		  governments to identify and address food safety issues on a scientific basis,

			 purposes</header>
			<subsection id="HD60D1A6FEC104C6CADE8392788B241BA"><enum>(a)</enum><header>Findings</header><text>Congress
			 finds that—</text>
				<paragraph id="HEF5B709DF8AF47E8A6210535120402C0"><enum>(1)</enum><text>American consumers
			 have a vital interest in a safe, affordable, and wholesome food supply;</text>
				</paragraph><paragraph id="H82B262EEDE944694AA1FFC068B826702"><enum>(2)</enum><text>maintenance of a
			 safe food supply requires scientifically based food safety standards;</text>
				</paragraph><paragraph id="H0D33E4A9470A430C938FB158C4E03B4"><enum>(3)</enum><text>food production and
			 distribution is increasingly global;</text>
				</paragraph><paragraph id="HBC32661E0ECB43168EF33CD2F5ABCED9"><enum>(4)</enum><text>ensuring the
			 safety of the food supply, regardless of the source of the food, is a
			 responsibility shared by food producers, processors, and retailers and by
			 Federal, State, and local agencies;</text>
				</paragraph><paragraph id="H31B5C5645E664835BF8235C44F52CA8"><enum>(5)</enum><text>assurance of the
			 safety of food is best achieved by the adoption of appropriate food production
			 and processing practices and procedures;</text>
				</paragraph><paragraph id="H21F608571D2E4F8A9B0061281BCB0AD"><enum>(6)</enum><text>enhanced
			 cooperation among regulatory agencies worldwide is critical to maintenance of a
			 safe food supply;</text>
				</paragraph><paragraph id="HD1400C1C63CD4EB495A908AA263D5958"><enum>(7)</enum><text>food producers,
			 processors, and retailers have a vital role in ensuring the safety of the food
			 supply;</text>
				</paragraph><paragraph id="H84749B3866DE432A866B5B3EEB8C0343"><enum>(8)</enum><text display-inline="yes-display-inline">food producers, processors, and retailers
			 are best situated to ensure the implementation of science-based food safety
			 standards worldwide;</text>
				</paragraph><paragraph id="H3FB72802EA434038A2DB454F23D8D900"><enum>(9)</enum><text display-inline="yes-display-inline">in order to provide appropriate oversight,
			 regulatory agencies with responsibility for food safety must have access to
			 adequate scientific resources, modern information technology systems, modern
			 and efficient laboratories, and adequate inspectional capacity;</text>
				</paragraph><paragraph id="H9477715E4F5A45B4A71C443E4E82BF53"><enum>(10)</enum><text>ensuring the
			 adequacy of resources for regulatory agencies is a public responsibility;
			 and</text>
				</paragraph><paragraph id="H0DBAC60D70404A90A75D6DA50004F5B"><enum>(11)</enum><text>efficient and
			 effective enforcement of food safety requirements for imported foods
			 necessitates a risk-based systems approach.</text>
				</paragraph></subsection></section><section display-inline="no-display-inline" id="H7C6F43C59B824AE893C105781941932D" section-type="subsequent-section"><enum>3.</enum><header>Inspection of records
			 during food-related emergencies</header>
			<subsection id="H1F4EF4E777E64E17BDCBFAD38BE0CBD6"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 414 of the
			 Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/350c">21 U.S.C. 350c</external-xref>) is amended—</text>
				<paragraph id="H057C5F69102A49FA863774B214334B86"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsections (b), (c), and
			 (d) as subsections (c), (d), and (e), respectively; and</text>
				</paragraph><paragraph id="HBAD3FFC4F4ED426EA25E71B35CCD177B"><enum>(2)</enum><text>by inserting after
			 subsection (a) the following:</text>
					<quoted-block display-inline="no-display-inline" id="HACA26A4DBCB84E4EB6F6CCF3ADBAF052" style="OLC">
						<subsection id="HECC0CAB48E5347A10016ED0054AD9FBF"><enum>(b)</enum><header>Records
				inspections during food-related emergencies</header><text>If the Secretary has
				a reasonable belief that an article of food presents a threat of serious
				adverse health consequences or death to humans or animals, during a
				food-related emergency, the Secretary—</text>
							<paragraph id="H9ECACA6EB6C247C09098A46DA243C387"><enum>(1)</enum><text>may have access to
				and copy all records relating to such article of food in the same manner and
				for the same purpose as described in subsection (a); and</text>
							</paragraph><paragraph id="H6C8256CABE964D698F47217301C08460"><enum>(2)</enum><text>shall, from each
				person (excluding farms and restaurants) who manufactures, processes, packs,
				distributes, receives, holds, or imports an article of food related to the
				article of food referred to under paragraph (1) (such as an article of food
				produced on the same manufacturing line as such article of food under paragraph
				(1)) at the request of an officer or employee duly designated by the Secretary,
				have permission for such officer or employee, upon presentation of appropriate
				credentials and a written notice to such person, at reasonable times and within
				reasonable limits and in a reasonable manner, to have access to and copy all
				records relating to such related article that are needed to assist the
				Secretary in determining whether the food presents a threat of serious adverse
				health consequences or death to humans or
				animals.</text>
							</paragraph></subsection><after-quoted-block>.
				</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H9D33B28D7CBA4074A2F25221DB3F36ED"><enum>(b)</enum><header>Conforming
			 amendments</header>
				<paragraph id="H0D4F0C6270FC4A01BD974B219C00D1F8"><enum>(1)</enum><text>Section 301(e) of
			 such Act (<external-xref legal-doc="usc" parsable-cite="usc/21/331">21 U.S.C. 331(e)</external-xref>) is amended by striking <quote>414(b)</quote> and
			 inserting <quote>414(c)</quote>.</text>
				</paragraph><paragraph id="H51D601A4535A4FB7AD74B1202DD13EE"><enum>(2)</enum><text>Section 704(a)(1)
			 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/21/374">21 U.S.C. 374(a)(1)</external-xref>) is amended by striking <quote>414(d)</quote>
			 and inserting <quote>414(e)</quote>.</text>
				</paragraph></subsection></section><section id="HE4A91D8B65CD4121864D4075BA36D91"><enum>4.</enum><header>Hazard analysis
			 and risk-based preventive controls</header>
			<subsection id="H7C20A0B68BA8404CAA00D63871B1CE84"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Chapter IV of the
			 Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/341">21 U.S.C. 341 et seq.</external-xref>) is amended by
			 adding at the end the following:</text>
				<quoted-block id="H18D821169211413D826C38AB116D5D15" style="OLC">
					<section id="H84BCC6B002794D3D9E3000F2F37831A5"><enum>418.</enum><header>Hazard analysis
				and risk-based preventive controls</header>
						<subsection id="HAAC26A2C721C4405BDF1D7B61C3101D"><enum>(a)</enum><header>In
				general</header><text>Each owner, operator, or agent in charge of a facility,
				as defined in subsection (k)(1), shall, in accordance with this section—</text>
							<paragraph id="HA987444E3A04498BB13EC367261CDFB8"><enum>(1)</enum><text>evaluate the
				hazards that could affect products from such facility;</text>
							</paragraph><paragraph id="HC927A2DBF0B84EC49CB0C672347C0712"><enum>(2)</enum><text>identify and
				implement risk-based preventive controls to keep such hazards from occurring or
				to significantly minimize their occurrence and provide reasonable assurances
				that a product is not adulterated;</text>
							</paragraph><paragraph id="H76F77813E0AC46A6818C90A04F23CCB0"><enum>(3)</enum><text>monitor the
				performance of those controls;</text>
							</paragraph><paragraph id="H7AE031D3A7AB4A4F9F006FE727813914"><enum>(4)</enum><text>maintain records
				of this monitoring as a matter of routine practice; and</text>
							</paragraph><paragraph id="H04B7160BBE0D4890B0B6DB3E45D2C773"><enum>(5)</enum><text>provide for
				inspection of the facility at such frequency, but not less often than
				biennially, as the Secretary may specify, with an increase in the periodicity
				of such inspections based on facilities identified as having an increased
				risk.</text>
							</paragraph></subsection><subsection id="HAE710161280643C483822E07B8FF00D5"><enum>(b)</enum><header>Hazard
				analysis</header><text>The owner, operator, or agent in charge of a facility
				shall identify and evaluate known or reasonably foreseeable biological,
				chemical, and physical hazards that may be associated with the facility.</text>
						</subsection><subsection id="HEB633E0DBC904B68B9A4567316410084"><enum>(c)</enum><header>Preventive
				controls</header>
							<paragraph id="H24849C7F53174682BAE0CBC466416577"><enum>(1)</enum><header>Implementation</header><text>The
				owner, operator, or agent in charge of a facility shall identify and implement
				reasonably appropriate preventive controls so that—</text>
								<subparagraph id="HB3063E12D65B4E4583E4CB8472D77D20"><enum>(A)</enum><text>risks identified
				in the hazard analysis conducted under subsection (b) will not affect the food
				manufactured, processed or packed by such facility;</text>
								</subparagraph><subparagraph id="H3D3CEF3D8D4E406990008D6BF682EC80"><enum>(B)</enum><text>the food will not
				be adulterated under section 402; and</text>
								</subparagraph><subparagraph id="HBB56F3D7CC8C4BC5A6E833389C484098"><enum>(C)</enum><text>the food will not
				present a threat of serious adverse health consequences or death to humans or
				animals.</text>
								</subparagraph></paragraph><paragraph id="H0659CD78FA154AC8BE3F768137A8B441"><enum>(2)</enum><header>Controls</header><text>Preventive
				controls include, at a minimum, the following practices that improve the safety
				of the food:</text>
								<subparagraph id="H167990957A5247628173046C3C33DAD6"><enum>(A)</enum><text>Sanitation
				procedures for food contact surfaces and utensils and food-contact surfaces of
				equipment.</text>
								</subparagraph><subparagraph id="H86CB7127A9284F5B9678E60080826CFB"><enum>(B)</enum><text>Supervisor,
				manager, and employee hygiene training.</text>
								</subparagraph><subparagraph id="HFBFA384EBB3940529475C933B87FE8AE"><enum>(C)</enum><text>An environmental
				monitoring program to verify the effectiveness of pathogen controls.</text>
								</subparagraph><subparagraph id="H640309AC8A2D446B95A1BCCFC821256B"><enum>(D)</enum><text>An allergen
				control program to ensure that products do not contain allergens that are not
				declared on the label.</text>
