		<section display-inline="no-display-inline" id="H56EE8AE2C55943F68037C55B0005329" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Screening Applied Fairly and Equitably
			 to Truckers Act of 2008</short-title></quote> or the <quote><short-title>SAFE Truckers Act of 2008</short-title></quote>.</text>
		</section><title id="H39D716B792BE4925825871F017D47CE"><enum>I</enum><header>Surface
			 transportation security</header>
			<section id="HAC79C54B0F974DA9B9D612DC58CC2758"><enum>101.</enum><header>Surface
			 transportation security</header>
				<subsection id="H446C84A4A44A4A73A8EDC8D68E662219"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Homeland Security
			 Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/101">6 U.S.C. 101 et seq.</external-xref>) is amended by adding at the end the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="HA9846F63A497494F94736422B00373E" style="OLC">
						<title id="H5BF5E6A0CE054B929F1082544C1E7CB0"><enum>XXI</enum><header>Surface
				transportation security</header>
							<section id="H0DD1EA6F87634968ADBAC9488751EAA5"><enum>2101.</enum><header>Designation of
				security sensitive material</header>
								<subsection id="H29A3621A72C44C109DB1443EEF490020"><enum>(a)</enum><header>Designation</header><text>The
				Secretary shall designate a material, or a group or class of material, in a
				particular amount and form as security sensitive when the Secretary determines
				that transporting the material by motor vehicle in commerce poses a significant
				risk to national security due to the potential use of the material in an act of
				terrorism.</text>
								</subsection><subsection id="H272AB73F6809494FA0FEFA8DEE17EBD"><enum>(b)</enum><header>Consultation</header><text>In
				carrying out subsection (a), the Secretary shall consult with—</text>
									<paragraph id="H1AC182C5AB4442C9AB633FF6FA5D3149"><enum>(1)</enum><text>the Secretary of
				Health and Human Services on the inclusion of chemical or biological materials
				or agents; and</text>
									</paragraph><paragraph id="HB84BE08DCD344EECA419769D93F40501"><enum>(2)</enum><text>the Secretary of
				Transportation, as appropriate.</text>
									</paragraph></subsection><subsection id="H40061DCB49CA45329C1365D05BF5F87"><enum>(c)</enum><header>Notice and
				comment</header><text>The Secretary shall make the designations under
				subsection (a) by regulation after providing notice and an opportunity for
				public comment.</text>
								</subsection></section><section id="H31E26C74D92E4910A360F878F8D9000"><enum>2102.</enum><header>Transportation
				of security sensitive materials</header>
								<subsection id="H5210E9A313F745AB8727006791574D5F"><enum>(a)</enum><header>Motor vehicle
				operators</header><text display-inline="yes-display-inline">The Secretary shall
				prohibit an individual from operating a motor vehicle in commerce while
				transporting a security sensitive material unless the individual holds a
				transportation security card issued by the Secretary under section 70105 of
				title 46, United States Code.</text>
								</subsection><subsection id="H79650C5453F14375A9B4195BFF6850F9"><enum>(b)</enum><header>Shippers</header><text display-inline="yes-display-inline">The Secretary shall prohibit a person
				from—</text>
									<paragraph id="H0EDC04FC58FB41F19172DA45ED673E99"><enum>(1)</enum><text>offering a
				security sensitive material for transportation by motor vehicle in commerce;
				or</text>
									</paragraph><paragraph id="H8B663E5269AC4A66B995650011A0D713"><enum>(2)</enum><text display-inline="yes-display-inline">causing a security sensitive material to be
				transported by motor vehicle in commerce,</text>
									</paragraph><continuation-text continuation-text-level="subsection">unless
				the motor vehicle operator transporting the security sensitive material holds a
				valid transportation security card.</continuation-text></subsection></section><section display-inline="no-display-inline" id="H753AE7667B1B488CA02471B95B84B6CB" section-type="subsequent-section"><enum>2103.</enum><header>Enrollment
				locations</header><text display-inline="no-display-inline">The Secretary
				shall—</text>
