		<official-title>To amend the Internal Revenue Code of 1986 to allow
		  charitable organizations to collect and disperse deductible contributions for
		  certain individuals who are injured or killed in an effort to protect life or
		  property.</official-title>

		<section id="H839D5A7D15A644B2A9003FF5A00021B2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Charitable Aid to Community Heroes Act
			 of 2008</short-title></quote>.</text>
		</section><section id="H2DDDA068203049C2AE837EB889F7136E"><enum>2.</enum><header>Charitable
			 organizations permitted to collect and disperse deductible contributions for
			 certain individuals who are injured or killed in an effort to protect life or
			 property</header>
			<subsection id="HED425F47E0714C808FE43DC15B791B18"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 170 of the
			 Internal Revenue Code of 1986 (relating to charitable, etc., contributions and
			 gifts) is amended by redesignating subsection (p) as subsection (q) and by
			 inserting after subsection (o) the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H101351EB6D1A49D89F492700E1909713" style="OLC">
					<subsection id="H68821963898E4BFFB46282CB1C8D00D6"><enum>(p)</enum><header>Charitable
				organizations permitted To collect and disperse deductible contributions for
				certain individuals who are injured or killed in an effort To protect life or
				property</header><text display-inline="yes-display-inline">For purposes of this
				title—</text>
						<paragraph id="H94443800DA3C4A6A8D696F849852DDC0"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Payments made by an
				organization described in paragraph (1) or (2) of section 509(a) to an eligible
				individual or to a member of such individual’s family shall be treated as
				related to the purpose or function constituting the basis for such
				organization's exemption under section 501 if the requirements of paragraphs
				(3), (4), and (5) are met.</text>
						</paragraph><paragraph id="H94764A7FB16045EAB7276E06CF1E17CF"><enum>(2)</enum><header>Eligible
				individual</header><text display-inline="yes-display-inline">For purposes of
				this subsection, the term <quote>eligible individual</quote> means any
				individual who is injured or killed in an effort to protect life or property if
				such individual is injured or killed while on duty as—</text>
							<subparagraph id="HE63DBF71BA4C48688200C43D6136E979"><enum>(A)</enum><text>any Federal,
				State, or local government employee, or</text>
							</subparagraph><subparagraph id="HE38ED2B6B6574F56A0E44DAA26C536DE"><enum>(B)</enum><text display-inline="yes-display-inline">a member of a qualified volunteer emergency
				response organization (as defined in section 139B(c)(3)).</text>
							</subparagraph></paragraph><paragraph id="H5F917EB207B342E3A946405FCF29BDB5"><enum>(3)</enum><header>Fundraising
				requirements</header><text display-inline="yes-display-inline">The requirements
				of this paragraph are met if—</text>
							<subparagraph id="H6A2D73F89CA14642B9B4B9D1EF4D956"><enum>(A)</enum><text>the organization
				referred to in paragraph (1) does not engage in any effort to solicit
				contributions for distribution under this subsection,</text>
							</subparagraph><subparagraph id="H3874830796BA4BD6BC0055BF7998D700"><enum>(B)</enum><text display-inline="yes-display-inline">such organization accepts contributions
				with respect to any death or injury only during the 1-year period beginning on
				the last day of the event which resulted in such death or injury,</text>
							</subparagraph><subparagraph id="H573F9DE93AE349D88FCA63C221FAD396"><enum>(C)</enum><text>at least 50 donors
				contribute to such organization with respect to such event, and</text>
							</subparagraph><subparagraph id="H5BAE81C1453246D5AD37393FD73FC2B8"><enum>(D)</enum><text display-inline="yes-display-inline">more than 95 percent of the funds are
				contributed by persons who are unrelated to any individual who is entitled to
				any distribution from such contributions.</text>
							</subparagraph></paragraph><paragraph id="HC204A2B5C9FE4A79AEEBFF7BFB9B03B4"><enum>(4)</enum><header>Administrative
				requirements</header><text display-inline="yes-display-inline">The requirements
				of this paragraph are met if the entire amount contributed (and any earnings
				thereon) is distributed to eligible individuals or members of their