								</subparagraph><subparagraph id="HD8FDD628CF6C408CB9AF608E6C9CF912"><enum>(E)</enum><text>A recall
				contingency plan.</text>
								</subparagraph><subparagraph id="H5FAADB010E4745EA94E0141235AC2172"><enum>(F)</enum><text>Good manufacturing
				practices.</text>
								</subparagraph></paragraph></subsection><subsection id="H676D2A5A1A8C4FBFBEE705ABDBC24511"><enum>(d)</enum><header>Monitoring of
				effectiveness</header><text>The owner, operator, or agent in charge of a
				facility shall monitor the effectiveness of the preventive controls implemented
				under subsection (c) to provide reasonable assurances that none of the outcomes
				set forth in subsection (c)(1) shall occur.</text>
						</subsection><subsection id="HAFC2DCBE11A448208E267844BCCCF8D5"><enum>(e)</enum><header>Corrective
				actions</header><text display-inline="yes-display-inline">The owner, operator,
				or agent in charge of a facility shall establish procedures that a facility
				will implement if the preventive controls implemented under subsection (c) are
				found to be ineffective through effectiveness monitoring under subsection (d)
				or if an adulteration or recall situation warrants such action.</text>
						</subsection><subsection id="HE4A281E6E4E1454CBE8C52DA9367051C"><enum>(f)</enum><header>Verification</header><text>The
				owner, operator, or agent in charge of a facility shall verify that—</text>
							<paragraph id="H4E1D38825AE2402CA51B772C6D22445D"><enum>(1)</enum><text>the preventive
				controls implemented under subsection (c) are adequate to control the hazards
				found under subsection (b);</text>
							</paragraph><paragraph id="HF535A7F40301409CB416D5BF66D101B8"><enum>(2)</enum><text>the owner,
				operator, or agent is conducting monitoring in accordance with subsection
				(d);</text>
							</paragraph><paragraph id="HDE2A394B3B1E46CDB0DEDD006F087D00"><enum>(3)</enum><text>the owner,
				operator, or agent is making appropriate decisions about corrective actions
				taken under subsection (e); and</text>
							</paragraph><paragraph id="HD7C53D9CB8954D8E92A992A6FEF4118E"><enum>(4)</enum><text>there is
				documented, periodic revalidation of the plan under subsection (h) to ensure
				that the plan is still relevant to the raw materials as well as to conditions
				and processes in the facility.</text>
							</paragraph></subsection><subsection id="H09254503BF464A31A256FF7623491B45"><enum>(g)</enum><header>Risk assessment
				and preventive control implementation plan</header><text>Each owner, operator,
				or agent in charge of a facility shall prepare a written plan that documents
				and describes the procedures used by the facility to comply with the
				requirements of this section, including analyzing the hazards under subsection
				(b) and identifying the preventive controls adopted to address those hazards
				under subsection (c). Such written plan, together with documentation that the
				plan is being implemented, shall be made promptly available to a duly
				authorized representative of the Secretary upon oral or written request for the
				purpose of verifying compliance with this requirement.</text>
						</subsection><subsection id="HB4B58ECD8DF64204A6FF08A0F2D31033"><enum>(h)</enum><header>Requirement To
				reanalyze</header><text>Each owner, operator, or agent in charge of a facility
				shall conduct a reanalysis under subsection (b), at a minimum, biennially, or
				whenever a significant change is made in the activities conducted at a facility
				operated by such owner, operator, or agent if the change creates a reasonable
				potential for a new hazard or a significant increase in a previously identified
				hazard. Such reanalysis shall take into account any new scientific or
				technological advances and any additional preventive controls needed to address
				the hazard identified, if any, and shall be implemented before any change in
				activities at the facility is commenced. Such owner, operator, or agent shall
				revise the written plan required under subsection (g) if such a significant
				change is made or document the basis for the conclusion that no additional or
				revised preventive controls are needed.</text>
						</subsection><subsection id="H8CD57B6BBC4F43FCBE942BF993740878"><enum>(i)</enum><header>Exception for
				food facilities in compliance with applicable HACCP or other regulatory
				standards</header><text display-inline="yes-display-inline">This section shall
				not apply to an owner, operator, or agent in charge of a facility that
				processes a food if such facility is subject to the standards for a Hazard
				Analysis Critical Control Points Program or other regulatory program of the
				Food and Drug Administration relating to that food.</text>
						</subsection><subsection id="H748D6DA866FB4DDA895F9C066B8FE34F"><enum>(j)</enum><header>Exception for
				facilities in compliance with section 419</header><text>This section shall not
				apply to an owner, operator, or agent in charge of a facility that is subject
				to section 419.</text>
						</subsection><subsection id="H928D60C948114881969BF832F5DB46C"><enum>(k)</enum><header>Definitions</header><text>For
				purposes of this section:</text>
							<paragraph id="HB78BC48EF72C42CBB0BBF08091189068"><enum>(1)</enum><header>Facility</header><text display-inline="yes-display-inline">The term <term>facility</term> means a
				domestic or a foreign facility that is required to register under section 415,
				but does include a warehouse that—</text>
								<subparagraph id="H5D609EB5F8F5480C00C2335E1D14F0F1"><enum>(A)</enum><text>holds food
				packaged for sale to consumers or packed in cases for commercial distribution;
				and</text>
								</subparagraph><subparagraph id="HFE519EF9A5124E31A806548870AADF31"><enum>(B)</enum><text>does not process
				food or otherwise expose food to the environment in a way as to dramatically
				increase the likelihood for contamination, not including processing incidental
				to the handling of fruits and vegetables that may be held in the warehouse and
				regulated under section 419.</text>
								</subparagraph></paragraph><paragraph id="H00C7FEC8B7854D799C6C44BEA62E4C88"><enum>(2)</enum><header>Reasonably
				appropriate science-based preventive controls</header><text>The term
				<term>reasonably appropriate science-based preventive controls</term> means
				those procedures, practices, and processes that a person knowledgeable about
				the processing and packing of food and science-based food safety practices
				would have employed to address the hazards identified during the hazard
				analysis under subsection (b) at the time of such analysis. Such term does not
				include those controls that result in a food that is not commercially
				viable.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H05607BBC1A074C858C3855009966EFF7"><enum>(b)</enum><header>Guidance
			 document</header><text>Not later than 1 year after the date of enactment of
			 this Act, the Secretary shall issue a guidance document related to the
			 preparation of a hazard analysis and preventive control plan required under
			 section 418 of the Federal Food, Drug, and Cosmetic Act, as added by subsection
			 (a).</text>
			</subsection><subsection id="HED04D878477448E4AB2906C1534F2765"><enum>(c)</enum><header>Regulations</header>
				<paragraph id="H4359DAD98C17426A9D91D9682DAAB14D"><enum>(1)</enum><header>In
			 general</header><text>The Secretary of Health and Human Services shall
			 promulgate regulations to establish minimum standards for the effective
			 implementation of section 418 of the Federal Food, Drug, and Cosmetic Act, as
			 added by subsection (a).</text>
				</paragraph><paragraph id="H512CEADEE1CB417EAD61E186880074D4"><enum>(2)</enum><header>Content</header><text>The
			 regulations promulgated under paragraph (1) shall—</text>
					<subparagraph id="H69044E8DB75845D2AEE8FDFC424B5AF"><enum>(A)</enum><text>be consistent with
			 the principles contained in internationally recognized hazard analysis and
			 preventive control standards; and</text>
					</subparagraph><subparagraph id="HCCA4C83C8AE143BAAC3F48C29EE23E1D"><enum>(B)</enum><text>provide sufficient
			 flexibility to be applicable in all situations, including in the operations of
			 small businesses.</text>
					</subparagraph></paragraph><paragraph id="H1F3B00B57AA640B3A21674BEAD9B7651"><enum>(3)</enum><header>Review</header><text>In
			 promulgating the regulations under paragraph (1), the Secretary shall review
			 regulatory hazard analysis and preventive control programs in existence on the
			 date of enactment of this Act to ensure that the program under such section 418
			 is consistent with applicable internationally recognized standards in existence
			 on such date.</text>
				</paragraph></subsection><subsection id="H486CA517FB2F4C0EB3C372551656C3EB"><enum>(d)</enum><header>Prohibited
			 acts</header><text>Section 301 of the Federal Food, Drug, and Cosmetic Act (21
			 U.S.C. 331) is amended by adding at the end the following:</text>
				<quoted-block id="HB6467D39A1724EF4A210AA6269D0DAC5" style="OLC">
					<subsection id="HDB572D11CC094374AE00ED4DB30FBB8"><enum>(oo)</enum><text>The operation of a
				facility that processes or packs food for sale in the United States if the
				person who operates such facility has not conducted the hazard analysis
				required under section 418(b), implemented reasonably appropriate science-based
				preventive controls under section 418(c) in accordance with 418(g), failed to
				conduct a reanalysis as required under section 418(h), or failed to have a plan
				documenting compliance with section
				418.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H2CA39AFEAB4447A4893EB141BF00DC06"><enum>(e)</enum><header>Effective
			 date</header>
				<paragraph id="HF070C100A4954FE0823808D981CB7927"><enum>(1)</enum><header>General
			 rule</header><text>The amendments made by this section shall take effect 1 year
			 after the date of enactment of this Act.</text>
				</paragraph><paragraph id="HFCE9010E310E496A8DF6D6E3F6F2F5AE"><enum>(2)</enum><header>Exceptions</header><text>Notwithstanding
			 paragraph (1)—</text>
					<subparagraph id="H54AB11B6A0084539A5451CC3FD49EE19"><enum>(A)</enum><text>the amendments
			 made by this section shall apply to a small business (as defined in the small
			 business size regulations of the Small Business Administration, as specified in
			 part 121 of title 13, Code of Federal Regulations) after the date that is 2
			 years after the date of enactment of this Act; and</text>
