			 level</header><text display-inline="yes-display-inline">Section 9(p)(2)(B)(ix)

				</subsection><subsection commented="no" display-inline="no-display-inline" id="H99E0A8B56B0D42FF98EEE02B6FF63"><enum>(c)</enum><header>Annual
			 adjustments</header><text>Section 9 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638</external-xref>)
			 is amended—</text>
					<paragraph commented="no" id="HFB2344508C60414AA93EBA81693E931C"><enum>(1)</enum><text>in subsection
			 (j)(2)(D), by striking <quote>and an adjustment of such amounts once every 5
			 years to reflect economic adjustments and programmatic considerations</quote>
			 and inserting <quote>and a mandatory annual adjustment of such amounts to
			 reflect economic adjustments and programmatic considerations</quote>;
			 and</text>
					</paragraph><paragraph commented="no" id="HD33C630C1469458BBCDF4DE93A03D25"><enum>(2)</enum><text>in subsection
			 (p)(2)(B)(ix), by striking <quote>greater or lesser amounts</quote> and
			 inserting <quote>with a mandatory annual adjustment of such amounts to reflect
			 economic adjustments and programmatic considerations, and with lesser
			 amounts</quote>.</text>
					</paragraph></subsection><subsection id="HB25239B17DE04F8B83A1AF007F088760"><enum>(d)</enum><header>Limitation on
			 certain awards</header><text>Section 9 of the Small Business Act (15 U.S.C.
			 638) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H97EBAB5E6E9A4A21B495C5008D0025A7" style="OLC">
						<subsection id="H0FE4BE4A328D46D89DCD404F9F9E4C2D"><enum>(z)</enum><header>Limitation on
				phase I and II awards</header>
							<paragraph id="HA717EB109A5142208981ADA2E8A0FA2C"><enum>(1)</enum><header>In
				general</header><text>No Federal agency shall issue an award under the SBIR
				program or the STTR program if the size of the award exceeds the amounts
				established under subsections (j)(2)(D) and (p)(2)(B)(ix), except as provided
				in paragraph (2).</text>
							</paragraph><paragraph id="HE59CE1EDCA8F443900092C65E6B719E5"><enum>(2)</enum><header>Exception</header><text>The
				prohibition in paragraph (1) does not apply to an agency for a fiscal year if
				the head of the agency—</text>
								<subparagraph id="H405732DE85874194B37373013961BCEE"><enum>(A)</enum><text>notifies the
				Administrator that the agency intends to issue awards in that fiscal year
				without regard to the prohibition in paragraph (1); and</text>
								</subparagraph><subparagraph id="H2A977280B8D44FFE003600D9BAEE528"><enum>(B)</enum><text display-inline="yes-display-inline">reports to the Committee on Small Business
				and the Committee on Science and Technology of the House of Representatives and
				the Committee on Small Business and Entrepreneurship of the Senate at least
				annually the number of instances in which the agency issued an award that
				exceeds the amounts referred to in paragraph (1) and the justification for each
				such
				instance.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section id="HCBACE7754F704AC4B700AC530822126"><enum>103.</enum><header>Establishment of
			 SBIR advisory boards</header>
				<subsection id="H1263BA0A724744578F4EB672B342006F"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 9 of the
			 Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638</external-xref>) is amended by inserting after subsection (z)
			 the following:</text>
					<quoted-block display-inline="no-display-inline" id="H16CEBDC11671477AAFE8F914719E61CD" style="OLC">
						<subsection id="H5B487828EF4C42FBBACACBAF6FDF57DF"><enum>(aa)</enum><header>SBIR advisory
				boards</header>
							<paragraph id="HB8D499714E3446B1BEA1A087516F5CF6"><enum>(1)</enum><header>Advisory boards
				required</header><text display-inline="yes-display-inline">Each Federal agency
				that is required by this section to conduct an SBIR program and that
				administers annually $50,000,000 or more in SBIR grants shall have an SBIR
				advisory board.</text>
							</paragraph><paragraph id="H58DB1D77334B4FFC8B8521F0A576F6D1"><enum>(2)</enum><header>Members</header><text>For
				each advisory board required by paragraph (1), the members of the advisory
				board shall include—</text>
								<subparagraph id="H0AAFC4D6D6CB4039B481272600275F8E"><enum>(A)</enum><text>at least two
				individuals who are employees of the agency;</text>
								</subparagraph><subparagraph id="H8D729728BE814FBCB61D1E3245206500"><enum>(B)</enum><text>at least two
				representatives of private sector technology firms;</text>
								</subparagraph><subparagraph id="H416DA9AFFCDF4BE6B66677A78B9D248D"><enum>(C)</enum><text>at least one
				individual who is a veteran who owns a small business concern owned and
				controlled by veterans; and</text>
								</subparagraph><subparagraph id="H03AB342B3AFF44DC811F002EA35C6391"><enum>(D)</enum><text>such other
				individuals as the agency considers appropriate.</text>
								</subparagraph></paragraph><paragraph id="H0A82E1DD48424741B73DFEC7068C236F"><enum>(3)</enum><header>Security
				clearances</header><text display-inline="yes-display-inline">Where it is
				appropriate to the work of an advisory board required by paragraph (1) that the
				members and staff of the advisory board have a security clearance, the
				appropriate departments and agencies of the executive branch shall cooperate
				with the advisory board to expeditiously provide members and staff with
				appropriate security clearances to the extent possible under applicable
				procedures and requirements.</text>
							</paragraph><paragraph id="H88CEC8DB55714A7DB5C6935EF5887196"><enum>(4)</enum><header>Meetings</header><text>Each
				advisory board required by paragraph (1) shall meet at least two times per
				year.</text>
							</paragraph><paragraph id="H17377410045E4CCE00383539E0BFD470"><enum>(5)</enum><header>Duties</header><text>Each
				advisory board required by paragraph (1) shall—</text>
								<subparagraph id="HBCA77236A35C441684EF0031CA32B22E"><enum>(A)</enum><text>review the
				quarterly reports submitted under subsection (g)(8);</text>
								</subparagraph><subparagraph id="HBFC9AC51622B4F66B5D1C787E3E10407"><enum>(B)</enum><text>make
				recommendations to the agency about potential modifications to the agency’s
				SBIR program that are intended to—</text>
									<clause id="H232615F390624086A6777E7447D0A663"><enum>(i)</enum><text display-inline="yes-display-inline">encourage applications, particularly
				applications from small business concerns owned and controlled by women, small
				business concerns owned and controlled by minorities, small business concerns
				owned and controlled by service-disabled veterans, and small business concerns
				in States and regions that historically receive few SBIR awards; and</text>
									</clause><clause id="H8040F030B291472294B1D1C74EAE655D"><enum>(ii)</enum><text>support
				commercialization of Federal research funded by SBIR awards; and</text>
									</clause></subparagraph><subparagraph id="HFF0D0F84C8E94E6C8D4916C1599ED27F"><enum>(C)</enum><text>submit to the
				Committee on Small Business and the Committee on Science and Technology of the
				House of Representatives and the Committee on Small Business and
				Entrepreneurship of the Senate an annual report on the SBIR program conducted
				by the agency.</text>
								</subparagraph></paragraph><paragraph id="H1EC3A1794E5E4E5D9316C1C763BFC39C"><enum>(6)</enum><header>Contents of
				annual report</header><text display-inline="yes-display-inline">The annual
				report required by paragraph (5)(C) shall include a description of how that
				agency’s SBIR program is functioning and any recommendations of the advisory
				board for strengthening that agency’s SBIR program. The annual report shall
				also state the number and dollar amount of awards under the agency’s SBIR
				program, and under the agency’s STTR program, that were made to small business
				concerns owned and controlled by women, small business concerns owned and
				controlled by minorities, small business concerns owned and controlled by
				veterans, and small business concerns in States and regions that historically
				receive few SBIR awards.</text>
							</paragraph><paragraph id="H968EC40519D447EDAB77E18F83F44714"><enum>(7)</enum><header>Non-applicability
				of FACA</header><text>The Federal Advisory Committee Act (5 U.S.C. App.) shall
				not apply to an advisory board required by paragraph
				(1).</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H67FF2FC53B8D44B7B965549371C0016"><enum>(b)</enum><header>Agency reports to
			 SBIR advisory boards</header><text>Section 9(g)(8) of the Small Business Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(g)(8)</external-xref>) is amended by inserting before the semicolon at the end
			 the following: <quote>and, if the agency is required by subsection (aa) to have
			 an SBIR advisory board, submit a quarterly report on the SBIR program to that
			 SBIR advisory board</quote>.</text>
				</subsection></section><section id="H4782C517D55F46408650716D99DF305B"><enum>104.</enum><header>Increase in
			 amount of technical assistance funds and option to purchase technical
			 assistance directly</header><text display-inline="no-display-inline">Section
			 9(q) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(q)</external-xref>) is amended—</text>
				<paragraph commented="no" id="H35E93BD9FFA24F38841BF008BB250044"><enum>(1)</enum><text>in paragraph
			 (1)—</text>
					<subparagraph commented="no" id="H92646800052748ECBAA9A5003BD5E9AE"><enum>(A)</enum><text>by striking
			 <quote>paragraph (2)</quote> and inserting <quote>paragraph (2)(A), or another
			 Federal agency under paragraph (2)(B),</quote>;</text>
					</subparagraph><subparagraph commented="no" id="HC8749C2675444D82A57518AEEE80C521"><enum>(B)</enum><text>by striking
			 <quote>and</quote> at the end of subparagraph (C);</text>
					</subparagraph><subparagraph commented="no" id="HE19247829ECC49A192A057C60047EB1B"><enum>(C)</enum><text>by striking the
			 period at the end of subparagraph (D) and inserting <quote>; and</quote>;
			 and</text>
					</subparagraph><subparagraph commented="no" id="HFF5A3FF7198E4F139062AAD5B5811808"><enum>(D)</enum><text>by adding at the
			 end the following new subparagraph:</text>