				families.</text>
						</paragraph><paragraph id="H6EB9CB2C3C194B2D9D50D4A0829B001"><enum>(5)</enum><header>Distribution
				requirements</header>
							<subparagraph id="HE8CCE6E8BD464552918E4BF2E7788CB2"><enum>(A)</enum><header>In
				general</header><text>The requirements of this paragraph are met with respect
				to an event if—</text>
								<clause id="HC7AC0408503E428784F9FBE002B724DE"><enum>(i)</enum><text>all distributions
				are made within 180 days after the close of the 1-year period referred to in
				paragraph (3)(B), and</text>
								</clause><clause id="H89B7C7CBC5714A5CA7A109A31511C9AF"><enum>(ii)</enum><text>of the aggregate
				amount to be distributed—</text>
									<subclause id="H00D034BC574848008E121038DFD8C964"><enum>(I)</enum><text>half is
				distributed in equal amounts to each eligible individual with respect to such
				event, and</text>
									</subclause><subclause id="H3848FE77573B4971B3F9006E07C97D5F"><enum>(II)</enum><text>half is
				distributed in accordance with subparagraph (B).</text>
									</subclause></clause></subparagraph><subparagraph id="HBFF8268E57CD403A85BC5DEFFC06A038"><enum>(B)</enum><header>Family
				shares</header><text>The amount required to be distributed under this
				subparagraph shall be distributed as follows (with shares being equal
				amounts):</text>
								<clause id="H923AFDEC42D04154A4F43E95B291BC9"><enum>(i)</enum><text>Each eligible
				individual shall receive 1 share.</text>
								</clause><clause id="H7C7CB1E1E3CF4AEEBE51DBB2FECC1791"><enum>(ii)</enum><text>Each spouse of an
				eligible individual shall receive 1 share.</text>
								</clause><clause id="H3FF89B7A77164E419234F2DA43F2F51E"><enum>(iii)</enum><text>Each qualifying
				child of an eligible individual or an eligible individual’s spouse shall
				receive ½ share.</text>
								</clause></subparagraph></paragraph><paragraph id="H62955665C8FB4F5A8737467182E94BFD"><enum>(6)</enum><header>Member of
				family</header><text>For purposes of this subsection—</text>
							<subparagraph id="H09B87E9C9BFB416986452BCBCE513C11"><enum>(A)</enum><header>In
				general</header><text>The members of the family of an eligible individual are
				the spouse and qualifying children of such individual.</text>
							</subparagraph><subparagraph id="H69891E7168EE4DD6B871B53B7FF18095"><enum>(B)</enum><header>Date of
				determination</header><text>The determination of whether an individual is a
				spouse or qualifying child of an eligible individual shall be made as of the
				date of the death or injury of such individual, whichever is earlier.</text>
							</subparagraph><subparagraph id="H14959CD80C9B4FEA9BC0334B6E913DB7"><enum>(C)</enum><header>Qualifying
				child</header><text>The term <quote>qualifying child</quote> means, with
				respect to an eligible individual, any individual—</text>
								<clause id="HBC9FE57181A04D99A2E5C2266A204BA"><enum>(i)</enum><text>who
				bears a relationship to the eligible individual or the eligible individual’s
				spouse which is described in section 152(c)(2),</text>
								</clause><clause id="H5023C0F77BF24D0391B6DE7F579EB5C0"><enum>(ii)</enum><text>who meets the age
				requirements of section 152(c)(3), and</text>
								</clause><clause id="H4CE1C2D581ED4AAC9C7671989887C184"><enum>(iii)</enum><text>over half of
				whose support is provided by the eligible individual.</text>
								</clause></subparagraph></paragraph><paragraph id="H15570EE5B3074BA9A42738D49D3943FA"><enum>(7)</enum><header>Deceased
				eligible individuals</header><text>In the case of an eligible individual who
				died as a result of the event to which this subsection applies, references to
				such individual shall be treated as references to the estate of such
				individual.</text>
						</paragraph><paragraph id="H1E73B6CE82874D409C7C9185E18E3B92"><enum>(8)</enum><header>Organizations
				receiving contributions with respect to more than 1 event</header><text>If any
				organization receives contributions with respect to more than 1 event, the
				provisions of this subsection shall be applied separately with respect to each
				event.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HCF7293A86087427F81F6E2CF11E73766"><enum>(b)</enum><header>Effective
			 date</header><text>The amendment made by this section shall apply to
			 contributions received by organizations after the date of the enactment of this
			 Act.</text>