					</subparagraph><subparagraph id="HB990E08B112C40AAAB53DC9E61EF0155"><enum>(B)</enum><text>the amendments
			 made by this section shall apply to a very small business (as defined in such
			 regulations) after the date that is 3 years after the date of enactment of this
			 Act.</text>
					</subparagraph></paragraph></subsection></section><section id="H0EBE9AA28F0E470E8B6F936D1FD594B4"><enum>5.</enum><header>Mandatory foreign
			 supplier safety assurance program</header>
			<subsection id="H24CAEC7A2B9E4A6B94FA13B896B22EF8"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Chapter VIII of the
			 Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/381">21 U.S.C. 381 et seq.</external-xref>) is amended by
			 adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HF78D4D003CA34511B8BFD8BCD760D8CF" style="OLC">
					<section id="HAA3DE20116D642F196C1C047E25682F"><enum>805.</enum><header>Mandatory
				foreign supplier safety assurance program</header>
						<subsection id="H5831D6D140A449E885BDBB484120848E"><enum>(a)</enum><header>Foreign supplier
				safety assurance program</header>
							<paragraph id="H564ACB070E84409289E9B817CBC037DF"><enum>(1)</enum><header>In
				general</header><text>Each U.S. importer of record shall adopt and document a
				foreign supplier safety assurance program to assure that food imported into the
				United States—</text>
								<subparagraph id="H887BBEAFFD74403DB7F8B12343EAB4AF"><enum>(A)</enum><text>is in compliance
				with the requirements of section 418;</text>
								</subparagraph><subparagraph id="H922C50337922474891272D63401938A5"><enum>(B)</enum><text>is not adulterated
				under section 402; and</text>
								</subparagraph><subparagraph id="HB87757C07A974A3590B1DEEEB1DE529"><enum>(C)</enum><text display-inline="yes-display-inline">does not pose a threat of serious adverse
				health consequences or death.</text>
								</subparagraph></paragraph><paragraph id="H1E8B75B253A64301A4005BF040026F5"><enum>(2)</enum><header>Treatment of
				certain customs brokers</header><text display-inline="yes-display-inline">For
				purposes of this section, an <quote>importer of record</quote> shall not
				include a person holding a valid license under <external-xref legal-doc="usc" parsable-cite="usc/19/1641">section 1641</external-xref> of title 19, United
				States Code (commonly referred to as a <quote>customs broker</quote>), if the
				customs broker has executed a written agreement with another person who has
				agreed to comply with the requirements of this section with regard to food
				imported or offered for import by the customs broker.</text>
							</paragraph></subsection><subsection id="H41B1DF82C72B438E9D6D11B78258A13F"><enum>(b)</enum><header>Requirements</header>
							<paragraph id="H021A2D9935994FB397BE944EC0FABAC"><enum>(1)</enum><header>In
				general</header><text>A foreign supplier safety assurance program shall include
				such risk-based processes and procedures as the U.S. importer of record
				determines to be necessary and appropriate to reasonably ensure that food
				imported into the United States by the importer of record complies with U.S.
				food safety requirements in accordance with section 418 and is not adulterated
				within the meaning of section 402.</text>
							</paragraph><paragraph id="HB8F1247E43924F6CB8B3D2F7673CCD8B"><enum>(2)</enum><header>Components of a
				foreign supplier safety assurance program</header><text display-inline="yes-display-inline">In establishing a foreign supplier safety
				assurance program, a U.S. importer of record shall verify, with respect to each
				foreign supplier from which it obtains food, that the foreign supplier has an
				effective safety assurance program. Such verification may include certification
				by a recognized third party certification program (under section 421), but such
				certification from the approved third party certification program shall not
				serve as the sole means that may be accepted by the Secretary of verification
				of adherence to a foreign supplier safety assurance program. An effective
				safety assurance program shall include, at a minimum, an evaluation of hazards
				in accordance with section 418 and the implementation of reasonable and
				appropriate preventive controls.</text>
							</paragraph></subsection><subsection id="HB3FC5BB2C6284C14AC949B2B3B4072C9"><enum>(c)</enum><header>Guidance</header><text>Within
				270 days of the date of the enactment of this section, the Secretary shall
				issue guidance to assist U.S. importers of record in developing foreign
				supplier safety assurance programs.</text>
						</subsection><subsection id="H3E83B3A3B419482DB0C879787F75505B"><enum>(d)</enum><header>Record
				access</header><text>Records of a U.S. importer of record related to a foreign
				supplier safety assurance program shall, for a period of not less than 2 years,
				be made available promptly to the Secretary upon written or oral
				request.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H0E1F684233CF4527ADCDA8C4CFDD6FE3"><enum>(b)</enum><header>Prohibited
			 acts</header><text>Section 301 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/21/331">21 U.S.C. 331</external-xref>), as amended by
			 section 4(d), is further amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HBBB9FEFF530048739BD18FE664354522" style="OLC">
					<paragraph id="H71295B039B734CC000B986EE301BA97F" indent="up1"><enum>(pp)</enum><text display-inline="yes-display-inline">The importation or offering for importation
				of a food if the importer of record does not have in place a foreign supplier
				safety assurance program in compliance with section
				805.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HC0846F4CED524828903B4632DBBC531"><enum>(c)</enum><header>Imports</header><text>Section
			 801(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/21/381">21 U.S.C. 381(a)</external-xref>) is amended by inserting <quote>or section
			 805</quote> after <quote>or in violation of section 505</quote>.</text>
			</subsection></section><section id="H6A6401C20EAB404CBBB168B3DCFB50EF"><enum>6.</enum><header>Certification of
			 certain imports by competent authority of exporting country</header>
			<subsection id="H87B25C8B371D47C7A23FDC94EBE2CBF8"><enum>(a)</enum><header>In
			 general</header><text>Whenever the Secretary of Health and Human Services (in
			 this section referred to as the <quote>Secretary</quote>) determines to enter
			 into a memorandum of understanding or equivalent agreement with the regulatory
			 authorities of another country with responsibility for food safety, the
			 Secretary shall include in such memorandum of understanding or equivalent
			 agreement a provision to provide for the certification of certain foods offered
			 for import into the United States by a competent regulatory authority in the
			 country of export.</text>
			</subsection><subsection id="H39E3639B8BEC44E7A3A695432AC5800"><enum>(b)</enum><header>Certification</header><text>Such
			 certification provision shall provide that, upon reasonable notice given by the
			 Secretary, and as a condition of permitting the importation of food from a
			 specific foreign country or from a specific facility within a foreign country,
			 a competent regulatory authority in the exporting country agrees to certify
			 that each specific shipment of food or food from a specific facility offered
			 for importation into the United States has been produced, packaged, and held
			 under conditions that meet United States food safety standards. Nothing in this
			 section shall limit the Secretary’s ability to conduct random checks of
			 imported food or to take such other steps as the Secretary deems necessary to
			 assure the safety of imported food.</text>
			</subsection><subsection id="H583B657023CF438AAA003483F4BBB4E0"><enum>(c)</enum><header>Notification and
			 detention</header><text>Whenever the Secretary has entered into a memorandum of
			 agreement that includes a certification requirement, the Secretary shall notify
			 the Secretary of Homeland Security. The Secretary of Homeland Security shall
			 deny entry to any food offered for import for which a certification under this
			 section has been required if such certification has not been provided in a
			 manner deemed timely and appropriate by the Secretary.</text>
			</subsection><subsection id="H481C89E10F8E493E94D9D789767F232D"><enum>(d)</enum><header>Registry of
			 certified facilities</header><text>The Secretary shall maintain a registry of
			 facilities with respect to which certification has been made under this
			 section.</text>
			</subsection></section><section id="H66663937C94C4B3A0007A33AAEE6EF6"><enum>7.</enum><header>Voluntary
			 qualified importer program</header><text display-inline="no-display-inline">Chapter VIII of the Federal Food, Drug, and
			 Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/381">21 U.S.C. 381 et seq.</external-xref>), as amended by section 5(a), is further
			 amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H2035D4B36C0648AFAF44C6B4C308844" style="OLC">
				<section id="H084906B2B72545EC85BB3BCEB9FB42D5"><enum>806.</enum><header>Voluntary
				qualified importer program</header>
					<subsection id="H27F21A03958149948B3B0056F353D3C3"><enum>(a)</enum><header>In
				general</header><text>Beginning not later than 1 year after the date of
				enactment of this section, the Secretary shall establish a program, in
				consultation with the Secretary of Agriculture and Secretary of Homeland
				Security, to provide for the expedited review and importation of food products
				offered for importation by U.S. importers of record who have voluntarily agreed
				to participate in such program. In establishing such a program, the Secretary
				shall ensure that the program does not impose redundant requirements on persons
				who participate in existing border security programs. In determining
				eligibility to participate in such a program, the Secretary shall consider,
				among other relevant information, the following:</text>
						<paragraph id="H66D8BB03C2094262A3C71E212EAE072"><enum>(1)</enum><text>Nature and
				risk-profile of the food or ingredient to be imported.</text>
						</paragraph><paragraph id="H021BFB4452E14A408DD024FC4DFB8E35"><enum>(2)</enum><text>Compliance history
				of the foreign supplier.</text>
						</paragraph><paragraph id="HB13CB247034945E4B0AF5104AA3F711B"><enum>(3)</enum><text display-inline="yes-display-inline">Capability of the regulatory system of the
