		<section id="HA14C4BDFE5B548AAB803005DFD260232" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>National MS Disease Registry
			 Act</short-title></quote>.</text>
		</section><section id="H8291D18C5A5B45A3A307EC0022A26384"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following
			 findings:</text>
			<paragraph id="H44BF3FF1019B4CBB915F821DC61D80C5"><enum>(1)</enum><text>Multiple sclerosis
			 (referred to in this section as <quote>MS</quote>) is a progressive, disabling
			 disease that affects the brain and the spinal cord causing loss of myelin,
			 damage to axons, and cerebral atrophy.</text>
			</paragraph><paragraph id="H5682DFAB9C5F4EC1B2301391BA76D93C"><enum>(2)</enum><text>MS is a
			 prime-of-life disease with an average age of onset at 30 to 35 years of
			 age.</text>
			</paragraph><paragraph id="H93C871537CE145A7A19F00309F4BCEF5"><enum>(3)</enum><text>The causes of MS
			 are not well understood.</text>
			</paragraph><paragraph id="HB69677EC77064B1D96A268005DAB818"><enum>(4)</enum><text>There is no known
			 cure for MS.</text>
			</paragraph><paragraph id="H857178A3DCB54674AA9C295BC220509C"><enum>(5)</enum><text>There are several
			 drugs currently approved by the Food and Drug Administration for the treatment
			 of MS, which have shown modest success in reducing relapses, slowing
			 progression of disability, and limiting the accumulation of brain
			 lesions.</text>
			</paragraph><paragraph id="H0F1F0906163144CB827DD2F7B5994158"><enum>(6)</enum><text>More than 10,000
			 individuals in the United States are diagnosed with MS annually, and it is
			 thought that more than 400,000 individuals in the United States have MS.</text>
			</paragraph><paragraph id="H90A8220607B34023AC46DC88B6311D67"><enum>(7)</enum><text>Studies have found
			 relationships between MS and environmental and genetic factors, but those
			 relationships are not well understood.</text>
			</paragraph><paragraph id="H66AF4A05306C43E3A1E83F5422285416"><enum>(8)</enum><text>Several small and
			 uncoordinated MS registries and databases exist in the United States and
			 throughout the world.</text>
			</paragraph><paragraph id="H01067A6A59F74919B100F72BA41C5C07"><enum>(9)</enum><text>A
			 single national system to collect and store information on the incidence and
			 prevalence of MS in the United States does not exist.</text>
			</paragraph><paragraph id="H432DE4AA8B7747A788D8FF5E3700C3C"><enum>(10)</enum><text>The Agency for
			 Toxic Substances and Disease Registry has established a series of small pilot
			 studies, beginning in fiscal year 2006, to evaluate the feasibility of various
			 methodologies that might be used to create a MS surveillance system at the
			 national level.</text>
			</paragraph><paragraph id="H9E8984671D284E9F9326225613EC3085"><enum>(11)</enum><text>The establishment
			 of a national surveillance system will help—</text>
				<subparagraph id="H7788193D23E8468CA717006179AE66C1"><enum>(A)</enum><text>to identify the
			 incidence and prevalence of MS in the United States;</text>
				</subparagraph><subparagraph id="HB8574AD27BEB403BB51F4FD23E52C351"><enum>(B)</enum><text>to collect data
			 important to the study of MS;</text>
				</subparagraph><subparagraph id="HBDA0DE6F64214EF8A0D3F88977ED8209"><enum>(C)</enum><text>to produce
			 epidemiologically sound data that can be used to compare with MS cluster
			 information, data sets of the Department of Veterans Affairs data sets, and
			 other information;</text>
				</subparagraph><subparagraph id="H934E108E30DB4A58B383FDF8458167D9"><enum>(D)</enum><text>to promote a
			 better understanding of MS;</text>
				</subparagraph><subparagraph id="HB743887E4C61468FA2560052799800E8"><enum>(E)</enum><text>to better
			 understand public and private resource impact;</text>
				</subparagraph><subparagraph id="H6773FF06D4E042389E31DED958CBE5D2"><enum>(F)</enum><text>to collect
