		<official-title>To authorize the Forest Service to provide financial
		  assistance to States for the acquisition of land to preserve and maintain such
		  land for traditional use by the public, and for other
		  purposes.</official-title>

		<section id="H8250E913A337455391C73C07FF91821B" section-type="section-one"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Traditional Use Protection Act of
			 2008</short-title></quote>.</text>
		</section><section id="H649D66B65CF740E3BC48A1F0ACB19121"><enum>2.</enum><header>Support for the
			 traditional use of lands</header>
			<subsection id="H34F1DAB3588F45B3BC2EB921005BC3C"><enum>(a)</enum><header>Grants</header><text display-inline="yes-display-inline">The Chief of the Forest Service shall
			 establish a program to award grants, on a competitive basis, to States for the
			 purpose of allowing such States—</text>
				<paragraph id="HE00D125A89A347EF8BA793B6C4010092"><enum>(1)</enum><text>to acquire the
			 rights to land to make such land available to the public for traditional use;
			 and</text>
				</paragraph><paragraph id="HC7821DD26E7B474696895C9003D4819"><enum>(2)</enum><text>to
			 make subgrants to an entity to allow such entity to acquire the rights to land
			 to make such land available to the public for traditional use.</text>
				</paragraph></subsection><subsection display-inline="no-display-inline" id="H9322CD5647A24953B0A8697E1828F7DB"><enum>(b)</enum><header>Requirements for
			 use of funds</header>
				<paragraph id="HD8B1DBEEEC9B447CAB03EDF68EC360BA"><enum>(1)</enum><header>In
			 general</header><text>A State shall use the funds received under this section
			 only—</text>
					<subparagraph id="H64D0E1E61AE74B8284B09786CDD7A14C"><enum>(A)</enum><text>to purchase land,
			 acquire an easement, or take other actions to acquire rights to land, as long
			 as such purchase, acquisition, or other action results in the State holding
			 rights to the land in perpetuity; and</text>
					</subparagraph><subparagraph id="H76A98077DF864254A6D026BB6D00BD5D"><enum>(B)</enum><text display-inline="yes-display-inline">to make a subgrant to an entity to allow
			 such entity to purchase land, acquire an easement, or take other actions to
			 acquire rights to land, as long as such purchase, acquisition, or other action
			 results in the entity holding rights to the land in perpetuity.</text>
					</subparagraph></paragraph><paragraph id="HC886B051ED9444C0A738FA53EFC49F9"><enum>(2)</enum><header>Willing
			 Sellers</header><text>A State or entity may only use funds received through a
			 grant or subgrant under
			 <internal-xref idref="H34F1DAB3588F45B3BC2EB921005BC3C" legis-path="2.(a)">subsection (a)</internal-xref> to acquire rights to land
			 from a willing seller.</text>
				</paragraph><paragraph id="HB99E5334838A4B9D8F2297111735B4DA"><enum>(3)</enum><header>Eminent Domain
			 Prohibited</header><text display-inline="yes-display-inline">A State may not
			 use funds received through a grant under
			 <internal-xref idref="H34F1DAB3588F45B3BC2EB921005BC3C" legis-path="2.(a)">subsection (a)</internal-xref> to acquire land through
			 eminent domain.</text>
				</paragraph></subsection><subsection id="HB7A0AE63FF314E8FA23669B15CE825DD"><enum>(c)</enum><header>Access</header><text display-inline="yes-display-inline">A State or entity shall make any land
			 purchased, acquired, or otherwise obtained using funds received through a grant
			 or subgrant under
			 <internal-xref idref="H34F1DAB3588F45B3BC2EB921005BC3C" legis-path="2.(a)">subsection (a)</internal-xref> available to the public for
			 appropriate traditional use, as determined by the State.</text>
			</subsection><subsection display-inline="no-display-inline" id="HB80FEE7C7CA64971A200267B1DADA52"><enum>(d)</enum><header>Application</header>
				<paragraph id="HF6187C17114C4AD59286EFBA41BEDD"><enum>(1)</enum><header>In
			 general</header><text>To be considered for a grant under this section, a State
			 shall submit to the Chief an application at such time and in such manner as the
			 Chief may require.</text>
				</paragraph><paragraph id="HFCC22D53ACB94955B73BEE6777E1D04"><enum>(2)</enum><header>Contents</header><text display-inline="yes-display-inline">The application shall include the
			 following:</text>
					<subparagraph display-inline="no-display-inline" id="H26C622D16FEF417BA66787D168F35901"><enum>(A)</enum><text>Information
			 demonstrating the commitment of the State to stewardship and maintenance of
			 land currently held by the State for traditional and recreational use
			 (including park land).</text>
					</subparagraph><subparagraph id="HF3384D9F1AE54CBBB1C749B5A80016C0"><enum>(B)</enum><text>Certification by
			 the State that the State maintains a landowner relations program.</text>
					</subparagraph><subparagraph id="H6D039EC14775475EA0F0279930211F66"><enum>(C)</enum><text>A copy of the
			 comprehensive State plan.</text>
					</subparagraph><subparagraph id="H8F3FC0EB6EBC45778700E2900E73F00"><enum>(D)</enum><text>Such information as
			 the Chief may require.</text>