				country of export to ensure compliance with United States food safety
				standards, including hazard analysis and preventive control measures in
				accordance with section 418.</text>
						</paragraph><paragraph id="H8A36B05D0EF6479DB83C7965EA729500"><enum>(4)</enum><text>Compliance of the
				importer of record with the requirements of section 805.</text>
						</paragraph><paragraph id="H6ED375E9E5B443E7B3847B3D1405FEE0"><enum>(5)</enum><text display-inline="yes-display-inline">Whether the importer of record has been
				certified by a recognized third party certification program under section
				421.</text>
						</paragraph><paragraph id="HF873495A3D9C4A73BD789752CDCE3B07"><enum>(6)</enum><text display-inline="yes-display-inline">Any other factors the Secretary deems
				necessary.</text>
						</paragraph></subsection><subsection id="H427416A9180C470DAE58B39D1E585363"><enum>(b)</enum><header>Voluntary
				participation</header><text>An importer of record may request the Secretary to
				provide for the expedited review and importation of designated foods in
				accordance with the procedures established by the Secretary and the Secretary
				may establish a list of foods for which expedited review and importation under
				this section is authorized.</text>
					</subsection><subsection id="H4C9B5B55C1844AF493E4415706C28E00"><enum>(c)</enum><header>Fee</header><text>A
				fee is established under section 741 for participation of facilities in the
				program under this
				section.</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HEEA846938FB24C1D8D81CE931BD9B8E9"><enum>8.</enum><header>Recognition of
			 qualified laboratories for analyses of imported foods</header>
			<subsection id="H0D615ACE5B0447D993BD48D13135B43"><enum>(a)</enum><header>In
			 general</header><text>The Secretary of Health and Human Services shall provide
			 for the recognition of laboratories with a demonstrated capability to conduct
			 analytical testing of food products through programs administered by other
			 government agencies, or by qualified nongovernmental organizations and shall
			 establish a registry of laboratories that have been so recognized.</text>
			</subsection><subsection id="H7074034D990F4849BFD5B1FD6B396F1B"><enum>(b)</enum><header>Criteria</header><text>The
			 Secretary of Health and Human Services shall require, as a condition of
			 inclusion in the registry provided for under subsection (a), that entities
			 providing laboratory analyses establish to the satisfaction of the agency or
			 organization that is providing the recognition that—</text>
				<paragraph id="H789D6D4462F4454D80006425DA402246"><enum>(1)</enum><text>appropriate
			 sampling and analytical procedures are followed and reports of analyses are
			 certified as true and accurate;</text>
				</paragraph><paragraph id="HA8AF316E06374897BA84ADFE1D17EE38"><enum>(2)</enum><text>internal quality
			 systems are established and maintained;</text>
				</paragraph><paragraph id="HE523F6E3B8DB4445A1D927BCF9F3494E"><enum>(3)</enum><text>procedures exist
			 to evaluate and respond promptly to complaints regarding analyses and other
			 activities for which the laboratory is recognized; and</text>
				</paragraph><paragraph id="HF0DF06C3FC084225A487137DB3F85049"><enum>(4)</enum><text>individuals who
			 conduct the analyses are qualified by training and experience to do so.</text>
				</paragraph></subsection><subsection id="HF1B2879F74C64EB199EB8CFDFA9FB4ED"><enum>(c)</enum><header>Review of
			 recognition</header><text>Any agency or organization that maintains a program
			 under which laboratories are recognized as qualified to conduct analyses in
			 accordance with the criteria set forth in this section shall conduct periodic
			 assessments of the qualifications of the laboratories that have been recognized
			 by it and shall promptly revoke the recognition of any laboratory found not to
			 be in compliance with the agency’s or organization’s standards. The agency or
			 organization shall also promptly notify the Secretary of Health and Human
			 Services of any change in the status of a previously recognized laboratory and
			 the Secretary shall promptly revise the registry maintained under subsection
			 (a).</text>
			</subsection><subsection id="H6445D3E2C19C47E8AF0278EC5853DAD"><enum>(d)</enum><header>Alternative
			 laboratories</header><text display-inline="yes-display-inline">Nothing in this
			 section shall prevent a person from using an alternative laboratory, such as a
			 university or food company laboratory, so long as such person submits—</text>
				<paragraph id="H61DB28F61D0E4CF696C8BC22F12FE82"><enum>(1)</enum><text>to
			 the Secretary evidence to establish the qualifications of the laboratory and a
			 reference to the validated test method (or methods) used; and</text>
				</paragraph><paragraph id="H689EF5C908E541378CFCBE6CFFBB144F"><enum>(2)</enum><text>to the Food and
			 Drug Administration all testing results and data.</text>
				</paragraph></subsection></section><section id="H509BBB9BC3024BAEA627BC255C6C5E61"><enum>9.</enum><header>Standards for the
			 safety of fruits and vegetables</header>
			<subsection id="H6978A4C800C04685BD6C613132FA0044"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Chapter IV of the
			 Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/341">21 U.S.C. 341 et seq.</external-xref>), as amended by
			 section 4(a), is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H112C0C3284AC412294A4E3487F2D7DA5" style="OLC">
					<section id="HDE0881CC9ECA479286AF29A07DC81BFC"><enum>419.</enum><header>Standards for
				the safety of fruits and vegetables</header>
						<subsection id="HF51FDF33746C472396F7B3BD22025768"><enum>(a)</enum><header>Definition</header><text display-inline="yes-display-inline">For purposes of this section, the term
				<term>fruits and vegetables</term> shall mean raw agricultural products as
				defined in section 201(r).</text>
						</subsection><subsection id="H7375BFC0A48046D3B638438E2EFD4BB8"><enum>(b)</enum><header>In
				general</header><text>Not later than 1 year after enactment of this section,
				the Secretary, in consultation with the Secretary of Agriculture and
				representatives of State departments of agriculture, shall publish a notice of
				proposed rulemaking to establish regulations for the safe production,
				harvesting, and packaging of those types of fruits and vegetables for which the
				Secretary has determined that such regulations are necessary to minimize the
				risk of serious adverse health consequences.</text>
						</subsection><subsection id="HC24F8236FDC64C9BBC7EB111B7EDB5CC"><enum>(c)</enum><header>Final
				regulation</header><text>Not later than 1 year after the close of the comment
				period on the notice of proposed rulemaking under subsection (a), the Secretary
				shall adopt a final regulation covering those types of fruits and vegetables
				for which the Secretary has determined that such regulations are necessary to
				minimize the risk of serious adverse health consequences. The final regulation
				shall provide a reasonable period of time for implementation, taking into
				account the needs of small businesses for additional time to comply. The final
				regulation shall provide for coordination of education and enforcement
				activities by the Secretary of Agriculture, appropriate State and local
				agencies, and appropriate agencies of foreign governments.</text>
						</subsection><subsection display-inline="no-display-inline" id="HB6C536BD55C043C484751CE600CFC626"><enum>(d)</enum><header>Cooperation</header><text display-inline="yes-display-inline">The Secretary shall work with State and
				local public health officials in carrying out this section. The Secretary shall
				coordinate activities with the Secretary of Agriculture related to on-farm
				requirements for growers including the development of food safety standards and
				enforcement mechanisms that will address regulations adopted under subsection
				(c).</text>
						</subsection><subsection id="HB2C6C64FF33841B3BE8DF64900C78CFE"><enum>(e)</enum><header>Criteria</header><text>The
				regulations adopted under subsection (b) shall—</text>
							<paragraph id="HF5832C31C2CE40B5945B7E3F2EE372A9"><enum>(1)</enum><text>set forth those
				procedures, processes, and practices as the Secretary determines to be
				reasonably necessary to minimize the introduction of known or reasonably
				foreseeable biological, chemical, and physical hazards into fruits and
				vegetables and to provide reasonable assurance that the fruits and vegetables
				are not adulterated under section 402;</text>
							</paragraph><paragraph id="HE6377EF72B1546E68CE8B0E3F169BB61"><enum>(2)</enum><text>permit States and
				foreign governments to seek variances from the requirements of the regulations,
				where the State or foreign government determines that the variance is necessary
				in light of local growing conditions and that the procedures, processes, and
				practices to be followed under the variance are reasonably likely to ensure
				that the fruits or vegetables are not adulterated within the meaning of section
				402 to the same extent as the requirements of the regulation adopted under
				subsection (b);</text>
							</paragraph><paragraph id="H7B9319202ADD4A6B97EC79F172B4A991"><enum>(3)</enum><text>require that any
				State or foreign government seeking a variance under paragraph (2) shall first
				notify the Secretary of the intended variance and the basis for it, and the
				Secretary may grant the variance after 90 days of such notification if
				Secretary does not communicate objections or modifications to the intended
				variance to the respective State or foreign government prior to the conclusion
				of the 90-day period; and</text>
							</paragraph><paragraph id="H7073CBC15AE64D4A0077570664E3087B"><enum>(4)</enum><text>provide for
				publication of notices of requests for variances under paragraph (2) at the
				time they are received.</text>
							</paragraph></subsection><subsection id="HD5488EFC58DC46F8B12000009265B67C"><enum>(f)</enum><header>Enforcement</header><text display-inline="yes-display-inline">The Secretary shall coordinate enforcement
				under this section with appropriate State and local agencies and with
				appropriate agencies of foreign governments. In enforcing any standards for the
				safety of fruits and vegetables, the Secretary shall, to the maximum extent
				practicable, use the Department of Agriculture and state agricultural agencies.
