		<section id="HAE2F98134BF940159C48BC5978A6A244" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Nuclear Used Fuel Prize Act of
			 2008</short-title></quote>.</text>
		</section><section id="HB324D0808FA248FA8FACB680EA895CAC"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="HAFB33ECCDC464E97002832BF732BECC2"><enum>(1)</enum><header>Administering
			 Entity</header><text>The term <quote>administering entity</quote> means the
			 entity with which the Secretary enters into an agreement under section
			 4(c).</text>
			</paragraph><paragraph id="HCF32BD6586874CBEA774DB52AABB2DCD"><enum>(2)</enum><header>Department</header><text>The
			 term <quote>Department</quote> means the Department of Energy.</text>
			</paragraph><paragraph id="HB55397E3DD284954B6BC9CC9D09C46A"><enum>(3)</enum><header>Secretary</header><text>The
			 term <quote>Secretary</quote> means the Secretary of Energy.</text>
			</paragraph></section><section commented="no" id="HF67BC47131D247F2A204024412DD5436"><enum>3.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds the following:</text>
			<paragraph commented="no" id="H9CBE1DDC8A154745923B13B3F7783DE2"><enum>(1)</enum><text>The rising cost of
			 energy has become a hindrance to American economic progress.</text>
			</paragraph><paragraph commented="no" id="H5F01400F61AC4ADC8FA961839442B9D"><enum>(2)</enum><text>High and rising
			 energy costs have become a burden upon the American family.</text>
			</paragraph><paragraph commented="no" id="H5286E4461D5D42BEA38C3E65ED0585"><enum>(3)</enum><text display-inline="yes-display-inline">Nuclear energy can be a safe, efficient,
			 clean, and affordable source of renewable energy and should be considered as
			 part of the solution for long-term American energy independence.</text>
			</paragraph><paragraph commented="no" id="HD6448C27D0A442E700A3D7ED7C2EC14E"><enum>(4)</enum><text>Used nuclear fuel
			 is and has been safely stored on nuclear energy electricity producing reactor
			 sites for many years.</text>
			</paragraph><paragraph commented="no" id="HB397AFCD9BDB452B002C951B69D383BE"><enum>(5)</enum><text>Those sites were
			 originally not designed or built for such storage.</text>
			</paragraph><paragraph commented="no" id="H730491A43FDE4547007C53A9E5F545F"><enum>(6)</enum><text>By 2015 it is
			 estimated that the United States will maintain 70,000 tons of high-level
			 nuclear waste.</text>
			</paragraph><paragraph commented="no" id="HBD90F974597E4D3C88CEFFADE3A5958B"><enum>(7)</enum><text>The country’s
			 electricity needs are best served by allowing new nuclear reactors to be built,
			 in many cases on existing reactor sites.</text>
			</paragraph><paragraph commented="no" id="H939E7932C4C04550A41C7B0637DE48B2"><enum>(8)</enum><text>Removal of the
			 used nuclear fuel from those sites can be safely done and would lead to more
			 efficient management of used fuel, and lower costs.</text>
			</paragraph><paragraph commented="no" id="H2FADAF9DA6BB4AA6B6F74742B819AF12"><enum>(9)</enum><text>Development of
			 alternatives to current storage facilities, including the Yucca Mountain
			 long-term storage facility, would also allow used nuclear fuel from
			 decommissioned reactor sites to be moved and final clean up of those sites to
			 take place.</text>
			</paragraph><paragraph commented="no" id="HCBCAD8BA604B4DCD83BABEF1451842F5"><enum>(10)</enum><text>Citizens and
			 communities in the United States interested in developing alternatives to
			 current storage proposals, including the high-level Yucca Mountain storage
			 facility, should be provided the incentive to move forward with these designs
			 and plans.</text>
			</paragraph><paragraph commented="no" id="H616DBA1FD5CD4F8A8B2B576B9DAC983B"><enum>(11)</enum><text>Prize legislation
			 has been a successful method used by the United States Government to solve some
			 of our country’s most difficult problems, from space travel to vehicles with
			 super efficiency.</text>
			</paragraph><paragraph commented="no" id="H40883B2DD9D24D44AF365491FFA652E3"><enum>(12)</enum><text>There is merit in
			 and need for establishing a program of prize incentives to develop used nuclear
			 fuel management plans.</text>
			</paragraph></section><section id="HC3163B7FE69043B2A8DC61D8D6000A5"><enum>4.</enum><header>Prize
			 authority</header>
			<subsection id="H3D977372AA4F44CAB69C47132467D3C6"><enum>(a)</enum><header>In
			 general</header><text>The Secretary shall carry out a program to competitively
			 award cash prizes in conformity with this Act to advance the research,
			 development, demonstration, and commercial application of nuclear used fuel
			 storage.</text>
			</subsection><subsection id="H3C9FB12B054F474B8B6CA4CA882EE668"><enum>(b)</enum><header>Advertising and
			 solicitation of competitors</header>
				<paragraph id="HE9A01E0DE7B144879E5B33D526BCCE2"><enum>(1)</enum><header>Advertising</header><text>The
			 Secretary shall widely advertise prize competitions to encourage broad