			 information that is important for research into genetic and environmental risk
			 factors for MS;</text>
				</subparagraph><subparagraph id="H8808E82B320D44BFB1B2148BF1D94C00"><enum>(G)</enum><text>to enhance
			 biomedical and clinical research by providing a basis for population
			 comparisons; and</text>
				</subparagraph><subparagraph id="HE46B24B4A18A4167976157E6085E04F8"><enum>(H)</enum><text>to enhance efforts
			 to find treatments and a cure for MS.</text>
				</subparagraph></paragraph></section><section id="H4FD53DF676164FB8B3F95FEE00069709"><enum>3.</enum><header>Amendment to the
			 Public Health Service Act</header><text display-inline="no-display-inline">Part
			 P of title III of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/280g">42 U.S.C. 280g et seq.</external-xref>) is
			 amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="HB4EF8279463A4E0DBA10932760025B94" style="OLC">
				<section id="HA433BD945BD942CD89371606F8F27374"><enum>399R.</enum><header>Multiple
				sclerosis national surveillance system</header>
					<subsection id="HDE103193B45F4CBD8CD656D4ED73491"><enum>(a)</enum><header>Establishment</header>
						<paragraph id="H945F36909B674E239C011DBD735561A2"><enum>(1)</enum><header>In
				general</header><text>Not later than 1 year after the receipt of the report
				described in subsection (b)(3), the Secretary, acting through the Director of
				the Agency for Toxic Substances and Disease Registry and in consultation with a
				national voluntary health organization with experience serving the population
				of individuals with multiple sclerosis (referred to in this section as
				<quote>MS</quote>), shall—</text>
							<subparagraph id="H8F48172E839B4C52ABF6386195C60000"><enum>(A)</enum><text>develop a system
				to collect data on MS including information with respect to the incidence and
				prevalence of the disease in the United States; and</text>
							</subparagraph><subparagraph id="HDBD7E6C54C1C4353A7B5E4AF1B63B8BB"><enum>(B)</enum><text display-inline="yes-display-inline">establish a national surveillance system
				for the collection and storage of such data to include a population-based
				registry of cases of MS in the United States.</text>
							</subparagraph></paragraph><paragraph id="HEDC03DCE9D3B40D89509EDA2AF52BB10"><enum>(2)</enum><header>Purpose</header><text>It
				is the purpose of the registry established under paragraph (1)(B) to gather
				available data concerning—</text>
							<subparagraph id="HBE00246AE6084684AAC9891242F1A676"><enum>(A)</enum><text>MS, including the
				incidence and prevalence of MS in the United States;</text>
							</subparagraph><subparagraph id="HCCFBA9A60A6F4297B87CCDB59DBD5960"><enum>(B)</enum><text>the age, race or
				ethnicity, gender, and family history of individuals who are diagnosed with the
				disease; and</text>
							</subparagraph><subparagraph id="H2E9F1DAC93B6491EB0FA92968ED46145"><enum>(C)</enum><text>other matters as
				recommended by the Advisory Committee established pursuant to subsection
				(b).</text>
							</subparagraph></paragraph></subsection><subsection id="HEB31E96B9F4840F59ECCDE001CB9BF66"><enum>(b)</enum><header>Advisory
				Committee</header>
						<paragraph id="HCEDCCE01ECF64550B25129ED00C9ACD9"><enum>(1)</enum><header>Establishment</header><text>Not
				later than 180 days after the date of the enactment of this section, the
				Secretary, acting through the Director of the Agency for Toxic Substances and
				Disease Registry shall establish a committee to be known as the Advisory
				Committee on the MS National Surveillance System (referred to in this section
				as the <quote>Advisory Committee</quote>). The Advisory Committee shall be
				composed of at least one member, to be appointed by the Secretary, acting
				through the Director of the Agency for Toxic Substances and Disease Registry,
				representing each of the following:</text>
