<official-title display="yes">To amend title 44, United States Code, to require preservation of certain electronic records by Federal agencies, to require a certification and reports relating to Presidential records, and for other purposes.</official-title>

<section id="H39DF1B97507F49A5B6A2C1911514AF00" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Electronic Message Preservation Act</short-title></quote>.</text> </section> 
<section id="HBF6CB2CE27094277B529493B86CE58C1"><enum>2.</enum><header>Preservation of electronic messages</header> 
<subsection id="HC04E1CCACB0849F6843CDD5CE7D772D6"><enum>(a)</enum><header>Requirement for Preservation of Electronic Messages</header> 
<paragraph id="H8931AB921ED04FEDA86257F7FE00A538"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/29">Chapter 29</external-xref> of title 44, United States Code, is amended by adding at the end the following new section:</text>

<section id="HC6D4F9B2F85D45D480003E5F6FA512CD"><enum>2911.</enum><header>Electronic messages</header> 
<subsection id="H96F2DCD5C7BE46FD8FAE80585C31C365"><enum>(a)</enum><header>Regulations Required</header><text>Not later than 18 months after the date of the enactment of this section, the Archivist shall promulgate regulations governing agency preservation of electronic messages that are records. Such regulations shall, at a minimum—</text> 
<paragraph id="HA5407280AF024628B400BA4DD8C7EFA8"><enum>(1)</enum><text>require the electronic capture, management, and preservation of such electronic records in accordance with the records disposition requirements of chapter 33 of this title;</text> </paragraph> 
<paragraph id="HC96CA08326FF4493823F33AF12955B07"><enum>(2)</enum><text>require that such electronic records are readily accessible for retrieval through electronic searches;</text> </paragraph> 
<paragraph id="H81E49F2B347D4CF10092590094839BC6"><enum>(3)</enum><text>establish mandatory minimum functional requirements for electronic records management systems to ensure compliance with the requirements in paragraphs (1) and (2);</text> </paragraph> 
<paragraph id="HD73643A5E21646AC99A521247BBCAC5D"><enum>(4)</enum><text>establish a process to certify that Federal agencies’ electronic records management systems meet the functional requirements established under paragraph (3); and</text> </paragraph> 
<paragraph id="HED00C0105F254C41A01FA1BEF594B00"><enum>(5)</enum><text>include timelines for agency compliance with the regulations that ensure compliance as expeditiously as practicable but not later than four years after the date of the enactment of this section.</text> </paragraph></subsection> 
<subsection id="HB7C5C9C37F4541438ECD14F86513032C"><enum>(b)</enum><header>Coverage of Other Electronic Records</header><text>To the extent practicable, the regulations promulgated under subsection (a) shall also include requirements for the capture, management, and preservation of other electronic records.</text> </subsection> 
<subsection id="H2F1E43D27AD543C9B873BC64F9DCED2"><enum>(c)</enum><header>Compliance by Federal Agencies</header><text>Each Federal agency shall comply with the regulations promulgated under subsection (a).</text> </subsection> 
<subsection id="H3541C85004FC48719CE934C85C6321A2"><enum>(d)</enum><header>Review of Regulations Required</header><text>The Archivist shall periodically review and, as necessary, amend the regulations promulgated under this section.</text> </subsection> 
<subsection id="H82A8AC6E62AD441DA2B8D4DAD5EFB24"><enum>(e)</enum><header>Reports on Implementation of Regulations</header> 
<paragraph id="HCF15083310A1441386DFC8D2E4319FC6"><enum>(1)</enum><header>Agency report to archivist</header><text>Not later than four years after the date of the enactment of this section, the head of each Federal agency shall submit to the Archivist a report on the agency’s compliance with the regulations promulgated under this section.</text> </paragraph> 
<paragraph id="HB92E7E41A8174B5CABB150D4E300E425"><enum>(2)</enum><header>Archivist report to congress</header><text>Not later than 90 days after receipt of all reports required by paragraph (1), the Archivist shall submit to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Oversight and Government Reform of the House of Representatives a report on Federal agency compliance with the regulations promulgated under this section.</text> </paragraph></subsection></section> <after-quoted-block>.</after-quoted-block></quoted-block> </paragraph> 
<paragraph id="H1F66B7F9D7414D4C82D4A4DBD1E28657"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/29">chapter 29</external-xref> of title 44, United States Code, is amended by adding after the item relating to section 2910 the following new item:</text>

<paragraph id="HED9DFBDDF041404DAD175EE1C0F64916"><enum>(1)</enum><text>by striking <quote>and</quote> at the end of paragraph (14);</text> </paragraph> 
<paragraph id="H482C7D79C64C49E48B8D44782860C66F"><enum>(2)</enum><text>by striking the period at the end of paragraph (15) and inserting a semicolon; and</text> </paragraph> 
<paragraph id="H4A8C282AF0AE43E4A21B7E502C98E48E"><enum>(3)</enum><text>by adding at the end the following new paragraphs:</text>