			 participation in the program carried out under subsection (a), including
			 individuals, universities, communities, and large and small businesses.</text>
				</paragraph><paragraph id="H7E8F6830818047E68FC200F356D08E84"><enum>(2)</enum><header>Announcement
			 Through Federal Register Notice</header><text>The Secretary shall announce each
			 prize competition by publishing a notice in the Federal Register. This notice
			 shall include essential elements of the competition such as the subject of the
			 competition, the duration of the competition, the eligibility requirements for
			 participation in the competition, the process for participants to register for
			 the competition, the amount of the prize, and the criteria for awarding the
			 prize.</text>
				</paragraph></subsection><subsection id="H662FDB8B180E4F249E78BAED0074767E"><enum>(c)</enum><header>Administering
			 the competition</header><text>The Secretary may enter into an agreement with a
			 private, nonprofit entity to administer the prize competitions, subject to the
			 provisions of this Act. The administering entity shall perform the following
			 functions:</text>
				<paragraph id="H73EC500879974E12A5DBC2F2D2CBCFFB"><enum>(1)</enum><text>Advertise the
			 competition and its results.</text>
				</paragraph><paragraph id="HAF21FBA5EF304FA8BFABEC0894B98D98"><enum>(2)</enum><text>Raise funds from
			 private entities and individuals to pay for administrative costs and cash
			 prizes.</text>
				</paragraph><paragraph id="HE0F3EAE22CAA40ED819EECFA724F0329"><enum>(3)</enum><text>Develop, in
			 consultation with and subject to the final approval of the Secretary, criteria
			 to select winners based upon the goal of safely and adequately storing nuclear
			 used fuel.</text>
				</paragraph><paragraph id="HD2A727747439409485F352EFFD574362"><enum>(4)</enum><text>Determine, in
			 consultation with and subject to the final approval of the Secretary, the
			 appropriate amount of the awards.</text>
				</paragraph><paragraph id="H12024E8A0A51430497F2C24E3E7588C0"><enum>(5)</enum><text>Protect against
			 the administering entity’s unauthorized use or disclosure of a registered
			 participant’s intellectual property, trade secrets, and confidential business
			 information. Any information properly identified as trade secrets or
			 confidential business information that is submitted by a participant as part of
			 a competitive program under this Act may be withheld from public
			 disclosure.</text>
				</paragraph><paragraph id="H6214C4093585482F8180C970E0F7B4E2"><enum>(6)</enum><text>Develop and
			 promulgate sufficient rules to define the parameters of designing and proposing
			 safe and secure nuclear energy used fuel storage with input from industry,
			 citizens, and corporations familiar with such activities.</text>
				</paragraph></subsection><subsection id="H0E28564ABB2E4CD68324D4F57C6E79"><enum>(d)</enum><header>Funding
			 sources</header><text>Prizes under this Act may consist of Federal appropriated
			 funds, funds provided by the administering entity, or funds raised through
			 grants or donations. The Secretary may accept funds from other Federal agencies
			 for such cash prizes and, notwithstanding <external-xref legal-doc="usc" parsable-cite="usc/31/3302">section 3302(b)</external-xref> of title 31, United
			 States Code, may use such funds for the cash prize program. Other than
			 publication of the names of prize sponsors, the Secretary may not give any
			 special consideration to any private sector entity or individual in return for
			 a donation to the Secretary or administering entity.</text>
			</subsection><subsection id="H8DB6A338B6E746930017706E12FAC58C"><enum>(e)</enum><header>Announcement of
			 prizes</header><text>The Secretary may not publish a notice required by
			 subsection (b)(2) until all the funds needed to pay out the announced amount of
			 the prize have been appropriated to the Department or the Department has
			 received from the administering entity a written commitment to provide all
			 necessary funds.</text>
			</subsection></section><section id="HAE558AF11394419BAAB2CE6E30009BD4"><enum>5.</enum><header>Eligibility</header><text display-inline="no-display-inline">To be eligible to win a prize under this
			 Act, an individual or entity—</text>
			<paragraph id="HD77BFC25FF38455FA57200E3BFDB4112"><enum>(1)</enum><text>shall notify the
			 administering entity of intent to submit ideas and intent to collect the prize
			 upon selection;</text>
			</paragraph><paragraph id="HFB9785A3663A489089599170B5D53C5"><enum>(2)</enum><text>shall comply with
			 all the requirements stated in the Federal Register notice required under
			 section 4(b)(2);</text>
			</paragraph><paragraph id="H70C6DA606D7C443889A335C8E7D8728"><enum>(3)</enum><text>in
			 the case of a private entity, shall be incorporated in and maintain a primary
			 place of business in the United States, and in the case of an individual,
			 whether participating singly or in a group, shall be a citizen of the United
