<section id="HF0D86F91DE564C7F97FC881F14C8411F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Cache la Poudre River National Heritage Area Technical Amendments Act of 2007</short-title></quote>.</text></section>
<section id="H79408C6320414093A400A200FAD7C0C7"><enum>2.</enum><header>Cache la poudre river national heritage area</header>
<subsection id="HBBA6847CBC94487CAC92F1E8EE007C17"><enum>(a)</enum><header>Purpose</header><text>Section 101 of the Cache La Poudre River Corridor Act (<external-xref legal-doc="usc" parsable-cite="usc/16/461">16 U.S.C. 461</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/104/323">Public Law 104–323</external-xref>) is amended—</text>
<paragraph id="H5F8920A22516423999C778B43C2D5540"><enum>(1)</enum><text>by striking <quote>Cache La Poudre Corridor</quote> and inserting <quote>Cache la Poudre River National Heritage Area</quote>;</text></paragraph>
<paragraph id="H6053674DF24749719824B545E598D200"><enum>(2)</enum><text>by striking <quote>Cache La Poudre River Basin</quote> and inserting <quote>Cache la Poudre River Basin</quote>; and</text></paragraph>
<paragraph id="H30F10331DC864BD6A1ECCA7D8000E9A6"><enum>(3)</enum><text>by striking <quote>the Corridor</quote> and inserting <quote>the Heritage Area</quote>.</text></paragraph></subsection>
<subsection id="HFD0C4AD8ADBE4AD398EF9CCF45CD1F4"><enum>(b)</enum><header>Definitions</header><text>Section 102 of the Cache La Poudre River Corridor Act (<external-xref legal-doc="usc" parsable-cite="usc/16/461">16 U.S.C. 461</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/104/323">Public Law 104–323</external-xref>) is amended—</text>

<paragraph id="H35E26D20FB164840A8C0FE2FAACD5568"><enum>(1)</enum><header>Alliance</header><text>The term <quote>Alliance</quote> means the Poudre Heritage Alliance, a nonprofit corporation incorporated in the State of Colorado.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph>

<paragraph id="H38A5A735C88C4281BC66478436023DC1"><enum>(3)</enum><header>Heritage area</header><text>The term <quote>Heritage Area</quote> means the Cache la Poudre River National Heritage Area established by section 103(a).</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph>

<paragraph id="H7DDCC36A6A3B4679B7CF9C95CBD06034"><enum>(4)</enum><text>in paragraph (5), by striking <quote>Corridor</quote> and inserting <quote>Heritage Area</quote>.</text></paragraph></subsection>
<subsection id="H0C152250B1E1409196CADCB2627FC31C"><enum>(c)</enum><header>Establishment and Boundaries; Landowner Withdrawal Authority</header><text>Section 103 of the Cache La Poudre River Corridor Act (<external-xref legal-doc="usc" parsable-cite="usc/16/461">16 U.S.C. 461</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/104/323">Public Law 104–323</external-xref>) is amended—</text>
<paragraph id="H51CE3AB7FC4046B8B414D1F434E942F"><enum>(1)</enum><text>in subsection (a), by striking <quote>Cache La Poudre Corridor</quote> and inserting <quote>Cache la Poudre River National Heritage Area</quote>;</text></paragraph>
<paragraph id="H458A61216F89416098CA26CD4118A837"><enum>(2)</enum><text>in subsection (b)—</text>
<subparagraph id="H701D87DB00F04CB784F2E1D5614FEEE7"><enum>(A)</enum><text>by striking <quote>the boundaries of the Corridor</quote> and inserting <quote>the boundaries of the Heritage Area</quote>;</text></subparagraph>
<subparagraph id="H176512C0FDFA428AA003AFFD02BF5958"><enum>(B)</enum><text>by striking <quote>Cache La Poudre River</quote> each place it appears and inserting <quote>Cache la Poudre River</quote>; and</text></subparagraph>
<subparagraph id="H2FB4605986734EE1BCDCB1112D0059C3"><enum>(C)</enum><text>by striking <quote>and generally depicted</quote> and all that follows through the period at the end of the matter following paragraph (19) and inserting <quote>as generally depicted on the map entitled <quote>Cache la Poudre River National Heritage Area</quote>, numbered 960/80,003, and dated April, 2004.</quote>; and</text></subparagraph></paragraph>
