			</subsection></section><section commented="no" id="HB7185C11704744B993BA309B5D55FD34"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph commented="no" id="H39ADFACCE1ED4B70836CDFE49CDC0077"><enum>(1)</enum><text display-inline="yes-display-inline">As the world’s largest economy, the United
			 States has an enormous stake in the future of the global trading system.</text>
			</paragraph><paragraph commented="no" id="H9AC3911A309E4F96BCDEDD20443EEFFA"><enum>(2)</enum><text display-inline="yes-display-inline">Exports are a crucial force driving the
			 United States economy and job creation.</text>
			</paragraph><paragraph commented="no" id="HD2030BDA765544F695283EF2C1A18DCC"><enum>(3)</enum><text display-inline="yes-display-inline">While nearly 97 percent of United States
			 exporters are small and medium enterprises (SMEs), SMEs account for just over
			 one-fourth of exports, leaving much room for growth.</text>
			</paragraph><paragraph commented="no" id="HC22ADCA2D315405F9FCD00936F6DF226"><enum>(4)</enum><text display-inline="yes-display-inline">Two-thirds of United States exporters have
			 fewer than 20 employees and sell to just one foreign market.</text>
			</paragraph><paragraph commented="no" id="HF7D13C9DD1524F479EC0E146A02820E1"><enum>(5)</enum><text display-inline="yes-display-inline">Manufacturers account for 61 percent of
			 total United States exports with small manufacturers accounting for
			 approximately 15 percent of total United States exports. Thirty percent of
			 small manufacturers do not currently export but would consider doing so if they
			 had more help in securing vital information on foreign markets, customers, and
			 export procedures.</text>
			</paragraph><paragraph commented="no" id="H0D6073E986BD42028C3F11A311AB7565"><enum>(6)</enum><text display-inline="yes-display-inline">United States small and medium enterprises
			 face tough competition from trading partners of the United States that
			 aggressively undertake export promotion programs that directly support and
			 underwrite the expanded growth in trade of their small and medium
			 enterprises.</text>
			</paragraph><paragraph commented="no" id="H2675A915F1D841768FD0F1168B4E73"><enum>(7)</enum><text display-inline="yes-display-inline">United States trade promotion is carried
			 out in part by 21 departments and agencies of the Federal Government.
			 Representatives from these Federal departments and agencies are members of the
			 Trade Promotion Coordinating Committee (TPCC), a Federal committee that has not
			 lived up to congressional intent to provide a seamless offering of export
			 promotion products and services due in part to the inadequate allocation of
			 resources and a lack of ultimate decision making budget input authority to
			 ensure effective results are achieved for the invested resources.</text>
			</paragraph></section><section commented="no" id="HA4D82E4A889D4BF3B3F00BD986EE554"><enum>3.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act and the amendments
			 made by this Act is to improve the performance and results of trade promotion
			 policies and programs of the Federal Government in accordance with the
			 Government Performance and Results Act of 1993 (<external-xref legal-doc="public-law" parsable-cite="pl/103/62">Public Law 103–62</external-xref>).</text>
		</section><title id="H2CCEE570455242389392DBFAAE01E943"><enum>I</enum><header>Amendments to
			 Export Enhancement Act of 1988</header>
			<section id="H5EC0756EAAA34A04B8BC74682DA8507E"><enum>101.</enum><header>Establishment
			 and purpose</header><text display-inline="no-display-inline">Section 2312 of
			 the Export Enhancement Act of 1988 (<external-xref legal-doc="usc" parsable-cite="usc/15/4727">15 U.S.C. 4727</external-xref>) is amended—</text>
				<paragraph id="H29D353FFDEB141FAB9A74C698797F4C6"><enum>(1)</enum><text>in subsection
			 (a)—</text>
					<subparagraph id="H7891FE5873624229846E77A428676344"><enum>(A)</enum><text>in the matter
			 preceding paragraph (1)—</text>
						<clause id="H60E637DD4EA147F3BB76A182C2F027FB"><enum>(i)</enum><text>by
			 inserting <quote>in the Executive Office of the President</quote> after
			 <quote>shall establish</quote>;</text>
						</clause><clause id="H97BC0E443FCE4BEDA121DCF7ECA41E19"><enum>(ii)</enum><text>by
			 striking <quote>Trade Promotion Coordinating Committee</quote> and inserting

			 by inserting <quote>and supervise implementation of</quote> after <quote>to
			 develop</quote>; and</text>

