increase</header><text display-inline="no-display-inline">Section 9(f)(1) of
the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(f)(1)</external-xref>) is amended—</text>
<paragraph id="H883085250D5F4846B140655F92B4019D"><enum>(1)</enum><text>in subparagraph
(B), by striking <quote>and</quote> at the end;</text>
</paragraph><paragraph id="H0093AC54A6864104969254AC48CEE14"><enum>(2)</enum><text>in

Adjustments</header><text>Section 9(j)(2)(D) of the Small Business Act (15
U.S.C. 638(j)(2)(D)) is amended—</text>
<paragraph id="H94E385178DCD404300ADB0F29577658E"><enum>(1)</enum><text>by striking
<quote>$100,000</quote> and inserting <quote>$300,000</quote>; and</text>
</paragraph><paragraph id="HD0D2DC5B1FBB4F1394ED33FFD47E9BD2"><enum>(2)</enum><text>by striking
<quote>$750,000</quote> and inserting <quote>$2,200,000</quote>.</text>

Certain Awards</header><text>Section 9 of the Small Business Act (15 U.S.C.
638) is amended by adding at the end the following:</text>
<quoted-block display-inline="no-display-inline" id="HE1A9BC843C594AE2B166ED0824E8BE09" style="OLC">
<subsection id="H714E3B1D7F894F3CAAF9FFA96B007B38"><enum>(z)</enum><header>Limitation on
Phase I and II Awards</header><text>No Federal agency shall issue an award
under the SBIR program or the STTR program if the size of the award exceeds the
amounts established under subsections (j)(2)(D) and (p)(2)(B)(ix).</text>
</subsection><subsection id="H0B7A3A1B3FDA49F0B42B12CE89841553"><enum>(aa)</enum><header>Subsequent
Phases</header>
<paragraph id="HAB7C3F9479C542C39F768FCBC132001D"><enum>(1)</enum><header>In
general</header><text>A small business concern which received an award from a
Federal agency under this section shall be eligible to receive an award for a
subsequent phase from another Federal agency, if the head of each relevant
Federal agency makes a written determination that the topics of the relevant
awards are the same.</text>
</paragraph><paragraph id="H577605D8C5CA4F83B28C3355365021D4"><enum>(2)</enum><header>Crossover
between programs</header><text>A small business concern which received an award
under this section under the SBIR program or the STTR program may, at the
discretion of the granting agency, receive an award under this section for a
subsequent phase in either the SBIR program or the STTR program.</text>
</paragraph><paragraph id="H0809FA53FCD74EFA9019CD1DAC98E413"><enum>(3)</enum><header>Phase ii sbir
applications</header><text display-inline="yes-display-inline">An agency may
permit an applicant to apply directly for a Phase II award, as described in
subsection (e)(4)(B), without first completing a Phase I award, as described in
subsection (e)(4)(A), if the applicant can demonstrate that project feasibility
was achieved without SBIR or other Federal funding.</text>
</paragraph><paragraph id="H21A1AA8EA5C5407EA1D835C18696F5B5"><enum>(4)</enum><header>Phase ii sttr
applications</header><text>An agency may permit an applicant to submit
proposals for Phase II awards, as described in subsection (e)(6)(B), without
first completing a Phase I award, as described in subsection (e)(6)(A), if the
applicant can demonstrate it has accomplished Phase I through cooperative
research and development achieved without STTR or other Federal funding.</text>
</paragraph></subsection><subsection id="H1566E04D71024B28ADEB2F8362219B7F"><enum>(bb)</enum><header>Waiver of
minimum work requirement</header><text>A Federal agency making an SBIR or STTR
award under this section may waive the minimum small business concern or
research institution work requirements under subsection (e)(7) if the agency
determines that to provide such waiver would be consistent with the purposes of
this section and consistent with achieving the objectives of the award
proposal.</text>
</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
</subsection></section><section commented="no" id="H7C90CD80993043F1BE8C82009F77FED1"><enum>204.</enum><header>Majority equity
investment in SBIR and STTR firms</header><text display-inline="no-display-inline">Section 9 of the Small Business Act (15
U.S.C. 638), as amended by this Act, is further amended by adding at the end
the following:</text>
<quoted-block display-inline="no-display-inline" id="HE4208BAC32D64F83938125B2EF71135F" style="OLC">
<subsection commented="no" id="HB7DED05BA73844219BFAD4BA78E5035C"><enum>(cc)</enum><header>Majority equity
investment in SBIR and STTR firms</header>
<paragraph commented="no" id="H7B8D41312207443699CCEEF14DA9E938"><enum>(1)</enum><header>Qualification
Requirements</header><text display-inline="yes-display-inline">No small
business concern shall be excluded from participation in the SBIR or STTR
program on the ground that such small business concern is owned in majority