<paragraph id="HE68062813C464F9CBA420912A0823903"><enum>(3)</enum><text>by adding at the end the following:</text>
<quoted-block id="HBEAB507EB58043F0B408221CDE392DD0" style="OLC">
<subsection id="H312735FB484F47178BB66F1C1C243E26"><enum>(d)</enum><header>Management Entity</header><text>The Alliance shall be the management entity for the Heritage Area.</text></subsection>
<subsection id="HA224CFCFB273443392477F857BEF9A0"><enum>(e)</enum><header>Landowner Withdraw</header><text>Any owner of private property included within the boundaries of the Heritage Area shall have that property immediately removed from the boundaries of the Heritage Area by submitting a written request to the Alliance.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section>
<section id="H026A132100E74EA5A2BF1F4FD3429"><enum>3.</enum><header>Poudre heritage alliance</header><text display-inline="no-display-inline">Section 104 of the Cache La Poudre River Corridor Act (<external-xref legal-doc="usc" parsable-cite="usc/16/461">16 U.S.C. 461</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/104/323">Public Law 104–323</external-xref>) is amended to read as follows:</text>

<section id="H727AEE0794734A1E941C875DF2DCD5D"><enum>104.</enum><header>Authorities and duties of the alliance</header>
<subsection id="H13C2CA2E455D4A96BA811BC61BB8E4A8"><enum>(a)</enum><header>Duties of the Alliance</header><text>To further the purposes of the Heritage Area, the Alliance shall—</text>
<paragraph id="HF2763A8F78054FF3B7E7D81FE11F3F3B"><enum>(1)</enum><text>prepare, obtain approval for, implement, and support the Plan in accordance with section 105;</text></paragraph>
<paragraph id="H3FD15A7C187B49EB9928F39F2BD96D44"><enum>(2)</enum><text>administer the Heritage Area;</text></paragraph>
<paragraph id="H07690FC786064AAD874CE29E016CF26F"><enum>(3)</enum><text>conduct meetings regarding the development and implementation of the Plan at least quarterly that are open to the public;</text></paragraph>
<paragraph id="H17B4292D81394B97895000F3408100B8"><enum>(4)</enum><text>for any fiscal year in which the Alliance receives Federal funds under this Act—</text>
<subparagraph id="HDB336AF48A92450C8542B9F96E96D57"><enum>(A)</enum><text>submit to the Secretary an annual report that describes the accomplishments, expenses, and income of the Alliance, including grants provided to any other entities during the fiscal year; and</text></subparagraph>
<subparagraph id="H41C3949DF25C4F8EAB8E95AED3DC4E3E"><enum>(B)</enum>
<clause id="H4FBAF49752B345ACA57C92C0419179B9" display-inline="yes-display-inline"><enum>(i)</enum><text>make available for audit all information relating to the expenditure of the Federal funds and any matching funds; and</text></clause>
<clause id="H87E08DDB3F184F8597A2D6009ECB73C" indent="up1"><enum>(ii)</enum><text>in any agreement authorizing expenditures of Federal funds by other organizations, require that the receiving organizations make available for audit all records and other information relating to the expenditure of the Federal funds;</text></clause></subparagraph></paragraph>
<paragraph id="H15D73C6FE436471086E8D68389EE5206"><enum>(5)</enum><text>encourage by appropriate means economic viability that is consistent with the purposes of the Heritage Area; and</text></paragraph>
<paragraph id="HA2994A9D0F7147EDB2D97741E5EECA21"><enum>(6)</enum><text>carry out other duties of the Alliance as required under this Act.</text></paragraph></subsection>
<subsection id="H5DB79CF096B24A5A95F0A18D22062600"><enum>(b)</enum><header>Authorities</header><text>The Alliance may, for the purposes of preparing and implementing the Plan, use Federal funds made available under this Act to—</text>