<paragraph id="H50D15B186D624B959EA69C12783E8CB7"><enum>(16)</enum><text>the term <term>electronic messages</term> means electronic mail and other electronic messaging systems that are used for purposes of communicating between individuals; and</text> </paragraph> 
<paragraph id="H97074B6E7A6E4F76BC89E0C46D960052"><enum>(17)</enum><text>the term <term>electronic records management system</term> means a software system designed to manage electronic records within an information technology system, including by—</text> 
<subparagraph id="HC18646A34BB240F28819ACC5C4A84227"><enum>(A)</enum><text>categorizing and locating records;</text> </subparagraph> 
<subparagraph id="H5FEECC7C7C64415FADA7006CBBEEBCE4"><enum>(B)</enum><text>ensuring that records are retained as long as necessary;</text> </subparagraph> 
<subparagraph id="HB7DA682E7D904388ABF0E0F1066B9BE8"><enum>(C)</enum><text>identifying records that are due for disposition; and</text> </subparagraph> 
<subparagraph id="H22A9D7894F684040B9566F9772824375"><enum>(D)</enum><text>the storage, retrieval, and disposition of records.</text> </subparagraph></paragraph> <after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection></section> 
<section id="HCCF69A4ADA704E54BCDFDE8CA1A2E0D9"><enum>3.</enum><header>Presidential records</header> 
<subsection id="HA3009A33D4024FAB8FBBFAB6F76F0001"><enum>(a)</enum><header>Additional Regulations Relating to Presidential Records</header> 
<paragraph id="H3714F98091D24DBDB274E67022E95C6C"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/44/2206">Section 2206</external-xref> of title 44, United States Code, is amended—</text> 
<subparagraph id="H9461F5EB2BE44816B52B98BCC71F250"><enum>(A)</enum><text>by striking <quote>and</quote> at the end of paragraph (3);</text> </subparagraph> 
<subparagraph id="HE24CFBCA8F4F4EA691139950D575877B"><enum>(B)</enum><text>by striking the period at the end of paragraph (4) and inserting <quote>; and</quote>; and</text> </subparagraph> 
<subparagraph id="H87A52391CA0B4780802C0200BEFA8C29"><enum>(C)</enum><text>by adding at the end the following:</text>

<paragraph id="HA1AF6788D4ED4F098734715B09AC9CC1"><enum>(5)</enum><text>provisions for establishing standards necessary for the economical and efficient management of Presidential records during the President’s term of office, including—</text> 
<subparagraph id="H3EF66705B0F54BDDAF93BD97FEACB30"><enum>(A)</enum><text>records management controls necessary for the capture, management, and preservation of electronic messages;</text> </subparagraph> 
<subparagraph id="HEACB4C2972B741D6AE9F8D9C53D41D00"><enum>(B)</enum><text>records management controls necessary to ensure that electronic messages are readily accessible for retrieval through electronic searches; and</text> </subparagraph> 
<subparagraph id="HF071063EEEF54481BDF2D28DF5E927BA"><enum>(C)</enum><text>a process to certify the electronic records management system to be used by the President for the purposes of complying with the requirements in subparagraphs (A) and (B).</text> </subparagraph></paragraph> <after-quoted-block>.</after-quoted-block></quoted-block> </subparagraph></paragraph> 
<paragraph id="HC1359E63EB4B471792519CD3366FD38E"><enum>(2)</enum><header>Definition</header><text><external-xref legal-doc="usc" parsable-cite="usc/44/2201">Section 2201</external-xref> of title 44, United States Code, is amended by adding at the end the following new paragraphs:</text>

<subsection id="H6BC169374D7C40218348BC7D05670090"><enum>(b)</enum><header>Certification of President’s Management of Presidential Records</header> 
<paragraph id="H67917562E13043FEA6999EE6D12EFC3F"><enum>(1)</enum><header>Certification required</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/22">Chapter 22</external-xref> of title 44, United States Code, is amended by adding at the end the following new section:</text>

<section id="HE612B776F0484D879DDD56FE1B14A673"><enum>2208.</enum><header>Certification of the President’s management of Presidential records</header> 
<subsection id="H4FE050C687094DE1A86CA81397F2B086"><enum>(a)</enum><header>Annual Certification</header><text>The Archivist shall annually certify whether the records management controls established by the President meet requirements under sections 2203(a) and 2206(5) of this title.</text> </subsection> 
<subsection id="HA5D3A2A9C81B4C4BB9F09C279CF99C04"><enum>(b)</enum><header>Report to Congress</header><text>The Archivist shall report annually to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Oversight and Government Reform of the House of Representatives on the status of the certification.</text> </subsection></section> <after-quoted-block>.</after-quoted-block></quoted-block> </paragraph> 
<paragraph id="H39985B2065FC4C5EBF66067C11EC95AE"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/22">chapter 22</external-xref> of title 44, United States Code, is amended by adding at the end the following new item:</text>

