		<official-title>To require the Federal Communications Commission to
		  auction spectrum for a free and open access broadband service.</official-title>

		<section id="H96197EFC0C3243C7A5C2283EF2933DA0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Wireless Internet Nationwide for
			 Families Act of 2008</short-title></quote>.</text>
		</section><section id="HA1287DE407E8460CA96F5EE09407B984"><enum>2.</enum><header>Open access
			 broadband spectrum auction</header><text display-inline="no-display-inline">Section 309(j) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/309">47 U.S.C. 309(j)</external-xref>) is amended
			 by adding at the end the following new paragraph:</text>
			<quoted-block id="HD4F4DC512D98472E00BCBB737471BD40" style="OLC">
				<paragraph id="HAC0E0E8E482647A799576F35CA39AB93"><enum>(17)</enum><header>Open access
				broadband spectrum auction</header>
					<subparagraph id="H65885A2E4B9543F4B4C5C293B5B6A8B0"><enum>(A)</enum><header>Auctions
				required</header><text display-inline="yes-display-inline">The Commission shall
				promote nationwide broadband competition through the use of wireless services
				by issuing nationwide licenses, for a term of not less than 15 years, for two
				bands of frequencies that consist of an initial band and a second band of
				frequencies—</text>
						<clause id="HBDD02173F4074C31A3B6E9244FAF984"><enum>(i)</enum><text>each of which shall
				be composed of 20 megahertz of unpaired contiguous spectrum;</text>
						</clause><clause id="H12C8503CD7C54500B6C4C9DCF9C7CE3"><enum>(ii)</enum><text>the initial band
				of which shall be spectrum located between 2155 and 2180 megahertz, inclusive;
				and</text>
						</clause><clause id="HE12AD47D0A104128876518004585729D"><enum>(iii)</enum><text display-inline="yes-display-inline">the second band of which shall be spectrum
				that—</text>
							<subclause id="H220B18E3CE504EECB077B0F29B24D961"><enum>(I)</enum><text>is located under 3
				gigahertz; and</text>
							</subclause><subclause id="H349AFBE607374BE39FA1E74377024D96"><enum>(II)</enum><text>is not part of
				the recovered analog spectrum, as such term is defined in paragraph
				(15)(C)(vi).</text>
							</subclause></clause></subparagraph><subparagraph id="H4A485618459240B29D9E6E40B4CB4FF9"><enum>(B)</enum><header>Deadlines for
				initial auction</header><text>The Commission shall carry out the initial
				auctions required by this paragraph by—</text>
						<clause id="H798A8CA1975141A689DE35F5008B3F41"><enum>(i)</enum><text>commencing an
				auction of a single nationwide license for the initial band described in
				<internal-xref idref="H12C8503CD7C54500B6C4C9DCF9C7CE3" legis-path="(17)(A)(ii)">subparagraph (A)(ii)</internal-xref> not later than
				180 days after the date of enactment of the <short-title>Wireless Internet Nationwide for Families Act of
				2008</short-title>; and</text>
						</clause><clause id="H99E3E4585FCE42D6AA088B6FF5519E2C"><enum>(ii)</enum><text>depositing the
				proceeds of such auction in accordance with paragraph (8)(A) not later than 210
				days after such date of enactment.</text>
						</clause></subparagraph><subparagraph id="H7DD42A62BF164412A8BD6E66B4DEFD23"><enum>(C)</enum><header>Second
				auction</header><text display-inline="yes-display-inline">The Commission shall
				commence and complete a separate rule-making or other procedures for licensing
				through auction additional unpaired contiguous spectrum of 20 megahertz below 3
				gigahertz within 1 year of such date of enactment. Such auction shall be
				conducted without the conditions specified in
				<internal-xref idref="HCC01370709BC474B8DD015562DE2DBE1" legis-path="(17)(F)">subparagraph (F)</internal-xref> unless the Commission
				finds it is in the public interest to do so pursuant to a rulemaking.</text>
					</subparagraph><subparagraph id="HDB0013AC3E564E20B3C0E59B15C3E773"><enum>(D)</enum><header>Interference
				Protection</header><text>The Commission shall ensure that licensees of spectrum
				obtained pursuant to an auction under this paragraph and licensees of adjacent
				spectrum are mutually and adequately protected from harmful
				interference.</text>
					</subparagraph><subparagraph id="HAD8D2AEB2B7C4C1BA3A5C5B14323E700"><enum>(E)</enum><header>Service and
				auction rules</header><text>At least 30 days prior to the deadlines established
				in subparagraphs (B)(i) and (C), the Commission shall promulgate service and
				auction rules for the licenses issued under subparagraphs (B) and (C)
				that—</text>
						<clause id="H0C8FD92E86004F76AB5FE56DCD58A43C"><enum>(i)</enum><text>make available
				spectrally efficient nationwide broadband services; and</text>
						</clause><clause id="H6C9611E2D2D042DCAF7BA0BABD1DDBBD"><enum>(ii)</enum><text>promote the goals
				listed in subparagraphs (B), (D) and (F) of paragraph (4).</text>
						</clause></subparagraph><subparagraph id="HCC01370709BC474B8DD015562DE2DBE1"><enum>(F)</enum><header>Content of