<paragraph id="H1F64C6CA5B864000A6410099394694D8"><enum>(1)</enum><text>make grants to the State of Colorado, political subdivisions of the State, nonprofit organizations, and other persons;</text></paragraph>
<paragraph id="H7A631D7CF3564C5DA9EF129DCCA076F2"><enum>(2)</enum><text>enter into cooperative agreements with, or provide technical assistance to, the State of Colorado, political subdivisions of the State, nonprofit organizations, and other interested persons;</text></paragraph>
<paragraph id="H6327013575AB43F2B189DFEB432B9155"><enum>(3)</enum><text>hire and compensate staff, including individuals with expertise in cultural, historic, and natural resources protection and heritage programming;</text></paragraph>
<paragraph id="HFC6A1E57C7B341BDAA765CFF2FFD3D8B"><enum>(4)</enum><text>obtain money or services from any source, including money or services that are provided under any other Federal law or program;</text></paragraph>
<paragraph id="H49D30AF07A65434FAA0007F9E78CF446"><enum>(5)</enum><text>contract for goods or services; and</text></paragraph>
<paragraph id="H1349C2F439AE4FF4A87FEA2F81ADF0D7"><enum>(6)</enum><text>support activities that—</text>
<subparagraph id="H4CA96936603D47389075ED94A9273763"><enum>(A)</enum><text>further the purposes of the Heritage Area; and</text></subparagraph>
<subparagraph id="HD095DD660A0A4E8F9EEF76CCCA43F126"><enum>(B)</enum><text>are consistent with the approved Plan.</text></subparagraph></paragraph></subsection>
<subsection id="HFAFB834CE0024945B9BF0771FD92A6E7"><enum>(c)</enum><header>Acquisition of Land and Real Property</header>
<paragraph id="H82039599E6104D30BE28E218025B2300"><enum>(1)</enum><header>Acquisition of real property</header>
<subparagraph id="H58E95FCF50A84D61AC71A1E777832507"><enum>(A)</enum><header>Prohibition on use of federal funds</header><text>The Alliance shall not use Federal funds received under this Act to acquire real property.</text></subparagraph>
<subparagraph id="H2557BB8350DE400DA8AA93F09B79F9F5"><enum>(B)</enum><header>Other funds</header><text>Notwithstanding subparagraph (A), the Alliance may acquire real property using any other source of funding, including other Federal funding.</text></subparagraph></paragraph>
<paragraph id="HCDE6F5F2F9094A50BF41ADC0ADA9CE78"><enum>(2)</enum><header>Acquisition of land from willing sellers</header><text>No land or interest in land may be acquired by the Secretary or the Alliance under this Act without the consent of the owner of the land or interest.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section id="H2E4A73EBCED944D9B05664E255E8CCA3"><enum>4.</enum><header>Cache la poudre river national heritage area management plan</header>
<subsection id="HB416AC15A9064650BDF287DB14BFB85"><enum>(a)</enum><header>In General</header><text>The Cache La Poudre River Corridor Act (<external-xref legal-doc="usc" parsable-cite="usc/16/461">16 U.S.C. 461</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/104/323">Public Law 104–323</external-xref>) is amended by striking sections 105 through 109 and inserting the following:</text>
<quoted-block id="HD00438289C3F42A899456383290074BD" style="OLC">
<section id="H788FE30426744BD5A4C5D92374FF2895"><enum>105.</enum><header>Cache la poudre river national heritage area management plan</header>
<subsection id="HED904EEA18574C49AA218D45FFDD1B14"><enum>(a)</enum><header>Requirements</header><text>The Alliance shall prepare and submit to the Secretary for approval a management plan for the Heritage Area that—</text>
<paragraph id="H5EEA0E1ECA4A47EBA2D5729724804BE9"><enum>(1)</enum><text>describes comprehensive policies, goals, strategies, and recommendations for—</text>
<subparagraph id="HECEB827D600E47F987A29C42D7420000"><enum>(A)</enum><text>telling the story of the heritage of the Heritage Area; and</text></subparagraph>
