD10243C1BF05018531217DD0" indent="up1"><enum>(3)</enum><text>The Secretary of Veterans Affairs
				shall furnish the information and forms described in paragraph (2), and other
				educational materials on educational assistance under this chapter, to
				educational institutions, training establishments, military education
				personnel, and such other persons and entities as the Secretary considers
				appropriate.</text>
											</paragraph></subsection><subsection id="H1E31E1B3291440FC83A0A83B1EDBEE53"><enum>(c)</enum><header>Regulations</header><paragraph commented="no" display-inline="yes-display-inline" id="H2FF3CF704D544198B5213B7C95907FC0"><enum>(1)</enum><text>The Secretary shall
				prescribe regulations for the administration of this chapter.</text>
											</paragraph><paragraph id="H9233F1E744F64DC48D141D30FE613511" indent="up1"><enum>(2)</enum><text>Any regulations prescribed by the
				Secretary of Defense for purposes of this chapter shall apply uniformly across
				the Armed Forces.</text>
											</paragraph></subsection></section><section id="H17C4569C6F1A422AB74917D4D7CF813E"><enum>3324.</enum><header>Allocation of
				administration and costs</header>
										<subsection id="HB507EDE7A31B4DCE88290133007F169C"><enum>(a)</enum><header>Administration</header><text>Except
				as otherwise provided in this chapter, the Secretary shall administer the
				provision of educational assistance under this chapter.</text>
										</subsection><subsection id="HFFB5CBBB3E3444BEAF28431E9C681D42"><enum>(b)</enum><header>Costs</header><text>Payments
				for entitlement to educational assistance earned under this chapter shall be
				made from funds appropriated to, or otherwise made available to, the Department
				of Veterans Affairs for the payment of readjustment
				benefits.</text>
										</subsection></section></subchapter></chapter><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph id="H8D0B2BFD482745CB864000B9ED5B9067"><enum>(2)</enum><header>Clerical
			 amendments</header><text>The tables of chapters at the beginning of title 38,
			 United States Code, and at the beginning of part III of such title, are each
			 amended by inserting after the item relating to chapter 32 the following new
			 item:</text>

			 title 38, United States Code, is amended—</text>

			 subsection (a)(1), by inserting <quote>33,</quote> after <quote>32,</quote>;

			 eligible to elect participation in educational assistance program for service
			 in support of a contingency operation</header><text>An individual may elect to
			 receive educational assistance under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/33">chapter 33</external-xref> of title 38, United States Code
			 (as added by subsection (a)), if such individual—</text>
						<subparagraph id="H709A2053270349ECBE62FA38AE4DBFDD"><enum>(A)</enum><text>before, on, or
			 after of the date of the enactment of this Act—</text>
							<clause id="HC93B9B45BD414965A0CD4292006C5DFF"><enum>(i)</enum><text>is
			 entitled to basic educational assistance under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/30">chapter 30</external-xref> of title 38, United
			 States Code, whether or not the individual has used all or part of the
			 individual’s entitlement under that chapter;</text>
							</clause><clause id="H6C59F8C78E564A53996600600074392C"><enum>(ii)</enum><text display-inline="yes-display-inline">is entitled to educational assistance under
			 chapter 107, 1606, or 1607 of title 10, United States Code, whether or not the
			 individual has used all or part of the individual’s entitlement under that
			 chapter;</text>
							</clause><clause id="HB77D940186EE468EB38C79DFEAD82B5D"><enum>(iii)</enum><text>is
			 a member of the Armed Forces who is eligible for receipt of basic educational
			 assistance under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/30">chapter 30</external-xref> of title 38, United States Code, and is making
			 contributions toward such assistance under section 3011(b) or 3012(c) of such
			 title; or</text>
							</clause><clause id="H51DB8D398813430EB19828D5F4222592"><enum>(iv)</enum><text>is
			 a member of the Armed Forces who is not entitled to basic educational
			 assistance under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/30">chapter 30</external-xref> of title 38, United States Code, by reason of an
			 election under section 3011(c)(1) or 3012(d)(1) of such title; and</text>
							</clause></subparagraph><subparagraph id="HD525FC46908F472E95816E88363E9532"><enum>(B)</enum><text>as of the date of
			 the individual's election under this paragraph, meets the requirements for
			 entitlement to educational assistance under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/33">chapter 33</external-xref> of title 38, United
			 States Code (as so added).</text>
						</subparagraph></paragraph><paragraph id="H74B96091FF4B4F5C88A47798E0BCD9C8"><enum>(2)</enum><header>Election on
			 treatment of transferred entitlement</header>
