<section id="H1DA98C9D015549CDB3F390D200002F4C" section-type="section-one"><enum>1.</enum><header>Nonmailability of certain tobacco products</header>
<subsection id="HADF4F4EC0C4E4794885CA09980AB04A7"><enum>(a)</enum><header>In General</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/39/30">Chapter 30</external-xref> of title 39, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/39/3002a">section 3002a</external-xref> the following:</text>

<section id="H11145BC746AE4CF789C954C48F45F38"><enum>3002b.</enum><header>Nonmailability of certain tobacco products</header>
<subsection id="H4941537C901B433BB889E6A61D770233"><enum>(a)</enum><header>In General</header><text>Cigarettes, smokeless tobacco, and roll-your-own-tobacco—</text>
<paragraph id="HE43511ABD0664C81A8F14D1727C84400"><enum>(1)</enum><text>are nonmailable matter;</text></paragraph>
<paragraph id="HD16C02A975014E78BE8F3B51378E4F69"><enum>(2)</enum><text>shall not be—</text>
<subparagraph id="H403C7DF055DC47128732F87990715854"><enum>(A)</enum><text>deposited in the mails; or</text></subparagraph>
<subparagraph id="H317D50BC6F574324A692FAE6A9C9845F"><enum>(B)</enum><text>carried or delivered through the mails; and</text></subparagraph></paragraph>
<paragraph id="HB93C6A01D6334695A87700FEA3F5FBE"><enum>(3)</enum><text>shall be disposed of as the Postal Service directs.</text></paragraph></subsection>
<subsection id="H41A15E5A9BC9468C80B32639A483DE3D"><enum>(b)</enum><header>Civil Penalty</header>
<paragraph id="H4A70272CB0A64EBD8601D148F3B38419"><enum>(1)</enum><header>In general</header><text>Any person who violates subsection (a)(2)(A) shall be liable to the United States for a civil penalty in an amount not to exceed $100,000 for each violation.</text></paragraph>
<paragraph id="HA0DD0EBBD4B143D182907807B93500F4"><enum>(2)</enum><header>Hearings</header>
<subparagraph id="H27CE4938B43B4245849852A0B9D98432"><enum>(A)</enum><header>In general</header><text>The Postal Service may determine that a person has violated subsection (a)(2)(A) only after notice and an opportunity for a hearing. Proceedings under this paragraph shall be conducted in accordance with section 3001(m).</text></subparagraph>
<subparagraph id="H3288130ED7C1470E8D55D4CDAF93E832"><enum>(B)</enum><header>Penalty considerations</header><text>In determining the amount of a civil penalty under this paragraph, the Postal Service shall consider—</text>
<clause id="H4C6D5A9867EB4D2B96194F1CA5C5EEA6"><enum>(i)</enum><text>the nature, circumstances, extent, and gravity of the violation;</text></clause>
<clause id="HF63BF6A2F8044B8A93FC0041D1A4218F"><enum>(ii)</enum><text>with respect to the violator, the degree of culpability, ability to pay, and any history of prior violations; and</text></clause>
<clause id="H00DDBBD42F1546FFA2003EA2EDCB58D"><enum>(iii)</enum><text>such other matters as justice may require.</text></clause></subparagraph></paragraph>
<paragraph id="H5132CF0C0B4642048BD1024B153BB80"><enum>(3)</enum><header>Civil Actions to Collect</header><text>The Postal Service may bring a civil action in an appropriate district court of the United States, in accordance with section 409(g)(2), to collect a civil penalty under this section.</text></paragraph>
<paragraph id="HD85AAC4FA0624E1B8795BF41ACAF1C00"><enum>(4)</enum><header>Disposition of amounts</header><text>Amounts received in payment of any civil penalties under this subsection shall be deposited as miscellaneous receipts in the Treasury of the United States.</text></paragraph></subsection>
<subsection display-inline="no-display-inline" id="H8617AC51F49546259414F6B42837E625"><enum>(c)</enum><header>Orders</header><text display-inline="yes-display-inline">Upon evidence satisfactory to the Postal Service that any person is, for commercial or money-making purposes, engaged in the sending of mail matter which is nonmailable under this section, the Postal Service may issue an order which—</text>
<paragraph id="H248C7332F0754044AB45B133B900D953"><enum>(1)</enum><text>directs any postmaster, to whom any mailing originating with such person or his representative is tendered for transmission through the mails (other than a mailing that consists only of one or more sealed letters), to refuse to accept any such mailing, unless such person or his representative first establishes to the satisfaction of the postmaster that the mailing does not contain any matter which is nonmailable under this section; and</text></paragraph>