				production strategies for
				utilization.</text>
							</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph commented="no" id="HAAAA825BB8B341D291B6082AB88E2C2"><enum>(2)</enum><text>by amending
			 paragraph (2) to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="H57CF5BF9FB59460A88BE4614F1393C92" style="OLC">
						<paragraph commented="no" id="HCC5B6E91C28C445EB48728CC22D89F82"><enum>(2)</enum><header>Assistance
				providers</header>
							<subparagraph commented="no" id="H2BE1AFC126BE4086A5274DD85DD2519E"><enum>(A)</enum><header>Vendor
				selection</header><text display-inline="yes-display-inline">Each agency may
				select a vendor to assist small business concerns to meet the goals listed in
				paragraph (1) for a term not to exceed 3 years. Such selection shall be
				competitive and shall utilize merit-based criteria.</text>
							</subparagraph><subparagraph commented="no" id="H2A64A794168A4CB5824F441B763B40A6"><enum>(B)</enum><header>Interagency
				collaboration</header><text>In addition, each agency may enter into a
				collaborative agreement with the technical extension or assistance programs of
				other Federal agencies in order to provide the assistance described in
				paragraph (1).</text>
							</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H50EF4BA8B16C479F871FCE36158F5444"><enum>(3)</enum><text>in paragraph
			 (3)—</text>

				final report issued by the ‘Transit Research and Development: Federal Role in
				the National Program’ project and the ‘Transportation Research, Development and
				Technology Strategic Plan (2006–2010)’ issued by the United States Department
				of Transportation Research and Innovative Technology Administration, and in
				subsequent reports issued by the National Academy of Sciences and United States

				</paragraph></section><section id="HED8C51C0AC2C464DABAD6B461748FDC9"><enum>108.</enum><header>Federal agency
			 engagement with SBIR awardees that have been awarded multiple Phase One awards
			 but have not been awarded Phase Two awards</header><text display-inline="no-display-inline">Section 9(j) of the Small Business Act (15
			 U.S.C. 638(j)) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H6BE012C17E824E698090BE602DE56F39" style="OLC">
					<paragraph id="HB326C8E224C149A7BE7EC1E9C9018427"><enum>(4)</enum><header>Requirements
				relating to Federal agency engagement with certain first phase SBIR
				awardees</header><text display-inline="yes-display-inline">The Administrator
				shall modify the policy directives issued pursuant to this subsection to
				provide for each Federal agency required by this section to conduct an SBIR