				Such enforcement may be in the form of audit-based verification systems or
				other methods of inspection.</text>
						</subsection><subsection id="H276B9BC3320A4E19AD580051814CF5B3"><enum>(g)</enum><header>Guidance for
				good agricultural practices</header><text>Not later than 1 year after the date
				of the enactment of this section, the Secretary shall publish updated guidance,
				in coordination with the Secretary of Agriculture and representatives of State
				departments of agriculture, based on the most currently available scientific
				evidence, for the safe production, harvesting, and packaging of fruits and
				vegetables. The Secretary shall publish subsequently updated guidance, as
				necessary.</text>
						</subsection><subsection id="H2B5AD3C9651B42AF85E12FCE0366A2F8"><enum>(h)</enum><header>Scope</header><text>This
				section shall apply to the production, harvesting, and packaging of fruits and
				vegetables intended for human consumption, but not to—</text>
							<paragraph id="H6EAE68B3C3804167BF9293A4884B7D59"><enum>(1)</enum><text>activities
				involving the further processing of fruits and vegetables which shall be
				subject to section 418; or</text>
							</paragraph><paragraph id="H4E56FCEC27F543DFAC02A858A8D534A1"><enum>(2)</enum><text display-inline="yes-display-inline">those activities that occur in a retail
				food establishment (as such term is defined in regulations to carry out section
				415(b)(1)).</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H488FAC82BB5E4505A17B33C00A7973F"><enum>(b)</enum><header>Prohibited</header><text>Section
			 301 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/331">21 U.S.C. 331</external-xref>), as amended by
			 sections 4(d) and 5(b), is further amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H176C46614DEA41A200E8405F419742DF" style="OLC">
					<paragraph id="H5E9EC0C8EA9749C693DCFBEA4630F452" indent="up1"><enum>(qq)</enum><text display-inline="yes-display-inline">Production, harvesting, or packaging of
				fruits or vegetables not in accordance with the regulations or a variance
				issued under section
				419(d)(2).</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section display-inline="no-display-inline" id="H7A707B31EE4E479380E4CDE81670F546" section-type="subsequent-section"><enum>10.</enum><header>Targeting of
			 inspection resources for domestic facilities and points of entry</header><text display-inline="no-display-inline">Chapter IV of the Federal Food, Drug, and
			 Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/341">21 U.S.C. 341 et seq.</external-xref>), as amended by sections 4(a) and 9(a), is
			 amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H2B243C7C271C4817ABB5DFE84799F9A9" style="OLC">
				<section id="H6711F978E5674801B94D48F61FEB0741"><enum>420.</enum><header>Targeting of
				inspection resources for domestic facilities and points of entry</header>
					<subsection id="H583E7ECD1AE34D4982FE988FA97DF5BD"><enum>(a)</enum><header>Identification
				and inspection of facilities</header>
						<paragraph id="H103AF40E9D8E485CB33E43D0B5CE656D"><enum>(1)</enum><header>Identification</header><text display-inline="yes-display-inline">The Secretary shall allocate resources to
				inspect facilities according to the risk profile of the facilities, which shall
				be based on the following factors:</text>
							<subparagraph id="H3C8C65EAD0CD4A70AB33ED9449EEF293"><enum>(A)</enum><text>The risk profile
				of the food manufactured, processed, packed, handled, prepared, treated,
				distributed, or stored at the facility.</text>
							</subparagraph><subparagraph id="HBC5F0F97F446415182DF135E14A49189"><enum>(B)</enum><text>The facility's
				history of food recalls, outbreaks, and violations of food safety
				standards.</text>
							</subparagraph><subparagraph id="H18D411476E994EADA60953A9B463A3D2"><enum>(C)</enum><text>The rigor of the
				facility's hazard analysis and risk-based preventive controls.</text>
							</subparagraph><subparagraph id="H6597E3D1B8FB49B7A2AC27DFD16FD780"><enum>(D)</enum><text display-inline="yes-display-inline">Whether the facility has been certified to
				conform with United States food safety standards by a recognized third party
				certification program under section 421.</text>
							</subparagraph><subparagraph id="H6C4A08DD680147E5891C3300BC5FC574"><enum>(E)</enum><text>Any other criteria
				deemed necessary and appropriate by the Secretary for purposes of allocating
				inspection resources.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2A0612A3181143978CEA04D06059875"><enum>(2)</enum><header>Inspections</header><text>The
				Secretary shall conduct inspections of domestic facilities identified under
				paragraph (1) as high-risk facilities not less often than once a year.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H4DB7A30EE1594640B0ED5E0393D1074F"><enum>(b)</enum><header>Identification
				and inspection of points of entry</header><text>The Secretary shall inspect
				shipments of food imported into the United States according to the risk profile
				of the food shipment, which shall be based on the following factors:</text>
						<paragraph id="H69AEABBCCD58468BBF651711778D59B5"><enum>(1)</enum><text>The risk profile
				of the food imported.</text>
						</paragraph><paragraph id="HF8703059A36D4E3FAEA07D7145385511"><enum>(2)</enum><text>The risk profile
				of the origin of the food imported.</text>
						</paragraph><paragraph id="HD433D4F5152E409E9CA6ED4E8CCDF6D"><enum>(3)</enum><text>The history of food
				recalls, outbreaks, and violations of food safety standards of the food
				importer.</text>
						</paragraph><paragraph id="H56AD216E3EFE433190D0F1A97434C223"><enum>(4)</enum><text>The rigor of the
				foreign supplier verification of the food importer under section 805.</text>
						</paragraph><paragraph id="H4068371E86A4462C8157EACCE44F5EC"><enum>(5)</enum><text>Whether the food
				importer participates in the Voluntary Qualified Importer Program under section
				806.</text>
						</paragraph><paragraph id="H3D813057F3BF4DC38859FAC8BC203C2"><enum>(6)</enum><text display-inline="yes-display-inline">Whether the facility has been certified to
				conform with United States food safety standards by a recognized third party
				certification program under section 421.</text>
						</paragraph><paragraph id="H25A2923D41AB48FE9448A0D654D5462B"><enum>(7)</enum><text>Any other criteria
				deemed necessary and appropriate by the Secretary for purposes of allocating
				inspection resources.</text>
						</paragraph></subsection><subsection id="H5A088E915D244950B43817CCF8FAEA1"><enum>(c)</enum><header>Facility</header><text>For
				purposes of this section, the term <term>facility</term> has the meaning given
				that term in section
				415.</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HBCC7D001C00C471FA0D603D1ED4C1C9C"><enum>11.</enum><header>Recognition of
			 third party certification programs</header><text display-inline="no-display-inline">Chapter IV of the Federal Food, Drug, and
			 Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/341">21 U.S.C. 341 et seq.</external-xref>), as amended by sections 4(a), 9(a), and
			 10, is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H026C7A71145D40FFA2F85FCE01068CF1" style="OLC">
				<section id="H08D8FEAF28D44410878211B515F9EED3"><enum>421.</enum><header>Recognition of
				third party certification programs</header>
					<subsection id="H60FFF5AB319C4B769E3BE4C28D00C1AA"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">Beginning not later
				than 2 years after the date of the enactment of this section, the Secretary
				shall establish a process under which a third party may apply to the Secretary
				for recognition of a third party certification program it operates.</text>
					</subsection><subsection id="HAD85E3F1CC1343D5B934D30383D99DB7"><enum>(b)</enum><header>Recognition of
				programs</header>
						<paragraph id="H9F42F9FDE3BC488A96AE6E3326F57D8D"><enum>(1)</enum><header>In
				general</header><text>The Secretary may not recognize a third party with
				respect to its operation of a third party certification program unless the
				following requirements are met:</text>
							<subparagraph id="H2CCB5387F2DE4EA5B700544C00301D7F"><enum>(A)</enum><text display-inline="yes-display-inline">The third party has demonstrated the
				capacity and competence to operate a third party certification program.</text>
							</subparagraph><subparagraph id="H0BF7F66A1F8C4F148117EEAA56C3AFE"><enum>(B)</enum><text>The processes and
				standards used by the third party in the auditing and certification of food
				processors and producers are sufficient to verify compliance of such producers
				and processors with federal food safety standards.</text>
							</subparagraph><subparagraph id="H6009320A023645CFBDFEF782A7E4CC61"><enum>(C)</enum><text>The third party
				must conform to requirements established by the Secretary, including periodic
				reevaluation by the Secretary. In establishing such requirements, the Secretary
				shall consider existing standards and procedures established by national and
				international accreditation organizations.</text>
							</subparagraph></paragraph><paragraph id="H314CAC419F854698B1B43078B0D72630"><enum>(2)</enum><header>Application of
				accreditation</header><text>In approving third parties with respect to third
				party accreditation programs under this section, the Secretary may take into
				account the accreditation of such entities and programs by national and
				international accreditation organizations.</text>
						</paragraph><paragraph id="HEEBF8E01A8084A7FBBA5EDF98E3EED9F"><enum>(3)</enum><header>Registry</header><text display-inline="yes-display-inline">The Secretary shall maintain a registry of
				recognized third party certification programs.</text>
						</paragraph></subsection><subsection id="HB3829966107F438AA9CE89D5C2962E78"><enum>(c)</enum><header>Third party
				certification program defined</header><text display-inline="yes-display-inline">In this section:</text>