<subparagraph id="H5693825F14CD4C2F90DC46C5962823C"><enum>(B)</enum><text>encouraging long-term resource protection, enhancement, interpretation, funding, management, and development of the Heritage Area;</text></subparagraph></paragraph>
<paragraph id="H8EE35892D6254A62A225881018C4004D"><enum>(2)</enum><text>includes a description of actions and commitments that State and local governments, private organizations, and citizens in the Heritage Area will take to protect, enhance, and interpret the cultural, historic, natural, and scenic resources of the Heritage Area;</text></paragraph>
<paragraph id="H36843C57FE0549C78564AF383E7CD524"><enum>(3)</enum><text>specifies existing and potential sources of funding or economic development strategies to protect, enhance, interpret, fund, manage, and develop the Heritage Area;</text></paragraph>
<paragraph id="HC52511C3E4BE4FE5AE3DAE8D5DA27891"><enum>(4)</enum><text>includes an inventory of the cultural, educational, historical, natural, recreational, and scenic resources of the Heritage Area and associated sites relating to the stories and themes of the region that should be protected, enhanced, managed or developed;</text></paragraph>
<paragraph id="H6802603B7D3941669EF39128E00E362"><enum>(5)</enum><text>recommends policies and strategies for resource management, including the development of intergovernmental and interagency agreements to protect the cultural, educational, historic, natural, recreational, and scenic resources of the Heritage Area;</text></paragraph>
<paragraph id="H02B0AD426B6040BDB2F8DA36B5D45BBB"><enum>(6)</enum><text>describes a program of implementation for the Plan, including—</text>
<subparagraph id="HB8B1B2CA8617435DAF00A5361CFB1EC"><enum>(A)</enum><text>performance goals;</text></subparagraph>
<subparagraph id="HDE6F1C6D076341DCBAC71643009F442F"><enum>(B)</enum><text>plans for resource protection, enhancement, and interpretation; and</text></subparagraph>
<subparagraph id="H88745FAD0A1C487897B9C5E1FD1E87D"><enum>(C)</enum><text>specific commitments for implementation that have been made by the Alliance or any government, organization, business, or individual in the Heritage Area;</text></subparagraph></paragraph>
<paragraph id="H1876CB6A96B0467EA44E1281E0D50034"><enum>(7)</enum><text>includes an analysis of, and recommendations for, ways in which Federal, State, and local programs may best be coordinated to further the purposes of this Act, including an analysis of the role of the National Park Service and other Federal agencies associated with the Heritage Area; and</text></paragraph>
<paragraph id="HAC26CE9A3001465682B120FA28C696E9"><enum>(8)</enum><text>includes a business plan that—</text>
<subparagraph id="H5BE96BDE14054008B138DBDDAEFF927"><enum>(A)</enum><text>describes the role, operation, financing, and functions of—</text>
<clause id="H5A0F94B87296447B9C36C0903E465C89"><enum>(i)</enum><text>the Alliance; and</text></clause>
<clause id="H0FE755A30B184B53AD26323261FAC215"><enum>(ii)</enum><text>each of the major activities included in the Plan; and</text></clause></subparagraph>
<subparagraph id="HB52B4894BCBD464D99C9FDC238DF8699"><enum>(B)</enum><text>provides adequate assurances that the Alliance has the partnerships and financial and other resources necessary to implement the Plan.</text></subparagraph></paragraph></subsection>
<subsection id="HB88FF6090E0C4B57A2EDCDBCB7FF2E50"><enum>(b)</enum><header>Termination of Funding</header><text>If the Plan is not submitted to the Secretary in accordance with this section, the Secretary shall not provide to the Alliance any additional financial assistance under this Act until the Plan is submitted to and approved by the Secretary under this section.</text></subsection>
<subsection id="H17DCBC48AB2D4341965DA6009C0038C7"><enum>(c)</enum><header>Approval of Plan</header>