				develop performance metrics to measure awardee progression in the SBIR

					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section commented="no" display-inline="no-display-inline" id="H3E1C35466BE14CCE890390357E0159A5"><enum>109.</enum><header>Limitation on
			 certain awards</header><text display-inline="no-display-inline">Section 9 of
			 the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638</external-xref>) is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H80EAFB8C02FD4F6EA4C7C9AB2ED25B60" style="OLC">
					<subsection commented="no" id="HDF969A6F63B3488C9685D42D07A195D3"><enum>(bb)</enum><header>Subsequent
				Phases</header>
						<paragraph commented="no" id="H55AF0115788549D59BFEBA01A17E8C5D"><enum>(1)</enum><header>In
				general</header><text>A small business concern which received an award from a
				Federal agency under this section shall be eligible to receive an award for a
				subsequent phase from another Federal agency, if the head of each relevant
				Federal agency makes a written determination that the topics of the relevant
				awards are the same.</text>
						</paragraph><paragraph commented="no" id="HEBD2A87CF11D4556B1425634FE96F0C2"><enum>(2)</enum><header>Crossover
				between programs</header><text>A small business concern which received an award
				under this section under the SBIR program or the STTR program may, at the
				discretion of the granting agency, receive an award under this section for a
				subsequent phase in either the SBIR program or the STTR program.</text>
						</paragraph><paragraph commented="no" id="HC595E400B59F41258274C1D9F7D91151"><enum>(3)</enum><header>Phase ii sbir
				applications</header><text display-inline="yes-display-inline">An agency may
				permit an applicant to apply directly for a Phase II award, as described in
				subsection (e)(4)(B), without first completing a Phase I award, as described in
				subsection (e)(4)(A), if the applicant can demonstrate that project feasibility
				was achieved without SBIR or other Federal funding.</text>
						</paragraph><paragraph commented="no" id="HDF6B6599005E48B19665A780CEF77B49"><enum>(4)</enum><header>Phase ii sttr
				applications</header><text>An agency may permit an applicant to submit
				proposals for Phase II awards, as described in subsection (e)(6)(B), without
				first completing a Phase I award, as described in subsection (e)(6)(A), if the
				applicant can demonstrate it has accomplished Phase I through cooperative
				research and development achieved without STTR or other Federal funding.</text>
						</paragraph></subsection><subsection commented="no" id="H4917AC847FEC46BFA356D49C5661F0F1"><enum>(cc)</enum><header>Waiver of
				minimum work requirement</header><text>A Federal agency making an SBIR or STTR
				award under this section may waive the minimum small business concern or
				research institution work requirements under subsection (e)(7) if the agency
				determines that to provide such waiver would be consistent with the purposes of
				this section and consistent with achieving the objectives of the award
				proposal.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H60F4307B26764593B762D0CC137359DB"><enum>110.</enum><header>Comptroller
			 General audit of how Federal agencies calculate extramural research
			 budgets</header><text display-inline="no-display-inline">The Comptroller
			 General of the United States shall carry out a detailed audit of how Federal
			 agencies calculate extramural research budgets for purposes of calculating the
			 size of the agencies’ Small Business Innovation Research and Small Business
			 Technology Transfer budgets. Not later than 1 year after the date of the
			 enactment of this Act, the Comptroller General shall submit to the Committee on
			 Small Business and the Committee on Science and Technology of the House of
			 Representatives and the Committee on Small Business and Entrepreneurship of the
			 Senate a report on the results of the audit.</text>
			</section><section id="H01136A5436AB4B94AD5B73CDBF992B73"><enum>111.</enum><header>Providing
			 explanations to unsuccessful applicants</header><text display-inline="no-display-inline">Section 9 of the Small Business Act (15
			 U.S.C. 638) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H10BBA58608234B2FA18D6384E5A88C00" style="OLC">
					<subsection id="HD38D84DA32FE4E1BACBFDB2185233D38"><enum>(dd)</enum><header>Providing
				explanations to unsuccessful applicants</header><text display-inline="yes-display-inline">Whenever an entity applies for, but does
				not receive, an award under an SBIR or STTR program under this section, the
				Federal agency conducting the program shall—</text>
						<paragraph id="HF798FEFEC6184E3EA9DF4267594E7D48"><enum>(1)</enum><text>in a plain and
				conspicuous manner, notify that entity that it can request an explanation
				(which must be of a constructive nature) of the reasons why the entity did not
				receive the award; and</text>
						</paragraph><paragraph id="H73EA71CB8EDB410C936FA1A69D6BEC00"><enum>(2)</enum><text>provide such an
				explanation to that entity, if the entity so
				requests.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section></title><title id="HA7F6D1EC405B4FE5A0A8E28400DD4140"><enum>II</enum><header>Venture Capital
			 Investment Standards</header>
			<section id="HF3456D1D05374A1F9583935D24B3AA74"><enum>201.</enum><header>Ensuring that
			 innovative small businesses with substantial investment from venture capital
			 operating companies are able to participate in the SBIR program</header><text display-inline="no-display-inline">Section 9(e) of the Small Business Act (15
			 U.S.C. 638(e)) is amended by striking <quote>and</quote> at the end of
			 paragraph (8), striking the period at the end of paragraph (9) and inserting
			 <quote>; and</quote>, and adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HDC48E812B7404B74A696AF8B9C695224" style="OLC">
					<paragraph id="HF992E835852843FC928DC31C017300F1"><enum>(10)</enum><text display-inline="yes-display-inline">effective only for the SBIR and STTR
				programs, notwithstanding any other amendment made by the SBIR/STTR
				Reauthorization Act, the following shall apply:</text>
						<subparagraph id="HCFD0F3AB8F28437BA12460DC67D0C3CA"><enum>(A)</enum><text>A business concern
				that has more than 500 employees shall not qualify as a small business
				concern.</text>
						</subparagraph><subparagraph id="H8D838FC28A05416695D4112CF670C3FB"><enum>(B)</enum><text display-inline="yes-display-inline">In determining whether a small business
				concern is independently owned and operated under section 3(a)(1) or meets the
				small business size standards instituted under section 3(a)(2), the
				Administrator shall not consider a business concern to be affiliated with a
				venture capital operating company (or with any other business that the venture
				capital operating company has financed) if—</text>
							<clause id="H762DCE14FC094CD6B79600007B4B7D37"><enum>(i)</enum><text>the venture
				capital operating company does not own 50 percent or more of the business
				concern; and</text>
							</clause><clause id="H53897A43113F4EB098DBE9732452F70"><enum>(ii)</enum><text>employees of the
				venture capital operating company do not constitute a majority of the board of
				directors of the business concern.</text>
							</clause></subparagraph><subparagraph id="H4285351B22A24AF0A66DB065ABD6DCE"><enum>(C)</enum><text>A business concern
				shall be deemed to be <quote>independently owned and operated</quote>
				if—</text>
							<clause id="H6CE0D5FA710F481BA96BCA754BACEB0"><enum>(i)</enum><text>it
				is owned in majority part by one or more natural persons or venture capital
				operating companies;</text>
							</clause><clause id="H125C4C6D51BE413BABE1F6746E83E"><enum>(ii)</enum><text>there is no single
				venture capital operating company that owns 50 percent or more of the business
				concern; and</text>
							</clause><clause id="H7A935B47AB2E42548062B0E3B6882DC"><enum>(iii)</enum><text>there is no
				single venture capital operating company the employees of which constitute a
				majority of the board of directors of the business concern.</text>
							</clause></subparagraph><subparagraph id="H9C4CC86936564BA79BDD203795A3BB42"><enum>(D)</enum><text display-inline="yes-display-inline">If a venture capital operating company
				controlled by a business with more than 500 employees (in this subparagraph
				referred to as a <quote>VCOC under large business control</quote>) has an
				ownership interest in a small business concern that is owned in majority part
				by venture capital operating companies, the small business concern is eligible
				to receive an award under the SBIR or STTR program only if—</text>
							<clause id="H45EDA7B81C194E559317049C7E9C0047"><enum>(i)</enum><text>not more than two
				VCOCs under large business control have an ownership interest in the small
				business concern;</text>
							</clause><clause id="H356BE41F25914B39844D3321F45FC57E"><enum>(ii)</enum><text>the VCOCs under
				large business control do not collectively own more than 20 percent of the
				small business concern; and</text>
							</clause><clause id="HF2B303EC47874F9FB9D47463DCB59215"><enum>(iii)</enum><text>the VCOCs under
				large business control do not collaborate with each other to exercise more
				control over the small business concern than they could otherwise exercise
				individually.</text>
							</clause></subparagraph><subparagraph id="HA317E89A758C49C5A731B47FB2F99AD"><enum>(E)</enum><text>The term
				<term>venture capital operating company</term> means a business concern—</text>
							<clause id="H320A052156F34705008418FB78D21DF8"><enum>(i)</enum><text>that—</text>
								<subclause id="HDFD686B0FE664A70AD099C26CC117400"><enum>(I)</enum><text>is a Venture
				Capital Operating Company, as that term is defined in regulations promulgated
				by the Secretary of Labor; or</text>
								</subclause><subclause id="H2F61D5F27B5F40AAB8B13CD00F97EC4"><enum>(II)</enum><text>is an entity
				that—</text>
									<item id="HB5BCE5F1E7C24677A80087FFF600924D"><enum>(aa)</enum><text>is
				registered under the Investment Company Act of 1940 (<external-xref legal-doc="usc" parsable-cite="usc/15/80a-51">15 U.S.C. 80a-51 et seq.</external-xref>);
				or</text>
									</item><item id="HFCF6978E6936441B8BBFEE87F61866AB"><enum>(bb)</enum><text>is
				an investment company, as defined in section 3(c)(14) of such Act (15 U.S.C.
				80a-3(c)(14)), which is not registered under such Act because it is
				beneficially owned by less than 100 persons; and</text>
									</item></subclause></clause><clause id="H6EEAFFB4F1BE4A8D83A43753F810AFD"><enum>(ii)</enum><text>that is itself
				organized or incorporated and domiciled in the United States, or is controlled
				by a business concern that is incorporated and domiciled in the United
				States.</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section></title><title id="H8207D75DAE0E470E9DEA2F7580A8B60"><enum>III</enum><header>SBIR
			 and Economic Development</header>
			<section id="H574F016381C5477D8FD629B5A1B8B9E"><enum>301.</enum><header>Reauthorization
			 and modernization of Federal and State Technology Partnership Program
			 (FAST)</header><text display-inline="no-display-inline">Section 9 of the Small
			 Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638</external-xref>) is amended by inserting after subsection (r) the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="HEF3B8A5EBA024B339F48097B97AA24F1" style="OLC">
					<subsection id="H9A42E4DA9FDF477EA9DF6191CEDCDF72"><enum>(s)</enum><header>Outreach and
				support activities</header>
						<paragraph id="HD9927ED3B6A446759C4828D476DA6CAC"><enum>(1)</enum><header>In
				general</header><text>Subject to the other provisions of this subsection, the
				Administrator shall make grants on a competitive basis to organizations, to be
				used by the organizations to do one or both of the following:</text>
							<subparagraph id="H0373E6BE91BC4A8F996DACD02F52C0FE"><enum>(A)</enum><text>To conduct
				outreach efforts to increase participation in the programs under this
				section.</text>
							</subparagraph><subparagraph display-inline="no-display-inline" id="HA6FAD44D4F9F400DAFC979BFBA1018F"><enum>(B)</enum><text>To provide
				application support and entrepreneurial and business skills support to
				prospective participants in the programs under this section.</text>
							</subparagraph></paragraph><paragraph id="HE03005977E074843BCBC59852800E45B"><enum>(2)</enum><header>Program
				authority</header><text display-inline="yes-display-inline">Of the amounts made
				available to carry out this section for each of fiscal years 2009 through 2010,
				the Administrator may expend not more than $10,000,000 in each such fiscal year
				to carry out paragraph (1).</text>
						</paragraph><paragraph id="H2C0F2311D57B409098BE1742B9A85B9B"><enum>(3)</enum><header>Amount of
				assistance</header><text>For each of subparagraphs (A) and (B) of paragraph
				(1), the amount of assistance provided to an organization under that
				subparagraph in any fiscal year—</text>
							<subparagraph id="H0C54273200304264B46ED222F375DAB6"><enum>(A)</enum><text>shall be equal to
				the total amount of matching funds from non-Federal sources provided by the
				organization; and</text>
							</subparagraph><subparagraph id="H3A8F0521F8794A11A525ECF0577EEC37"><enum>(B)</enum><text>shall not exceed
				$250,000.</text>
							</subparagraph></paragraph><paragraph id="HBA1D5AAFDF48471A96367EC660962000"><enum>(4)</enum><header>Direction</header><text>An
				organization receiving funds under paragraph (1) shall, in using those funds,
				direct its activities at one or both of the following:</text>
							<subparagraph id="H2F5804C68EDA47B6A90566F500FD2B70"><enum>(A)</enum><text>Small business
				concerns located in geographic areas that are underrepresented in the programs
				under this section.</text>
							</subparagraph><subparagraph id="HDBA688EA9611406DAA817895CFF13EB6"><enum>(B)</enum><text>Small business
				concerns owned and controlled by women, small business concerns owned and
				controlled by service-disabled veterans, and small business concerns owned and
				controlled by minorities.</text>
							</subparagraph></paragraph><paragraph id="HF314D8A525224560BDE8646F2FFFEEC4"><enum>(5)</enum><header>Advisory
				board</header>
							<subparagraph id="H5752A2879BAA4627B8C9A32CF94CF700"><enum>(A)</enum><header>Establishment</header><text>Not
				later than 90 days after the date of the enactment of this subsection, the
				Administrator shall establish an advisory board for the activities carried out
				under this subsection.</text>
							</subparagraph><subparagraph id="HC273A3E79F5B4D0EAC824062A24CB4D9"><enum>(B)</enum><header>Non-applicability
				of FACA</header><text>The Federal Advisory Committee Act (5 U.S.C. App.) shall
				not apply to the advisory board.</text>
							</subparagraph><subparagraph id="H0D2F22CB3007460181C772D2CAECDC78"><enum>(C)</enum><header>Members</header><text>The
				members of the advisory board shall include the following:</text>
								<clause id="H1ADE0E60B7874335AE5E1584A66D1576"><enum>(i)</enum><text>The Administrator
				(or the Administrator’s designee).</text>
								</clause><clause id="H167822F2B23B4826A0B57B547631AAA4"><enum>(ii)</enum><text>For each Federal
				agency required by this section to conduct an SBIR program, the head of the
				agency (or the designee of the head of the agency).</text>
								</clause><clause id="H1C88C5C18A7A4B96AAC2009D00A659DD"><enum>(iii)</enum><text>Representatives
				of small business concerns that are current or former recipients of SBIR
				awards, or representatives of organizations of such concerns.</text>
								</clause><clause id="H4AA538C4EA19451EA9438470085CFA2E"><enum>(iv)</enum><text>Representatives
				of service providers of SBIR outreach and assistance, or representatives of
				organizations of such service providers.</text>
								</clause></subparagraph><subparagraph id="H6ED70A691E034B85B17DF084FB9F84D5"><enum>(D)</enum><header>Duties</header><text>The
				advisory board shall have the following duties:</text>
								<clause id="H3DB74C83EFCF470DA8B1611EDAF48458"><enum>(i)</enum><text display-inline="yes-display-inline">To develop guidelines for awards under
				paragraph (1)(A), including guidelines relating to award sizes, proposal
				requirements, metrics for monitoring awardee performance, and metrics for
				measuring overall value of the activities carried out by the awardees.</text>
								</clause><clause id="HA57C9ED124E4462F86374778FCA961D0"><enum>(ii)</enum><text>To identify
				opportunities for coordinated outreach, technical assistance, and
				commercialization activities among Federal agencies, the recipients of the
				awards under paragraph (1)(A), and applicants and recipients of SBIR awards,
				including opportunities such as—</text>
									<subclause id="H63FA4FAD4C054D38BE008E72CE0979BF"><enum>(I)</enum><text>podcasting or
				webcasting for conferences, training workshops, and other events;</text>
									</subclause><subclause id="H10A69569282B45BAA4B0ED82EF00C0AE"><enum>(II)</enum><text>shared online
				resources to match prospective applicants with the network of paragraph (1)(A)
				recipients; and</text>
									</subclause><subclause id="H3FADBFA7F2C34EF7BFAE148EABD20"><enum>(III)</enum><text>venture capital
				conferences tied to technologies and sectors that cross agencies.</text>
									</subclause></clause><clause id="HD1B28AB914B6485F94DE053A5D216EE"><enum>(iii)</enum><text>To review and
				recommend revisions to activities under paragraph (1)(A).</text>
								</clause><clause id="HF43C8E2C5E054385834832057DC4C5D"><enum>(iv)</enum><text>To
				submit to the Committee on Small Business and Entrepreneurship of the Senate
				and the Committee on Small Business and the Committee on Science and Technology
				of the House of Representatives an annual report on the activities carried out
				under paragraph (1)(A) and the effectiveness and impact of those
				activities.</text>
								</clause></subparagraph></paragraph><paragraph id="H9B9C748EF45F4A3D86EABDC76B0084D8"><enum>(6)</enum><header>Selection
				criteria</header><text>In awarding grants under this subsection, the
				Administrator shall use selection criteria developed by the advisory board
				established under paragraph (5). The criteria shall include—</text>
							<subparagraph id="H3415988CB6314210A732C9928B619FA3"><enum>(A)</enum><text>criteria designed
				to give preference to applicants who propose to carry out activities that will
				reach either an underperforming geographic area or an underrepresented
				population group (as measured by the number of SBIR applicants);</text>
							</subparagraph><subparagraph id="H3FB8DFA230BC4728B433C2B3654F9DB1"><enum>(B)</enum><text>criteria designed
				to give preference to applicants who propose to carry out activities that
				complement, and are integrated into, the existing public-private innovation
				support system for the targeted region or population;</text>
							</subparagraph><subparagraph id="HEFEFA01FEE5D401FBFCAA35F211617E6"><enum>(C)</enum><text display-inline="yes-display-inline">criteria designed to give preference to
				applicants who propose to measure the effectiveness of the proposed activities;
				and</text>
							</subparagraph><subparagraph id="H403B6697877D4FAE8BD29E90EBA6A7C"><enum>(D)</enum><text display-inline="yes-display-inline">criteria designed to give preference to
				applicants who include an SBDC program that is accredited for its technology
				services.</text>
							</subparagraph></paragraph><paragraph id="HF3097DC756F143808CBC2EB56603D29D"><enum>(7)</enum><header>Peer
				review</header><text>In awarding grants under this subsection, the
				Administrator shall use a peer review process. Reviewers shall include—</text>
							<subparagraph id="HDF39777762AE4887A5004148EB59EF78"><enum>(A)</enum><text>SBIR program
				managers for agencies required by this section to conduct SBIR programs;
				and</text>
							</subparagraph><subparagraph id="H7A9E6889D44D4626BBE3C703ED5B707"><enum>(B)</enum><text display-inline="yes-display-inline">private individuals and organizations that
				are knowledgeable about SBIR, the innovation process, technology
				commercialization, and State and regional technology-based economic development