<paragraph commented="no" id="H0007C30450FD4E919D142D6052E142F5"><enum>(2)</enum><text display-inline="yes-display-inline">requires the person or his representative to cease and desist from mailing any mail matter which is nonmailable under this section.</text></paragraph></subsection>
<subsection id="H0BF09A9968434F1593E2A865D5A5DB00"><enum>(d)</enum><header>Prima facie evidence of purpose</header><text>For the purposes of this section, the repeated mailing of matter which is nonmailable under this section by any person or the advertisement by any person that the person will mail cigarettes, smokeless tobacco, or roll-your-own tobacco in return for payment shall constitute prima facie evidence that such person is engaged, for commercial or money-making purposes, in the mailing of matter which is nonmailable under this section.</text></subsection>
<subsection id="HEABAF13E6AD74C3BBCC13B74A1CA576E"><enum>(e)</enum><header>Coordination of efforts</header><text display-inline="yes-display-inline">In the enforcement of this section, the Postal Service shall cooperate and coordinate its efforts with related activities of any other Federal agency or of any State or local government, whenever appropriate.</text></subsection>
<subsection id="H81B24E1740884BC79C1D3C8F7251B100"><enum>(f)</enum><header>Actions by States relating to certain tobacco products</header>
<paragraph id="H64A615CC1FB4406CA185683FB0D67C08"><enum>(1)</enum><header>Authority of States</header><text>Whenever the attorney general of a State (or an official or agency of a State or local government designated by the State) has reason to believe that any person has engaged or is engaging in mailings to residents of that State in violation of subsection (a)(2)(A), the State (or designee) may bring, in an appropriate district court of the United States, a civil action to enjoin such mailings, to carry out paragraphs (1) and (4) of subsection (b), or to obtain such other relief as the court may deem appropriate.</text></paragraph>
<paragraph id="H0775F702FE9048D3891C739BB2FC628"><enum>(2)</enum><header>Rights of the Postal Service</header><text>The State (or designee) shall serve prior written notice of any action under paragraph (1) upon the Postal Service and provide the Postal Service with a copy of its complaint, except in any case where such prior notice is not feasible, in which case the State (or designee) shall serve such notice immediately upon instituting such action. The Postal Service, in accordance with section 409(g)(2), shall have the right (A) to intervene in the action, (B) upon so intervening, to be heard on all matters arising therein, and (C) to file petitions for appeal.</text></paragraph>
<paragraph id="H6635555E05134B5DBA6DF8A149C3771D"><enum>(3)</enum><header>Effect on State court proceedings</header><text>Nothing contained in this section shall be construed to prohibit an authorized State official from proceeding in State court on the basis of an alleged violation of any general civil or criminal statute of such State.</text></paragraph>
<paragraph id="H2AF0D20FB65A4D989B951CB939EA6B0"><enum>(4)</enum><header>Limitation</header><text display-inline="yes-display-inline">Whenever the Postal Service institutes a civil action for violation of subsection (a)(2)(A), no State may, during the pendency of such action instituted by the Postal Service, subsequently institute a separate civil action for any violation of subsection (a)(2)(A) against any defendant named in the Postal Service’s complaint.</text></paragraph></subsection>
<subsection id="H59CA2FBCBDAC4266A642DD8B29027470"><enum>(g)</enum><header>Definitions</header><text>For purposes of this section—</text>
<paragraph id="H791AAD8C95034956B522882EEBFDE768"><enum>(1)</enum><text>the terms <term>cigarette</term> and <term>roll-your-own-tobacco</term> have the meanings given them by <external-xref legal-doc="usc" parsable-cite="usc/26/5702">section 5702</external-xref> of the Internal Revenue Code of 1986;</text></paragraph>
<paragraph id="H703058C2B6544C5788A1E6213CFC05A"><enum>(2)</enum><text>the term <term>smokeless tobacco</term> has the meaning given such term by <external-xref legal-doc="usc" parsable-cite="usc/18/2341">section 2341</external-xref> of title 18; and</text></paragraph>
