<official-title>To amend title 38, United States Code, to extend the time limitation for the use of entitlement to educational assistance under the Montgomery GI Bill for certain persons actively pursuing a qualifying educational degree or certificate.</official-title>

<section id="H0BAFD4383068469D9C81726E8BAD4E73" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Montgomery GI Bill Degree Extension Act of 2008</short-title></quote>.</text></section>
<section id="HA7EC6274299D4E72A8BEBF46D16118D"><enum>2.</enum><header>Extension of time limitation for use of entitlement to educational assistance under Montgomery GI Bill</header>
<subsection id="H9B59FA99113C4CC7BEF535F3446E1B53"><enum>(a)</enum><header>Extension of limitation period</header><text><external-xref legal-doc="usc" parsable-cite="usc/38/3031">Section 3031</external-xref> of title 38, United States Code, is amended—</text>
<paragraph id="H35AC3AE4A6C34F38974EC332CABAE105"><enum>(1)</enum><text>by redesignating subsection (h) as subsection (i);</text></paragraph>
<paragraph id="HE3ADBEFDB26F445E890086049140886D"><enum>(2)</enum><text>by inserting after subsection (g) the following new subsection (h):</text>

<subsection id="HDA7105EFAFBB4C7EB1F0D38D68A7FB81"><enum>(h)</enum>
<paragraph commented="no" display-inline="yes-display-inline" id="HA0D3286A8E7F422EBCC455C27481F5B7"><enum>(1)</enum><text>In the case of an individual eligible for educational assistance under this chapter who has completed at least 50 percent of the credit or time requirements leading to a degree or certificate before the last day of the 10-year period prescribed in subsection (a), the period during which the individual may use the individual’s entitlement shall terminate on the earlier of the following dates:</text>
<subparagraph id="HB4838C31C7A3407F9DEA4D4473E22F88" indent="up1"><enum>(A)</enum><text>The date on which the individual completes all of the credit or time requirements leading to the degree or certificate.</text></subparagraph>
<subparagraph id="H477E033189EE47D88347673B57B456A0" indent="up1"><enum>(B)</enum><text>The date that is two years after the last day of the 10-year period prescribed in subsection (a).</text></subparagraph></paragraph>
<paragraph id="HCB5C500E205049F5AC441B6D72FCAB32" indent="up1"><enum>(2)</enum><text>An individual described in paragraph (1) who uses the individual’s entitlement after the last day of the 10-year period prescribed in subsection (a) may only use the individual’s entitlement for the pursuit of a course that leads to the degree or certificate referred to in that paragraph.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="HA8FC601918A14707AAB0E0EABB21318D"><enum>(b)</enum><header>Conforming amendments</header><text>Subsection (a) of such section is amended—</text>
<paragraph id="H5F70350CFE0C4247880093FF2EF5137E"><enum>(1)</enum><text>by striking <quote>subsections (b) through (g)</quote> and inserting <quote>subsections (b) through (h)</quote>; and</text></paragraph>
<paragraph id="HA06001AA111247A7B9BE1EEDE6A5062C"><enum>(2)</enum><text>by striking <quote>subsection (h)</quote> and inserting <quote>subsection (i)</quote>.</text></paragraph></subsection>
<subsection id="H0EE551CC13404097A6981270F3EDD61D"><enum>(c)</enum><header>Effective date and applicability</header><text>The amendments made by subsections (a) and (b) shall apply with respect to an individual whose entitlement to educational assistance under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/30">chapter 30</external-xref> of title 38, United States Code, has not expired as of the date of the enactment of this Act under section 3031 of such title, as in effect on the day before that date.</text></subsection></section>
