		<official-title>To establish a program to provide grants to help
		  homeowners who are facing foreclosure to receive professional
		  counseling.</official-title>

		<section id="H064ED805CB27435292CEAB51D49E8800" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Foreclosure Counseling Assistance Act of
			 2008</short-title></quote>.</text>
		</section><section id="HF8486A2D82CC4C848FA20273F3E3865"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to promote
			 adequate professional counseling for homeowners facing foreclosure due to the
			 mortgage crisis.</text>
		</section><section id="H4528F57016BE4B678C09B1B504A5D285"><enum>3.</enum><header>Foreclosure
			 Counseling Assistance</header>
			<subsection id="HF7683F1E5519446F87A201F9826C80D9"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Neighborhood Reinvestment Corporation
			 (hereinafter in this Act referred to as the <quote>NRC</quote>) shall make
			 grants to qualified counseling intermediaries and qualified legal organizations
			 to provide legal assistance to homeowners of owner-occupied homes with
			 mortgages in default, in danger of default, or subject to or at risk of
			 foreclosure.</text>
			</subsection><subsection id="H70ECB846DF5F4D3EB635B42D9E75EA05"><enum>(b)</enum><header>Definitions</header><text>For
			 purposes of this Act:</text>
				<paragraph id="H1E9BF423C47743FF9CE23CA759AF12CD"><enum>(1)</enum><header>Legal
			 assistance</header><text display-inline="yes-display-inline">The term
			 <quote>legal assistance</quote> means those services performed by, or under the
			 supervision of, a licensed legal professional in representing homeowners of
			 owner-occupied homes with mortgages in default, in danger of default, or
			 subject to or at risk of foreclosure.</text>
				</paragraph><paragraph id="H29793442B0E840C8BB61CBECE9BAC6E8"><enum>(2)</enum><header>Qualified
			 counseling intermediaries</header><text display-inline="yes-display-inline">The
			 term <quote>qualified counseling intermediaries</quote> means counseling
			 intermediaries approved by the Department of Housing and Urban Development or
			 the NRC to hire attorneys to assist homeowners who have legal issues related to
			 homeownership preservation, home foreclosure preservation, and tenancy
			 associated with foreclosures.</text>
				</paragraph><paragraph id="H3122C8C12D2649EB9D524F6DE76E0000"><enum>(3)</enum><header>Qualified legal
			 organizations</header><text display-inline="yes-display-inline">The term
			 <quote>qualified legal organizations</quote> means State and local legal
			 organizations that have demonstrated legal experience in home foreclosure law,
			 as such experience is determined by the Chief Executive Officer of the
			 NRC.</text>
				</paragraph></subsection><subsection id="HAC9559D2385D4D2DB566E700B969E9A1"><enum>(c)</enum><header>Grant
			 priority</header><text>In making grants under this Act, the NRC shall give
			 priority to qualified counseling intermediaries and qualified legal
			 organizations that—</text>
				<paragraph id="HDFA79DBE03824B7798D425A04F3BC984"><enum>(1)</enum><text display-inline="yes-display-inline">provide legal assistance in the 100
			 metropolitan statistical areas (as defined by the Director of the Office of
			 Management and Budget) with the highest home foreclosure rates; and</text>
				</paragraph><paragraph id="H5C1F5C87522A46959C14976E5F662BEE"><enum>(2)</enum><text>have the capacity
			 to begin using the grant funds within 90 days after receipt of the
			 funds.</text>
				</paragraph></subsection><subsection id="HC70F5A3EC5E641DAAE6CEF168342721F"><enum>(d)</enum><header>Grant contingent
			 on reporting</header><text display-inline="yes-display-inline">As a condition
			 of the receipt of any grant under this Act, the grantee shall agree to disclose
			 to the Chief Executive Officer of NRC basic information relating to the
			 demographics of the borrower, the dollar amount and terms of the homeowner’s
			 mortgage, and the outcome of any legal proceedings related to the foreclosure
			 proceedings, including, but not limited to, resolution of the foreclosure or
			 delinquency, with details about modifications, workouts, short sales or
			 foreclosure.</text>
			</subsection></section><section id="H93FB269211C040D3A0701492E7FEF5EB"><enum>4.</enum><header>Authorization of
			 Appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated $37,500,000 to carry out this Act, to remain
			 available until expended.</text>
