			 the Speaker, in each case for consideration of such provisions as fall within
			 the jurisdiction of the committee concerned</action-desc>

		<legis-type>A BILL</legis-type>
		<official-title>To permit leave under the Family and Medical Leave Act of
		  1993 for victims of violent crime and domestic violence and immediate family
		  members of victims of violent crime and domestic violence to attend court
		  proceedings relating to such crimes.</official-title>

	<legis-body id="HCB62F61F104C46AD8031721D6B2DACAC" style="OLC">
		<section id="H131AE2AED9AA4779AC1F483E3FCC0329" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Crime Victims Employment Leave
			 Act</short-title></quote>.</text>
		</section><section id="H733CBA540563444D8150336B7B43AE70"><enum>2.</enum><header>Leave for victims
			 of violent crime and domestic violence</header>
			<subsection id="HE2A01710D86E4A1BBF266C60D4B481FD"><enum>(a)</enum><header>Leave
			 requirement</header><text display-inline="yes-display-inline">Section 102 of
			 the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612</external-xref>) is amended—</text>
				<paragraph id="H5E026921A4F048D1AC41AED1AA46533D"><enum>(1)</enum><text>in subsection
			 (a)(1), by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H9AFA8C2185864EE88B79C66E503FED76" style="OLC">
						<subparagraph id="H362EDD58A0F642D4AAFCA9633C3E37A2"><enum>(F)</enum><text>To attend court
				proceedings relating to the prosecution of a person for a violent crime
				(including domestic violence) committed against the employee, a spouse, parent,
				son, or daughter of the employee, or other next of kin of the employee (as such
				term is defined in section 101 of this Act and under regulations promulgated by
				the
				Secretary).</text>
						</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H8B27C1561BA443FA86E42205CB33F5BA"><enum>(2)</enum><text>in subsection
			 (b)(1), by striking <quote>subparagraph (C) or (D)</quote> and inserting
			 <quote>subparagraph (C), (D), or (F)</quote>; and</text>
				</paragraph><paragraph id="H29FBBC2643434251A6A6003E118741B5"><enum>(3)</enum><text>in subsection
			 (d)(2)(A), by striking <quote>or (E)</quote> and inserting <quote>(E), or
			 (F)</quote>.</text>
				</paragraph></subsection><subsection id="H41B99F8DE8004E938E02E64708A0C2AF"><enum>(b)</enum><header>Notice</header><text>Section
			 102(e)(1) of the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(e)(1)</external-xref>) is
			 amended—</text>
				<paragraph id="H25BFBE7944154DDC959181009FFBD065"><enum>(1)</enum><text>by striking
			 <quote>In any case</quote> and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="HD95CE79AFFA34138BE2519CDB4C39081" style="OLC">
						<subparagraph id="H9D56F26C33534F659E1C7EE83DB199AB"><enum>(A)</enum><header>Childbirth or
				placement</header><text>In any case</text>
						</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H5B18F46032484EFD8100243533585114"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H009668D84E5240CAB92459F110C0FBB4" style="OLC">
						<subparagraph id="H165DA769DF654894805D77E3E38DC159"><enum>(B)</enum><header>Court
				proceedings</header><text display-inline="yes-display-inline">In any case in
				which the necessity for leave under subparagraph (F) of subsection (a)(1) is
				foreseeable based on a scheduled court proceeding, the employee shall provide
				the employer with not less than 14 days’ notice, before the date the leave is
				to begin, of the employee’s intention to take leave under such subparagraph,
				except that if the date of the court proceeding requires leave to begin in less
				than 14 days, the employee shall provide such notice as is
				practicable.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H88ED436A3715448C97F5EB4B7DF54653"><enum>(c)</enum><header>Certification</header><text>Section
			 103 of the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2613">29 U.S.C. 2613</external-xref>) is amended by
			 adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H82CBB48E2D344A67B9B55FC2EAAB34B7" style="OLC">
					<subsection id="HAC1E830898354712A58F586FF4FCA674"><enum>(f)</enum><header>Certification
				for leave taken To attend court proceedings</header><text display-inline="yes-display-inline">An employer may require that a request for
				leave under subparagraph (E) of section 102(a)(1) be supported by a
				certification issued by a court or prosecutor relating to the court proceeding
				for which leave is taken. The employee shall provide, in a timely manner, a
				copy of such certification to the employer. Any notification of the court
				proceeding issued by the appropriate court or court personnel or prosecutor
				shall be sufficient certification for purposes of this section. An employer
				shall not disclose any certification provided by the employee pursuant to this
				subsection and shall maintain confidential any information contained therein
				relating to the nature of the court proceeding for which the employee is taking
				leave.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H810856DC97984E1388DCD8F3635EFBA4"><enum>(d)</enum><header>Definitions</header><text>Section
			 101 of the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2611">29 U.S.C. 2611</external-xref>) is
			 amended—</text>
				<paragraph id="H09276810FC01476A99A2669DC4B12E81"><enum>(1)</enum><text>in paragraph (18),
			 by striking <quote>; and</quote> and inserting a semicolon;</text>
				</paragraph><paragraph id="H85351B4956154EC188616400AFF19A9"><enum>(2)</enum><text>in
			 paragraph (19), by striking the period and inserting <quote>; and</quote>;
			 and</text>
				</paragraph><paragraph id="H420DC4D9CC5C4FABA2D6D4EF9680D488"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HB3625D1283D84D69BF450091BDA93DA0" style="OLC">
						<paragraph id="H25C836D047FC4DAC82ADD8795605B014"><enum>(20)</enum><header>Domestic
				violence</header><text display-inline="yes-display-inline">The term
				<quote>domestic violence</quote> has the meaning given such term in section
				40002(a)(6) of the Violence Against Women Act of 1994 (42 U.S.C.
				13925(a)(6)).</text>