							<subparagraph id="H66F5102E23F14B0786533CFFF19B069F"><enum>(A)</enum><text>National voluntary
				health associations that focus solely on MS and have demonstrated experience in
				MS research, care, or patient services.</text>
							</subparagraph><subparagraph id="H45409E3577584B17B3C0E8C8F5E235D"><enum>(B)</enum><text>The National
				Institutes of Health, to include, upon the recommendation of the Director of
				the National Institutes of Health, representatives from the National Institute
				of Neurological Disorders and Stroke, the National Institute of Environmental
				Health Sciences, and the National Institute of Allergy and Infectious
				Diseases.</text>
							</subparagraph><subparagraph id="H02C7C1E8081C4F56B36675754053F44C"><enum>(C)</enum><text>The Department of
				Veterans Affairs.</text>
							</subparagraph><subparagraph id="HEE7E79A49F5C4E70BEE000A9A4C037B5"><enum>(D)</enum><text>The Department of
				Defense.</text>
							</subparagraph><subparagraph id="HDF784D632C174475A400AA0337B16085"><enum>(E)</enum><text>The Agency for
				Toxic Substances and Disease Registry.</text>
							</subparagraph><subparagraph id="H33B76FE760ED4B03A694C0A44B6111CA"><enum>(F)</enum><text>The Centers for
				Disease Control and Prevention.</text>
							</subparagraph><subparagraph id="H62F76B3DF3D1430C83C4C51F6E64A8E6"><enum>(G)</enum><text>Patients with MS
				or their family members.</text>
							</subparagraph><subparagraph id="H4D758EE84533481C8E241428976EFDA7"><enum>(H)</enum><text>Clinicians with
				expertise on MS and related diseases.</text>
							</subparagraph><subparagraph id="HED838BBA36644D098DD602A27F1D0095"><enum>(I)</enum><text>Epidemiologists
				with experience in data registries.</text>
							</subparagraph><subparagraph id="H645FE9B9D18646D0B02420A83CC2CC3"><enum>(J)</enum><text>Geneticists or
				experts in genetics who have experience with the genetics of MS.</text>
							</subparagraph><subparagraph id="H9695E45BF01C4C06A809564C29DFDAC"><enum>(K)</enum><text>Statisticians.</text>
							</subparagraph><subparagraph id="HABF63EB1A7A841169565EACB647B2000"><enum>(L)</enum><text>Ethicists.</text>
							</subparagraph><subparagraph id="H031FCE739D5F490D9F564F516CCA86C0"><enum>(M)</enum><text>Attorneys.</text>
							</subparagraph><subparagraph id="HF679FE90266D458EBB52815182786191"><enum>(N)</enum><text>Other individuals,
				organizations, or agencies with an interest in developing and maintaining the
				MS National Surveillance System.</text>
							</subparagraph></paragraph><paragraph id="H7C651C35CA7A4323A86D5BFEB5425B2"><enum>(2)</enum><header>Duties</header><text>The
				Advisory Committee shall review information and make recommendations to the
				Secretary concerning—</text>
							<subparagraph id="H9DE34882353F427C8F76DF002DE2A4A0"><enum>(A)</enum><text>the development
				and maintenance of the MS National Surveillance System;</text>
							</subparagraph><subparagraph id="HAAC4BFAB43164862857706CC39BAF699"><enum>(B)</enum><text>the type of
				information to be collected and stored in the System;</text>
							</subparagraph><subparagraph id="H531632F5153B45BCA23F39C6C2D8007D"><enum>(C)</enum><text>the manner in
				which such data is to be collected; and</text>
							</subparagraph><subparagraph id="H19A37D3B69E8406E8767F11916D1AF3C"><enum>(D)</enum><text>the use and
				availability of such data including guidelines for such use.</text>
							</subparagraph></paragraph><paragraph id="HFC03C99156A743A48C75341F9371A29D"><enum>(3)</enum><header>Report</header><text>Not
				later than 1 year after the date on which the Advisory Committee is
				established, the Advisory Committee shall submit a report concerning the review
				conducted under paragraph (2) that contains the recommendations of the Advisory
				Committee with respect to the results of such review.</text>