<paragraph id="H67DC2343C6674F1EB1ED4D5D0011A91B"><enum>(1)</enum><header>Review</header><text>Not later than 180 days after the date of receipt of the management plan under subsection (a), the Secretary, in consultation with the Governor, shall review and approve or disapprove the Plan.</text></paragraph>
<paragraph id="H8A1A409FBEDB413A8091B973E15B6745"><enum>(2)</enum><header>Criteria</header><text>In determining whether to approve the Plan, the Secretary shall consider whether—</text>
<subparagraph id="H740E16758A2F481AA9CBC601D4D26517"><enum>(A)</enum><text>the Alliance is representing the diverse interests of the Heritage Area, including—</text>
<clause id="H6B2A6BEA72D64469A69C17B6FA6914E2"><enum>(i)</enum><text>governments;</text></clause>
<clause id="H4FBDE65345984DD38ED742557CEAB5EA"><enum>(ii)</enum><text>natural and historic resource protection organizations;</text></clause>
<clause id="HC8BE16E2E4EA4A1E852F82472B61E748"><enum>(iii)</enum><text>educational institutions;</text></clause>
<clause id="H0048F3A1FCE642A1891CB79C2D758CA8"><enum>(iv)</enum><text>businesses;</text></clause>
<clause id="H843EB20D34C1496EBB63182E3DD9370"><enum>(v)</enum><text>recreational organizations;</text></clause>
<clause id="H410123015F0A48B28F7D6D901E8EB54B"><enum>(vi)</enum><text>community residents; and</text></clause>
<clause id="H440512BA25194715BBD4C365F7D088C"><enum>(vii)</enum><text>private property owners;</text></clause></subparagraph>
<subparagraph id="H2162A1E25DEC492CA09F61001DE7FEF6"><enum>(B)</enum><text>the Alliance provided adequate opportunity, workshops, and hearings for public and governmental involvement in the preparation of the Plan;</text></subparagraph>
<subparagraph id="HFC720D3A5E884980AA3516886600C54D"><enum>(C)</enum><text>the Alliance includes provisions for at least semiannual public meetings to ensure adequate implementation of the Plan;</text></subparagraph>
<subparagraph id="HF2870E26F7DB4D10BA674743B000B24C"><enum>(D)</enum><text>the resource protection and interpretation strategies in the Plan would adequately protect, enhance, and interpret the cultural, historic, natural, and scenic resources of the Heritage Area;</text></subparagraph>
<subparagraph id="HF74F3C51E7F4419F8093B56D74149234"><enum>(E)</enum><text>the Plan would adversely affect any activities authorized on Federal land under public land laws or land use plans;</text></subparagraph>
<subparagraph id="H77B59A4B6C21461C98D959490045B2A8"><enum>(F)</enum><text>the Alliance has demonstrated financial capability, in partnership with others, to carry out the Plan;</text></subparagraph>
<subparagraph id="HD5F3027DA46449C7B6E218D9522673B2"><enum>(G)</enum><text>the Secretary has received adequate assurances from the appropriate State and local officials, the support of which is needed to ensure the effective implementation of the State and local aspects of the Plan; and</text></subparagraph>
<subparagraph id="H143AB31074B147A688FBA3237721A06D"><enum>(H)</enum><text>the Plan demonstrates partnerships among the Alliance, Federal, State, and local governments, regional planning organizations, nonprofit organizations, or private-sector parties for implementation of the Plan.</text></subparagraph></paragraph>
<paragraph id="H6C3AC807D9D646ECA939264DA6596F31"><enum>(3)</enum><header>Action following disapproval</header><text>If the Secretary disapproves the Plan under paragraph (1), the Secretary shall—</text>
<subparagraph id="H6EE0605C32C94749BF27A4CB883951A9"><enum>(A)</enum><text>advise the Alliance in writing of the reasons for the disapproval;</text></subparagraph>
<subparagraph id="HAAAAC7F809344BD3BFC6F0FAF892865D"><enum>(B)</enum><text>make recommendations for revisions to the Plan; and</text></subparagraph>
<subparagraph id="H92FD24080C4C42EC8C85C0E3904CEA2"><enum>(C)</enum><text>not later than 180 days after the date of receipt of a proposed revision to the Plan, approve or disapprove the proposed revision.</text></subparagraph></paragraph>