						<subparagraph id="H13EB4BAA6D2A40768161B8ED702DE972"><enum>(A)</enum><header>Election</header><text>If,
			 on the date an individual described in subparagraph (A)(i) or (A)(iii) of
			 paragraph (1) makes an election under that paragraph, a transfer of the
			 entitlement of the individual to basic educational assistance under section
			 3020 of title 38, United States Code, is in effect and a number of months of
			 the entitlement so transferred remain unutilized, the individual may elect to
			 revoke all or a portion of the entitlement so transferred that remains
			 unutilized.</text>
						</subparagraph><subparagraph id="HB330351913354EAA964FCE1C314E8FA3"><enum>(B)</enum><header>Availability of
			 revoked entitlement</header><text>Any entitlement revoked by an individual
			 under this paragraph shall no longer be available to the dependent to whom
			 transferred, but shall be available to the individual instead for educational
			 assistance under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/33">chapter 33</external-xref> of title 38, United States Code (as so added), as
			 provided in paragraph (3)(B).</text>
						</subparagraph><subparagraph id="H623B7FCAA2E744B7AD53D29FF5588206"><enum>(C)</enum><header>Availability of
			 unrevoked entitlement</header><text>Any entitlement described in subparagraph
			 (A) that is not revoked by an individual in accordance with that subparagraph
			 shall remain available to the dependent or dependents concerned in accordance
			 with the current transfer of such entitlement under <external-xref legal-doc="usc" parsable-cite="usc/38/3020">section 3020</external-xref> of title 38,
			 United States Code.</text>
						</subparagraph></paragraph><paragraph id="H7F321AA3A1BF4D86AE6828C5351E761D"><enum>(3)</enum><header>Educational
			 assistance for service in support of a contingency operation</header>
						<subparagraph id="H30D95B01CADE41BFB1AE98EA57236EA5"><enum>(A)</enum><header>In
			 general</header><text>Subject to subparagraph (B), an individual making an
			 election under paragraph (1) shall be entitled to educational assistance under
			 <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/33">chapter 33</external-xref> of title 38, United States Code (as so added), in accordance with
			 the provisions of such chapter, instead of basic educational assistance under
			 <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/30">chapter 30</external-xref> of title 38, United States Code, or educational assistance under
			 chapter 107, 1606, or 1607 of title 10, United States Code, as
			 applicable.</text>
						</subparagraph><subparagraph id="H7C45963704B74CF28D2C82E908BAC284"><enum>(B)</enum><header>Limitation on
			 entitlement for certain individuals</header><text>In the case of an individual
			 making an election under paragraph (1) who is described by subparagraph (A)(i)
			 of that paragraph, the number of months of entitlement of such individual to
			 educational assistance under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/33">chapter 33</external-xref> of title 38, United States Code (as so
			 added), shall be the number of months equal to the number of months of unused
			 entitlement of such individual under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/30">chapter 30</external-xref> of title 38, United States
			 Code, as of the date of the election, including any number of months
			 entitlement revoked by the individual under paragraph (2)(A).</text>
						</subparagraph></paragraph><paragraph id="H5716FD59E4A74D9391E7C700A8BC43DF"><enum>(4)</enum><header>Continuing
			 educational assistance under montgomery gi bill</header>
						<subparagraph id="H35CBD0FB47D8448FBCA1621D19AEEFC"><enum>(A)</enum><header>In
			 general</header><text>If the aggregate amount of entitlement to educational
			 assistance under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/33">chapter 33</external-xref> of title 38, United States Code (as so added),
			 accumulated by an individual described in subparagraph (A)(i) or (A)(ii) of
			 paragraph (1) who makes an election under that paragraph is less than 36
			 months, the individual shall retain, and may utilize, any unutilized
			 entitlement of the individual to educational assistance under chapter 30 of
			 title 38, United States Code, or chapter 107, 1606, or 1607 of title 10, United
			 States Code, as applicable, for a number of months equal to the lesser
			 of—</text>
							<clause id="H159B4547966F4A3EA2A417D050DE11C5"><enum>(i)</enum><text>36
			 months minus the number of months of entitlement so accumulated by the
			 individual; or</text>
							</clause><clause id="HC91A42D680614071A06344D8F624D43"><enum>(ii)</enum><text>the
			 number of months of such unutilized entitlement of the individual.</text>
							</clause></subparagraph><subparagraph id="H5522F6D368F748D7A3C5B9E00848ABCA"><enum>(B)</enum><header>Utilization of
			 retained entitlement</header><text>The utilization of entitlement retained by
			 an individual under this paragraph shall be governed by the provisions of