				programs.</text>
							</subparagraph></paragraph><paragraph id="HB191368F2B1E461D92B47B00BBF523F4"><enum>(8)</enum><header>Per-State
				limitations</header>
							<subparagraph id="HAD13CD3EE5E942AFA1CCE472B325FAFB"><enum>(A)</enum><header>In
				general</header><text>To be eligible to receive a grant under this subsection,
				the applicant must have the written endorsement of the Governor of the State
				where the targeted regions or populations are located (if the regions or
				populations are located in more than one State, the applicant must have the
				written endorsement of the Governor of each such State). Such an endorsement
				must indicate that the Governor will ensure that the activities to be carried
				out under the grant will be integrated with the balance of the State’s
				portfolio of investments to help small business concerns commercialize
				technology.</text>
							</subparagraph><subparagraph id="HBE2C80E70F6842AD8B00BD85006E613C"><enum>(B)</enum><header>Limitation</header><text display-inline="yes-display-inline">Each fiscal year, a Governor may have in
				effect not more than one written endorsement for a grant under paragraph
				(1)(A), and not more than one written endorsement for a grant under paragraph
				(1)(B).</text>
							</subparagraph></paragraph><paragraph id="HE9A17C9A71384D58AC437D324F36CC5B"><enum>(9)</enum><header>Specific
				requirements for FAST Awards</header><text>In making awards under paragraph
				(1)(A) (to be known as <quote>FAST</quote> awards) the Administrator shall
				ensure the following:</text>
							<subparagraph id="H989F0D80A7E0494DB998372811E590B5"><enum>(A)</enum><header>Goals</header><text>Priority
				shall be given applications that address one or more of the following
				goals:</text>
								<clause display-inline="no-display-inline" id="HA6749A27800A482C9C020281F844AF80"><enum>(i)</enum><text>Increasing the
				number of SBIR applications from underperforming geographic areas (as measured
				by the number of SBIR applicants).</text>
								</clause><clause id="HDDFC56CF5BA1457296D6A3DC8D587ED9"><enum>(ii)</enum><text>Increasing the
				number of SBIR applications from underrepresented population groups (as
				measured by the number of SBIR applicants).</text>
								</clause></subparagraph><subparagraph id="H1161108D11CD4B079FE8A3B2A40518F3"><enum>(B)</enum><header>Duration</header><text>Each
				award shall be for a period of 2 fiscal years. The Administrator shall
				establish rules and performance goals for the disbursement of funds for the
				second fiscal year, and funds shall not be disbursed to a recipient for such a
				fiscal year until after the advisory board established under this subsection
				has determined that the recipient is in compliance with the rules and
				performance
				goals.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="HEA2EC13499C8471EB63EDE9345B598A9"><enum>302.</enum><header>Obtaining SBIR
			 applicant’s consent to release contact information to economic development
			 organizations</header><text display-inline="no-display-inline">Section 9 of the
			 Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638</external-xref>) is amended in subsection (s) (as added by
			 this title) by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H868822967C3E49DC9FA000DB125E05BC" style="OLC">
					<paragraph id="HF56308EE211F4DE795D12B517BB68E6B"><enum>(5)</enum><header>Consent to
				release contact information to organizations</header>
						<subparagraph id="H00C4FD0F91B04443A2919F64786198FF"><enum>(A)</enum><header>Enabling concern
				to give consent</header><text display-inline="yes-display-inline">Each Federal
				agency required by this section to conduct an SBIR program shall enable a small
				business concern that is an SBIR applicant to indicate to the agency whether
				the agency has its consent to—</text>
							<clause id="H5034CA44210947D08982DF3261CC31EF"><enum>(i)</enum><text>identify the
				concern to appropriate local and State-level economic development organizations
				as an SBIR applicant; and</text>
							</clause><clause id="HFE814E060DD94E90805EAAF169A268E6"><enum>(ii)</enum><text>release the
				concern’s contact information to such organizations.</text>
							</clause></subparagraph><subparagraph id="H9AA7C96936374891A1C9B991687B4D09"><enum>(B)</enum><header>Rules</header><text>The
				Administrator shall establish rules to implement this paragraph. The rules
				shall include a requirement that the agency include in its SBIR application
				forms a provision through which the applicant can indicate consent for purposes
				of subparagraph
				(A).</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section></title><title id="H5C84988AD93B4F619309A8284E632DA"><enum>IV</enum><header>Advancing
			 Commercialization of SBIR–Funded Research</header>
			<section id="H573C1C56E998467590DB00FF9079E5C3"><enum>401.</enum><header>Clarifying the
			 definition of <quote>Phase Three</quote></header><text display-inline="no-display-inline">Section 9(e) of the Small Business Act (15
			 U.S.C. 638(e)) is amended—</text>
				<paragraph id="H22236998E32C45BE856F0083B174EC35"><enum>(1)</enum><text>in paragraph
			 (4)(C)—</text>
					<subparagraph id="HD275200D384D407C822E961B0003EA00"><enum>(A)</enum><text>in the matter
			 preceding clause (i) by inserting after <quote>a third phase</quote> the
			 following: <quote>, which shall consist of work that derives from, extends, or
			 logically concludes efforts performed under prior SBIR funding agreements
			 (which may be referred to as <quote>Phase III</quote>)</quote>; and</text>
					</subparagraph><subparagraph id="H7633D505449A4119A600CC4E104F3C51"><enum>(B)</enum><text>in clause (i) by
			 inserting after <quote>non-SBIR Federal funding awards</quote> the following:
			 <quote>: <italic>Provided,</italic> That for purposes of this clause, such
			 sources of capital and such funding awards include private investment, private
			 research, development, testing, and evaluation (RDT&amp;E) awards, private
			 sales or licenses, government RDT&amp;E contracts and awards, and government
			 sales</quote>;</text>
					</subparagraph></paragraph><paragraph id="HA1D01F2D601343DC863185539DD9EA08"><enum>(2)</enum><text>in paragraph (8)
			 by striking <quote>and</quote> at the end;</text>
				</paragraph><paragraph id="H9A5C00BAB04F437CB4DD1DF4C82B69C9"><enum>(3)</enum><text>in paragraph (9)
			 by striking the period at the end and inserting <quote>; and</quote>;
			 and</text>
				</paragraph><paragraph id="HAE02FE16EEAD4258A4C0AF14CFFA9FA"><enum>(4)</enum><text>by
			 adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H361C1882E994429883C3A6811DB4FEF2" style="OLC">
						<paragraph id="HB3DC3571F1BF47FE91ABC938F963591C"><enum>(10)</enum><text display-inline="yes-display-inline">the term <term>commercialization</term>
				means the process of developing marketable products or services and producing
				and delivering products or services for sale (whether by the originating party
				or by others) to government or commercial
				markets.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section display-inline="no-display-inline" id="H8569F988EA554DFB9F710094E2E1C882" section-type="subsequent-section"><enum>402.</enum><header>Agency research
			 goals</header><text display-inline="no-display-inline">Section 9 of the Small
			 Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638</external-xref>) is amended by striking subsection (h) and
			 inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="HD3DB59ED6CE947808F2F45D77B549636" style="OLC">
					<subsection id="H7D606C6AD0C14F9999955DCE8DFFC721"><enum>(h)</enum><header>Agency research
				goals</header>
						<paragraph id="HFADC8E9946A840C3AA74AF9005E48468"><enum>(1)</enum><header>In
				general</header><text>In addition to the requirements of subsection (f), each
				Federal agency that is required by this section to have an SBIR program and
				that awards annually $5,000,000,000 or more in procurement contracts shall,
				effective for fiscal year 2009 and each fiscal year thereafter, establish
				annual goals for commercialization of projects funded by SBIR awards.</text>
						</paragraph><paragraph id="HF284C281E267417B95C2CDE1591CE39D"><enum>(2)</enum><header>Specific
				goals</header><text>The goals required by paragraph (1) shall include specific
				goals for each of the following:</text>
							<subparagraph id="HC9C86DCE3B1A44DC84D2B986E39EFD3"><enum>(A)</enum><text>The percentage of
				SBIR projects that receive funding for the third phase (as defined in
				subsection (e)(4)(C)).</text>
							</subparagraph><subparagraph id="H1EE0B42A815149D800FCE261B62F17F3"><enum>(B)</enum><text>The percentage of
				SBIR projects that are successfully integrated into a program of record.</text>
							</subparagraph><subparagraph id="H156DC6D6B1DC46A4B3CA8E6054D8C6A5"><enum>(C)</enum><text>The amount of
				Federal dollars received by SBIR projects through Federal contracts, not
				including dollars received through the SBIR program.</text>
							</subparagraph></paragraph><paragraph id="H246137D03ECA4363912B9C071885D958"><enum>(3)</enum><header>Submission to
				advisory board</header><text>For each fiscal year for which goals are required
				by paragraph (1), the agency shall submit to the agency’s SBIR advisory
				board—</text>
							<subparagraph id="H8AEE1E83B402496CA8B770F5ADA8F164"><enum>(A)</enum><text>not later than 60
				days after the beginning of the fiscal year, the goals; and</text>
							</subparagraph><subparagraph id="HA0AD64C6399048118FF6A4B159D90408"><enum>(B)</enum><text>not later than 90
				days after the end of the fiscal year, data on the extent to which the goals
				were met and a description of the methodology used to collect that
				data.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H0679C6AC454647A8B8CC1FC71252E025"><enum>403.</enum><header>Express
			 authority for an agency to award sequential Phase Two awards for SBIR-funded
			 projects</header><text display-inline="no-display-inline">Section 9(j) of the
			 Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(j)</external-xref>) is amended by adding after paragraph (4)
			 (as added by section 109) the following:</text>
				<quoted-block display-inline="no-display-inline" id="H39E8DB3578E44B1BA33C3B2D1E06E2D4" style="OLC">
					<paragraph id="H4356826B44374C52BD74E22107A185F7"><enum>(5)</enum><header>Requirements
				relating to additional second phase SBIR awards</header><text display-inline="yes-display-inline">The Administrator shall modify the policy
				directives issued pursuant to this subsection to provide the following:</text>
						<subparagraph id="H57307AEC81B94C4288D12F938222C29F"><enum>(A)</enum><text display-inline="yes-display-inline">A small business concern that receives a
				second phase SBIR award for a project remains eligible to receive additional
				second phase SBIR awards.</text>
						</subparagraph><subparagraph id="H1E63C46E559E4E5C86CCE844444CDA8B"><enum>(B)</enum><text>Agencies are
				expressly authorized to provide additional second phase SBIR awards for testing
				and evaluation assistance for the insertion of SBIR technologies into technical
				or weapons systems.</text>
						</subparagraph><subparagraph id="HAE6FB1E90C474AE78ECBC2163DE7AD2D"><enum>(C)</enum><text>Each agency that
				is required by subsection (aa) to have an SBIR advisory board shall include in
				the quarterly reports submitted under subsection (g)(8) the number of projects
				that have received additional second phase SBIR awards and the total dollar
				amount of those additional second phase SBIR
				awards.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="HD32BDB1BE1C44F418564BFDFDE1F3800"><enum>404.</enum><header>Increased
			 partnerships between SBIR awardees and prime contractors, venture capital
			 investment companies, and larger businesses</header><text display-inline="no-display-inline">Section 9(j) of the Small Business Act (15
			 U.S.C. 638(j)) is amended by adding after paragraph (5) (as added by section
			 403) the following:</text>
				<quoted-block display-inline="no-display-inline" id="H318904205277446A9CC3980049C79C9B" style="OLC">
					<paragraph id="HF839711096EB49F38B22767B9FDF9953"><enum>(6)</enum><header>Increased
				partnerships</header>
						<subparagraph id="H18213AC448C04860B3E5812D82889D00"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">Each agency required
				by this section to conduct an SBIR program shall establish initiatives by which
				the agency encourages partnerships between SBIR awardees and prime contractors,
				venture capital investment companies, business incubators, and larger
				businesses, for the purpose of facilitating the progress of the SBIR awardees
				to the third phase. If the agency is required by subsection (aa) to have an
				SBIR advisory board, the advisory board shall include in each report submitted
				under subsection (aa) a description of the initiatives established and an
				assessment of the effectiveness of such initiatives.</text>
						</subparagraph><subparagraph id="HDD94063D0A014F9999DFD42B95556A0"><enum>(B)</enum><header>Definition</header><text display-inline="yes-display-inline">In this paragraph, the term <quote>business
				incubator</quote> means an entity that provides coordinated and specialized
				services to entrepreneurial businesses which meet selected criteria during the
				businesses' startup phases, including providing services such as shared office
				space and office services, access to equipment, access to telecommunications
				and technology services, flexible leases, specialized management assistance,
				access to financing, mentoring and training services, or other coordinated
				business or technical support services designed to provide business development
				assistance to entrepreneurial businesses during these businesses’ startup
				phases.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="HEFF6AF2614254BD7A909006BD012B602"><enum>405.</enum><header>Express
			 authority to <quote>fast-track</quote> Phase Two awards for promising Phase One
			 research</header><text display-inline="no-display-inline">Section 9(j)(2)(G) of
			 the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(j)(2)(G)</external-xref>) is amended by inserting before
			 the semicolon at the end the following: <quote>, and to encourage agencies to
			 develop <quote>fast-track</quote> programs to eliminate that delay by issuing
			 second phase SBIR awards as soon as practicable, including in appropriate cases
			 simultaneously with the issuance of the first phase SBIR award</quote>.</text>
			</section><section id="HDEE9BCFA5D62456BA4D2616747004022"><enum>406.</enum><header>Commercialization
			 programs</header><text display-inline="no-display-inline">Section 9(j) of the
			 Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(j)</external-xref>) is amended by adding after paragraph (6)
			 (as added by section 404) the following:</text>
				<quoted-block display-inline="no-display-inline" id="H1574560CE47F46F784B4D3767DD5EFFB" style="OLC">
					<paragraph id="H16BAC9325B9E48718FF942819BC3A5D2"><enum>(7)</enum><header>Commercialization
				programs</header><text display-inline="yes-display-inline">Each agency required
				by this section to conduct an SBIR program shall establish a commercialization
				program that supports the progress of SBIR awardees to the third phase. The
				commercialization program may include activities such as partnership databases,
				partnership conferences, multiple second phases, mentoring between prime
				contractors and SBIR awardees, multiple second phases with matching private
				investment requirements, jumbo awards, SBIR helpdesks, and transition
				assistance programs. The agency shall include in its annual report an analysis
				of the various activities considered for inclusion in the commercialization
				program and a statement of the reasons why each activity considered was
				included or not included, as the case may be. If the agency is required by
				subsection (aa) to have an SBIR advisory board, the advisory board shall
				include in each report under subsection (aa) a statement identifying the number
				of SBIR awardees that successfully progressed to the third phase.</text>
					</paragraph><paragraph id="HC4CBDBE01F5C40A1A0ACE3E82D05C8B9"><enum>(8)</enum><header>Funding for
				commercialization programs</header>
						<subparagraph id="H6BC227D18C464D37801C408157E33480"><enum>(A)</enum><header>In
				general</header><text>From amounts made available to carry out this paragraph,
				the Administrator may, on petition by agencies required by this section to
				conduct an SBIR program, transfer funds to such agencies to support the
				commercialization programs of such agencies.</text>
						</subparagraph><subparagraph id="HF3E9610949F84A5D9FA378630017CEEF"><enum>(B)</enum><header>Petitions</header><text>The
				Administrator shall establish rules for making transfers under subparagraph
				(A). The initial set of rules shall be promulgated not later than 90 days after
				the date of the enactment of this paragraph.</text>
						</subparagraph><subparagraph id="H2647C4AA93E848ED94E07ED4AEE91C"><enum>(C)</enum><header>Authorization of
				appropriations</header><text>There is authorized to be appropriated to the
				Administrator to carry out this paragraph $27,500,000 for fiscal year 2009 and
				each fiscal year thereafter.</text>
						</subparagraph><subparagraph id="H6C5CF3C7EEE34DAFBE5F4C98070161A7"><enum>(D)</enum><header>Minority
				institution pilot program</header>
							<clause id="H342D04780E614497934007B9A7C3253"><enum>(i)</enum><header>Establishment</header><text>From
				amounts made available to carry out this subparagraph, the Administrator shall
				establish and carry out a pilot program to make grants to minority institutions
				that partner with nonprofit organizations that have experience developing
				relationships between industry, minority institutions, and other entities, for
				the purpose of increasing the number of SBIR and STTR program applications by
				minority-owned small businesses.</text>
							</clause><clause id="H73DC10005AE540A99093CE3442892214"><enum>(ii)</enum><header>Application</header><text>To
				be eligible to receive a grant under the pilot program established in clause
				(i), a minority institution shall submit an application to the Administrator at
				such time, in such manner, and containing such information and assurances as
				the Administrator may require.</text>
							</clause><clause id="HE413FF1826B84511A74DEF78F6C23FC"><enum>(iii)</enum><header>Matching
				requirement</header><text display-inline="yes-display-inline">As a condition of
				a grant under the pilot program, the Administrator shall require that a
				matching amount be provided from a source other than the Federal Government
				that is equal to the amount of the grant.</text>
							</clause><clause id="HA96A44B0181B4E1EAB085CD1E54F341F"><enum>(iv)</enum><header>Minority
				institution</header><text display-inline="yes-display-inline">In this
				subparagraph, the term <quote>minority institution</quote> has the meaning
				given that term in section 365(3) of the Higher Education Act of 1965 (20
				U.S.C. 1067k(3)).</text>
							</clause><clause id="H0F8AB42110574F5984EBC69BD0A80093"><enum>(v)</enum><header>Funding</header><text>For
				each of fiscal years 2009 through 2012, of the amounts appropriated pursuant to
				the authorization of appropriations in subparagraph (C), up to $4,000,000 shall
				be available to carry out this subparagraph.</text>
							</clause></subparagraph></paragraph><paragraph id="H1AD57CF1CE7544AD009B11BE11817D4"><enum>(9)</enum><header>Funding
				limitation</header><text display-inline="yes-display-inline">For payment of
				expenses incurred to administer the commercialization programs described in
				paragraphs (7) and (8), the head of the agency may use not more than an amount
				equal to 1 percent of the funds available to the agency pursuant to the Small
				Business Innovation Research program. Such funds—</text>
						<subparagraph id="HA7930E4BE8A448E4B54548B512C60DB"><enum>(A)</enum><text>shall not be
				subject to the limitations on the use of funds in subsection (f)(2); and</text>
						</subparagraph><subparagraph id="H4ED176AD2DA042CAA7C0C31379050780"><enum>(B)</enum><text>shall not be used