					</subparagraph></paragraph></subsection><subsection id="HB5A1E6BC4E2C46618F5313B7368FE08C"><enum>(e)</enum><header>Cost
			 Sharing</header><text display-inline="yes-display-inline">The amount of any
			 grant under this section may not exceed 75 percent of the total cost of the
			 land rights acquired with the grant.</text>
			</subsection><subsection id="H54CD0398F8384DC28C61434CAD955DE3"><enum>(f)</enum><header>Publication of
			 Criteria</header><text>Not later than 60 days after the date of enactment of
			 this Act, the Chief shall publish criteria for making grants under
			 <internal-xref idref="H34F1DAB3588F45B3BC2EB921005BC3C" legis-path="2.(a)">subsection (a)</internal-xref> in the Federal
			 Register.</text>
			</subsection><subsection id="HA157E77CE21B4563A682AF087211A358"><enum>(g)</enum><header>Report</header><text>Not
			 later than one year after the date of enactment of this Act, and annually
			 thereafter, the Chief shall submit to Congress a report on the grant program
			 established under
			 <internal-xref idref="H34F1DAB3588F45B3BC2EB921005BC3C" legis-path="2.(a)">subsection (a)</internal-xref>.</text>
			</subsection><subsection id="HD1511128EE9C44B0AAF237B86B26800"><enum>(h)</enum><header>Definitions</header><text>For
			 purposes of this section:</text>
				<paragraph id="H7029D8D0C34C4D1CB876F391E7E513CB"><enum>(1)</enum><header>Chief</header><text display-inline="yes-display-inline">The term <term>Chief</term> means the Chief
			 of the Forest Service.</text>
				</paragraph><paragraph id="H8CEDDACA6936422285F0B174603346C6"><enum>(2)</enum><header>Comprehensive
			 State Plan</header><text display-inline="yes-display-inline">The term
			 <term>comprehensive State plan</term> means a comprehensive plan developed by
			 the State, regarding recreational access to and conservation of land in the
			 State, that—</text>
					<subparagraph id="H66991822943B4525A93D8612DA69C33"><enum>(A)</enum><text display-inline="yes-display-inline">is developed through a process that
			 involves interested persons from both the public and private sectors, including
			 landowners; and</text>
					</subparagraph><subparagraph id="HA6F4D211CA3C44E887D48581463B8BAD"><enum>(B)</enum><text display-inline="yes-display-inline">includes strategies for developing
			 partnerships between the public and private sectors to develop, improve, and
			 preserve traditional recreational opportunities.</text>
					</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H00E6AF22DBF1426F8E8F891215FA69D9"><enum>(3)</enum><header>Landowner
			 Relations Program</header><text display-inline="yes-display-inline">The term
			 <term>landowner relations program</term> means a program established by the
			 State that—</text>
					<subparagraph id="H5B6ED28AFD994635986C009B3045BDB8"><enum>(A)</enum><text>engages private
			 landowners to facilitate public access to their property for traditional
			 use;</text>
					</subparagraph><subparagraph id="HCA9A8A571C5F414FB3FEB705DB392330"><enum>(B)</enum><text>addresses the
			 concerns of landowners relating to public access to private land; and</text>
					</subparagraph><subparagraph id="H3BE33FDD45EE4CC99148E3A485CE005B"><enum>(C)</enum><text>serves as a
			 clearinghouse for information about rules, regulations, certifications, and
			 procedures for land use.</text>
					</subparagraph></paragraph><paragraph id="HCFF3867838D34D08B580AA8151762940"><enum>(4)</enum><header>Program</header><text display-inline="yes-display-inline">The term <term>program</term> means the
			 grant program established under
			 <internal-xref idref="H34F1DAB3588F45B3BC2EB921005BC3C" legis-path="2.(a)">subsection (a)</internal-xref>.</text>
				</paragraph><paragraph commented="no" id="HAFF1D5F8D3A9415ABBDF859E3FFA497B"><enum>(5)</enum><header>Traditional
			 Use</header>
					<subparagraph id="H15170BD50ADC457290446CB3601D78F6"><enum>(A)</enum><header>In
			 general</header><text>Except as provided in
			 <internal-xref idref="H83D1B5D5864343A695A8B58D1243D849" legis-path="2.(h)(5)(B)">subparagraph (B)</internal-xref>, the term
			 <term>traditional use</term> has the meaning given that term by the State
			 receiving a grant under
			 <internal-xref idref="H34F1DAB3588F45B3BC2EB921005BC3C" legis-path="2.(a)">subsection (a)</internal-xref>. Such term may include
			 hunting, fishing, access to water, motorized recreation, hiking, bird watching,
			 and non-motorized recreational activities.</text>
					</subparagraph><subparagraph id="H83D1B5D5864343A695A8B58D1243D849"><enum>(B)</enum><header>Exclusion</header><text>The
			 term <term>traditional use</term> does not include residential or commercial
			 development.</text>
					</subparagraph></paragraph></subsection></section><section id="H872B4EB5CEB24AE5B3A04B6D8F85C6DD"><enum>3.</enum><header>Authorization of
			 Appropriations</header><text display-inline="no-display-inline">There is
			 authorized to be appropriated to the Chief to carry out this Act, $50,000,000
			 for each fiscal year from 2009 through 2013.</text>