			 through (f), by striking <quote>TPCC</quote> each place it appears and
			 inserting <quote>Office</quote>.</text>
				</paragraph></section><section id="H85AAF303F5A0421DAEED9550598F6D31"><enum>102.</enum><header>Duties</header><text display-inline="no-display-inline">Section 2312(b) of the Export Enhancement
			 Act of 1988 (<external-xref legal-doc="usc" parsable-cite="usc/15/4727">15 U.S.C. 4727(b)</external-xref>) is amended—</text>
				<paragraph id="HCAB69542DAA7435CB7ECC4C83672C0E7"><enum>(1)</enum><text>by redesignating
			 paragraphs (1) through (6) as paragraphs (2) through (7), respectively;</text>
				</paragraph><paragraph id="H10402016B1DD41B382B8C3A742849233"><enum>(2)</enum><text>by inserting
			 before paragraph (2) (as redesignated) the following new paragraph:</text>

			 Export Enhancement Act of 1988 (<external-xref legal-doc="usc" parsable-cite="usc/15/4727">15 U.S.C. 4727(c)</external-xref>) is amended—</text>
				<paragraph id="HE314F3EF14CC4E6D00616468B9416BCB"><enum>(1)</enum><text>in paragraph
			 (1)—</text>
					<subparagraph id="HB20906F79755437CA2FE173958F4FD2C"><enum>(A)</enum><text>by striking
			 <quote>and explain</quote> and inserting <quote>, explain</quote>; and</text>
					</subparagraph><subparagraph id="H8A06738F7FAE4BF0B5D311AD1FE2AF2D"><enum>(B)</enum><text>by adding at the
			 end before the semicolon the following: <quote>, and detail the benchmarks for
			 the implementation of the priorities</quote>;</text>

			 by striking <quote>; and</quote> and inserting a period; and</text>

				</paragraph></section><section id="H371A54D9F1A84DC985CA00D6A3E9A9A9"><enum>104.</enum><header>Director and
			 Associate Directors</header><text display-inline="no-display-inline">Section
			 2312 of the Export Enhancement Act of 1988 (<external-xref legal-doc="usc" parsable-cite="usc/15/4727">15 U.S.C. 4727</external-xref>) is amended by
			 striking subsection (d) and inserting the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H3AA4F55C35D549BF8E5B9EE644FA8E97" style="OLC">
					<subsection id="H1AE5DF56B9C34381BCEA500EFA4071E"><enum>(d)</enum><header>Director and
				Associate Directors</header>
						<paragraph id="HD01B5D6D9B8F4F36B4D79BEC74EE65CC"><enum>(1)</enum><header>Director</header><text>There
				shall be at the head of the Office a Director of the Office of Trade Promotion,
				who shall—</text>
							<subparagraph id="HDEFDC670250A40C687D4CE89A6009827"><enum>(A)</enum><text>be appointed by
				the President, by and with the advice and consent of the Senate; and</text>
							</subparagraph><subparagraph id="HADAEFE2DE3374ACBB48C68439DDB2EE5"><enum>(B)</enum><text>be compensated at
				a rate consistent with the compensation of the directors of other offices
				within the Executive Office of the President.</text>
							</subparagraph></paragraph><paragraph id="HF14800D380304118B2FD8CAE8483C52"><enum>(2)</enum><header>Associate
				directors</header><text>The President may appoint not more than two Associate
				Directors of the Office of Trade Promotion, by and with the advice and consent
				of the Senate, who shall each—</text>
							<subparagraph id="H79D9F5B02A57402AA6B470F357637891"><enum>(A)</enum><text>be compensated at
				a rate not to exceed the rate provided for other associate directors of offices
				within the Executive Office of the President; and</text>
							</subparagraph><subparagraph id="HF104D95529874F61A9F0F0101DD21BE4"><enum>(B)</enum><text>perform such
				functions as the Director may
				prescribe.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H7A770ECBBF5B48DEB0F2EF1352DFDB8F"><enum>105.</enum><header>Staff; experts
			 and consultants</header><text display-inline="no-display-inline">Section 2312
			 of the Export Enhancement Act of 1988 (<external-xref legal-doc="usc" parsable-cite="usc/15/4727">15 U.S.C. 4727</external-xref>) is amended by striking
			 subsection (e) and inserting the following new subsection:</text>