			</section><section id="H3B1F96912AFC4446006E00E1687F17FA"><enum>407.</enum><header>Report on
			 efforts to enhance manufacturing activities</header><text display-inline="no-display-inline">Section 9(j) of the Small Business Act (15
			 U.S.C. 638(j)) is amended by adding after paragraph (9) (as added by section
			 406) the following:</text>
				<quoted-block display-inline="no-display-inline" id="HFBAB6264A15C40C98EC6001CDD86B076" style="OLC">
					<paragraph id="HDB7AEA50D5994CCFA22900AE40EC86CA"><enum>(10)</enum><header>Efforts to
				enhance manufacturing activities</header><text display-inline="yes-display-inline">If an agency is required by subsection (aa)
				to have an SBIR advisory board, the advisory board shall include in each report
				under subsection (aa) a part relating to efforts to enhance manufacturing
				activities, which shall include—</text>
						<subparagraph id="HC502617D67004CF1A14586E73542FBF9"><enum>(A)</enum><text>a comprehensive
				description of the actions undertaken each year by the SBIR and STTR programs
				of that agency in support of Executive Order No. 13329;</text>
						</subparagraph><subparagraph id="H61C52B7B3B6C44828100C1DDB5CF21F"><enum>(B)</enum><text>an assessment of
				the effectiveness of such actions toward enhancing the research and development
				of manufacturing technologies and processes; and</text>
						</subparagraph><subparagraph id="H4DAF56A2BFB6457996B4F72FF4491044"><enum>(C)</enum><text>any
				recommendations that the program managers of the SBIR and STTR programs
				consider appropriate for additional actions to be undertaken in order to
				increase the effectiveness toward enhancing manufacturing activities within the
				defense industrial
				base.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section></title><title id="HC3444209818F4C1088BDDD6DB870DCA6"><enum>V</enum><header>Supporting Program
			 Utilization</header>
			<section commented="no" id="H18C9C251C6844370BEC0F8424ED8911"><enum>501.</enum><header>Agency databases
			 to support program evaluation</header><text display-inline="no-display-inline">Section 9(k) of the Small Business Act (15