								<paragraph id="H6688C517EC1E4FD48E616660EBE80088"><enum>(1)</enum><text display-inline="yes-display-inline">work with appropriate entities to ensure
				that fingerprinting locations for individuals applying for a transportation
				security card under <external-xref legal-doc="usc" parsable-cite="usc/46/70105">section 70105</external-xref> of title 46, United States Code, have
				flexible operating hours; and</text>
								</paragraph><paragraph id="HAB2B36066D3D496182591C0700B2AD4C"><enum>(2)</enum><text>permit an
				individual applying for a transportation security card to utilize a
				fingerprinting location outside of the individual’s State of residence to the
				greatest extent practicable.</text>
								</paragraph></section><section id="H48B864AF44A845969D39FB52F227EAC1"><enum>2104.</enum><header>Authority to
				ensure compliance</header>
								<subsection id="HE5843E8E078243388D12D5B7C0E12754"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary is
				authorized to ensure compliance with this title.</text>
								</subsection><subsection id="HB83C8B362D10461D8EEF402947C448F6"><enum>(b)</enum><header>Memorandum of
				understanding</header><text>The Secretary may enter into a memorandum of
				understanding with the Secretary of Transportation to ensure compliance with
				sections 2102 and 2107(b).</text>
								</subsection></section><section id="HC5C6F8118BFD47E38568BD8CBC8755C0"><enum>2105.</enum><header>Civil
				penalties</header>
								<subsection id="H7DB642EAF3F34E3B8D1791053B070061"><enum>(a)</enum><header>Penalty</header>
									<paragraph display-inline="no-display-inline" id="H2EC72C6387564C6DAFFA6B5C945E0060"><enum>(1)</enum><header>In
				general</header><text>A person that violates this title or a regulation or
				order issued under this title is liable to the United States Government for a
				civil penalty of at least $250 but not more than $75,000 for each
				violation.</text>
									</paragraph><paragraph id="H9CF122587B93425EA31CCB5800ADEB65"><enum>(2)</enum><header>Increased
				penalties</header><text>If the Secretary finds that a violation under paragraph
				(1) results in a transportation security incident, the Secretary may increase
				the amount of the civil penalty for such violation to not more than
				$100,000.</text>
									</paragraph><paragraph id="H25BB302881AA407AB578C4447145D455"><enum>(3)</enum><header>Separate
				violations</header><text>A separate violation occurs for each day the violation
				continues.</text>
									</paragraph></subsection><subsection id="H39DD9B246588443FBE676115F98EA20"><enum>(b)</enum><header>Hearing
				Requirement</header><text>The Secretary may find that a person has violated
				this title or a regulation or order issued under this title only after notice
				and an opportunity for a hearing. The Secretary shall impose a penalty under
				this section by giving the person written notice of the amount of the
				penalty.</text>
								</subsection><subsection id="H591411E1CFF54F7BA16D220099FE47D"><enum>(c)</enum><header>Penalty
				Considerations</header><text>In determining the amount of a civil penalty under
				this section, the Secretary shall consider—</text>
									<paragraph id="HE26B7A4B766741F08C93C31E479F077B"><enum>(1)</enum><text>the nature,
				circumstances, extent, and gravity of the violation;</text>
									</paragraph><paragraph id="H9A72FDB05F5F433389E77800BD4151FC"><enum>(2)</enum><text>with respect to
				the violator, the degree of culpability, any history of prior violations, the
				ability to pay, and any effect on the ability to continue to do business;
				and</text>
									</paragraph><paragraph id="H6BE804A7235540A4A7CFDEE7EC36BA6"><enum>(3)</enum><text>other matters that
				justice requires.</text>
									</paragraph></subsection><subsection id="H97D5C3940F344138BBBA989E4183D3F2"><enum>(d)</enum><header>Civil Actions To
				Collect</header><text>The Attorney General may bring a civil action in an
				appropriate district court of the United States to collect a civil penalty
				under this section and any accrued interest on the civil penalty as calculated
				in accordance with section 1005 of the Oil Pollution Act of 1990 (33 U.S.C.
