<official-title display="yes">To provide that 8 of the 12 weeks of parental leave made available to a Federal employee shall be paid leave, and for other purposes.</official-title>

<section id="H378031EEB869413BA13BCAECB971CE3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Employees Paid Parental Leave Act of 2008</short-title></quote>.</text> </section> 
<section id="H20A5C44CB8CA49C500E49DA2FF5F51C"><enum>2.</enum><header>Paid parental leave under title 5</header> 
<subsection id="H3F23CA6B737842F28958E0731BFFF2F6"><enum>(a)</enum><header>Amendment to title 5</header><text display-inline="yes-display-inline">Subsection (d) of <external-xref legal-doc="usc" parsable-cite="usc/5/6382">section 6382</external-xref> of title 5, United States Code, is amended—</text> 
<paragraph id="H73BE2409DA0F42E386ADFD448167CDB8"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating such subsection as subsection (d)(1);</text> </paragraph> 
<paragraph id="H98B0F18F67BF49C381DBA3DB7FA00C0"><enum>(2)</enum><text>by striking <quote>subparagraph (A), (B), (C), or</quote> and inserting <quote>subparagraph (C) or</quote>; and</text> </paragraph> 
<paragraph id="HB649912607F344E19C5994DF39736C37"><enum>(3)</enum><text>by adding at the end the following:</text> 
<quoted-block id="H69C02CA5F6E34E6DBB00E007B62EB3E" style="OLC"> 
<paragraph id="H934AABCC364D406C93765C420022BE2B" indent="up1"><enum>(2)</enum><text>An employee may elect to substitute for any leave without pay under subparagraph (A) or (B) of subsection (a)(1) any paid leave which is available to such employee for that purpose.</text> </paragraph> 
<paragraph id="HC625D12874F44A53AADBCF43C0006F10" indent="up1"><enum>(3)</enum><text>The paid leave that is available to an employee for purposes of paragraph (2) is—</text> 
<subparagraph id="HE102FFAC49EF4061892727402EC08417"><enum>(A)</enum><text>subject to paragraph (6), 4 administrative workweeks of paid parental leave under this subparagraph in connection with the birth or placement involved; and</text> </subparagraph> 
<subparagraph id="H9325C35AE3994C17A7A08DD8BCC62F72"><enum>(B)</enum><text>any annual or sick leave accrued or accumulated by such employee under subchapter I.</text> </subparagraph></paragraph> 
<paragraph id="H019ED519C3174E78A7C73B32EF18C4EC" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">Nothing in this subsection shall be considered to require that an employee first use all or any portion of the leave described in subparagraph (B) of paragraph (3) before being allowed to use the paid parental leave described in subparagraph (A) of paragraph (3).</text> </paragraph> 
<paragraph id="HCFD8A47B792A4635A9C275FC22D06DF7" indent="up1"><enum>(5)</enum><text>Paid parental leave under paragraph (3)(A)—</text> 
<subparagraph id="HE4CA5DB15F7B48CC9400137B83FC2F65"><enum>(A)</enum><text>shall be payable from any appropriation or fund available for salaries or expenses for positions within the employing agency;</text> </subparagraph> 
<subparagraph id="H2EC0C23DA9494A03BF07CB6D0019DA95"><enum>(B)</enum><text>shall not be considered to be annual or vacation leave for purposes of section 5551 or 5552 or for any other purpose; and</text> </subparagraph> 
<subparagraph id="H4F3586B8C5A142B3A8D679129B651414"><enum>(C)</enum><text>if not used by the employee before the end of the 12-month period (as referred to in subsection (a)(1)) to which it relates, shall not accumulate for any subsequent use.</text> </subparagraph></paragraph> 
<paragraph id="H67C6F48FD357486CBBD09500F5F8A732" indent="up1"><enum>(6)</enum><text>The Director of the Office of Personnel Management—</text> 
<subparagraph id="HBD8439F0E2B34914A280104348286824"><enum>(A)</enum><text display-inline="yes-display-inline">may promulgate regulations to increase the amount of paid parental leave available to an employee under paragraph (3)(A), to a total of not more than 8 administrative workweeks, based on the consideration of—</text> 
<clause id="H55B49580371240D18D93D1001F30347B"><enum>(i)</enum><text display-inline="yes-display-inline">the benefits provided to the Federal Government of offering increased paid parental leave, including enhanced recruitment and retention of employees;</text> </clause> 
<clause id="H27CF91943651406E90A1EB821BDA37A6"><enum>(ii)</enum><text>the cost to the Federal Government of increasing the amount of paid parental leave that is available to employees;</text> </clause> 
