		<official-title>To provide for the medical use of marijuana in accordance
		  with the laws of the various States.</official-title>

		<section id="HDABE24C32BF349CEB33C359B6191F5C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Medical Marijuana Patient Protection
			 Act</short-title></quote>.</text>
		</section><section id="HD9CFDBEFBE50493CBEB84B58ECD60042"><enum>2.</enum><header>Controlled
			 Substances Act</header>
			<subsection id="HC571A23F759D410B8600A5C6D7EDE872"><enum>(a)</enum><header>Schedule</header><text display-inline="yes-display-inline">Marijuana is moved from schedule I of the
			 Controlled Substances Act to schedule II of such Act.</text>
			</subsection><subsection id="H04716236331F41F6AA00407E74F4009B"><enum>(b)</enum><header>Prescription or
			 recommendation</header>
				<paragraph id="H5CA08351152C4B848090E57CE4147CCD"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">No provision of the
			 Controlled Substances Act shall prohibit or otherwise restrict in a State in
			 which marijuana may be prescribed or recommended by a physician for medical use
			 under applicable State law—</text>
					<subparagraph id="H55CB7314BC9345C38BC844FABABEA6E5"><enum>(A)</enum><text>the prescription
			 or recommendation of marijuana by a physician for medical use;</text>
					</subparagraph><subparagraph id="H06EE4BD68A0F441CA8F3BD4277E000B7"><enum>(B)</enum><text display-inline="yes-display-inline">an individual from obtaining, possessing,
			 or transporting within their State, manufacturing or using marijuana in
			 accordance with a prescription or recommendation of marijuana by a physician
			 for medical use by such individual hereinafter in this section referred to as
			 <quote>an authorized patient</quote>;</text>
					</subparagraph><subparagraph id="HD21E7B9B4B4C45EAB593544B9926AF8F"><enum>(C)</enum><text display-inline="yes-display-inline">an individual authorized under State law to
			 obtain, possess, transport within their State, or manufacture marijuana from
			 obtaining, possessing, transporting within their State, or manufacturing
			 marijuana on an authorized patient’s behalf; or</text>
					</subparagraph><subparagraph id="H0DE55F37465545BA00845B7E514D04E4"><enum>(D)</enum><text display-inline="yes-display-inline">a pharmacy or other entity authorized under
			 local or State law to distribute medical marijuana to authorized patients from
			 obtaining, possessing or distributing marijuana to such authorized
			 patients.</text>
					</subparagraph></paragraph><paragraph id="HC963ADC3267241FE8DCF0936C1FAFDC"><enum>(2)</enum><header>Production</header><text>No
			 provision of the Controlled Substances Act shall prohibit or otherwise restrict
			 an entity authorized by a State or local government, in which marijuana may be
			 prescribed or recommended by a physician for medical use, for the purpose of
			 producing marijuana for prescription or recommendation by a physician for
			 medical use from producing, processing, or distributing marijuana for such
			 purpose.</text>
				</paragraph></subsection></section><section id="H5FBF67CFD6554A6FB0F7554DFADB1804"><enum>3.</enum><header>Federal Food,
			 Drug, and Cosmetic Act</header>
			<subsection id="HE0CC14125EFA4771AC550831EBA3CB45"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">No provision of the
			 Federal Food, Drug, and Cosmetic Act shall prohibit or otherwise restrict in a
			 State in which marijuana may be prescribed or recommended by a physician for
			 medical use under applicable State law—</text>
				<paragraph id="H6D89D7D2D74D4940A5004808B8F5A831"><enum>(1)</enum><text>the prescription
			 or recommendation of marijuana by a physician for medical use;</text>
				</paragraph><paragraph id="H4CDC4987C7E14C61873F33EE88DD0321"><enum>(2)</enum><text display-inline="yes-display-inline">an individual from obtaining, possessing,
			 or transporting within their State, manufacturing, or using marijuana in
			 accordance with a prescription or recommendation of marijuana by a physician
			 for medical use by such individual, hereinafter in this section referred to as
			 <quote>an authorized patient</quote>;</text>
				</paragraph><paragraph id="HBBF0DE8E93E14580B19CED7D4FFFEBAB"><enum>(3)</enum><text display-inline="yes-display-inline">an individual authorized under State law to
			 obtain, possess, transport within their State, or manufacture marijuana from
			 obtaining, possessing, transporting within their State, or manufacturing
			 marijuana on an authorized patient’s behalf; or</text>
				</paragraph><paragraph id="H84CA17313BEE48CD9BF20051778F6BF"><enum>(4)</enum><text display-inline="yes-display-inline">a pharmacy or other entity authorized under
			 local or State law to distribute medical marijuana to authorized patients from
			 obtaining, possessing or distributing marijuana to such authorized
			 patients.</text>
				</paragraph></subsection><subsection id="H99CB68EC14A64D3BB842303599A9B1F6"><enum>(b)</enum><header>Production</header><text>No
			 provision of the Federal Food, Drug, and Cosmetic Act shall prohibit or
			 otherwise restrict an entity authorized by a State or local government, in
			 which marijuana may be prescribed or recommended by a physician for medical
			 use, for the purpose of producing marijuana for prescription or recommendation
			 by a physician for medical use from producing, processing, or distributing
			 marijuana for such purpose.</text>
			</subsection></section><section id="H82983AF0AD00440BA1AAB86CE7BAABFE"><enum>4.</enum><header>Relation of Act
			 to certain prohibitions relating to smoking</header><text display-inline="no-display-inline">This Act does not affect any Federal, State,
			 or local law regulating or prohibiting smoking in public.</text>
