		<section id="HDD05CD52C5A841039DD527E2FA59B05" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Insurance Information Act of
			 2008</short-title></quote>.</text>
		</section><section id="H038BA8262C6E408FACF849E8D1C732D1"><enum>2.</enum><header>Office of
			 Insurance Information</header>
			<subsection id="H07E6A7BC3A9540BA00A74128E73D21C7"><enum>(a)</enum><header>Duties of
			 Secretary</header><text><external-xref legal-doc="usc" parsable-cite="usc/31/321">Section 321(a)</external-xref> of title 31, United States Code, is
			 amended—</text>
				<paragraph id="H98CAB6E19F184BB3B6C16DC2599FE9D"><enum>(1)</enum><text>in
			 paragraph (7), by striking <quote>and</quote> at the end;</text>
				</paragraph><paragraph id="H2F3C73F3710744C582046832D8E94D6D"><enum>(2)</enum><text>in paragraph
			 (8)(C), by striking the period at the end and inserting <quote>; and</quote>;
			 and</text>
				</paragraph><paragraph id="H7C4AE1E0373E4653BA5BDE8C56143468"><enum>(3)</enum><text>by adding at the
			 end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="H675A3607085A4104A2A48276D8B71D40" style="OLC">
						<paragraph id="H0922700E4A644F6C9D88AA45BC127156"><enum>(9)</enum><text display-inline="yes-display-inline">advise the President and the Congress on
				domestic and international policy issues in connection with all lines of
				insurance except health
				insurance.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H22F9A0CFFF854CA88F20A5206BC5888D"><enum>(b)</enum><header>Establishment of
			 Office</header><text display-inline="yes-display-inline">Subchapter I of
			 <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/3">chapter 3</external-xref> of title 31, United States Code, is amended—</text>
				<paragraph id="H8E1D963AFFAD4BBEBE6B24CCFE37D409"><enum>(1)</enum><text>by transferring
			 and inserting section 312 after section 313;</text>
				</paragraph><paragraph id="HE2B7B49715DB41F2A0059313E1663627"><enum>(2)</enum><text>by redesignating
			 sections 313 and 312 (as so transferred) as sections 312 and 314, respectively;
			 and</text>
				</paragraph><paragraph id="H0DF5B914C9A74E89ADD254D99C7D5106"><enum>(3)</enum><text>by inserting after
			 section 312 (as so redesignated) the following new section:</text>
					<quoted-block display-inline="no-display-inline" id="HC2D21C8DA685427BA57639D024F47969" style="OLC">
						<section id="H35F44E329E344EA7A0AD65D26CBE9605"><enum>313.</enum><header>Office of
				Insurance Information</header>
							<subsection id="H5053AEFC1D9A41AC8DD308009E6131CA"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established within the Department
				of the Treasury the Office of Insurance Information (in this section referred
				to as the <quote>Office</quote>).</text>
							</subsection><subsection id="H83D3B239A53F4398A86915B9FBE14051"><enum>(b)</enum><header>Leadership</header><text display-inline="yes-display-inline">The Office shall be headed by a Deputy
				Assistant Secretary, who shall be appointed by the Secretary of the Treasury.
				The position of such Deputy Assistant Secretary shall be a career reserved
				position in the Senior Executive Service.</text>
							</subsection><subsection id="H7113AEE7F29F48FB9FD7C4D00AAC948"><enum>(c)</enum><header>Functions</header><text display-inline="yes-display-inline">The Deputy Assistant Secretary who is the
				head of the Office shall have the authority—</text>
								<paragraph id="HD44C56284D914636A3FE6B6022E04343"><enum>(1)</enum><text display-inline="yes-display-inline">pursuant to the direction of the
				Secretary—</text>
									<subparagraph id="H8EEFEA36CA4649E5BC5800CB0E322E9"><enum>(A)</enum><text display-inline="yes-display-inline">to receive, analyze, collect, and
				disseminate publicly available data and information and issue reports regarding
				all lines of insurance except health insurance; and</text>
									</subparagraph><subparagraph id="H7F466EBA026C45E1A2006237F71DBD5"><enum>(B)</enum><text display-inline="yes-display-inline">to establish Federal policy on
				international insurance matters and ensure that State insurance laws are
				consistent with agreements relating to such Federal policy entered into by the
				United States or on its behalf by a designated representative (including the
				Secretary of the Treasury and the United States Trade Representative) with a
				foreign government or regulatory entity; and</text>
									</subparagraph></paragraph><paragraph id="H76EF55EEFEE54088A3433C93A7CFF7F"><enum>(2)</enum><text>to advise the
				Secretary on major domestic and international insurance policy issues,
				including matters that affect consumers and insurers, such as bond insurance
				and other financial guarantee insurance, private mortgage insurance,
				catastrophe insurance, and reinsurance collateral requirements.</text>
								</paragraph></subsection><subsection id="HCF4F6C2CC4524E6DB4B01555A6A39D20"><enum>(d)</enum><header>Scope</header><text display-inline="yes-display-inline">The authority of the Office and the Deputy
				Assistant Secretary with respect to insurance shall extend to all lines of
				insurance except health insurance.</text>
							</subsection><subsection id="H1063D29163884AD2BDFAB78D83CD0091"><enum>(e)</enum><header>Preemption of
				State law</header>
								<paragraph id="H4A04F7B2AD7B4DB2B124E7EBA0F3361E"><enum>(1)</enum><header>Standard</header><text>Any
				law or regulation of any State is preempted to the extent that such law or
				regulation is inconsistent with Federal policy on international insurance