<clause id="H86EF48FCBE7C4E0AAE73C067D1123D00"><enum>(iii)</enum><text>trends in the private sector and in State and local governments with respect to offering paid parental leave;</text> </clause> 
<clause id="HCB8AE35E17D0465BBC8F90AAE3008030"><enum>(iv)</enum><text>the Federal Government’s role as a model employer; and</text> </clause> 
<clause id="HF59CA9DAB2D947BFBE2984B821E569EB"><enum>(v)</enum><text>such other factors as the Director considers necessary; and</text> </clause></subparagraph> 
<subparagraph id="H620245E9D3174C978C02F4F174B38CF6"><enum>(B)</enum><text>shall prescribe any regulations necessary to carry out this subsection, including, subject to paragraph (4), the manner in which an employee may designate any day or other period as to which such employee wishes to use paid parental leave described in paragraph (3)(A).</text> </subparagraph></paragraph> <after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection> 
<subsection id="HC2115D29F4E745B2954DBD7862F20080"><enum>(b)</enum><header>Effective date</header><text>The amendment made by this section shall not be effective with respect to any birth or placement occurring before the end of the 6-month period beginning on the date of the enactment of this Act.</text> </subsection></section> 
<section id="HC635FA253F454636B0878326DC007113"><enum>3.</enum><header>Paid parental leave for Congressional employees</header> 
<subsection id="H6543FE4806F4459F99B0D1C151F917AF"><enum>(a)</enum><header>Amendment to Congressional Accountability Act</header><text>Section 202 of the Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1312">2 U.S.C. 1312</external-xref>) is amended—</text> 
<paragraph id="H26B017E5CD354EB191003F9ED04744B1"><enum>(1)</enum><text>in subsection (a)(1), by adding at the end the following: <quote>In applying section 102(a)(1)(A) and (B) of such Act to covered employees, subsection (d) shall apply.</quote>;</text> </paragraph> 
<paragraph id="H32DA465A5DA74ED5B91446B7E303265D"><enum>(2)</enum><text>by redesignating subsections (d) and (e) as subsections (e) and (f), respectively; and</text> </paragraph> 
<paragraph id="HB9C3F9737C14479CAD7E087C9968E6D3"><enum>(3)</enum><text>by inserting after subsection (c) the following:</text>

<subsection id="HA866D2C209A94A899334EE5BB39C2D00"><enum>(d)</enum><header>Special rule for paid parental leave for Congressional employees</header> 
<paragraph display-inline="no-display-inline" id="H4AD529768BA147BE9FE5BF0148FA81CF"><enum>(1)</enum><header>Substitution of paid leave</header><text>A covered employee taking leave without pay under subparagraph (A) or (B) of section 102(a)(1) of the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(a)(1)</external-xref>) may elect to substitute for any such leave any paid leave which is available to such employee for that purpose.</text> </paragraph> 
<paragraph id="H614D7DF486BB42F0AE7B4DF40749A212"><enum>(2)</enum><header>Amount of paid leave</header><text>The paid leave that is available to a covered employee for purposes of paragraph (1) is—</text> 
<subparagraph id="HD2272AEB79C4474E87D6D06D61BA079D"><enum>(A)</enum><text>the number of weeks of paid parental leave in connection with the birth or placement involved that correspond to the number of administrative workweeks of paid parental leave available to Federal employees under <external-xref legal-doc="usc" parsable-cite="usc/5/6382">section 6382(d)(3)(A)</external-xref> of title 5, United States Code; and</text> </subparagraph> 
<subparagraph id="H69E9DA687EB944CEA294FCF68406AD4"><enum>(B)</enum><text>any additional paid vacation or sick leave provided by the employing office to such employee.</text> </subparagraph></paragraph> 
<paragraph id="H8129F9661F784D009D0065BCA10987B7"><enum>(3)</enum><header>Limitation</header><text display-inline="yes-display-inline">Nothing in this subsection shall be considered to require that an employee first use all or any portion of the leave described in subparagraph (B) of paragraph (2) before being allowed to use the paid parental leave described in subparagraph (A) of paragraph (2).</text> </paragraph> 
<paragraph id="HE669A504D17F487781C2711BCED3B1E"><enum>(4)</enum><header>Additional rules</header><text>Paid parental leave under paragraph (2)(A)—</text> 