				2705). In the civil action, the amount and appropriateness of the civil penalty
				shall not be subject to review.</text>
								</subsection><subsection id="HA8C0754291234603AFA9C71565500063"><enum>(e)</enum><header>Compromise</header><text display-inline="yes-display-inline">The Secretary may compromise the amount of
				a civil penalty imposed under this section before referral to the Attorney
				General.</text>
								</subsection><subsection id="H60D50BAA15394067AD13DE54FC1413F"><enum>(f)</enum><header>Setoff</header><text>The
				Government may deduct the amount of a civil penalty imposed or compromised
				under this section from amounts it owes the person liable for the
				penalty.</text>
								</subsection><subsection id="H9BD9320C3708410F8F514B10E0F3E112"><enum>(g)</enum><header>Depositing
				Amounts Collected</header><text>Amounts collected under this section shall be
				deposited in the Treasury as miscellaneous receipts.</text>
								</subsection></section><section id="H2ED52CEF39FD4E0ABB918E46B4938EBD"><enum>2106.</enum><header>Criminal
				penalties</header><text display-inline="no-display-inline">A person that
				willfully violates this title or a regulation or order issued under this title
				shall be fined under title 18, United States Code, imprisoned for not more than
				5 years, or both; except that the maximum amount of imprisonment shall be 10
				years in any case in which the violation results in a transportation security
				incident.</text>
							</section><section id="H7D7DCBD26B514E7A9B66DDDD008F001E"><enum>2107.</enum><header>Enforcement</header>
								<subsection commented="no" display-inline="no-display-inline" id="H4F813C385D1F4FA29B483D405F1F0088"><enum>(a)</enum><header>In
				general</header><text>At the request of the Secretary, the Attorney General may
				bring a civil action in an appropriate district court of the United States to
				enforce this title or a regulation or order issued under this title. The court
				may award appropriate relief, including a temporary or permanent injunction,
				punitive damages, and assessment of civil penalties considering the same
				penalty amounts and factors as prescribed for the Secretary in an
				administrative case under section 2105.</text>
								</subsection><subsection display-inline="no-display-inline" id="H63D890E94A3A4764AEF150FFC84D298E"><enum>(b)</enum><header>Imminent
				security hazards</header>
									<paragraph display-inline="no-display-inline" id="H13567DD46E214991009830B925980058"><enum>(1)</enum><header>In
				general</header><text>If the Secretary has reason to believe that an imminent
				security hazard exists, the Secretary may bring a civil action in an
				appropriate district court of the United States—</text>
										<subparagraph id="HC7581714BD00479BAA0207C29592AFB"><enum>(A)</enum><text>to suspend or
				restrict the transportation of the security sensitive material responsible for
				the hazard; or</text>
										</subparagraph><subparagraph id="H9ED2840FB7524D4BB03891B41E8EB18"><enum>(B)</enum><text>to eliminate or
				mitigate the hazard.</text>
										</subparagraph></paragraph><paragraph id="H6ED7D51EAF2A4AC78403B2A7690785B1"><enum>(2)</enum><header>Actions by the
				Attorney General</header><text>On request of the Secretary, the Attorney
				General shall bring an action under paragraph (1).</text>
									</paragraph></subsection></section><section id="H761EAABDFC024526A786E52EEAEA856E"><enum>2108.</enum><header>Commercial
				motor vehicle operators registered to operate in Mexico or Canada</header><text display-inline="no-display-inline">A commercial motor vehicle operator
				registered to operate in Mexico or Canada shall not operate a commercial motor
				vehicle transporting a security sensitive material in commerce in the United
				States until the operator has undergone a background records check similar to
				the background records check required for commercial motor vehicle operators
				licensed in the United States to transport security sensitive materials in
				commerce.</text>
