		<section commented="no" display-inline="no-display-inline" id="H5F7EA6EE22FF4ED6AC009CC125E00076" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Human-Animal Hybrid Prohibition Act of
			 2008</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="H2C41690BE8104B4D919023B600903403" section-type="subsequent-section"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="H332581AAFE784093A85CA1AF3873CAB1"><enum>(1)</enum><text display-inline="yes-display-inline">advances in research and technology have
			 made possible the creation of human-animal hybrids;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFEB58D40610F40509EA776D0A3D84CCC"><enum>(2)</enum><text display-inline="yes-display-inline">human-animal hybrids are grossly unethical
			 because they blur the line between human and animal, male and female, parent
			 and child, and one individual and another individual;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H89BE598A5C5446AA9C27372D24FDD9F"><enum>(3)</enum><text display-inline="yes-display-inline">human dignity and the integrity of the
			 human species are compromised by human-animal hybrids;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H93AEFBC9DD7D4DE18FD0AF008B8CB0A"><enum>(4)</enum><text display-inline="yes-display-inline">the uniqueness of individual human beings
			 is manifested in a particular way through their brain and their reproductive
			 organs/cells; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0BE5E1AA25524A82859501D2CDF9D77F"><enum>(5)</enum><text display-inline="yes-display-inline">with an increase in emerging zoonotic
			 infection threatening the global public health, human-animal hybrids present a
			 particularly optimal means of genetic transfers that could increase the
			 efficiency or virulence of diseases threatening both humans and animals.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="H0F7A82455E6245DCB3D059129CC9E377" section-type="subsequent-section"><enum>3.</enum><header>Prohibition on
			 human-animal hybrids</header><text display-inline="no-display-inline">Part I of
			 title 18, United States Code, is amended by inserting after chapter 51 the
			 following:</text>

				  Definitions.</toc-entry>
						<toc-entry bold="off" level="section">1132. Prohibition on
				  human-animal hybrids.</toc-entry>
					</toc>
					<section commented="no" display-inline="no-display-inline" id="H2D8B286C5C49450A919C650051AF7831" section-type="subsequent-section"><enum>1131.</enum><header>Definitions</header><text display-inline="no-display-inline">In this chapter the following definitions
				apply:</text>
						<paragraph commented="no" display-inline="no-display-inline" id="H728B7977B0A24671BF7852A014F51CEC"><enum>(1)</enum><header>Human-animal
				hybrid</header><text display-inline="yes-display-inline">The term
				<term>human-animal hybrid</term> means—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="H3912CAEBF8DC492C95C01EC31E50A120"><enum>(A)</enum><text display-inline="yes-display-inline">a human embryo into which a non-human cell
				or cells (or the component parts thereof) have been introduced to render the
				embryo's membership in the species Homo sapiens uncertain;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H4D39EC29AF7146BE9F85E3AB7357273F"><enum>(B)</enum><text display-inline="yes-display-inline">a hybrid human/animal embryo produced by
				fertilizing a human egg with non-human sperm;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H62687843129D4823A6F4679CD7C5400"><enum>(C)</enum><text display-inline="yes-display-inline">a hybrid human/animal embryo produced by
				fertilizing a non-human egg with human sperm;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H0E9D012365494D02B829D669119097E"><enum>(D)</enum><text display-inline="yes-display-inline">an embryo produced by introducing a
				non-human nucleus into a human egg;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H05491A1031174727912320E5549E56BC"><enum>(E)</enum><text display-inline="yes-display-inline">an embryo produced by introducing a human
				nucleus into a non-human egg;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3A2146BFC0064ED18F1D54F04B82A2E0"><enum>(F)</enum><text display-inline="yes-display-inline">an embryo containing at least haploid sets
				of chromosomes from both a human and a non-human life form;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H4FC59F45BBA047ED9229B3E0AD28856D"><enum>(G)</enum><text display-inline="yes-display-inline">a non-human life form engineered such that
				human gametes develop within the body of a non-human life form; or</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9A4E8986BBEC4D3A966783D506842B7C"><enum>(H)</enum><text display-inline="yes-display-inline">a non-human life form engineered such that
				it contains a human brain or a brain derived wholly or predominantly from human
				neural tissues.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD18A705D70154A95B248B94634B31615"><enum>(2)</enum><header>Human
				embryo</header><text display-inline="yes-display-inline">The term <term>human
				embryo</term> means an organism of the species Homo sapiens during the earliest
				stages of development, from 1 cell up to 8 weeks.</text>
						</paragraph></section><section commented="no" display-inline="no-display-inline" id="HCD0257CBDD5148DF99C822D99B71122F" section-type="subsequent-section"><enum>1132.</enum><header>Prohibition on
				human-animal hybrids</header>
						<subsection commented="no" display-inline="no-display-inline" id="H1F64DB37CB3D4CE3B3273EE909AFEAFD"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">It shall be unlawful
				for any person to knowingly, in or otherwise affecting interstate
				commerce—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="HA7B048C2299D4E1BB9958C58BFF7D882"><enum>(1)</enum><text display-inline="yes-display-inline">create or attempt to create a human-animal
				hybrid;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC595A59A7400403A92829C16F6174ED"><enum>(2)</enum><text display-inline="yes-display-inline">transfer or attempt to transfer a human
				embryo into a non-human womb;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HED2950A4A7874235A5606E5F3CD0F238"><enum>(3)</enum><text display-inline="yes-display-inline">transfer or attempt to transfer a non-human
				embryo into a human womb; or</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4BC5AA497BAD41DDBDABBF5C22399CD"><enum>(4)</enum><text display-inline="yes-display-inline">transport or receive for any purpose a
				human-animal hybrid.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H7EB7FF4A8BFD4F71BC925FA8FF620061"><enum>(b)</enum><header>Penalties</header>
							<paragraph commented="no" display-inline="no-display-inline" id="H3E6F5FAFA059493DAB7CED58CFD433D2"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Whoever violates
				subsection (a) shall be fined under this title, imprisoned not more than 10
				years, or both.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD8A7B694BAF849CCBD42C257A108DD51"><enum>(2)</enum><header>Civil
				penalty</header><text display-inline="yes-display-inline">Whoever violates
				subsection (a) and derives pecuniary gain from such violation shall be subject
				to a civil fine of the greater of $1,000,000 and an amount equal to the amount
				of the gross gain multiplied by
				2.</text>
							</paragraph></subsection></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" display-inline="no-display-inline" id="H292B9838CDF1474BB5CD46F3781CC4E" section-type="subsequent-section"><enum>4.</enum><header>Technical
			 amendment</header><text display-inline="no-display-inline">The table of
			 chapters for part I of title 18, United States Code, is amended by inserting
			 after the item relating to chapter 51 the following:</text>