						<paragraph id="H779F6F58DFEE43469E6017AD75A17FB"><enum>(1)</enum><text>The term
				<term>third party certification program</term> means an independent auditing
				and certification program—</text>
							<subparagraph id="H70548DA44A8447848CD08690004ED7F"><enum>(A)</enum><text>that evaluates the
				food safety management systems and practices of food producers and processors
				using recognized auditing standards; and</text>
							</subparagraph><subparagraph id="HDE945D982C8244629300E0D459EA4C4"><enum>(B)</enum><text>that only certifies
				such producers or processors that it determines are in compliance with such
				standards.</text>
							</subparagraph></paragraph><paragraph id="H672F1716B41A4900833E7EF4DFE85E38"><enum>(2)</enum><text>The term
				<term>recognized third party certification program</term> means a third party
				certification program, and the entity operating which, is recognized under this
				section.</text>
						</paragraph></subsection><subsection id="H08F137A8FBB240DDBE6B1ECC20D634A9"><enum>(d)</enum><header>Construction</header><text display-inline="yes-display-inline">Nothing in the section should be construed
				to limit the ability of the Secretary or a designated agent of the Secretary to
				conduct random checks of imported food or audit facilities as the Secretary
				deems necessary to ensure compliance with federal food safety standards.</text>
					</subsection><subsection id="HA24E793F25C3477B87CF78BDFB7C02FC"><enum>(e)</enum><header>Termination of
				recognition</header><text display-inline="yes-display-inline">The Secretary may
				terminate the recognition of a third party with respect to its operation of a
				third party accreditation program under this section—</text>
						<paragraph id="HD0646ECA6A1E47389800A3DD10094D19"><enum>(1)</enum><text>following an
				investigation and finding by the Secretary that the third party or program is
				no longer in compliance with requirements for recognition under this section;
				or</text>
						</paragraph><paragraph id="H86FC2F3D1C1748189FF26C85469470E1"><enum>(2)</enum><text>following the
				party’s refusal to allow United States officials to conduct such audits as may
				be necessary to ensure continued compliance of the entity and program with the
				applicable requirements of this
				section.</text>
						</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section display-inline="no-display-inline" id="HA88242EE1D084038ADAC65AD237DBB66"><enum>12.</enum><header>Fees relating to
			 food</header>
			<subsection id="HDF922096D167488888A03098CD29E96F"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Chapter VII of the
			 Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/371">21 U.S.C. 371 et seq.</external-xref>) is amended—</text>
				<paragraph id="H630E07C593EB4F3496C4BC10D7EDCC5D"><enum>(1)</enum><text>by redesignating
			 sections 741 and 742 as sections 744 and 745, respectively; and</text>
				</paragraph><paragraph id="HE1B0A2DED93B4EBF848E14A318073BF3"><enum>(2)</enum><text>by adding at the
			 end of subchapter C the following:</text>
					<quoted-block display-inline="no-display-inline" id="H9DED54E177AD45148745D0B908231300" style="OLC">
						<part id="H2DB9C50FC0CE4FE8B7CE87EEDDB6E46C"><enum>3</enum><header>Fees
				Relating to Food</header>
							<section display-inline="no-display-inline" id="HEDFC7C7BE8374FB084DCDD94494BDB9C"><enum>741.</enum><header>Authority to
				collect and use reimbursable fees for voluntary qualified importer
				program</header>
								<subsection id="H4EC5A8E3B37442C0A507633773267B7D"><enum>(a)</enum><header>Fees for
				voluntary qualified importer program</header><text>For fiscal year 2009 and
				each subsequent fiscal year, the Secretary shall, in accordance with this
				section, assess and collect fees from each importer required to register under
				section 415 which participates in the voluntary qualified importer program
				under section 806 in such year, to reimburse the Food and Drug Administration
				for the administrative costs of that importer’s participation in such program
				for such year.</text>
								</subsection><subsection id="HCF8F5FE7FAE24674B438E0D6A66BBC5"><enum>(b)</enum><header>Establishment of
				fees</header>
									<paragraph id="H4BEFDBB2CFCD4F75B762B49429F6007C"><enum>(1)</enum><header>In
				general</header><text>Subject to subsection (c), the Secretary shall establish
				a fee schedule for reimbursable expenses to be collected under this section for
				each fiscal year specified in section (a), based on the methodology described
				in paragraph (2). The Secretary shall publish such fee schedule for a fiscal
				year in a Federal Register notice not later than 60 days before the beginning
				of each fiscal year.</text>
									</paragraph><paragraph id="H23F785FABFB6405EA3B7971250CE98AF"><enum>(2)</enum><header>Fee methodology
				and fee schedule</header>
										<subparagraph id="H25D6CF70A00E41DBBF23008B8EBFF841"><enum>(A)</enum><header>Fee
				methodology</header><text>Fees amounts established for collection shall be
				based on 100 percent of the Secretary’s actual costs of the activities for each
				importer participating in the voluntary qualified importer program, as
				described in subsection (a), for such fiscal year.</text>
										</subparagraph><subparagraph id="HD0776800A3E84C16BE008012F0EA31F9"><enum>(B)</enum><header>Fee
				schedule</header><text>The Secretary shall establish in each such fiscal year a
				fee schedule to include all reimbursable expenses, including an hourly rate for
				salaries and expenses for government personnel carrying out of such activities,
				as well as a rate to cover indirect costs necessary for the efficient conduct
				of such activities. The Secretary’s publication of the fee schedule under
				paragraph (1) shall be accompanied by a written explanation of the methodology
				for determining each fee on the fee schedule.</text>
										</subparagraph><subparagraph id="H219A5004222043E7893DFC13D95B6DD7"><enum>(C)</enum><header>Other
				considerations</header><text>In establishing the fee schedule for a fiscal
				year, the Secretary shall also consider the need to account for any adjustment
				of fees under paragraph (3) and such other factors as the Secretary determines
				appropriate.</text>
										</subparagraph></paragraph><paragraph id="H98C82DF26A9B4133BD6185DDEF499023"><enum>(3)</enum><header>Adjustment of
				fees</header><text>The Secretary may provide for the waiver or reduction of
				fees under this subsection based on financial hardship or other circumstances
				as determined appropriate by the Secretary.</text>
									</paragraph><paragraph id="H854477A1527B447AA65CE436F05F95BB"><enum>(4)</enum><header>Compliance with
				international agreements</header><text>Nothing in this section shall be
				construed to authorize the assessment of any fee inconsistent with the
				agreement establishing the World Trade Organization or any other treaty or
				international agreement to which the United States is a party.</text>
									</paragraph></subsection><subsection id="HE5E046FACFCA46AEBD002FDC6311D420"><enum>(c)</enum><header>Crediting and
				availability of fees</header><text>Fees collected for each fiscal year under
				this section shall be credited to a fund, hereby established in the Treasury of
				the United States and to be known as the <quote>Food and Drug Administration
				Food User Fee Account</quote>, and shall be available in accordance with
				appropriations Acts until expended, without fiscal year limitation. Such fees
				shall be made available solely to carry out the activities by the Center for
				Food Safety and Applied Nutrition and related activities of the Office of
				Regulatory Affairs related to the voluntary qualified importer program.</text>
								</subsection><subsection id="HAA85D572E59E476F8150322520610082"><enum>(d)</enum><header>Collection of
				fees</header>
									<paragraph id="HCE2BB35985884A280063718500E137F2"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall specify in the Federal Register
				notice described in subsection (b)(1) the time and manner in which fees
				assessed under this section shall be collected, but in no case shall a facility
				be required to pay a reimbursable fee less than 60 days after the date of
				receipt of a notice from the Secretary assessing such fee.</text>
									</paragraph><paragraph id="H6342DB11F0934BE9B3633D302DB8D6E"><enum>(2)</enum><header>Collection of
				unpaid fees</header><text>In any case where the Secretary does not receive
				payment of a fee assessed under this section within 30 days after it is due,
				such fee shall be treated as a claim of the United States Government subject to
				provisions of subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/37">chapter 37</external-xref> of title 31, United States
				Code.</text>
									</paragraph></subsection><subsection id="H2C478B8AC36941F3BD84DAA400BD26FB"><enum>(e)</enum><header>Annual report to
				Congress</header><text>Not later than 90 days after the end of each fiscal year
				for which fees are assessed under this section, the Secretary shall submit a
				report to the Committee on Health, Education, Labor, and Pensions of the United
				States Senate and the Committee on Energy and Commerce of the United States
				House of Representatives, that includes a description of fees assessed and
				collected for each such fiscal year and a summary description of the entities
				paying such fees and the types of business in which such entities
				engage.</text>
								</subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H8E74B7A233C24DEEBAFB9B5338B33551"><enum>(b)</enum><header>Export
			 certification fees for foods and animal feed</header>
				<paragraph id="H833844CBE96D4B4C84E64B33C93EBD20"><enum>(1)</enum><header>Authority for
			 export certifications for food, including animal feed</header><text>Section
			 801(e)(4)(A) of the Federal Food, Drug, and Cosmetic Act (21 U.S.C.