							</section><section id="H07B152CE1C3F4E718F7D8733E148E1E"><enum>2109.</enum><header>Transition</header>
								<subsection id="H82B56DFC11F0495B8E9E157D005B5285"><enum>(a)</enum><header>Treatment of
				individuals receiving prior hazardous materials endorsements</header><text>An
				individual who has obtained a hazardous materials endorsement in accordance
				with <external-xref legal-doc="regulation" parsable-cite="cfr/49/1572">section 1572</external-xref> of title 49, Code of Federal Regulations, before the date of
				enactment of this title, shall be treated as having met the background check
				requirements of the transportation security card under section 70105 of title
				46, United States Code, subject to reissuance or expiration dates as determined
				by the Secretary.</text>
								</subsection><subsection id="H9CB336D4F9BD4F09A6AE80E02F9945F"><enum>(b)</enum><header>Reduction in
				fees</header><text>The Secretary shall reduce, to the great extent practicable,
				any fees associated with obtaining a transportation security card under section
				70105 of title 46, United Sates Code, for any individual referred to in
				subsection (a).</text>
								</subsection></section><section id="H891843DB749549859994B9DE31C6BAAB"><enum>2110.</enum><header>Savings
				clause</header><text display-inline="no-display-inline">Nothing in the title
				shall be construed as affecting the authority of the Secretary of
				Transportation to regulate hazardous materials under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/51">chapter 51</external-xref> of title 49,
				United States Code.</text>
							</section><section id="HCEE681A15BE042AE89944E00EF6039B"><enum>2111.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title, the following definitions
				apply:</text>
								<paragraph id="H7666EA971C934EC4B000181D473959DA"><enum>(1)</enum><header>Commerce</header><text>The
				term <quote>commerce</quote> means trade or transportation in the jurisdiction
				of the United States—</text>
									<subparagraph id="HD3B27F35753E4913A88100927B50A418"><enum>(A)</enum><text>between a place in
				a State and a place outside of the State; or</text>
									</subparagraph><subparagraph id="H10675A27B4CF47459FE1A1C01596D468"><enum>(B)</enum><text>that affects trade
				or transportation between a place in a State and a place outside of the
				State.</text>
									</subparagraph></paragraph><paragraph id="HD765AC2FAC4D49C3A664227800D600AF"><enum>(2)</enum><header>Hazardous
				material</header><text display-inline="yes-display-inline">The term
				<quote>hazardous material</quote> means a substance or material the Secretary
				of Transportation designates under <external-xref legal-doc="usc" parsable-cite="usc/49/5103">section 5103(a)</external-xref> of title 49, United States
				Code.</text>
								</paragraph><paragraph id="HB316D24E85184104B54F1700CEAC0176"><enum>(3)</enum><header>Imminent
				security hazard</header><text>The term <quote>imminent security hazard</quote>
				means the existence of a condition relating to security sensitive materials
				that—</text>
									<subparagraph id="H008EB1E72B8D499FA5DAF24F56C158D7"><enum>(A)</enum><text>presents a
				substantial likelihood of a transportation security incident; and</text>
									</subparagraph><subparagraph id="H662D3185A7384CB8AF5F75F858AB1E81"><enum>(B)</enum><text>may occur before
				the reasonably foreseeable completion date of a formal proceeding begun to
				lessen the risk of that incident.</text>
									</subparagraph></paragraph><paragraph id="HD2808B82DD3942A1846E032BF42EA65"><enum>(4)</enum><header>Person</header><text>The
				term <quote>person</quote>, in addition to its meaning under section 1 of title
				1, United States Code—</text>
									<subparagraph id="HCA3E9D2DA5E045BC818E261300F642B9"><enum>(A)</enum><text>includes a
				government, Indian tribe, or authority of a government or tribe offering
				security sensitive material for transportation in commerce or transporting
				security sensitive material to further a commercial enterprise; but</text>