				general</header><text display-inline="yes-display-inline">A Federal agency
				shall not make a Phase I or Phase II payment to a small business concern under
				this section unless the small business concern has provided all information
				required under this subsection with respect to the award under which the
				payment is made, and with respect to any other award under this section
				previously received by the small business concern or a predecessor in interest
				to the small business concern.</text>
							</subparagraph><subparagraph commented="no" id="H44DF725E08F840698D3F57DCE158AEF1"><enum>(B)</enum><header>Apportionment</header><text>In
				complying with this paragraph, a small business concern may apportion sales or
				additional investment information relating to more than one second phase award
				among those awards, if it notes the apportionment for each award.</text>
							</subparagraph><subparagraph commented="no" id="HC32C4510324A41C890A006599DE8861"><enum>(C)</enum><header>Annual updates
				upon termination</header><text display-inline="yes-display-inline">A small
				business concern receiving an award under this section shall—</text>
								<clause commented="no" id="HA5C66AED24DA43B0B0FE1CEF52D1A115"><enum>(i)</enum><text display-inline="yes-display-inline">in the case of a second phase award, update
				information in the databases required under paragraphs (2) and (6) concerning
				that award at the termination of the award period;</text>
								</clause><clause commented="no" id="H812E2EAA50574E1E00A83D17CDABF627"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of award recipients not
				described in clause (iii), be requested to voluntarily update such information
				annually thereafter for a period of 5 years; and</text>
								</clause><clause commented="no" id="H02F40DD1456F41B98B1FC040E1D5B22F"><enum>(iii)</enum><text display-inline="yes-display-inline">in the case of a small business concern
				applying for a subsequent first phase or second phase award, be required to
				update such information annually thereafter for a period of 5
				years.</text>
								</clause></subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" id="H36359C5702244A6FA6B731978CAD374C"><enum>(3)</enum><text>by adding at the
			 end the following new paragraph:</text>