			 381(e)(4)(A)) is amended—</text>
					<subparagraph id="HE12B8017449D44178F5E2504C02C691D"><enum>(A)</enum><text>in the matter
			 preceding clause (i), by striking <quote>a drug,</quote> and inserting <quote>a
			 food, drug</quote>;</text>
					</subparagraph><subparagraph id="HF3486FDA0F8E4E4684AC8D00942C9746"><enum>(B)</enum><text>in clause (i), by
			 striking <quote>exported drug,</quote> and inserting <quote>exported food,
			 drug,</quote>; and</text>
					</subparagraph><subparagraph id="H6DC33E0A9E7745AABD1229994267EA8F"><enum>(C)</enum><text display-inline="yes-display-inline">in clause (ii), by striking <quote>the
			 drug</quote> and <quote>the drug,</quote> and inserting <quote>the food,
			 drug</quote> and <quote>the food, drug,</quote>, respectively.</text>
					</subparagraph></paragraph><paragraph id="H82A80FB152D441D8BF38499C16A085E5"><enum>(2)</enum><header>Treatment of
			 fees</header><text display-inline="yes-display-inline">Section 801(c)(4) of
			 such Act (<external-xref legal-doc="usc" parsable-cite="usc/21/381">21 U.S.C. 381(3)(4)</external-xref>) is amended—</text>
					<subparagraph id="HEFAB445DDD9C4F6F89A1C2886C602F11"><enum>(A)</enum><text>in subparagraph
			 (B), by striking all that follows the first sentence; and</text>
					</subparagraph><subparagraph id="HDFE48E2A20D44A4980A544F312B9F86B"><enum>(B)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="HDCB6572161BB4AE5B4D15E24C3B581CE" style="traditional">
							<subparagraph id="HBE60E8DB5FE543A7802D5893BEA95DF" indent="up2"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="HFCEFA632C8C34D18AC37DFEDF438585B"><enum>(i)</enum><text display-inline="yes-display-inline">In the case of fees collected for a fiscal
				year pursuant to this paragraph for certification of exported drugs, animal
				drugs, or devices, the fees shall be credited to the appropriation account for
				salaries and expenses of the Food and Drug Administration and be available in
				accordance with appropriations Acts until expended, without fiscal year
				limitation. To cover the cost of issuing such certifications, such sums as
				necessary may be transferred from such appropriation account for salaries and
				expenses of the Food and Drug Administration without fiscal year limitation to
				such appropriation account for salaries and expenses with fiscal year
				limitation.</text>
								</clause><clause id="H7DC8CD031EEF443F84BF8B008EB334F3" indent="up1"><enum>(ii)</enum><text>In the case of fees collected for a
				fiscal year pursuant to this paragraph for the certification of exported foods,
				the fees shall be credited to the Food and Drug Administration Food User Fee
				Account and be available in accordance with appropriations Acts until expended,
				without fiscal year
				limitation.</text>
								</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H605E23B131904614A273C8009405BA51"><enum>(3)</enum><header>Clarification of
			 certification</header><text>Section 801(e)(4) of such Act (21 U.S.C.
			 381(e)(4)), as amended by paragraph (2), is further amended by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HD7FEBAB41C794230AD14AC914900F15F" style="traditional">
						<subparagraph id="HE16C3CF92608476DB88246FAD8B39D8" indent="up2"><enum>(D)</enum><text>For purposes of this paragraph, a
				certification by the Secretary shall be made on such basis, and in such form
				(including a publicly available listing) as the Secretary determines
				appropriate.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="HEB4C80ED6D2A46B9B6403C4CD89B89FB"><enum>13.</enum><header>Biennial
			 registration renewal</header><text display-inline="no-display-inline">Section
			 415(a) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/350d">21 U.S.C. 350d(a)</external-xref>) is
			 amended—</text>
			<paragraph id="H02B642E720DD4A93803E3780CCDDB665"><enum>(1)</enum><text>by redesignating
			 paragraphs (3) and (4) as paragraphs (4) and (5), respectively; and</text>
			</paragraph><paragraph id="H236CE81A1ECE45DC8C433743CED68948"><enum>(2)</enum><text>by inserting after
			 paragraph (2) the following:</text>
				<quoted-block display-inline="no-display-inline" id="HBD99AACAEA3E42A783D3F7C8BBD7CF2" style="OLC">
					<paragraph id="HD140B776AA6E4453928FFE1B7354973D"><enum>(3)</enum><header>Biennial
				registration renewal</header><text>On a biennial basis, a registrant that has
				submitted a registration under paragraph (1) shall submit to the Secretary a
				renewal registration containing the information described in paragraph (2). The
				Secretary may provide for an abbreviated registration renewal process for any
				registrant that has not had any changes to such information since the
				registrant submitted the preceding registration or registration renewal for the
				facility
				involved.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H0D0F25E926E64FCF855F8237284963BF"><enum>14.</enum><header>Mandatory recall
			 authority</header>
			<subsection id="H03F4668B004F4C0B9E3391EA2E76D24C"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 417 of the
			 Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/350f">21 U.S.C. 350f</external-xref>) is amended by adding at
			 the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HB138C8FE3F0541BD96647FFE6E0064B1" style="OLC">
					<subsection id="H42E112386FE847EF91DFBA00EFF5052"><enum>(l)</enum><header>Recall of
				reportable food</header>
						<paragraph id="H43D030417B50496EB09C00A8F53D7975"><enum>(1)</enum><header>Voluntary
				procedures</header><text display-inline="yes-display-inline">If the Secretary
				determines that there is a reasonable probability that the use of or exposure
				to an article of food (other than infant formula) will cause serious adverse
				health consequences, the Secretary shall provide the responsible party that
				produced or processed packed or held the reportable food with an opportunity
				to—</text>
							<subparagraph id="HE4EB1C7CCB5049459C50E9A3D690CD48"><enum>(A)</enum><text>cease distribution
				of such article;</text>
							</subparagraph><subparagraph id="H2EE60B83A4FE483CABACCCD2123CF0BC"><enum>(B)</enum><text>notify all
				persons—</text>
								<clause id="HA351CEFEC63F4D4E8823F3F8894435E8"><enum>(i)</enum><text>producing,
				manufacturing, packing, processing, preparing, treating, packaging,
				distributing, or holding such articles; or</text>
								</clause><clause id="HB0F081F783914150A2274E22D137F602"><enum>(ii)</enum><text>to which such
				article has been distributed, transported, or sold, to immediately cease
				distribution of such article;</text>
								</clause></subparagraph><subparagraph id="H7EB7D17E861E4EC1A93F3B09005BA41B"><enum>(C)</enum><text>recall such
				article;</text>
							</subparagraph><subparagraph id="HDD367FE8A88B49009B5B2CDDE4DB0B7"><enum>(D)</enum><text>provide, in
				consultation with the Secretary and where deemed necessary, notice to consumers
				to whom such article was, or may have been, distributed; and</text>
							</subparagraph><subparagraph id="H21DA5C863D2540F8B906E22900C273F0"><enum>(E)</enum><text>take any
				combination of the above measures, as appropriate in the circumstances.</text>
							</subparagraph><continuation-text continuation-text-level="paragraph">The
				Secretary may not delegate recall authority under this subsection to any person
				other than the Commissioner.</continuation-text></paragraph><paragraph id="H2B0D3FB2C6384459AA4B27A236F887F6"><enum>(2)</enum><header>Pre-hearing
				order to cease distribution and give notice</header><text>If the responsible
				party refuses to or does not voluntarily cease distribution, make notification,
				recall such article, or provide notice to consumers as applicable, the
				Secretary may, by order, require, as the Secretary deems necessary, such person
				to—</text>
							<subparagraph id="H7877C1091A4947478EA0FF013EA28CA9"><enum>(A)</enum><text>immediately cease
				distribution of such article;</text>
							</subparagraph><subparagraph id="H42D50935CF3845AC8946099517BFE2E2"><enum>(B)</enum><text>immediately notify
				all persons—</text>
								<clause id="HFBE000C24EC94328BC552098EDAC4DC9"><enum>(i)</enum><text>producing,
				manufacturing, packing, processing, preparing, treating, packaging,
				distributing, or holding such articles; or</text>
								</clause><clause id="H6AE64B062B184984A6BEAB81618C701F"><enum>(ii)</enum><text>to which such
				article has been distributed, transported, or sold, to immediately cease
				distribution of such article; or</text>
								</clause></subparagraph><subparagraph id="H810A6EB9DA2C4319BECF68B969A199CE"><enum>(C)</enum><text>immediately take
				the actions specified in both subparagraphs (A) and (B).</text>
							</subparagraph></paragraph><paragraph id="H9AC4F3B16C0D4C57A11C099244CFF8A6"><enum>(3)</enum><header>Notification of
				consumers by secretary</header><text>The Secretary may, as the Secretary deems
				necessary, provide notice to consumers to whom such article was, or may have
				been, distributed.</text>
						</paragraph><paragraph id="HF7C377EC674D401CB2AB5F7F4E8F4F81"><enum>(4)</enum><header>Hearing on
				order</header><text>The Secretary shall provide the responsible party subject
				to an order under paragraph (2) with an opportunity for a hearing, to be held
				as soon as possible but not later than 2 days after the date of the issuance of
