<section id="H1460765960E043F4A05BE98025EE571E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Halting Airplane Noise to Give Us Peace Act of 2008</short-title></quote>.</text> </section>
<section id="H207AAF30ECC34FF584A602EE20A00A2"><enum>2.</enum><header>Prohibitions against voice communications using mobile communications devices on scheduled flights</header> 
<subsection id="HD2D68306B1804B949307DDCCD5B7003B"><enum>(a)</enum><header>In general</header><text>Subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/417">chapter 417</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H4A8BCEBBE9F54C86A3B1896B8F677DFE" style="USC"> 
<section id="H31AA8E8C1E64419F9711FA206BFEF771"><enum>41724.</enum><header>Prohibitions against voice communications using mobile communications devices on scheduled flights</header> 
<subsection id="H5D5B1FC46CBC4EFBBAEAA7826880D62"><enum>(a)</enum><header>Interstate and intrastate air transportation</header> 
<paragraph id="HDCD6A59FB6BB48A381E4699EE24E8CC4"><enum>(1)</enum><header>In general</header><text>An individual may not engage in voice communications using a mobile communications device in an aircraft during a flight in scheduled passenger interstate air transportation or scheduled passenger intrastate air transportation.</text> </paragraph>
<paragraph id="H5550D7B426274C149CB5DA824253E96"><enum>(2)</enum><header>Flight crew and flight attendants</header><text>The prohibition described in paragraph (1) shall not apply to a member of the flight crew or flight attendants on an aircraft.</text> </paragraph></subsection>
<subsection id="H03F018F011DF48E0B684B8F3264E8B48"><enum>(b)</enum><header>Foreign air transportation</header> 
<paragraph display-inline="no-display-inline" id="H3523E92EC6F348CDA500383BAD37AF00"><enum>(1)</enum><header>In general</header><text>The Secretary of Transportation shall require all air carriers and foreign air carriers to adopt the prohibition described in subsection (a) with respect to the operation of an aircraft in scheduled passenger foreign air transportation.</text> </paragraph>
<paragraph id="HF98B5F3506C34DCA911500203F7533A8"><enum>(2)</enum><header>Alternate prohibition</header><text>If a foreign government objects to the application of paragraph (1) on the basis that paragraph (1) provides for an extraterritorial application of the laws of the United States, the Secretary shall waive the application of paragraph (1) to a foreign air carrier licensed by that foreign government at such time as an alternative prohibition on voice communications using a mobile communications device during flight is negotiated by the Secretary with such foreign government through bilateral negotiations.</text> </paragraph></subsection>
<subsection id="H6BA76FC17A724A1EB22FC39E74729726"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section, the following definitions apply:</text> 
<paragraph id="HE67F15AD2C7B4555A6003BDEE35738FF"><enum>(1)</enum><header>Flight</header><text>The term <quote>flight</quote> means the period beginning when an aircraft takes off and ending when an aircraft lands.</text> </paragraph>
<paragraph id="H2C554D2401004CF791706D0768B7BB50"><enum>(2)</enum><header>Voice communications using a mobile communications device</header> 
<subparagraph id="H6B077BB070544E4B85A175214C37CE40"><enum>(A)</enum><header>Inclusions</header><text>The term <quote>voice communications using a mobile communications device</quote> includes voice communications using—</text> 
<clause id="HCD89C10249D64C6884D367487CCFD49B"><enum>(i)</enum><text>a commercial mobile radio service or other wireless communications device;</text> </clause>
<clause id="H3D21600C53234BAC8273E4D6FEC130A6"><enum>(ii)</enum><text>a broadband wireless device or other wireless device that transmits data packets using the Internet Protocol or comparable technical standard; or</text> </clause>
<clause id="HCA823405FDC946C9A89646955E4EA53C"><enum>(iii)</enum><text>a device having voice override capability.</text> </clause></subparagraph>
<subparagraph id="HF3B234A966974AEFBF6136D998001480"><enum>(B)</enum><header>Exclusion</header><text>Such term does not include voice communications using a phone installed on an aircraft.</text> </subparagraph></paragraph></subsection>
<subsection id="H6C90709810874DC09BEA128F97AB20BA"><enum>(d)</enum><header>Safety regulations</header><text display-inline="yes-display-inline">This section shall not be construed to affect the authority of the Secretary to impose limitations on voice communications using a mobile communications device for safety reasons.</text> </subsection>
<subsection id="HEA4B2343C9D844E2B9DB7BB299D9C44"><enum>(e)</enum><header>Regulations</header><text>The Secretary shall prescribe such regulations as are necessary to carry out this section.</text> </subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection>

<subsection id="H57BF247A6492466192A093D079BAB8B"><enum>(a)</enum><header>In general</header><text>Subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/417">chapter 417</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text>

<section id="HC3C83C9844E64984B9254D52C681EFDF"><enum>41724.</enum><header>Prohibitions against voice communications using mobile communications devices on scheduled flights</header>
<subsection id="H44667C9F9896419E9600A3C566AFB7A7"><enum>(a)</enum><header>Interstate and intrastate air transportation</header>
<paragraph id="HF274F411BD984D36B921825840E5FA45"><enum>(1)</enum><header>In general</header><text>An individual may not engage in voice communications using a mobile communications device in an aircraft during a flight in scheduled passenger interstate air transportation or scheduled passenger intrastate air transportation.</text></paragraph>
<paragraph id="H9CDF7BB16BAE406C98E46E98B800FF00"><enum>(2)</enum><header>Exceptions</header><text>The prohibition described in paragraph (1) shall not apply to—</text>
<subparagraph id="H7EECE803FB824F20BA78E6E902F02BE0"><enum>(A)</enum><text>a member of the flight crew or flight attendants on an aircraft; or</text></subparagraph>
<subparagraph id="H39211B3A737B46219342EF58D56656C4"><enum>(B)</enum><text>a Federal law enforcement officer acting in an official capacity.</text></subparagraph></paragraph></subsection>
<subsection id="H076513A85A7C4811B316FC1486DC19ED"><enum>(b)</enum><header>Foreign air transportation</header>
<paragraph display-inline="no-display-inline" id="H742CB05B55784BC18033B67B467194EE"><enum>(1)</enum><header>In general</header><text>The Secretary of Transportation shall require all air carriers and foreign air carriers to adopt the prohibition described in subsection (a) with respect to the operation of an aircraft in scheduled passenger foreign air transportation.</text></paragraph>

<subparagraph id="H00CE780D38174DEC9774498CE237DE9D"><enum>(A)</enum><header>Inclusions</header><text>The term <quote>voice communications using a mobile communications device</quote> includes voice communications using—</text>
<clause id="HFCB0BD6B08F045DFAFAEC266037BD27"><enum>(i)</enum><text>a commercial mobile radio service or other wireless communications device;</text></clause>
<clause id="HF334CDB51F04458FB78F67628164FB83"><enum>(ii)</enum><text>a broadband wireless device or other wireless device that transmits data packets using the Internet Protocol or comparable technical standard; or</text></clause>
<clause id="H31F7DB52C1504720BBAE90E74DB5EEF6"><enum>(iii)</enum><text>a device having voice override capability.</text></clause></subparagraph>
<subparagraph id="HAE3BB1D671944A5F902D7717ED6B1F1F"><enum>(B)</enum><header>Exclusion</header><text>Such term does not include voice communications using a phone installed on an aircraft.</text></subparagraph></paragraph></subsection>