				shall develop and maintain, for the purpose of evaluating such programs, a
				database containing information required to be contained in the database under
				paragraph (2). Each such database shall be designed to be accessible to other
				agencies that are required to maintain a database under this
				paragraph.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section commented="no" id="H48F25849F698448F9D463F6FFCED83F"><enum>502.</enum><header>Agency databases
			 to support technology utilization</header><text display-inline="no-display-inline">Section 9(k) of the Small Business Act (15
			 U.S.C. 638(k)), as amended by this Act, is further amended by adding at the end
			 the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="HAA57A4B0EFA74D8CB85FCCA2E6E5D7F1" style="OLC">
					<paragraph commented="no" id="H122E8FEC90F042AAB6FB00105C6D7B37"><enum>(7)</enum><header>Agency databases
				to support technology utilization</header><text display-inline="yes-display-inline">Each Federal agency with an SBIR or STTR
				program shall create and maintain a technology utilization database, which
				shall be available to the public and shall contain data supplied by the award
				recipients specifically to help them attract customers for the products and
				services generated under the SBIR or STTR project, and to attract additional
				investors and business partners. Each database created under this paragraph
				shall include information on the other databases created under this paragraph
				by other Federal agencies. Participation in a database under this paragraph
				shall be voluntary, except that such participation is required of all award
				recipients who received supplemental payments from SBIR and STTR program funds
				above their initial Phase II
				award.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section commented="no" id="HB3DE94EB186E4B86B13579BEDC87A4DC"><enum>503.</enum><header>Interagency
			 Policy Committee</header>
				<subsection commented="no" id="HD9F80D37F44246B7006FC1566429D640"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Director of the Office of Science and
			 Technology Policy shall establish an Interagency SBIR/STTR Policy Committee
			 comprised of one representative from each Federal agency with an SBIR
			 program.</text>
				</subsection><subsection commented="no" id="HE17015C7553348F9A399DC00CA00DABD"><enum>(b)</enum><header>Cochairs</header><text display-inline="yes-display-inline">The Director of the Office of Science and
			 Technology Policy and the Director of the National Institute of Standards and
			 Technology shall jointly chair the Interagency Policy Committee.</text>
				</subsection><subsection commented="no" id="H0AD2010ECF8C4ABF9DF8DE443BEC218F"><enum>(c)</enum><header>Duties</header><text display-inline="yes-display-inline">The Interagency Policy Committee shall
			 review the following issues and make policy recommendations on ways to improve
			 program effectiveness and efficiency:</text>
					<paragraph commented="no" id="H0456DA7A78D84EE5A0409414BCE4575C"><enum>(1)</enum><text>The public and
			 government databases described in section 9(k)(1) and (2) of the Small Business
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(k)(1)</external-xref> and (2)).</text>
					</paragraph><paragraph commented="no" id="H2CB4A5355F364B1CB74FC98B4F1701EA"><enum>(2)</enum><text>Federal agency
			 flexibility in establishing Phase I and II award sizes, and appropriate
			 criteria to exercise such flexibility.</text>
					</paragraph><paragraph commented="no" id="HEDB44F22450D459D879B8E8BB99918F5"><enum>(3)</enum><text>Commercialization
			 assistance best practices in Federal agencies with significant potential to be
			 employed by other agencies, and the appropriate steps to achieve that leverage,
			 as well as proposals for new initiatives to address funding gaps business
			 concerns face after Phase II but before commercialization.</text>
					</paragraph></subsection><subsection commented="no" id="H04024B2E0D784B149200F6E5107ED946"><enum>(d)</enum><header>Reports</header><text>The
			 Interagency Policy Committee shall transmit to the Committee on Science and
			 Technology and the Committee on Small Business of the House of Representatives,
			 and to the Committee on Small Business and Entrepreneurship of the
			 Senate—</text>
					<paragraph commented="no" id="H1809E3DBE91F4547ADD800558BF73F3D"><enum>(1)</enum><text>a report on its
			 review and recommendations under subsection (c)(1) not later than 1 year after
			 the date of enactment of this Act;</text>
					</paragraph><paragraph commented="no" id="H9A9AD5523A124CC2A956E79E9EE07CB5"><enum>(2)</enum><text>a report on its
			 review and recommendations under subsection (c)(2) not later than 18 months
			 after the date of enactment of this Act; and</text>
					</paragraph><paragraph commented="no" id="H699523FA326A4697823F7FEDEE47DA02"><enum>(3)</enum><text>a report on its
			 review and recommendations under subsection (c)(3) not later than 2 years after
			 the date of enactment of this Act.</text>
					</paragraph></subsection></section><section id="H438300E9F52245CC932F46ED8363F9B5"><enum>504.</enum><header>Nanotechnology-related
			 research topics</header>
				<subsection id="H436C06A39EC44217968FF4E3093C6521"><enum>(a)</enum><header>SBIR</header><text display-inline="yes-display-inline">Section 9(g)(3) of the Small Business Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(g)(3)</external-xref>), as amended by section 107, is further amended by adding
			 at the end the following new subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="H3F7096DC2F344B1C87F08D146E3C4295" style="OLC">
						<subparagraph id="HFE0D230C66B143F6824B88B76E04DC36"><enum>(F)</enum><text display-inline="yes-display-inline">the national nanotechnology strategic plan