<paragraph id="H36B767049B4848EDB898FC26B32BD7B4"><enum>(3)</enum><text>the term <term>State</term> includes the District of Columbia, the Commonwealth of Puerto Rico, and the Virgin Islands.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="H51FC58C9A43541A089A6D5A322AFDCE"><enum>(b)</enum><header>Administrative Subpoenas</header><text><external-xref legal-doc="usc" parsable-cite="usc/39/3016">Section 3016(a)</external-xref> of title 39, United States Code, is amended in paragraphs (1)(A) and (2) by inserting <quote>3002b or</quote> before <quote>3005(a)</quote>.</text></subsection>
<subsection id="HF628EBEEDBA245ABA96EEDCC07E8971B"><enum>(c)</enum><header>Enforcement of Postal Service Orders</header><text><external-xref legal-doc="usc" parsable-cite="usc/39/3012">Section 3012</external-xref> of title 39, United States Code, is amended—</text>
<paragraph id="H9599C2FD51464512A6055E7B03258374"><enum>(1)</enum><text>in subsection (a)—</text>
<subparagraph id="HB323F5700A20491692398FD11BE43DBE"><enum>(A)</enum><text>in paragraph (1), by striking <quote>section 3005(a)(1) or</quote> and inserting <quote>section 3002b(c)(1), 3005(a)(1), or</quote>; and</text></subparagraph>
<subparagraph id="H794A90E792034A3A925EE12F35263250"><enum>(B)</enum><text>in paragraph (2), by inserting <quote>3002b(c)(2) or</quote> before <quote>3005(a)(3)</quote>;</text></subparagraph></paragraph>
<paragraph id="HE749367FA99B41CBB47EBA96A4E47478"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (c), by inserting <quote>3002b(c) or</quote> before <quote>3005(a)</quote> each place it appears; and</text></paragraph>
<paragraph id="HF9E88D90C4334D38A1F1F05C1079F8A"><enum>(3)</enum><text>in subsection (f), by inserting <quote>3002b(c) or</quote> before <quote>3005</quote> each place it appears.</text></paragraph></subsection>
<subsection id="HA57BCC7BD7454D9FA6A459C1E4C3C64E"><enum>(d)</enum><header>Semiannual Reports</header><text><external-xref legal-doc="usc" parsable-cite="usc/39/3013">Section 3013</external-xref> of title 39, United States Code, is amended—</text>
<paragraph id="HB2F6095B834E4F10899EB95B774DB6C4"><enum>(1)</enum><text>in paragraph (1), by inserting <quote>3002b(b) or</quote> before <quote>3005</quote>; and</text></paragraph>
<paragraph id="H6491967937AB4EC2853364000007005E"><enum>(2)</enum><text>in paragraph (3), by striking <quote>section 3007 of this title</quote> and inserting <quote>section 3002b(c) or section 3007, respectively,</quote>.</text></paragraph></subsection>
<subsection id="H490642FB39B94C0E829E704928E9654F"><enum>(e)</enum><header>Clerical Amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/39/30">chapter 30</external-xref> of title 39, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/39/3002a">section 3002a</external-xref> the following:</text>

<subsection id="H63CC554CE7AE4577B9489B4C3700F950"><enum>(f)</enum><header>Effective Dates</header>
<paragraph id="H8FC22102B7D04C4BAFDDFE858545C92D"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the amendments made by this section shall take effect on the 60th day after the date of the enactment of this Act, and shall apply with respect to any mail matter mailed on or after such 60th day.</text></paragraph>
<paragraph id="H4DEC73621DAE4694A8DE26DB5354D5FE"><enum>(2)</enum><header>Semiannual reports</header><text>The amendments made by subsection (d) shall apply beginning with the report submitted for the reporting period in which occurs the 60th day after the date of the enactment of this Act.</text></paragraph></subsection></section>
<section id="H94C35FF5CE2C4127009B3B1B6EBFFF16"><enum>2.</enum><header>Technical correction</header>
<subsection id="H354EDA92FF0E4617AB186C29166E965B"><enum>(a)</enum><header>In General</header><text>Sections 3007(a)(1), 3012(b)(1), and 3018(f)(1) of title 39, United States Code, are amended by striking <quote>409(d)</quote> and inserting <quote>409(g)(2)</quote>.</text></subsection>
<subsection id="H73896BFAE5DC4F92BA2CAF4067CD295E"><enum>(b)</enum><header>Effective Date</header><text>The amendments made by subsection (a) shall take effect as if included in the enactment of the Postal Accountability and Enhancement Act (<external-xref legal-doc="public-law" parsable-cite="pl/109/435">Public Law 109–435</external-xref>).</text></subsection></section>
