		<section display-inline="no-display-inline" id="HDB73E3BC37B849A094244823006E6143" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Consumer Reasonable Energy Price
			 Protection Act of 2008</short-title></quote>.</text>
		</section><section id="H4D45C433684641A28FC31BA171390183"><enum>2.</enum><header>Windfall profits
			 tax</header>
			<subsection id="H9A34C5251C0A49378F2C49D681B7B0BA"><enum>(a)</enum><header>In
			 general</header><text>Subtitle E of the Internal Revenue Code of 1986 (relating
			 to alcohol, tobacco, and certain other excise taxes) is amended by adding at
			 the end thereof the following new chapter:</text>

					<chapter id="HA0D20D2173D04B3C9187FF564D7D8891"><enum>56</enum><header>Windfall profit
				on crude oil, natural gas, and products thereof</header>

							<toc-entry level="section">Sec. 5896. Imposition of
				  tax.</toc-entry>
						</toc>
						<section id="HF30DCC59247A43CA8FB36363631D3FDC"><enum>5896.</enum><header>Imposition of
				tax</header>
							<subsection id="H489BC449967C4EBF85D4065BECAC8D9B"><enum>(a)</enum><header>In
				general</header><text>In addition to any other tax imposed under this title,
				there is hereby imposed an excise tax on the sale in the United States of any
				crude oil, natural gas, or other taxable product a tax equal to the applicable
				percentage of the windfall profit on such sale.</text>
							</subsection><subsection id="HC2526F35A99E4F97BA6FF3680643FDCA"><enum>(b)</enum><header>Definitions</header><text>For
				purposes of this section—</text>
								<paragraph id="H0D51EC7258874204A0A3297889F6AAE"><enum>(1)</enum><header>Taxable
				product</header><text>The term <term>taxable product</term> means any fuel
				which is a product of crude oil or natural gas.</text>
								</paragraph><paragraph id="HA44D6AE9EF6B482E94BD1E038DC227AE"><enum>(2)</enum><header>Windfall
				profit</header><text>The term <term>windfall profit</term> means, with respect
				to any sale, so much of the profit on such sale as exceeds a reasonable
				profit.</text>
								</paragraph><paragraph id="H098A9F87E1944047A1A83729DC341109"><enum>(3)</enum><header>Applicable
				percentage</header><text>The term <term>applicable percentage</term>
				means—</text>
									<subparagraph id="H1DDDBA1984DF438D803F4BE3A6C87265"><enum>(A)</enum><text>50 percent to the
				extent that the profit on the sale exceeds 100 percent of the reasonable profit
				on the sale but does not exceed 102 percent of the reasonable profit on the
				sale,</text>
									</subparagraph><subparagraph id="HCCC150A537344892BD3CCD7F3046CE9D"><enum>(B)</enum><text>75 percent to the
				extent that the profit on the sale exceeds 102 percent of the reasonable profit
				on the sale but does not exceed 105 percent of the reasonable profit on the
				sale, and</text>
									</subparagraph><subparagraph id="HEBC39BB9D70A4FCA9364A67F278335D2"><enum>(C)</enum><text>100 percent to the
				extent that the profit on the sale exceeds 105 percent of the reasonable profit
				on the sale.</text>
									</subparagraph></paragraph><paragraph id="HC66BB8E9775940A6A7919B1732EE8B80"><enum>(4)</enum><header>Reasonable
				profit</header><text>The term <term>reasonable profit</term> means the amount
				determined by the Reasonable Profits Board to be a reasonable profit on the
				sale.</text>
								</paragraph></subsection><subsection id="H495B9B63B1014B108D55A41B67AC2590"><enum>(c)</enum><header>Liability for
				payment of tax</header><text>The taxes imposed by subsection (a) shall be paid
				by the
				seller.</text>
							</subsection></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HF9EAD65B338940E7923F00AD69A062CA"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of chapters for subtitle E of such Code is
			 amended by adding at the end the following new item:</text>