						</paragraph></subsection><subsection id="H7C1F4173A85C43F2B8AE4C21F9C1849"><enum>(c)</enum><header>Grants</header><text>Notwithstanding
				the recommendations of the Advisory Committee under subsection (b), the
				Secretary, acting through the Director of the Agency for Toxic Substances and
				Disease Registry, may award grants to, and enter into contracts and cooperative
				agreements with, public or private nonprofit entities for the collection,
				analysis, and reporting of data on MS.</text>
					</subsection><subsection id="HCFD7757CB039493BB8ADB775882DC065"><enum>(d)</enum><header>Coordination
				with State, local, and Federal registries</header>
						<paragraph id="HE5C9CC28E1A342D58049ABC4875C5614"><enum>(1)</enum><header>In
				general</header><text>In establishing the MS National Surveillance System under
				subsection (a), the Secretary, acting through the Director of the Agency for
				Toxic Substances and Disease Registry, shall—</text>
							<subparagraph id="HA0A8AD1EADCB4C579C32D2EFB3DB2C9F"><enum>(A)</enum><text>identify, build
				upon, expand, and coordinate existing data and surveillance systems, surveys,
				registries, and other Federal public health and environmental infrastructure
				wherever possible, including—</text>
								<clause id="HE6B64B9E54CB4D3300A61CD97E745BED"><enum>(i)</enum><text>the 2 MS
				surveillance pilot studies initiated in fiscal year 2006 by the Centers for
				Disease Control and Prevention and the Agency for Toxic Substances and Disease
				Registry;</text>
								</clause><clause id="HE35475B6FECC4746AB92F121E5BAF7AF"><enum>(ii)</enum><text display-inline="yes-display-inline">the MS database of the Department of
				Veterans Affairs;</text>
								</clause><clause id="HF1BD7A913122448B90728D922837CAB"><enum>(iii)</enum><text>current MS
				registries, including the New York State MS Registry and the North American
				Research Committee on MS (NARCOMS) Registry; and</text>
								</clause><clause id="H0DCDE4EA493E4B84AAA2A9FF31C0C5CF"><enum>(iv)</enum><text>any other
				existing or relevant databases that collect or maintain information on
				neurological diseases identified by researchers or recommended by the Advisory
				Committee established in subsection (b); and</text>
								</clause></subparagraph><subparagraph id="H4702470CC12E484AACB2EFF24EFCC513"><enum>(B)</enum><text>provide for
				research access to MS data as recommended by the Advisory Committee established
				pursuant to subsection (b) to the extent permitted by applicable statutes and
				regulations and in a manner that protects personal privacy consistent with
				applicable privacy statutes and regulations.</text>
							</subparagraph></paragraph><paragraph id="H792CB7B052B042B400A878ED241EEF00"><enum>(2)</enum><header>Coordination
				with other Federal agencies</header><text>Notwithstanding the recommendations
				of the Advisory Committee established pursuant to subsection (b), and
				consistent with applicable privacy statutes and regulations, the Secretary
				shall ensure that epidemiological and other types of information obtained under
				subsection (a) are made available to agencies such as the National Institutes
				of Health, the Department of Veterans Affairs, and the Department of
				Defense.</text>
						</paragraph></subsection><subsection id="H8BA1BBB111D84149BD1068CC7FCF6F15"><enum>(e)</enum><header>Definition</header><text>For
				the purposes of this section, the term <term>national voluntary health
				association</term> means a national nonprofit organization with chapters or
				other affiliated organizations in States throughout the United States.</text>
					</subsection><subsection id="H1BB45EAD9E284CB18353FDC3F2A1A725"><enum>(f)</enum><header>Authorization of
				Appropriations</header><text>There are authorized to be appropriated to carry
				out this section $5,000,000 for each of fiscal years 2009 through
				2013.</text>