part by more than 1 equity provider, except that no single equity provider
shall be permitted to own more than 49 percent of such small business
concern.</text>
</paragraph><paragraph commented="no" id="H7B29574345224809801792F8FB20F49D"><enum>(2)</enum><header>Definitions</header><text>For
purposes of this subsection—</text>
<subparagraph commented="no" id="HE7DF1B68AC1348879BC211BBBE891DA5"><enum>(A)</enum><text display-inline="yes-display-inline">the term <quote>equity provider</quote>
means a venture capital operating company; and</text>
</subparagraph><subparagraph commented="no" id="H24A3994D5E5B413597204D796EBA3000"><enum>(B)</enum><text display-inline="yes-display-inline">the term <quote>venture capital operating
company</quote> means a business concern that—</text>
<clause commented="no" id="HD8D1E5E653174045BAE1553C42A8886C"><enum>(i)</enum><text>is a venture
capital operating company, as that term is defined in regulations promulgated
by the Secretary of Labor under the Employee Retirement Income Security Act of
1974;</text>
</clause><clause commented="no" id="HB4468E126B0F4BFEA1F33F3218CDEBA4"><enum>(ii)</enum><text>is registered
under the Investment Company Act of 1940 (<external-xref legal-doc="usc" parsable-cite="usc/15/80a-51">15 U.S.C. 80a–51 et seq.</external-xref>); or</text>
</clause><clause commented="no" id="H0242E015F569407E9C924326A67435A1"><enum>(iii)</enum><text>is an investment
company, as defined in section 3(c)(14) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/15/80a-3">15 U.S.C. 80a–3(c)(14)</external-xref>),
which is not registered under such Act because it is beneficially owned by less
than 100
persons.</text>
</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
</section><enum>III</enum><header>Utilization
Support</header>
<section id="H94DE6E1502D642DA93041158F586C490"><enum>301.</enum><header>Agency
databases to support program evaluation</header><text display-inline="no-display-inline">Section 9(k) of the Small Business Act (15
U.S.C. 638(k)) is amended—</text>
<paragraph id="H8ECB6808E91B4C61904E33387BCA8869"><enum>(1)</enum><text>in paragraph
(2)(A)—</text>
<subparagraph id="H032191AD710741F6832FFB01C6EB6661"><enum>(A)</enum><text>by striking
<quote>and</quote> at the end of clause (ii);</text>
</subparagraph><subparagraph id="HFB41433B10F246F991EF6465872B43ED"><enum>(B)</enum><text>by inserting
<quote>and</quote> at the end of clause (iii); and</text>
</subparagraph><subparagraph id="HFF040E94B2A94F66A2051F1B2E01A407"><enum>(C)</enum><text>by adding at the
end the following new clause:</text>
<quoted-block display-inline="no-display-inline" id="H4AA00386BB8A4361B0CD2F79956EB800" style="OLC">
<clause id="H222F782313334391914DA5E27F964BC3"><enum>(iv)</enum><text display-inline="yes-display-inline">information on the ownership structure of
award recipients, both at the time of receipt of the award and upon completion
of the award
period;</text>
</clause><after-quoted-block>;</after-quoted-block></quoted-block>
</subparagraph></paragraph><paragraph id="HDB3CC4CBECE945E0A6A53954F2C73755"><enum>(2)</enum><text>by amending
paragraph (3) to read as follows:</text>
<quoted-block display-inline="no-display-inline" id="H52F6529877AF44478234B6B9AF4354E4" style="OLC">
<paragraph id="HC1738BE7C3E14D96813738C413903DE3"><enum>(3)</enum><header>Updating
information for database</header>
<subparagraph id="HC0AEDD7FF49C40E28E1BC0A3C97BA2CA"><enum>(A)</enum><header>In
general</header><text display-inline="yes-display-inline">A Federal agency
shall not make a Phase I or Phase II payment to a small business concern under
this section unless the small business concern has provided all information
required under this subsection with respect to the award under which the
payment is made, and with respect to any other award under this section
previously received by the small business concern or a predecessor in interest
to the small business concern.</text>
</subparagraph><subparagraph id="HE3C4760A0159411894002E66CD148C43"><enum>(B)</enum><header>Apportionment</header><text>In
complying with this paragraph, a small business concern may apportion sales or
additional investment information relating to more than one second phase award
among those awards, if it notes the apportionment for each award.</text>
</subparagraph><subparagraph id="HABCB601D541046E5859F24B79FE4EE27"><enum>(C)</enum><header>Annual updates
upon termination</header><text display-inline="yes-display-inline">A small
business concern receiving an award under this section shall—</text>
<clause id="H161C64F08E3A40B7BF75789666003B5C"><enum>(i)</enum><text display-inline="yes-display-inline">in the case of a second phase award, update
information in the databases required under paragraphs (2) and (6) concerning