									</subparagraph><subparagraph id="H1E21CAD9BCBA4C239CE9EABDCFC5C58"><enum>(B)</enum><text>does not
				include—</text>
										<clause id="HAB91EFCC66ED4DC79C4F50D1B79ADF5"><enum>(i)</enum><text>the
				United States Postal Service; and</text>
										</clause><clause id="H5F2FE54BFFF44332A768F99406000167"><enum>(ii)</enum><text>in sections 2105
				and 2106, a department, agency, or instrumentality of the Government.</text>
										</clause></subparagraph></paragraph><paragraph id="HACE1491D50E04CD0A4260278D97BE62C"><enum>(5)</enum><header>Security
				sensitive material</header><text>The term <quote>security sensitive
				material</quote> means a substance or material in quantity and form the
				Secretary designates under section 2101.</text>
								</paragraph><paragraph id="HCA2EA821E50F4F828406D42A7069B6D"><enum>(6)</enum><header>Transports;
				transportation</header><text>The term <quote>transports</quote> or
				<quote>transportation</quote> means the movement of property and loading,
				unloading, or storage incidental to the movement.</text>
								</paragraph><paragraph commented="no" id="H909826F8F04845FA93DD408593F824CF"><enum>(7)</enum><header>Transportation
				security incident</header><text>The term <quote>transportation security
				incident</quote> has the meaning given that term by <external-xref legal-doc="usc" parsable-cite="usc/46/70101">section 70101</external-xref> of title 46,
				United States
				Code.</text>
								</paragraph></section></title><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section id="HB9D3F34645E54F09B79BB253E0214396"><enum>102.</enum><header>Conforming
			 amendment</header><text display-inline="no-display-inline">The table of
			 contents contained in section 1(b) of the Homeland Security Act of 2002 (116
			 Stat. 2135) is amended by adding at the end the following:</text>

			 issuance of hazmat licenses</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/49/5103a">Section 5103a</external-xref> of title 49, United States
			 Code, is amended—</text>
				<paragraph id="HF86FE27E14044B7BBD1CCE34FF94CF62"><enum>(1)</enum><text>by striking
			 subsection (a) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="H941864929E5443A083FFE040BDEF27AD" style="OLC">
						<subsection id="HC3D3F123C9FD45EDABCC721C55DE09BA"><enum>(a)</enum><header>Limitation</header><text display-inline="yes-display-inline">The Secretary of Homeland Security shall
				periodically conduct a name-based background check of all individuals who
				possess a license to operate a motor vehicle transporting in commerce a
				hazardous material for which the Secretary of Transportation requires
				placarding. Such a name-based check shall be conducted against the integrated
				and consolidated terrorism watch list maintained by the Federal Government and
				relevant
				databases.</text>
						</subsection><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HA1305B47E3A44FA083E0D69EE8159BB4"><enum>(2)</enum><text>by striking
			 subsections (b) and (d) and redesignating subsections (c), (e), (f), (g), and
			 (h) as subsections (b), (c), (d), (e), and (f), respectively;</text>
				</paragraph><paragraph id="HD658ED4E84C346C89F2E013241D5B1EF"><enum>(3)</enum><text>in subsection (e)
			 (as redesignated by paragraph (3) of this section)—</text>
					<subparagraph id="HAC442204DF3B46EF98254C6EDC8E009D"><enum>(A)</enum><text>by striking
			 paragraph (1) and redesignating paragraphs (2) through (5) as paragraphs (1)
			 through (4), respectively;</text>

				</paragraph></section><section commented="no" id="H52888403F73042D5BAFA9C81F096A900"><enum>104.</enum><header>Deadlines and
			 effective dates</header>
				<subsection commented="no" id="HDE77559BCDF24105A684CB7685228844"><enum>(a)</enum><header>Designation of
			 security sensitive materials</header><text>Not later than 6 months after the
			 date of enactment of this Act, the Secretary of Homeland Security shall
			 promulgate regulations establishing the list of security sensitive materials
			 under section 2101 of the Homeland Security Act of 2002 (as added by this