<paragraph id="H4E5EEBE5CFEF4C230012B0FF8D25017F"><enum>(4)</enum><header>Amendments</header>
<subparagraph id="H4A3BB19544A34BD79E004E4B6C1F93DC"><enum>(A)</enum><header>In general</header><text>The Secretary shall review and approve or disapprove each amendment to the Plan that the Secretary determines may substantially alter the purposes of the Heritage Area.</text></subparagraph>
<subparagraph id="HB6982B234494497800A2F52383A7E58E"><enum>(B)</enum><header>Use of funds</header><text>Funds made available under this Act shall not be expended by the management entity to implement an amendment described in subparagraph (A) until the Secretary approves the amendment.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<paragraph id="H158FBFAE8C614CDCA5A8A28625561C5E"><enum>(1)</enum><header>In general</header><text>The Secretary may enter into cooperative agreements with the Alliance for the purpose of carrying out the Plan.</text></paragraph>
<paragraph id="H1FFDF2599EB34C9490430850CBD36F77"><enum>(2)</enum><header>Requirements</header><text>Any cooperative agreement shall, at a minimum, establish procedures for providing notice to the Alliance of any action that may affect the implementation of the Plan.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>

<section id="H4DE282786E6C44BAAF66B004FF9FFB9F"><enum>7.</enum><header>Effect on environmental and other standards, restrictions, and savings provisions</header><text display-inline="no-display-inline">Section 108 of the Cache La Poudre River Corridor Act (<external-xref legal-doc="usc" parsable-cite="usc/16/461">16 U.S.C. 461</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/104/323">Public Law 104–323</external-xref>) (as redesignated by section 4(b)) is amended—</text>
<paragraph id="H6720D3BE2E4440BABF89B9C281EB952"><enum>(1)</enum><text>in subsection (a)(1), by adding at the end the following: <quote>No privately owned property shall be preserved, conserved, or promoted by the Plan unless and until the owner of that private property gives the Alliance written consent for such preservation, conservation, or promotion after receiving written notification from the Alliance of the proposed preservation, conservation, or promotion.</quote>;</text></paragraph>
<paragraph id="H758BE42553C24FA9B929B4300375E2EE"><enum>(2)</enum><text>by striking subsections (c) and (d) and inserting the following:</text>

<subsection id="H5C4886D1E3334C6AA2F64E4BE5DB17DC"><enum>(c)</enum><header>Savings Provision</header><text>Nothing in this Act—</text>
<paragraph id="HDF0D5108B8DA49BCB133B472B58EE297"><enum>(1)</enum><text>diminishes, enlarges, or modifies a right of a Federal agency, State agency, or political subdivision of the State—</text>
<subparagraph id="H739060AA5F104485803900658F62222F"><enum>(A)</enum><text>to exercise civil and criminal jurisdiction within the Heritage Area; or</text></subparagraph>
<subparagraph id="H1B3BE43FDD564CB682B441ADDD1CF79D"><enum>(B)</enum><text>to tax persons, corporations, franchises, or property, including minerals and other interests in or on land or water within the urban portions of the Heritage Area;</text></subparagraph></paragraph>
<paragraph id="HCA895672D8814C8D85D00330A185F34"><enum>(2)</enum><text>authorizes the regulation of private land in the Heritage Area;</text></paragraph>
<paragraph id="HE173BBDE44654377A5AEF2960A45475"><enum>(3)</enum><text>authorizes the imposition of any mandatory streamflow requirements in the Heritage Area;</text></paragraph>
<paragraph id="H894B6D5EC8B8469FB76BA2FB75DE1CC5"><enum>(4)</enum><text>creates an express or implied Federal reserved water right;</text></paragraph>
<paragraph id="H7940F74F0C1C47D1A2A660521F31B0AB"><enum>(5)</enum><text>imposes any Federal water quality standard within or upstream of the Heritage Area that is more restrictive than would be applicable had the Heritage Area not been established; or</text></paragraph>