				</subsection><subsection id="H6C2E175A24E24CED963BB7A41C68CF2F"><enum>(b)</enum><header>STTR</header><text>Section
			 9(o)(1) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(o)(1)</external-xref>) is amended by inserting
			 <quote>, giving special consideration to topics that further 1 or more critical
			 technologies, as identified by the national nanotechnology strategic plan
			 required under section 2(c)(4) of the 21st Century Nanotechnology Research and
			 Development Act (<external-xref legal-doc="usc" parsable-cite="usc/15/7501">15 U.S.C. 7501(c)(4)</external-xref>) and in subsequent reports issued by the
			 National Science and Technology Council Committee on Technology, focusing on
			 areas of nanotechnology identified in such plan</quote> after <quote>its STTR
			 program</quote>.</text>
				</subsection></section><section id="HD3FFE89055494547BB8829CEBE974BB9"><enum>505.</enum><header>Rural
			 preference</header><text display-inline="no-display-inline">Section 9 of the
			 Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638</external-xref>) is amended by adding at the end the
			 following new subsection:</text>

			 areas that have lost a major source of employment</header><text display-inline="no-display-inline">Section 9 of the Small Business Act (15
			 U.S.C. 638) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H341B86D221084402B69E1642F8002D5F" style="OLC">
					<subsection id="H8F9BED36B8AA47D5B27E130750922600"><enum>(ee)</enum><header>Priority for
				areas that have lost a major source of employment</header><text display-inline="yes-display-inline">In making awards under this section,
				Federal agencies shall give priority to applications from companies located in
				geographic areas that, as determined by the Administrator, have lost a major
				source of employment. Not later than 90 days after the date of the enactment of
				this subsection, the Administrator shall promulgate rules for making the
				determination required by this
				subsection.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H0AEA437E83E9418FBA34F300ED4E438"><enum>507.</enum><header>Veterans
			 preference</header><text display-inline="no-display-inline">Section 9 of the
			 Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638</external-xref>) is further amended by adding at the end the
			 following:</text>

				to increase the number of SBIR and STTR award recipients who are

					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="HCBE16A565EB6447DAB4E00C303211940"><enum>508.</enum><header>Initiative to
			 publicize the SBIR program to veterans</header><text display-inline="no-display-inline">The Administrator of the Small Business
			 Administration, in consultation with the Secretary of Veterans Affairs, shall
			 develop an initiative to publicize the SBIR program to veterans returning from
			 service and encourage those veterans with applicable technical skills to apply
			 for SBIR grants.</text>
			</section><section id="H7BED82A5D3AE4980BC6C008E7EB4CBB3"><enum>509.</enum><header>Preference for
			 organizations that are making significant contributions towards energy
			 efficiency</header><text display-inline="no-display-inline">Section 9 of the
			 Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638</external-xref>) is further amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="HABBAF298A03644D9B4623C6332EF807C" style="OLC">
					<subsection id="H73091F5997624E4C916EC908DB5D22"><enum>(ff)</enum><header>Preference for
				organizations that are making significant contributions towards energy

				organizations that are making significant contributions towards energy
				efficiency, including organizations that are making efforts to reduce their

			</section></title><title id="HDCDAE91CA5984936A828385995027962"><enum>VI</enum><header>Implementation</header>
			<section commented="no" id="H3EA77649E0974DEEBAD5175203337095"><enum>601.</enum><header>Conforming
			 amendments to the SBIR and STTR policy directives</header><text display-inline="no-display-inline">Not later than 180 days after the date of
			 enactment of this Act, the Administrator of the Small Business Administration
			 shall promulgate amendments to the SBIR and the STTR Policy Directives to
			 conform such directives to this Act and the amendments made by this Act.</text>
			</section><section commented="no" id="H2F7BE2F514C6455491C9C3251D6D6304"><enum>602.</enum><header>National
			 Research Council SBIR Study</header><text display-inline="no-display-inline">Section 108(d) of the Small Business

			</section><section id="H4CADD3D08A00478F8E62ECC9E5352F5"><enum>604.</enum><header>Prohibition of
			 awards to aliens unlawfully present in the United States</header><text display-inline="no-display-inline">Section 9 of the Small Business Act is
			 amended by adding at the end the following:</text>

			 awards to firms in violation of immigration laws</header><text display-inline="no-display-inline">Any applicant found, based on a
			 determination by the Secretary of Homeland Security or the Attorney General to
			 have engaged in a pattern or practice of hiring, recruiting or referring for a
			 fee, for employment in the United States an alien knowing the person is an
			 unauthorized alien shall not be eligible for the receipt of future awards under