			 <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/30">chapter 30</external-xref> of title 38, United States Code, or chapter 107, 1606, or 1607 of
			 title 10, United States Code, as applicable.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8D4799C43E8349A0000517D63130488B"><enum>(5)</enum><header>Treatment of
			 contributions toward basic educational assistance</header>
						<subparagraph id="H5F8B58E4CECC40038762E9C506CE916E"><enum>(A)</enum><header>Refund of
			 contributions</header><text>Except as provided in subparagraph (B), the
			 Secretary of Veterans Affairs shall pay to each individual making an election
			 under paragraph (1) who is described by clause (i), (iii), or (v) of
			 subparagraph (A) of that paragraph an amount equal to the total amount of
			 contributions made by such individual under subchapter II of chapter 30 of
			 title 38, United States Code, for basic educational assistance under that
			 chapter, including any contributions made under subsection (b) or (e) of
			 section 3011 of such title or any contributions made under subsection (c) or
			 (f) of section 3012 of such title.</text>
						</subparagraph><subparagraph id="H927B47FD7B8D4DE5887E9E089112A49F"><enum>(B)</enum><header>Exception</header><text>In
			 the case of an individual described by subparagraph (A) who is entitled to
			 basic educational assistance under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/30">chapter 30</external-xref> of title 38, United States Code,
			 by reason of paragraph (4)(A), the amount payable to the individual under this
			 paragraph shall be an amount equal to—</text>
							<clause id="HB61BE4C82ECB404A88081107693CCADD"><enum>(i)</enum><text>the
			 amount otherwise payable to the individual under subparagraph (A), multiplied
			 by</text>
							</clause><clause id="H0B2C5BB654604F858105B3B5473B18E8"><enum>(ii)</enum><text>a
			 fraction—</text>
								<subclause id="HA368DAF52A69463181CF3C29B42D00C3"><enum>(I)</enum><text>the numerator of
			 which is the number equal to the number of months of basic educational
			 assistance under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/30">chapter 30</external-xref> of title 38, United States Code, to which the
			 individual is entitled by reason of paragraph (4)(A); and</text>
								</subclause><subclause id="H22496033EEB24BD088B330D2F3FAAB9"><enum>(II)</enum><text>the denominator of
			 which is 36.</text>
								</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H715F452FC9FB4A2DA677D4000990A4B"><enum>(C)</enum><header>Cessation of
			 contributions</header><text>Effective as of the first month beginning on or
			 after the date of an election under paragraph (1) of an individual described by
			 subparagraph (A)(v) of that paragraph, the obligation of such individual to
			 make contributions under section <external-xref legal-doc="usc" parsable-cite="usc/38/3011">3011(b)</external-xref> or <external-xref legal-doc="usc" parsable-cite="usc/38/3012">3012(c)</external-xref> of title 38, United States
			 Code, as applicable, shall cease, and the requirements of such section shall be
			 deemed to be no longer applicable to such person.</text>
						</subparagraph></paragraph><paragraph id="H9C236D1C4F80434E82B44627EC8562E2"><enum>(6)</enum><header>Termination of
			 entitlement under montgomery gi bill</header><text>Except as otherwise provided
			 in paragraph (4), effective on the last day of the month in which an individual
			 makes an election under paragraph (1), the entitlement, if any, of the
			 individual to basic educational assistance under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/30">chapter 30</external-xref> of title 38, United
			 States Code, or educational assistance under chapter 107, 1606, or 1607 of
			 title 10, United States Code, as applicable, shall terminate.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9D986DBAAA104BC19458C8308D13606C"><enum>(7)</enum><header>Irrevocability
			 of elections</header><text>An election under paragraph (1) or (2)(A) is

			 housing allowance</header>
				<subsection id="H618E5E5353C64A88A52FD3B50535E74"><enum>(a)</enum><header>Provision of
			 housing allowance</header><text display-inline="yes-display-inline">The
			 Secretary of Veterans Affairs shall provide to each qualifying veteran a
			 voucher in an amount sufficient to pay for the cost of the veteran’s housing
			 for 180 days, except that in no case shall the amount of the voucher exceed
			 $6,000.</text>
				</subsection><subsection commented="no" id="HA4791225898644908E9F9C36B49CF1F8"><enum>(b)</enum><header>Qualifying
			 veteran</header><text display-inline="yes-display-inline">For purposes of this
			 section, the term <term>qualifying veteran</term> means a veteran of Operation
			 Iraqi Freedom or Operation Enduring Freedom who, on or after September 11,
			 2001, serves or served, or both, an aggregate of at least 6 months on active
			 duty in the Armed Forces in support of a contingency operation.</text>