			 States;</text>
			</paragraph><paragraph id="HE9C54D8037744186994F2EF0B7A44971"><enum>(4)</enum><text>shall not be a
			 Federal entity, a Federal employee acting within the scope of his or her
			 employment, or an employee of a national laboratory acting within the scope of
			 employment;</text>
			</paragraph><paragraph id="H756F649DCE7B411AA3294699B939337E"><enum>(5)</enum><text>shall not use
			 Federal funding or other Federal resources to compete for the prize;</text>
			</paragraph><paragraph id="HA6822FF35E834ED69342B7C4491DDBE3"><enum>(6)</enum><text>shall not be an
			 entity acting on behalf of any foreign government or agent acting on behalf of
			 a current federally filed proposal for a spent nuclear fuel storage facility or
			 repository; and</text>
			</paragraph><paragraph id="HA70263B29F26423684AD2636F27D3281"><enum>(7)</enum><text>shall present a
			 proposal to the administering entity to remove used nuclear fuel for such
			 period of time as shall be necessary prior to the development of advanced fuel
			 cycle facilities and a final repository for used fuel waste as may be
			 ultimately in need of disposal.</text>
			</paragraph></section><section id="HC63B61F82EC24D9597864522521F1161"><enum>6.</enum><header>Intellectual
			 property</header><text display-inline="no-display-inline">The Federal
			 Government shall not, by virtue of offering or awarding a prize under this Act,
			 be entitled to any intellectual property rights derived as a consequence of, or
			 in direct relation to, the participation by a registered participant in a
			 competition authorized by this Act. This section shall not be construed to
			 prevent the Federal Government from negotiating a license for the use of
			 intellectual property developed for a prize competition under this Act. The
			 Federal Government may seek assurances that technologies for which prizes are
			 awarded under this Act are offered for commercialization in the event an award
			 recipient does not take, or is not expected to take within a reasonable time,
			 effective steps to achieve practical application of the technology.</text>
		</section><section id="HE38A0D28638C4AA0AAA4028969E23864"><enum>7.</enum><header>Waiver of
			 liability</header><text display-inline="no-display-inline">The Secretary may
			 require registered participants to waive claims against the Federal Government
			 and the administering entity (except claims for willful misconduct) for any
			 injury, death, damage, or loss of property, revenue, or profits arising from
			 the registered participants’ participation in a competition under this Act. The
			 Secretary shall give notice of any waiver required under this section in the
			 notice required by section 4(b)(2). The Secretary may not require a registered
			 participant to waive claims against the administering entity arising out of the
			 unauthorized use or disclosure by the administering entity of the registered
			 participant’s intellectual property, trade secrets, or confidential business
			 information.</text>
		</section><section id="H5D3172466D504FA3AD34BAB6B495C19"><enum>8.</enum><header>Authorization of
			 Appropriations</header>
			<subsection id="H3EE6E5BA39814157A2F6279C46EA3D4C"><enum>(a)</enum><header>Awards</header><text>There
			 are authorized to be appropriated to the Secretary for the period encompassing
			 fiscal years 2009 through 2020 for carrying out this Act—</text>
				<paragraph id="HD0ED61F162D6413F9D0044C7732419BC"><enum>(1)</enum><text>$10,000,000 each
			 for two awards, and Federal contracting opportunities; and</text>
				</paragraph><paragraph id="H9D93E52F6E9A46FFA1288BEB27514F38"><enum>(2)</enum><text>$2,000,000 for two
			 additional awards to support continued actions to develop the successful
			 entities.</text>
				</paragraph></subsection><subsection id="H087716FCEFCC4B109D35806458DB9000"><enum>(b)</enum><header>Treatment of
			 awards</header><text>Amounts received pursuant to an award under this Act may
			 not be taxed by any Federal, State, or local authority.</text>
			</subsection><subsection id="H52B5AC33CB894657B10060AD99196CD7"><enum>(c)</enum><header>Administration</header><text>In
			 addition to the amounts authorized under subsection (a), there are authorized
			 to be appropriated to the Secretary for each of fiscal years 2009 through 2020
			 $2,000,000 for the administrative costs of carrying out this Act.</text>
			</subsection><subsection id="HE45A79A66FBA42B89601C1FBAFB128F1"><enum>(d)</enum><header>Carryover of
			 Funds</header><text>Funds appropriated for prize awards under this Act shall
			 remain available until expended and may be transferred, reprogrammed, or
			 expended for other purposes only after the expiration of 11 fiscal years after
			 the fiscal year for which the funds were originally appropriated. No provision
			 in this Act permits obligation or payment of funds in violation of section 1341
			 of title 31, United States Code.</text>
			</subsection></section></legis-body>