<subparagraph id="H944314A185D7490A991C33D5CDDB4D"><enum>(A)</enum><text>shall be payable from any appropriation or fund available for salaries or expenses for positions within the employing office; and</text> </subparagraph> 
<subparagraph id="H9705DE819636482F9EE1841CA5C50930"><enum>(B)</enum><text display-inline="yes-display-inline">if not used by the covered employee before the end of the 12-month period (as referred to in section 102(a)(1) of the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(a)(1)</external-xref>)) to which it relates, shall not accumulate for any subsequent use.</text> </subparagraph></paragraph></subsection> <after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection> 
<subsection id="HC3F1B048D88C4F03A2AA66C4FD11B1EE"><enum>(b)</enum><header>Effective date</header><text>The amendment made by this section shall not be effective with respect to any birth or placement occurring before the end of the 6-month period beginning on the date of the enactment of this Act.</text> </subsection></section> 
<section id="HD08116FE23434FEFAA1565D0FD1DD9F7"><enum>4.</enum><header>Conforming amendment to Family and Medical Leave Act for GAO and Library of Congress employees</header>
<subsection id="H0051E374F1F74063B956A05B92EC95A4"><enum>(a)</enum><header>Amendment to Family and Medical Leave Act of 1993</header><text display-inline="yes-display-inline">Section 102(d) of the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(d)</external-xref>) is amended by adding at the end the following:</text>

<paragraph id="HED21650EA1914ED7A109792732495C8D"><enum>(3)</enum><header>Special rule for GAO and Library of Congress employees</header> 
<subparagraph id="H28B628E013594AD1BF6D174CBF51ED46"><enum>(A)</enum><header>Substitution of paid leave</header><text>An employee of an employer described in section 101(4)(A)(iv) taking leave under subparagraph (A) or (B) of subsection (a)(1) may elect to substitute for any such leave any paid leave which is available to such employee for that purpose.</text> </subparagraph> 
<subparagraph id="H327A15C59410465183E19568E871CF00"><enum>(B)</enum><header>Amount of paid leave</header><text display-inline="yes-display-inline">The paid leave that is available to an employee of an employer described in section 101(4)(A)(iv) for purposes of subparagraph (A) is—</text> 
<clause id="HAA8B336C7AEA4C5C881083CBD8DF9E2B"><enum>(i)</enum><text display-inline="yes-display-inline">the number of weeks of paid parental leave in connection with the birth or placement involved that correspond to the number of administrative workweeks of paid parental leave available to Federal employees under <external-xref legal-doc="usc" parsable-cite="usc/5/6382">section 6382(d)(3)(A)</external-xref> of title 5, United States Code; and</text> </clause> 
<clause id="HD971A61A304B443ABFCD259E4784B159"><enum>(ii)</enum><text>any additional paid vacation or sick leave provided by such employer.</text> </clause></subparagraph> 
<subparagraph id="H5061AA5FC23D48FA9CF9EE5531479900"><enum>(C)</enum><header>Limitation</header><text display-inline="yes-display-inline">Nothing in this paragraph shall be considered to require that an employee first use all or any portion of the leave described in clause (ii) of subparagraph (B) before being allowed to use the paid parental leave described in clause (i) of such subparagraph.</text> </subparagraph> 
<subparagraph id="H8C9F6BCE530349CB9CF18C9C560076E5"><enum>(D)</enum><header>Additional rules</header><text>Paid parental leave under subparagraph (B)(i)—</text> 
<clause id="H887822E5C2AD4DC88C819F6186C91CAD"><enum>(i)</enum><text display-inline="yes-display-inline">shall be payable from any appropriation or fund available for salaries or expenses for positions with the employer described in section 101(4)(A)(iv); and</text> </clause> 
<clause id="HA51DF644DA564F75A8E53C00D6143255"><enum>(ii)</enum><text>if not used by the employee of such employer before the end of the 12-month period (as referred to in subsection (a)(1)) to which it relates, shall not accumulate for any subsequent use.</text> </clause></subparagraph></paragraph> <after-quoted-block>.</after-quoted-block></quoted-block> </subsection>
<subsection id="H3201112122804CCF900051A545EFFB3D"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by this section shall not be effective with respect to any birth or placement occurring before the end of the 6-month period beginning on the date of the enactment of this Act.</text></subsection></section>