				and refined petroleum
				products.</toc-entry>
					</toc>
					<after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HAFEF45F5C7204504A37528B18815C4F7"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall take effect on the
			 date of the enactment of this Act.</text>
			</subsection></section><section id="HFC25FCC1A39C4B8C942E13E0647E354B"><enum>3.</enum><header>Reasonable
			 Profits Board</header>
			<subsection id="HE485B869E6FC47FFA83FDCC727593200"><enum>(a)</enum><header>Establishment</header><text>There
			 is established an independent board to be known as the <quote>Reasonable
			 Profits Board</quote> (hereafter in this section referred to as the
			 <quote>Board</quote>).</text>
			</subsection><subsection id="H44236453AC5B45F1A518A7E7F74508F6"><enum>(b)</enum><header>Duties</header><text>The
			 Board shall make reasonable profit determinations for purposes of applying
			 <external-xref legal-doc="usc" parsable-cite="usc/26/5896">section 5896</external-xref> of the Internal Revenue Code of 1986 (relating to windfall profit
			 on crude oil, natural gas, and products thereof).</text>
			</subsection><subsection id="H9ACB26D0D7284640BDC87708DC3737F4"><enum>(c)</enum><header>Advisory
			 Committee</header><text>The Board shall be considered an advisory committee
			 within the meaning of the <act-name parsable-cite="FACA">Federal Advisory
			 Committee Act</act-name> (5 U.S.C. App.).</text>
			</subsection><subsection id="H98BC0EA7E97D4EB58B08688FFBF27F21"><enum>(d)</enum><header>Appointment</header>
				<paragraph id="H92A0D7B32C73485E00FA7262C7733DB9"><enum>(1)</enum><header>Members</header><text>The
			 Board shall be composed of 3 members appointed by the President of the United
			 States.</text>
				</paragraph><paragraph id="HDEAC37BFF38F46E8A50671A283B922ED"><enum>(2)</enum><header>Term</header><text>Members
			 of the Board shall be appointed for a term of 3 years.</text>
				</paragraph><paragraph id="HEA287674ED7247E9987144ACBD03927"><enum>(3)</enum><header>Background</header><text>The
			 members shall have no financial interests in any of the businesses for which
			 reasonable profits are determined by the Board.</text>
				</paragraph></subsection><subsection id="HAEA015D823DF44C49C279BC81FFF8FEE"><enum>(e)</enum><header>Pay and travel
			 expenses</header>
				<paragraph id="HFE6BD4F4AC8343C787F068011D20125F"><enum>(1)</enum><header>Pay</header><text>Notwithstanding
			 section 7 of the <act-name parsable-cite="FACA">Federal Advisory Committee
			 Act</act-name> (5 U.S.C. App.), members of the Board shall be paid at a rate
			 equal to the daily equivalent of the minimum annual rate of basic pay for level
			 IV of the Executive Schedule under <external-xref legal-doc="usc" parsable-cite="usc/5/5315">section 5315</external-xref> of title 5, United States Code,
			 for each day (including travel time) during which the member is engaged in the
			 actual performance of duties vested in the Board.</text>
				</paragraph><paragraph id="HBCB755B46EBF4CF58608C586514451B3"><enum>(2)</enum><header>Travel
			 expenses</header><text>Members shall receive travel expenses, including per
			 diem in lieu of subsistence, in accordance with section 5702 and 5703 of title
			 5, United States Code.</text>
				</paragraph></subsection><subsection id="H253E8CC67F72435895C49869A9E46CD3"><enum>(f)</enum><header>Director of
			 staff</header>
				<paragraph id="H919652946C84421BAF0579E41B002581"><enum>(1)</enum><header>Qualifications</header><text>The
			 Board shall appoint a Director who has no financial interests in any of the
			 businesses for which reasonable profits are determined by the Board.</text>
				</paragraph><paragraph id="H461E7D9635E642BD8FAF8400B7A706C3"><enum>(2)</enum><header>Pay</header><text>Notwithstanding
			 section 7 of the <act-name parsable-cite="FACA">Federal Advisory Committee
			 Act</act-name> (5 U.S.C. App.), the Director shall be paid at the rate of basic
			 pay payable for level IV of the Executive Schedule under section 5315 of title
			 5, United States Code.</text>
				</paragraph></subsection><subsection id="HD1481E5E388B4E21B83FC4C7C17B7516"><enum>(g)</enum><header>Staff</header>
				<paragraph id="H4BB8867D7F9541F8981E876416EA581C"><enum>(1)</enum><header>Additional
			 personnel</header><text>The Director, with the approval of the Board, may
			 appoint and fix the pay of additional personnel.</text>
				</paragraph><paragraph id="H013FC34C97DC472DA906E6DB164C493B"><enum>(2)</enum><header>Appointments</header><text>The
			 Director may make such appointments without regard to the provisions of title
			 5, United States Code, governing appointments in the competitive service, and
			 any personnel so appointed may be paid without regard to the provisions of
			 chapter 51 and subchapter III of chapter 53 of that title relating to
			 classification and General Schedule pay rates.</text>
				</paragraph><paragraph id="H5AF4049B59424AED98FE001989E2F9B0"><enum>(3)</enum><header>Detailees</header><text>Upon
			 the request of the Director, the head of any Federal department or agency may
			 detail any of the personnel of that department or agency to the Board to assist
			 the Board in accordance with an agreement entered into with the Board.</text>
				</paragraph><paragraph id="HAA6CD047708B49B09BC9CBCE4E402716"><enum>(4)</enum><header>Assistance</header><text>The
			 Comptroller General of the United States may provide assistance, including the
			 detailing of employees, to the Board in accordance with an agreement entered
			 into with the Board.</text>
				</paragraph></subsection><subsection id="H91A0C4FED6CF4D0DBB0063DFBD699FB4"><enum>(h)</enum><header>Other
			 authority</header>
				<paragraph id="H420E6E520E27477A951EEEAF6E9F766B"><enum>(1)</enum><header>Experts and
			 consultants</header><text>The Board may procure by contract, to the extent
			 funds are available, the temporary or intermittent services of experts or
			 consultants pursuant to <external-xref legal-doc="usc" parsable-cite="usc/5/3109">section 3109</external-xref> of title 5, United States Code.</text>
				</paragraph><paragraph id="H6FDBA321AB044891A152D0D7C9AFC57"><enum>(2)</enum><header>Leasing</header><text>The
			 Board may lease space and acquire personal property to the extent that funds
			 are available.</text>
				</paragraph></subsection><subsection id="HB6350E7008104DD6B82684A2E49CFAB"><enum>(i)</enum><header>Funding</header><text>There
			 are authorized to be appropriated such funds as are necessary to carry out this
			 section.</text>
			</subsection></section><section id="H12269999E2DF486C84949C4180AA1E08"><enum>4.</enum><header>Low-Income Home
			 Energy Assistance Program</header><text display-inline="no-display-inline">In
			 addition to amounts appropriated pursuant to section 2602 of the Low-Income
			 Home Energy Assistance Act of 1981 (<external-xref legal-doc="usc" parsable-cite="usc/42/8621">42 U.S.C. 8621</external-xref>), there are hereby
			 appropriated to the Secretary of Health and Human Services amounts equivalent
			 to the taxes received in the Treasury under section 5896 of the Internal
			 Revenue Code of 1986. Amounts appropriated under the preceding sentence shall
			 be available for allocation under section 2604(a)(1)(A) of such Act (42 U.S.C.
			 8623(a)(1)(A)).</text>