			 Act).</text>
				</subsection><subsection commented="no" id="H1D0694DCA2DC4D7F8F09B5D4C3BF12FB"><enum>(b)</enum><header>Issuance of
			 transportation security cards</header><text>Not later than 18 months after
			 enactment of this Act, the Secretary shall begin issuance of transportation
			 security cards under <external-xref legal-doc="usc" parsable-cite="usc/46/70105">section 70105</external-xref> of title 46, United States Code, to
			 individuals who seek to operate a motor vehicle in commerce while transporting
			 security sensitive materials.</text>
				</subsection><subsection commented="no" id="H88E370BD2C734DE4973B6C842573716C"><enum>(c)</enum><header>Effective date
			 of prohibitions</header><text>The prohibitions contained in sections 2102 and
			 2108 of the Homeland Security Act of 2002 (as added by this Act) shall take
			 effect on the date that is 3 years after the date of enactment of this
			 Act.</text>
				</subsection><subsection commented="no" id="HF8975EF8E2B543898200BE288EAA6C82"><enum>(d)</enum><header>Effective date
			 of section 103 amendments</header><text display-inline="yes-display-inline">The
			 amendments made by section 103 of this Act shall take effect on the date that
			 is 3 years after the date of enactment of this Act.</text>
				</subsection></section></title><title id="H6465227DCA6C4AA8933CDACA79B41A0"><enum>II</enum><header>Miscellaneous
			 Provisions</header>
			<section id="H4EABE734451946A8ADA6DED7BF8A5C0"><enum>201.</enum><header>Task force on
			 highway security</header>
				<subsection id="HDAC292866C8C40D5A4D699A6818DB3C5"><enum>(a)</enum><header>Establishment</header><text>The
			 Secretary of Homeland Security shall establish a task force to assess security
			 risks to motor vehicles transporting security sensitive material, including the
			 vulnerabilities of such motor vehicles to hijacking, en route sabotage, theft,
			 and insider threats.</text>
				</subsection><subsection id="HB52E7715D8BB41F4B22FA1BD95362C38"><enum>(b)</enum><header>Membership</header><text display-inline="yes-display-inline">The task force shall be composed of
			 representatives of the Department of Homeland Security, the Department of
			 Transportation, appropriate industries, including employee organizations, and
			 other appropriate entities.</text>
				</subsection><subsection id="H7494187BA1444D1D8930B8ADC6ADFF12"><enum>(c)</enum><header>Report</header><text>Not
			 later than 180 days after the date of enactment of this Act, the task force
			 shall transmit to the Secretary and Congress a report containing the results of
			 the assessment, including proposed solutions for any vulnerabilities
			 identified.</text>
				</subsection></section><section id="H1CEE61C2742A4CCBBB1F88782DC346F7"><enum>202.</enum><header>Task force on
			 disqualifying crimes</header>
				<subsection commented="no" id="H5045EC8DF2674F2BA797EAA3147FB0EB"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary of Homeland Security shall
			 establish a task force to review the lists of crimes that disqualify
			 individuals from certain transportation-related employment under current
			 regulations of the Transportation Security Administration and assess whether
			 such lists of crimes are accurate indicators of a terrorism security
			 risk.</text>
				</subsection><subsection id="H34F7EA4A101149F5B6BDD5C7DF005F5E"><enum>(b)</enum><header>Membership</header><text display-inline="yes-display-inline">The task force shall be composed of
			 representatives of appropriate industries, including representatives of
			 employee organizations, Federal agencies, and other appropriate
			 entities.</text>
				</subsection><subsection id="H684569AF7A9840DB92A4C2983BDDF00"><enum>(c)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
			 enactment of this Act, the task force shall transmit to the Secretary and
			 Congress a report containing the results of the review, including
			 recommendations for a common list of disqualifying crimes and the rationale for
			 the inclusion of each crime on the list.</text>