that award at the termination of the award period;</text>
</clause><clause id="H7E21D8EB35F14A21BF202DE707677733"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of award recipients not
described in clause (iii), be requested to voluntarily update such information
annually thereafter for a period of 5 years; and</text>
</clause><clause id="H5D0F0B6569174E2EACCB5C5EC47E2B03"><enum>(iii)</enum><text display-inline="yes-display-inline">in the case of a small business concern
applying for a subsequent first phase or second phase award, be required to
update such information annually thereafter for a period of 5
years.</text>
</clause></subparagraph></paragraph><after-quoted-block>;
and</after-quoted-block></quoted-block>
</paragraph><paragraph id="HEF15B8858D8546EBAE04699D37E959B0"><enum>(3)</enum><text>by adding at the
end the following new paragraph:</text>
<quoted-block display-inline="no-display-inline" id="H6A00DDE71584420C822B85927E49D6D" style="OLC">
<paragraph id="HECD0DB8BA0204C7BAA138369A912F81"><enum>(6)</enum><header>Agency program
evaluation databases</header><text display-inline="yes-display-inline">Each
Federal agency required to establish an SBIR or STTR program under this section
shall develop and maintain, for the purpose of evaluating such programs, a
database containing information required to be contained in the database under
paragraph (2). Each such database shall be designed to be accessible to other
agencies that are required to maintain a database under this
paragraph.</text>
</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
</paragraph></section><section id="H9F96767E625442B3BB88CE377EFE2891"><enum>302.</enum><header>Agency
databases to support technology utilization</header><text display-inline="no-display-inline">Section 9(k) of the Small Business Act (15
U.S.C. 638(k)), as amended by this Act, is further amended by adding at the end
the following new paragraph:</text>
<quoted-block display-inline="no-display-inline" id="HACC284C3090B4A6BAD8B663EB72C240" style="OLC">
<paragraph id="H6EF879967B6C420A95D0F5D0C2008380"><enum>(7)</enum><header>Agency databases
to support technology utilization</header><text display-inline="yes-display-inline">Each Federal agency with an SBIR or STTR
program shall create and maintain a technology utilization database, which
shall be available to the public and shall contain data supplied by the award
recipients specifically to help them attract customers for the products and
services generated under the SBIR or STTR project, and to attract additional
investors and business partners. Each database created under this paragraph
shall include information on the other databases created under this paragraph
by other Federal agencies. Participation in a database under this paragraph
shall be voluntary, except that such participation is required of all award
recipients who received supplemental payments from SBIR and STTR program funds
above their initial Phase II
award.</text>
</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
</section><section commented="no" id="H03D16351949F43A7A93C28AB77F36DC4"><enum>303.</enum><header>Interagency
Policy Committee</header>
<subsection commented="no" id="H93816E7F13C94485984557EFD221E500"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Director of the Office of Science and
Technology Policy shall establish an Interagency SBIR/STTR Policy Committee
comprised of one representative from each Federal agency with an SBIR
program.</text>
</subsection><subsection id="HB744AB6F9F674AFDAFCC6623A5B62E46"><enum>(b)</enum><header>Cochairs</header><text display-inline="yes-display-inline">The Director of the Office of Science and
Technology Policy and the Director of the National Institute of Standards and
Technology shall jointly chair the Interagency Policy Committee.</text>
</subsection><subsection id="H65BCBF2CFE8B42F7953E43C96B2F241B"><enum>(c)</enum><header>Duties</header><text display-inline="yes-display-inline">The Interagency Policy Committee shall
review the following issues and make policy recommendations on ways to improve
program effectiveness and efficiency:</text>
<paragraph id="H2EBD8011FEE54581B5F2E130A66206A7"><enum>(1)</enum><text>The public and
government databases described in section 9(k)(1) and (2) of the Small Business
Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(k)(1)</external-xref> and (2)).</text>
</paragraph><paragraph id="H302E90D7D3EB4A608C27257817A12FBE"><enum>(2)</enum><text>Federal agency
flexibility in establishing Phase I and II award sizes, and appropriate
criteria to exercise such flexibility.</text>
</paragraph><paragraph id="HE552FF7B63A347339B94F99B49F1EF45"><enum>(3)</enum><text>Commercialization