				the order, on the actions required by the order and on why the article that is
				the subject of the order should not be recalled.</text>
						</paragraph><paragraph id="H5279954023054291B5A89587B6016308"><enum>(5)</enum><header>Post-hearing
				recall order</header>
							<subparagraph id="H10CD4F1AB3364B51BD1261AF94A3F26E"><enum>(A)</enum><header>Amendment of
				order</header><text>If, after providing opportunity for a hearing under
				paragraph (4), the Secretary determines that removal of the product is
				necessary, the Secretary, as the Secretary deems necessary, may—</text>
								<clause id="H62D51DD514A742C2B7702E2CEDEFF66E"><enum>(i)</enum><text>amend the order to
				require recall of such article or other appropriate action;</text>
								</clause><clause id="H546A6963764443B89644676EF2D379AC"><enum>(ii)</enum><text>specify a
				timetable in which the recall shall occur;</text>
								</clause><clause id="HAC78A7B5B94144B98C2D6E1300828C65"><enum>(iii)</enum><text>require periodic
				reports to the Secretary describing the progress of the recall; and</text>
								</clause><clause id="H9A3FDD10873A4BA7B7F3D36290D47F5B"><enum>(iv)</enum><text>provide notice to
				consumers to whom such article was, or may have been, distributed.</text>
								</clause></subparagraph><subparagraph id="HCF3F3531BE9146DA91CAF2BDFAB96F7E"><enum>(B)</enum><header>Vacating of
				order</header><text>If, after such a hearing, the Secretary determines that
				adequate grounds do not exist to continue the actions required by the order,
				the Secretary shall vacate or modify the order.</text>
							</subparagraph></paragraph><paragraph id="HF5044A706016461B808577B3624D52BC"><enum>(6)</enum><header>Failure To
				comply with recall order</header><text>Any person who does not comply with a
				recall order under this subsection shall be liable to a fine not to exceed
				$10,000 for each day of such noncompliance or to a term of imprisonment not
				exceeding 6 months, or both.</text>
						</paragraph><paragraph id="HADBE93F6D4F34F7C9069592CABDBD1D8"><enum>(7)</enum><header>Remedies not
				exclusive</header><text>The remedies provided in this subsection shall be in
				addition to and not exclusive of other remedies that may be available.</text>
						</paragraph><paragraph display-inline="no-display-inline" id="H0D6977FD352E4C36BCDBFB65E85CF868"><enum>(8)</enum><header>Cooperation</header><text>The
				Secretary shall work with the Secretary of Agriculture and State and local
				public health officials in carrying out this
				subsection.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HC61AC9275113409C8C9D79B2AF68EDA9"><enum>(b)</enum><header>Prohibited
			 Acts</header><text>Section 301 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/21/331">21 U.S.C. 331 et seq.</external-xref>), as amended
			 by sections 4(d), 5(b), and 9(b), is further amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="HCC13AE82612A4E638212AF1B3CD21E5D" style="OLC">
					<paragraph id="HC83C10DBE0A843C4A1DC907C3BEB4418" indent="up1"><enum>(rr)</enum><text display-inline="yes-display-inline">The refusal or failure to follow an order
				under section
				417(l).</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H289CA8B40EC945B19BD9E0CCC9DD5DE2"><enum>15.</enum><header>Building
			 capacity of foreign governments</header>
			<subsection id="H5C1F704BCC48456ABBA390A4A334FA18"><enum>(a)</enum><header>In
			 general</header><text>The Secretary of Health and Human Services (in this
			 section referred to as the <quote>Secretary</quote>) shall, within 2 years
			 after the date of the enactment of this Act, develop a comprehensive plan to
			 expand the technical, scientific, and regulatory capacity of foreign
			 governments, and their respective food industries, from which foods are
			 exported to the United States.</text>
			</subsection><subsection id="HFBD1213338C24C18AC442BC2364FECFB"><enum>(b)</enum><header>Consultation</header><text>In
			 developing the plan under subsection (a), the Secretary shall consult with the
			 Secretary of Agriculture, the Secretary of State, the Secretary of Treasury,
			 and the Secretary of Commerce, and representatives of the food industry and
			 nongovernmental organizations that represent the interests of consumers, and
			 other stakeholders.</text>
			</subsection><subsection id="H97E17C0C9E9845738CBFDE7601704853"><enum>(c)</enum><header>Plan</header><text>The
			 plan developed under subsection (a) shall include, as appropriate, the
			 following:</text>
				<paragraph id="H5E32FC221E8D40B9BCD67C0281C50E0"><enum>(1)</enum><text>Recommendations for
			 bilateral and multilateral agreements, including provisions to provide for
			 responsibility of exporting countries to ensure the safety of food.</text>
				</paragraph><paragraph id="H55A3B65A0AAA4BF1BD6797E1566185A0"><enum>(2)</enum><text>Provisions for
			 electronic data sharing.</text>
				</paragraph><paragraph id="HF5CE507D0DAD4628BCBAAFCD87A69F8E"><enum>(3)</enum><text>Provisions for
			 reciprocal inspectional authority.</text>
				</paragraph><paragraph id="H6067CA6E236E4AC4AB6952154CB7514D"><enum>(4)</enum><text>Training of
			 foreign governments and ingredient and food producers on United States
			 requirements for safe food.</text>
				</paragraph><paragraph id="H33A1FA96B00441F9B47D9E5900141DCA"><enum>(5)</enum><text>Recommendations to
			 harmonize requirements under the Codex Alimentarius.</text>
				</paragraph><paragraph id="HAE6744A0B19A4621919B003BE6288DAB"><enum>(6)</enum><text>Provisions for the
			 multilateral acceptance of laboratory methods and detection techniques.</text>
				</paragraph></subsection></section><section id="H74526A84927E4CA88091A651AF62E110"><enum>16.</enum><header>Domestic
			 capacity building and annual report on food safety programs</header>
			<subsection id="H8784B5B9EE0C461E90E5CAEF5CF1CD00"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary of
			 Health and Human Services (in this section referred to as the
			 <quote>Secretary</quote>) shall, not later than December 31 of each year
			 following the first full year after the date of the enactment of this Act, and
			 annually thereafter, submit to the Congress a report on the following:</text>
				<paragraph id="HA2A67C7D0DB540859065FDF6ED1DC00"><enum>(1)</enum><text>Progress in
			 implementing the food protection plan and the import safety action plan issued
			 in November 2007.</text>
				</paragraph><paragraph id="HEB82C20C49024F1184AEDF7618CFB500"><enum>(2)</enum><text>Progress in
			 modernizing good manufacturing practice regulations for food.</text>
				</paragraph><paragraph id="HFE51C04FA2F44F19AB1C8FBE93062645"><enum>(3)</enum><text>Progress in
			 implementing the requirements and programs required under this Act.</text>
				</paragraph><paragraph id="H35AF0F2A62C94EB7A375FB8C35F8A58F"><enum>(4)</enum><text>Adequacy of
			 resources available to the Secretary to ensure the safety of the food
			 supply.</text>
				</paragraph><paragraph id="H28F2DB90A7F04602BDEE544E74498967"><enum>(5)</enum><text>Adequacy of
			 laboratory facilities available to the Secretary to conduct analyses on food
			 and progress in the development of rapid detection technologies.</text>
				</paragraph><paragraph id="HA2BB9F8D7E99421980A562D07B2C7F1B"><enum>(6)</enum><text>Progress in
			 modernizing the information technology used by the Secretary for food safety
			 related activities and progress in developing and implementing modern
			 information technology systems for the review and processing of foods offered
			 for importation into the United States.</text>
				</paragraph><paragraph id="H467AA5227D054284AB9432AE4CAF7BFB"><enum>(7)</enum><text display-inline="yes-display-inline">Food safety research projects conducted
			 during the previous year, including the extent to which these projects have
			 helped identify potential food safety hazards and have provided appropriate
			 preventive control steps to address such hazards.</text>
				</paragraph><paragraph id="HBA1AFB04402E4C6C86F36BAA677EDD67"><enum>(8)</enum><text display-inline="yes-display-inline">Federal-State coordination on food safety
			 activities and proposals to improve the effectiveness of such Federal-State
			 partnerships, including with respect to information sharing, conducting
			 inspections, performing analysis and sampling, and conducting education and
			 outreach.</text>
				</paragraph><paragraph id="H950F66E8E29B44C1ADCDBC45D0F27F8B"><enum>(9)</enum><text display-inline="yes-display-inline">Progress in increasing coordination between
			 relevant Federal, State, and local agencies responsible for food safety.</text>
				</paragraph></subsection><subsection display-inline="no-display-inline" id="HF89A1C183A3B48ADAF26EEB4096EF6F5"><enum>(b)</enum><header>Annual food
			 safety improvement plan</header><text display-inline="yes-display-inline">In
			 addition to the annual report to Congress under subsection (a), the Secretary
			 shall submit a plan for improving food safety infrastructure. Such plan shall
			 include steps to address inadequacies as described in the annual report.</text>
			</subsection></section><section id="HE7803D53791A404EB420BA58F25BCE80"><enum>17.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">There is
			 authorized to be appropriated $50,000,000 as necessary to carry out this
			 Act.</text>