<subsection id="H3F0F2387A01D4FA4B0368B63707094FA"><enum>(c)</enum><header>Report to Congress</header><text><external-xref legal-doc="usc" parsable-cite="usc/44/2203">Section 2203(f)</external-xref> of title 44, United States Code, is amended by adding at the end the following:</text>

<paragraph id="HD1003DAD267A463C98236D38A760969C" indent="up1"><enum>(4)</enum><text>One year following the conclusion of a President’s term of office, or if a President serves consecutive terms one year following the conclusion of the last term, the Archivist shall submit to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Oversight and Government Reform of the House of Representatives a report on—</text> 
<subparagraph id="H46D5AE348C4148368E54087FC41EAA1D"><enum>(A)</enum><text>the volume and format of Presidential records deposited into that President’s Presidential archival depository; and</text> </subparagraph> 
<subparagraph id="HC96185BE88564182A5FFEC360057B243"><enum>(B)</enum><text>whether the records management controls of that President met the requirements under <external-xref legal-doc="usc" parsable-cite="usc/44/2203">sections 2203(a)</external-xref> and <external-xref legal-doc="usc" parsable-cite="usc/44/2206">2206(5)</external-xref> of this title.</text> </subparagraph></paragraph> <after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection id="H7C7CF110B4874B798C694C93E5B4AB65"><enum>(d)</enum><header>Effective Date</header><text>The amendments made by this section shall take effect one year after the date of the enactment of this Act.</text> </subsection></section>
<section id="HF1F4E81066D84FFF9500617E1B7C6513"><enum>4.</enum><header>Procedures to prevent unauthorized removal of classified records from National Archives</header>
<subsection id="HDCCBD914628D47AFA0B430A73BC9D8EB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Archivist of the United States shall prescribe internal procedures to prevent the unauthorized removal of classified records from the National Archives and Records Administration or the destruction or damage of such records, including when such records are accessed or searched electronically. The procedures shall include the following prohibitions:</text>
<paragraph id="H0D62694060A346A48E2D6E3FF3C4F338"><enum>(1)</enum><text>No person, other than personnel of the National Archives and Records Administration (in this section hereafter referred to as <quote>NARA personnel</quote>), shall view classified records in any room that is not secure except in the presence of NARA personnel or under video surveillance.</text></paragraph>
<paragraph id="HE87E665F15D242C0969F70F54EAA4EE8"><enum>(2)</enum><text>No person, other than NARA personnel, shall at any time be left alone with classified records, unless that person is under video surveillance.</text></paragraph>
<paragraph id="H9EB71478A9474A6196B82C668D16BD4D"><enum>(3)</enum><text>No person, other than NARA personnel, shall conduct any review of documents while in the possession of any cell phone or other personal communication device. </text></paragraph>
<paragraph id="HA2C2C038CCCB4F9696736952B373518D"><enum>(4)</enum><text display-inline="yes-display-inline">All persons seeking access to classified records, as a precondition to such access, must consent to a search of their belongings upon conclusion of their records review. </text></paragraph>
<paragraph id="HF753D8EE952641D99B297D00F441243B"><enum>(5)</enum><text>All notes and other writings prepared by persons during the course of a review of classified records shall be retained by the National Archives and Records Administration in a secure facility.</text></paragraph></subsection>
<subsection id="H856B8669CAA84BEC89150001A69460C8"><enum>(b)</enum><header>Definition of Records</header><text>In this section, the term <quote>records</quote> has the meaning provided in <external-xref legal-doc="usc" parsable-cite="usc/44/3301">section 3301</external-xref> of title 44, United States Code. </text></subsection></section>
<section id="H62F55FB2146C4F7FB5A5F9EBE85D6E16"><enum>5.</enum><header>Restrictions on access to presidential records</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/44/2204">Section 2204</external-xref> of title 44, United States Code (relating to restrictions on access to presidential records) is amended by adding at the end the following new subsection: </text>

<subsection id="HFD447FDB3AD045ECBCEC3B0D96C45B8"><enum>(f)</enum><text display-inline="yes-display-inline">The Archivist shall not make available any original presidential records to any individual claiming access to any presidential record as a designated representative under section 2205(3) if that individual has been convicted of a crime relating to the review, retention, removal, or destruction of records of the Archives.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>