assistance best practices in Federal agencies with significant potential to be
employed by other agencies, and the appropriate steps to achieve that leverage,
as well as proposals for new initiatives to address funding gaps business
concerns face after Phase II but before commercialization.</text>
</paragraph></subsection><subsection id="H20A25BDB38424710AF9F39264300F4FE"><enum>(d)</enum><header>Reports</header><text>The
Interagency Policy Committee shall transmit to the Committee on Science and
Technology and the Committee on Small Business of the House of Representatives,
and to the Committee on Small Business and Entrepreneurship of the
Senate—</text>
<paragraph id="H7EE9D61D73FF45AAABAF4EEFB206E512"><enum>(1)</enum><text>a
report its review and recommendations under subsection (c)(1) not later than 1
year after the date of enactment of this Act;</text>
</paragraph><paragraph id="H09323C4A34DA48F0AF5665F0DAF1A9D2"><enum>(2)</enum><text>a
report its review and recommendations under subsection (c)(2) not later than 18
months after the date of enactment of this Act; and</text>
</paragraph><paragraph id="H8520D3BD66104446945EC60046B804BE"><enum>(3)</enum><text>a
report its review and recommendations under subsection (c)(3) not later than 2
years after the date of enactment of this Act.</text>
</paragraph></subsection></section><enum>IV</enum><header>Outreach and
Technical Assistance</header>
<section id="H4EF2067552AC4792AD83FEFBE3702D80"><enum>401.</enum><header>Use of program
funds for administrative costs</header><text display-inline="no-display-inline">Section 9 of the Small Business Act (15
U.S.C. 638) is amended—</text>
<paragraph id="HDD45D5CB08F146B19DA1E75019636D9D"><enum>(1)</enum><text>in subsection
(f)(2)(A), by striking <quote>any</quote> and inserting <quote>more than 3.0
percent</quote>; and</text>
</paragraph><paragraph id="H04C3C622735C44D0AC7FE145F147B23"><enum>(2)</enum><text>in
subsection (n)(2)(A), by striking <quote>any</quote> and inserting <quote>more
than 3.0 percent</quote>.</text>
</paragraph></section><section id="H9DC776116544437FBD1D126C19CA2706"><enum>402.</enum><header>SBIR
discretionary technical assistance</header><text display-inline="no-display-inline">Section 9(q) of the Small Business Act (15
U.S.C. 638(q)) is amended—</text>
<paragraph id="H59DA3CEF475644BE00F91E52B6687D00"><enum>(1)</enum><text>in paragraph
(1)—</text>
<subparagraph id="H58168B23D2A644AB9868F8FAB305ABB5"><enum>(A)</enum><text>by striking
<quote>paragraph (2)</quote> and inserting <quote>paragraph (2)(A), or another
Federal agency under paragraph (2)(B),</quote>;</text>
</subparagraph><subparagraph id="H840AC3923F5440968C7C5D509E3EA51C"><enum>(B)</enum><text>by striking
<quote>and</quote> at the end of subparagraph (C);</text>

providers</header>
<subparagraph id="H4E571BBB6A8346A6BD02AE9F91CD7B6"><enum>(A)</enum><header>Vendor
selection</header><text display-inline="yes-display-inline">Each agency may
select a vendor to assist small business concerns to meet the goals listed in
paragraph (1) for a term not to exceed 3 years. Such selection shall be
competitive and shall utilize merit-based criteria.</text>
</subparagraph><subparagraph id="H1C8481D7BE7C4837B66CEA323EDA05CD"><enum>(B)</enum><header>Interagency
collaboration</header><text>In addition, each agency may enter into a
collaborative agreement with the technical extension or assistance programs of
other Federal agencies in order to provide the assistance described in
paragraph (1).</text>

</subparagraph></paragraph></section><enum>V</enum><header>Implementation</header>
<section id="HF5253AFB32B44D8685008ECFE1EC66D8"><enum>501.</enum><header>Conforming
amendments to the SBIR and STTR policy directives</header><text display-inline="no-display-inline">Not later than 180 days after the date of
enactment of this Act, the Administrator of the Small Business Administration
shall promulgate amendments to the SBIR and the STTR Policy Directives to
conform such directives to this Act and the amendments made by this Act.</text>
</section><section id="HA09BEF096F6743E196B7F2B020527900"><enum>502.</enum><header>National
Research Council SBIR Study</header><text display-inline="no-display-inline">Section 108(d) of the Small Business
Reauthorization Act of 2000 is amended—</text>
<paragraph id="H3D1E391D0D1C424FA0A6ADBF929283F5"><enum>(1)</enum><text>by striking
<quote>of the Senate</quote> and all that follows through <quote>not later than
3</quote> and inserting <quote>of the Senate, not later than 3</quote>;
and</text>
</paragraph><paragraph id="HD8A172725D594BADAE9C019218E2CFF0"><enum>(2)</enum><text>by striking
<quote>; and</quote> and all that follows through <quote>update of such
report</quote>.</text>
</paragraph></section>