<paragraph id="HC6D01891648A485DA7815D009BE1469D"><enum>(6)</enum><text>prevents the State of Colorado from acquiring an instream flow through the Heritage Area under the terms, conditions, and limitations of State law to assist in protecting the natural environment to the extent and for the purposes authorized by State law.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph>
<paragraph id="H2B48735E39CA4C8493EEAC6011959429"><enum>(3)</enum><text>by striking <quote>Corridor</quote> each place it appears and inserting <quote>Heritage Area</quote>; and</text></paragraph>
<paragraph id="HB3876890C7A848109B855FA2F540BC60"><enum>(4)</enum><text>by striking <quote>Commission</quote> each place it appears and inserting <quote>Alliance</quote>.</text></paragraph></section>
<section id="H668F0D17B93D441B82E96DFD2451DC20"><enum>8.</enum><header>Private property protections</header><text display-inline="no-display-inline">The Cache La Poudre River Corridor Act (<external-xref legal-doc="usc" parsable-cite="usc/16/461">16 U.S.C. 461</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/104/323">Public Law 104–323</external-xref>) is amended by inserting after section 108 (as redesignated by section 4(b) and amended by section 7) the following:</text>

<section id="H9C71EF951A3E4F71B79720E68850DD23"><enum>109.</enum><header>Private property protection</header>
<subsection id="HFB21870A701A47F8B674B89D88DC7D81"><enum>(a)</enum><header>Access to Private Property</header><text>Nothing in this Act shall be construed to—</text>
<paragraph id="HA337FC097BBE42E791B04D78813359A5"><enum>(1)</enum><text>require any private property owner to allow public access (including Federal, State, or local government access) to such private property; or</text></paragraph>
<paragraph id="H749645CEFA164A448BEF572D1EE7AB17"><enum>(2)</enum><text>modify any provision of Federal, State, or local law with regard to public access to or use of private property.</text></paragraph></subsection>
<subsection id="HC145A58F76EC4D35BEB28BFA4304EECC"><enum>(b)</enum><header>Liability</header><text>Designation of the Heritage Area shall not be considered to create any liability, or to have any effect on any liability under any other law, of any private property owner with respect to any persons injured on such private property.</text></subsection>
<subsection id="H03FB1C6C81874D80B4029DAC34CAECBE"><enum>(c)</enum><header>Recognition of Authority to Control Land Use</header><text>Nothing in this Act shall be construed to modify the authority of Federal, State, or local governments to regulate land use.</text></subsection>
<subsection id="HA7BEDB1A9A5B41349586ED5B717B50F6"><enum>(d)</enum><header>Participation of Private Property Owners in Heritage Area</header><text>Nothing in this Act shall be construed to require the owner of any private property located within the boundaries of the Heritage Area to participate in or be associated with the Heritage Area.</text></subsection>
<subsection id="HC1673EBEBB50403095827838525003EC"><enum>(e)</enum><header>Effect of Establishment</header><text>The boundaries designated for the Heritage Area represent the area within which Federal funds appropriated pursuant to the authorization of appropriations in section 110 may be expended. The establishment of the Heritage Area and its boundaries shall not be construed to provide any nonexisting regulatory authority on land use within the Heritage Area or its viewshed by the Secretary, the National Park Service, or the Alliance.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section id="HFD414B21BE3C48AFA87400E073550786"><enum>9.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">Section 110 of the Cache La Poudre River Corridor Act (<external-xref legal-doc="usc" parsable-cite="usc/16/461">16 U.S.C. 461</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/104/323">Public Law 104–323</external-xref>) (as redesignated by section 4(b)) is amended to read as follows:</text>