				matters set forth in an agreement entered into by the United States or on its
				behalf by a designated representative (including the Secretary of the Treasury
				and the United States Trade Representative) with a foreign government or
				regulatory entity.</text>
								</paragraph><paragraph id="H22FE2567B1EF46AE987B7F00F9087B00"><enum>(2)</enum><header>Determination</header><text>Pursuant
				to the direction of the Secretary, the Deputy Assistant Secretary is authorized
				to determine whether inconsistencies referred to in paragraph (1) exist and, in
				the case of any such determination, shall notify the appropriate State of such
				determination.</text>
								</paragraph><paragraph id="H4ABE86211550494FB1007C6227AA2FBF"><enum>(3)</enum><header>Administrative
				review</header><text display-inline="yes-display-inline">The State shall have
				the right to appeal any determination of inconsistency pursuant to paragraph
				(2) to the Secretary.</text>
								</paragraph><paragraph id="H683B1A85F3DF40C0A233122D96E73946"><enum>(4)</enum><header>Limitation</header><text display-inline="yes-display-inline">No State may enforce any insurance law or
				regulation that has been preempted pursuant to this subsection.</text>
								</paragraph></subsection><subsection id="H25254DC848AF45C6AD45E4C6B53407DE"><enum>(f)</enum><header>Reports to
				Congress</header><text display-inline="yes-display-inline">The Deputy Assistant
				Secretary who is the head of the Office shall submit a report during each
				Congress to the Committee on Financial Services of the House of Representatives
				and the Committee on Banking, Housing, and Urban Affairs of the Senate on the
				financial state of the insurance industry, meaningful trends in the industry,
				any actions taken by the Office pursuant to subsection (e) (regarding
				preemption of inconsistent State laws), and any other information as deemed
				relevant by the Deputy Assistant Secretary or as requested by such
				Committees.</text>
							</subsection><subsection id="HA7FC0548990E482BB67F612E469DC784"><enum>(g)</enum><header>Use of existing
				resources</header><text display-inline="yes-display-inline">The Office may
				employ personnel, facilities, and other Department of the Treasury resources
				available to the Secretary on the date of enactment of the
				<short-title>Insurance Information Act of
				2008</short-title> in carrying out this section, except as otherwise prohibited
				by law.</text>
							</subsection><subsection commented="no" id="HAA287D874D1C402EB21BE455A0A5BAE9"><enum>(h)</enum><header>Retention of
				existing regulatory authority</header><text display-inline="yes-display-inline">Except to the extent necessary to satisfy
				the requirements, obligations, and powers granted under this section and the
				<short-title>Insurance Information Act of
				2008</short-title>, nothing in this section may be construed to establish any
				general supervisory or regulatory authority of the Office or the Department of
				the Treasury over any insurer.</text>
							</subsection><subsection id="H48113071A2E14E89AE6C1BE059A30057"><enum>(i)</enum><header>Advisory
				group</header>
								<paragraph id="H173FCD674C7443C189A492FFFB7CC68E"><enum>(1)</enum><header>Establishment</header><text>There
				is hereby established the Advisory Group to the Office of Insurance
				Information.</text>
								</paragraph><paragraph id="H2E2A961D19D34F6D9FFF20CAB4E1D82D"><enum>(2)</enum><header>Membership</header><text>The
				Advisory Group shall consist of no more than 9 members who shall be appointed
				by the Secretary, and shall include representatives of the National Association
				of Insurance Commissioners, the Department of Commerce, and the Office of the
				United States Trade Representative, and such representatives of the insurance
				industry, consumer groups, and other organizations as the Secretary determines
				are appropriate.</text>
								</paragraph><paragraph id="HD28F791F55EE40B0A03F98FBE2A328A3"><enum>(3)</enum><header>Duties</header><text>The
				Advisory Group shall make recommendations to the Secretary and the Deputy
				Assistant Secretary who is the head of the Office regarding the function of the
				Office under subsection (c)(1)(B) and determinations pursuant to subsection
				(e)(2).</text>
								</paragraph></subsection><subsection id="H3BFC48AB66434EFCA8D8E8E8766CBA80"><enum>(j)</enum><header>Authorization of
				appropriations</header><text>There are authorized to be appropriated for the
				Office such sums as may be necessary for each fiscal
				year.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H66D4FE5945CA46FDB99ECDB00E6154F"><enum>(c)</enum><header>Independence in
			 congressional testimony and recommendations</header><text display-inline="yes-display-inline">Section 111 of <external-xref legal-doc="public-law" parsable-cite="pl/93/495">Public Law 93–495</external-xref> (12 U.S.C.
			 250) is amended by inserting ‘‘the Deputy Assistant Secretary of the Treasury
			 who is the head of the Office of Insurance Information of the Department of the
			 Treasury,’’ after <quote>Office of Thrift Supervision,</quote> .</text>
			</subsection><subsection id="H49F261C705104947B20781A5EB1DC28C"><enum>(d)</enum><header>Clerical
			 amendment</header><text display-inline="yes-display-inline">The table of
			 sections for subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/3">chapter 3</external-xref> of title 31, United States Code, is
			 amended by striking the item relating to section 312 and inserting the
			 following new items:</text>