				service requirements rules for auctioned spectrum</header><text>The Commission
				shall promulgate such rules and regulations as are necessary to require, as
				conditions of the licenses for the use of the frequencies auctioned under this
				paragraph, that the licensees shall—</text>
						<clause id="H03368E8E8F7B4A559EADA2487DB40018"><enum>(i)</enum><text>offer, at a
				minimum, always-on wireless broadband services within 2 years from the date of
				receipt of the license, and complete the construction of such wireless network
				with a signal covering at least 95 percent of the population of the United
				States and its territories within 10 years from the initial operation of the
				network;</text>
						</clause><clause id="H298EB9729B644240876C604E9CFFD22"><enum>(ii)</enum><text display-inline="yes-display-inline">offer a data service that is faster than
				200 kilobits per second one way (subject to
				<internal-xref idref="HC7B80B2589204D1398E6002BEB9EC4BF" legis-path="(17)(G)">subparagraph (G)</internal-xref>) for free to consumers
				and authorized public safety users without subscription, airtime, usage, or
				other charges;</text>
						</clause><clause id="H5BD907A8407143CA00268984412FA6E4"><enum>(iii)</enum><text>consistent with
				section 230 of this Act, offer such free data service with a technology
				protection measure or measures that protect underage users from accessing
				obscene or indecent material through such service;</text>
						</clause><clause id="HDC3046A22491440AA5947819B7AA4C3B"><enum>(iv)</enum><text>provide such free
				data services on a wireless network that permits open access to affiliated and
				unaffiliated consumer devices by providing, publicly and royalty-free,
				published technical standards for developing and deploying subscriber equipment
				that can operate on the network subject to this paragraph; and</text>
						</clause><clause id="H20E3F5AEF20144BDB229C347999E34AB"><enum>(v)</enum><text>provide such free
				data services using advanced and spectrally efficient wireless technologies
				that provide services to the largest feasible number of users and encourages
				broadband competition making broadband services more available and
				affordable.</text>
						</clause></subparagraph><subparagraph id="HC7B80B2589204D1398E6002BEB9EC4BF"><enum>(G)</enum><header>Review of free
				data service requirement</header><text display-inline="yes-display-inline">The
				Commission shall evaluate whether the speed of free services under
				<internal-xref idref="HCC01370709BC474B8DD015562DE2DBE1" legis-path="(17)(F)">subparagraph (F)</internal-xref> should be increased in
				light of consumer demand, developments in wireless broadband technologies, and
				the public interest and shall conduct the first such evaluation 5 years after
				the licensee commences operations, and shall conduct subsequent evaluations at
				the time of license renewal thereafter.</text>
					</subparagraph><subparagraph id="HF95BF807953443A9831D4FE6A1AB811B"><enum>(H)</enum><header>Biennial
				broadband spectrum utilization report</header>
						<clause id="H8B276341A5614282BA622C36F64CFD2F"><enum>(i)</enum><text>Beginning in March
				of 2009, the Commission and the National Telecommunications and Information
				Administration shall jointly review competitive market conditions with respect
				to availability and affordability of broadband as well as the state of
				utilization of spectrum under the Commission’s and the Administration’s
				respective jurisdictions. Thereafter, the Commission and the Administration
				shall provide Congress a joint biannual report of their findings.</text>
						</clause><clause id="HCA38D20F23074F25BD9C332DA24E9100"><enum>(ii)</enum><text>Such reports
				shall consider the state-of-the-art efficient use of all spectrum bands and
				shall include the basis on which such utilization and efficiency are
				determined.</text>
						</clause><clause id="H83F9F464053F4A7484A144002D479215"><enum>(iii)</enum><text>In making their
				recommendations, the Commission and the Administration shall expressly consider
				the technological advances in commercial use of the spectrum as well as other
				relevant uses including public safety, national defense and other uses as
				determined by the public interest.</text>
						</clause><clause id="H0AE2136BA7B842C29D9F8D483461B63E"><enum>(iv)</enum><text>The joint report
				shall also provide specific recommendations for the reallocation or
				reassignment of spectrum found to be underutilized in light of the public
				interest, necessity and convenience found in promoting broadband availability
				and affordability. In the joint report, the Commission and the Administration
				shall also recommend to Congress any statutory changes that would be required
				to implement any such reassignment or reallocation within 24 months of the
				report.</text>
						</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