<section id="HFA3E9285DF05414C994B7D7CAF22295"><enum>110.</enum><header>Authorization of appropriations</header>
<subsection id="H9F3979AD88A547848836C6E4769C0899"><enum>(a)</enum><header>In General</header><text>There are authorized to be appropriated to carry out this Act—</text>
<paragraph id="H0559263192FC4E3FA7FE71F82456B1EB"><enum>(1)</enum><text>not more than $100,000 for any fiscal year; and</text></paragraph>
<paragraph id="H39F4C71A33C04C9A9974933FD1F1EDD8"><enum>(2)</enum><text>not more than a total of $1,000,000.</text></paragraph></subsection>
<subsection id="H7E39DAA2F8724A12BE12AFBF0700DBB"><enum>(b)</enum><header>Availability</header><text>Funds appropriated pursuant to the authorization of appropriations in subsection (a) shall remain available until expended.</text></subsection>
<subsection id="H6C544394D8054596BCBD0198225FBD00"><enum>(c)</enum><header>Matching Funds</header>
<paragraph id="H8CAEFA8C0CAA42B200EDFA6E25BD1453"><enum>(1)</enum><header>In general</header><text>As a condition of providing a grant under this Act to the Alliance, the Secretary shall require that the Alliance provide matching funds equal to the amount of the grant.</text></paragraph>
<paragraph id="H935232967C5840EFA900A4E57B9F2CCB"><enum>(2)</enum><header>Form</header><text>Matching funds—</text>
<subparagraph id="H021C6507DAE74D2EA102C12D7FE1394E"><enum>(A)</enum><text>shall be from non-Federal sources; and</text></subparagraph>
<subparagraph id="HE98FFB2218A94FC8A89CF96735005580"><enum>(B)</enum><text>may be made in the form of in-kind contributions of goods or services fairly valued.</text></subparagraph></paragraph></subsection>
<subsection id="H3F9E8AEAD5554C52B5B0924ECAAC6394"><enum>(d)</enum><header>Administrative Expenses</header><text>Not more than 5 percent of the funds appropriated pursuant to the authorization of appropriations in subsection (a) for a fiscal year may be used by the Secretary for technical assistance, oversight, and administrative purposes.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section id="H408D1AFD31CE4ACFBCE52F8290F8C314"><enum>10.</enum><header>Termination of authority; references in law</header><text display-inline="no-display-inline">The Cache La Poudre River Corridor Act (<external-xref legal-doc="usc" parsable-cite="usc/16/461">16 U.S.C. 461</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/104/323">Public Law 104–323</external-xref>) is amended by adding at the end the following:</text>

<subsection id="H492EFE9F366545B5808F3B2C67364652"><enum>(a)</enum><header>Federal Laws and Documents</header><text>Any reference in any law (other than this Act), regulation, document, record, map, or other paper of the United States to <quote>Cache La Poudre River Corridor</quote> or <quote>Cache La Poudre Corridor</quote> shall be considered to be a reference to the <quote>Cache la Poudre River National Heritage Area</quote>.</text></subsection>
<subsection id="H49B381E2A3B64863B391E6DD8E8F362F"><enum>(b)</enum><header>Other Signs and Notices</header><text>Any directional or official sign or notice relating to <quote>Cache La Poudre River Corridor</quote> or <quote>Cache La Poudre Corridor</quote> shall be considered to be a reference to the <quote>Cache la Poudre River National Heritage Area</quote>.</text></subsection></section>
<section id="HB2A9E6BE62A14C11AA10B59C85FA2693"><enum>112.</enum><header>Termination of authority</header><text display-inline="no-display-inline">The authority of the Secretary to provide financial assistance to the Alliance (excluding technical assistance and administrative oversight) under this Act shall terminate 10 years after the date of enactment of the Cache la Poudre River National Heritage Area Technical Amendments Act of 2007.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
