		<section id="H0BDE2970242D4A069BA00849ED6A817" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Roth TSP Act of 2008</short-title></quote>.</text>
		</section><section id="HFD76093A61834EECABCD488381BC28B5"><enum>2.</enum><header>Requirement that
			 Thrift Savings Plan include a qualified Roth contribution program</header>
			<subsection id="H25AD789EDBD34D3C8795AC8EF5A58600"><enum>(a)</enum><header>In
			 general</header><text>Subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/84">chapter 84</external-xref> of title 5, United States
			 Code, is amended by inserting after section 8432c the following:</text>
				<quoted-block display-inline="no-display-inline" id="H62CFE821F4BD41778282A97F68E725AD" style="USC">
					<section id="H21A4A320EF554D3F964ECA37749F910"><enum>8432d.</enum><header>Qualified Roth
				contribution program</header>
						<subsection id="H35B3D8F870984901BE3F4C7941F36BDC"><enum>(a)</enum><header>In
				general</header><text>The Executive Director, in consultation with the
				Secretary of the Treasury, shall by regulation provide for the inclusion in the
				Thrift Savings Plan of a qualified Roth contribution program (hereinafter in
				this section referred to as the <quote>Program</quote>).</text>
						</subsection><subsection id="H9761FBD07FB8471A85C8E669C4768B00"><enum>(b)</enum><header>Qualified Roth
				contribution program</header><text>For purposes of this section, the term
				<term>qualified Roth contribution program</term> means a program that satisfies
				the requirements of paragraphs (1) and (2) of section 402A(b) of the Internal
				Revenue Code of 1986.</text>
						</subsection><subsection id="HD7BA5E512A8048148BE16EDFBD5E2941"><enum>(c)</enum><header>Required
				provisions</header><text>The regulations shall include—</text>
							<paragraph id="HEA4E9E6FD51A474E8DC3183BEE6B686D"><enum>(1)</enum><text>provisions under
				which an election to make designated Roth contributions may be made—</text>
								<subparagraph id="HD823DB1E8D1049D3BA6E1F79AD730003"><enum>(A)</enum><text>by any individual
				who is eligible to make contributions under section 8351, 8432(a), 8440a,
				8440b, 8440c, 8440d, or 8440e; and</text>
								</subparagraph><subparagraph id="H84B6A142F1EE4B0E97FACC01E39BF0BF"><enum>(B)</enum><text>by any individual
				not described in subparagraph (A) who is otherwise eligible to make elective
				deferrals under the Thrift Savings Plan, as identified under such regulations;
				and</text>
								</subparagraph></paragraph><paragraph id="H67B65CCC5B0B4F6AAC002650BDBC0997"><enum>(2)</enum><text display-inline="yes-display-inline">such other provisions as may be necessary
				to carry out this section.</text>
							</paragraph></subsection><subsection id="H8843AFA0421A43D49CABE577A4D1D9B6"><enum>(d)</enum><header>Returns and
				reports</header><text display-inline="yes-display-inline">The Executive
				Director shall, with respect to designated Roth contributions under the
				Program, make such returns and reports as the Secretary of the Treasury may
				prescribe under <external-xref legal-doc="usc" parsable-cite="usc/26/6047">section 6047(f)</external-xref> of the Internal Revenue Code of 1986.</text>
						</subsection><subsection id="HE0FFA46893E04332A03156CEF4BA2F58"><enum>(e)</enum><header>Definitions</header><text>For
				purposes of this section, the terms <term>designated Roth contribution</term>
				and <term>elective deferral</term> have the respective meanings given such
				terms in section 402A of the Internal Revenue Code of
				1986.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H28A4556AB13B41D894D8C7003C4800E9"><enum>(b)</enum><header>Technical and
			 conforming amendments</header>
				<paragraph id="H8D10739643E94BDDA055215203EAA1F"><enum>(1)</enum><header>Accounting and
			 information</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/8439">Section 8439(a)</external-xref> of title 5, United States Code, is
			 amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H8B6361CC877842A0A22F6CA7BECD5753" style="USC">
						<paragraph id="HF3742B4C4C294BECAC2C888206BF002E" indent="up1"><enum>(4)</enum><text>Pursuant to regulations prescribed by
				the Executive Director, this section shall be carried out in a manner
				consistent with section 8432d of this title and section 402A of the Internal
				Revenue Code of 1986, including by making any modifications to the definition
				of an <quote>account</quote> under this subsection which may be
				necessary.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H38D4D4AC4F5C474BB3CCDA64C83AC77"><enum>(2)</enum><header>Clerical
			 amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/84">chapter 84</external-xref> of title 5, United States
			 Code, is amended by inserting after the item relating to section 8432c the
			 following:</text>