							<subparagraph id="HE1DE4F614857427CA398AAB643A7BE9"><enum>(A)</enum><header>In
				general</header><text>The Director of the Office may appoint and fix the pay of
				additional personnel as the Director considers appropriate.</text>
							</subparagraph><subparagraph id="HE55E7E20196048FBA3791102C37633FD"><enum>(B)</enum><header>Staff of federal
				agencies</header><text>Upon request of the Director, the head of any Federal
				department or agency that is represented on the Advisory Board on Trade
				Promotion established pursuant to subsection (f) may detail any of the
				personnel of that department or agency to the Office to assist it in carrying
				out its duties under this section.</text>
							</subparagraph></paragraph><paragraph id="H38FDE8FB8B464DDDAAE4D2D6FD83467"><enum>(2)</enum><header>Experts and
				consultants</header><text>The Director of the Office may procure temporary and
				intermittent services under <external-xref legal-doc="usc" parsable-cite="usc/5/3109">section 3109(b)</external-xref> of title 5, United States Code, but
				at rates for individuals not to exceed the daily equivalent of the maximum
				annual rate of basic pay for GS–15 of the General
				Schedule.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="HAE96C0639B9642A08F7D72001056927D"><enum>106.</enum><header>Advisory Board
			 on Trade Promotion</header>
				<subsection id="H92F651C276CC4E598744E64F64A5F2A6"><enum>(a)</enum><header>Advisory Board
			 on Trade Promotion</header><text display-inline="yes-display-inline">Section
			 2312 of the Export Enhancement Act of 1988 (<external-xref legal-doc="usc" parsable-cite="usc/15/4727">15 U.S.C. 4727</external-xref>) is amended—</text>
					<paragraph id="HA9725AE2BFB54D5498B8385300DEB343"><enum>(1)</enum><text>by redesignating
			 subsection (f) as subsection (g); and</text>
					</paragraph><paragraph id="H9BE201F8D79A405992BBBB0096C0D364"><enum>(2)</enum><text>by inserting after
			 subsection (e) the following new subsection:</text>
						<quoted-block display-inline="no-display-inline" id="H2C41480582284F7395E2FA1E266FCE00" style="OLC">
							<subsection id="H6DD40617145A488F003C1FA7C3C7A5EC"><enum>(f)</enum><header>Advisory Board
				on Trade Promotion</header>
								<paragraph id="H593D8F4CF15F4BCE94CB00B6B0979274"><enum>(1)</enum><header>Establishment
				and purpose</header><text>The President shall establish the Advisory Board on
				Trade Promotion (hereafter in this subsection referred to as the
				<quote>Advisory Board</quote>). The purpose of the Advisory Board shall be to
				advise the Director of the Office in carrying out the duties of the Office
				under this section and section 6 of the Export Enhancement Act of 1999 (15
				U.S.C. 4727a).</text>
								</paragraph><paragraph id="HBFEBCC5702504EC8B400341E23888E9F"><enum>(2)</enum><header>Membership</header>
									<subparagraph id="HCBA44E3BF2BA413A008F92CFFA6E7BC"><enum>(A)</enum><header>In
				general</header><text>Members of the Advisory Board shall include
				representatives from—</text>
										<clause id="H4B407A4724E34CC0B85DD8E5C331A8EB"><enum>(i)</enum><text>the Department of
				Agriculture;</text>
										</clause><clause id="H94D38E75FB254B5FBF92AA80A00E819"><enum>(ii)</enum><text>the Department of
				Commerce;</text>
										</clause><clause id="H4EFCFE7C21964E40976E4477F1838FAB"><enum>(iii)</enum><text>the Department
				of Defense;</text>
										</clause><clause id="HF862D79EF4984B96AD3F776FE71F00CB"><enum>(iv)</enum><text>the Department of
				Energy;</text>
										</clause><clause id="HBB709D7E69F1407586B08C1E8B72B781"><enum>(v)</enum><text>the Department of
				the Interior;</text>
										</clause><clause id="H2F921C77317E4A368FA4C5987388B6FB"><enum>(vi)</enum><text>the Department of
				Labor;</text>
										</clause><clause id="H214EBDCD2E14487EBEA000AE3EF148F7"><enum>(vii)</enum><text>the Department
				of State;</text>

				of Transportation;</text>
										</clause><clause id="H3160AAFE417F442C00817EB7F1F8DFC5"><enum>(ix)</enum><text>the Department of
				the Treasury;</text>
										</clause><clause id="H47D4AFA7BBE34FB1B627D64892B10045"><enum>(x)</enum><text>the Environmental
				Protection Agency;</text>
										</clause><clause id="HC836500C5887441D99BE31CD6500F0AC"><enum>(xi)</enum><text>the Export-Import
				Bank of the United States;</text>
										</clause><clause id="HDBBF4AEC583A46D4B626BFEE6B269280"><enum>(xii)</enum><text>the United
