		<section display-inline="no-display-inline" id="HF416A4F1913A4DF6B327D24778BB3E24" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as <quote><short-title>Medicare Clinical Pharmacist Practitioner Services
			 Coverage Act of 2008</short-title></quote> .</text>
		</section><section id="H2EB97D53A3AF4B98BF85FDB070843685"><enum>2.</enum><header>Medicare coverage
			 of clinical pharmacist practitioner services</header>
			<subsection id="HC9F062C4F2FE4B19B657B0BA7BC2D7CE"><enum>(a)</enum><header>Coverage</header><text>Section
			 1861(s)(2) of the <act-name parsable-cite="SSA">Social Security Act</act-name>
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(s)(2)</external-xref>) is amended—</text>
				<paragraph id="HFB35D8D1F3714298AF41ACA42CE58EE"><enum>(1)</enum><text>by
			 striking <quote>and</quote> at the end of subparagraph (Z);</text>
				</paragraph><paragraph id="HBD5ECDD262164C46916B73BA3D41E3E0"><enum>(2)</enum><text>by adding
			 <quote>and</quote> at the end of subparagraph (AA); and</text>
				</paragraph><paragraph id="H6990FBC0FBDE44D2ACB669DB8DA28277"><enum>(3)</enum><text>by inserting after
			 subparagraph (AA) the following new subparagraph:</text>
					<quoted-block id="HF76060C4D18F43358821F66D75D20888" style="OLC">
						<subparagraph id="H46E9E1482CA4428D8B42A2669D1E4B48"><enum>(BB)</enum><text>clinical
				pharmacist practitioner services (as defined in subsection (ddd)(1));
				and</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H49E6E65ECE284B3D8B64BFDE103C7EB2"><enum>(b)</enum><header>Services
			 Described</header><text>Section 1861 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x</external-xref>) is amended
			 by adding at the end the following new subsection:</text>
				<quoted-block id="HC0C8502D06814F908CF487F037FE34FE" style="traditional">
					<subsection id="H9E81CFEBC5804ADD9513B3012194C56B"><enum>(ddd)</enum><header>Clinical
				Pharmacist Practitioner Services; Clinical Pharmacist
				Practitioner</header><paragraph commented="no" display-inline="yes-display-inline" id="H06ED38114BA84E3A9E008EB826BB3F36"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>clinical pharmacist
				practitioner services</term> means such direct patient care services provided
				by a pharmacist clinician or clinical pharmacist practitioner, and such
				services furnished as incident to the services of the clinician or
				practitioner, respectively, which the clinician or practitioner, respectively,
				is legally authorized to perform under State law (or the State regulatory
				mechanism as provided by State law) in a collaborative practice agreement as
				would otherwise be covered under this part if furnished by a physician, or as
				incident to a physician’s professional service.</text>
						</paragraph><paragraph id="H2F5DAC19EBB94BFD952000787B0279D8" indent="up1"><enum>(2)</enum><text>The terms <term>pharmacist
				clinician</term> and <term>clinical pharmacist practitioner</term> mean a
				pharmacist who—</text>
							<subparagraph id="H9CDF60BA591E45C0B537E45C007F006C"><enum>(A)</enum><text>is certified by a State as a
				pharmacist clinician or clinical pharmacist practitioner as a result of
				completing training in physical assessment and clinical hours of experience, as
				required by State law and the rules of State Boards of Pharmacy, in addition to
				any requirements of such State to be a licensed pharmacist;</text>
							</subparagraph><subparagraph id="H6ED565F4D5C04C69B887B3E99D11D41C"><enum>(B)</enum><text display-inline="yes-display-inline">has prescriptive authority, as established
				by State statute; and</text>
							</subparagraph><subparagraph id="H6A4ED1CEAAEB4B72B5C40094C52694A6"><enum>(C)</enum><text display-inline="yes-display-inline">is
				involved in the application of the scientific principles of pharmacology,
				toxicology, therapeutics, clinical pharmacokinetics, pharmacoeconomics, and
				other life sciences for the direct care of
				patients</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H10F23D897AA5486BA75F14440093F43C"><enum>(c)</enum><header>Payment</header>
				<paragraph id="H8C8BCC16ACBC477496E6AFB9F86F9164"><enum>(1)</enum><header>In
			 general</header><text>Section 1833(a)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395l">42 U.S.C. 1395l(a)(1)</external-xref>) is
			 amended—</text>
					<subparagraph id="H156C5226349841D7B4F0AB1F85C89FF4"><enum>(A)</enum><text>by striking
			 <quote>and (V)</quote> and inserting <quote>(V)</quote>; and</text>
					</subparagraph><subparagraph id="H11B8D02D1ED5483A9700DF05A0678ED4"><enum>(B)</enum><text>by striking the
			 semicolon at the end and inserting the following: <quote>, and (W) with respect
			 to clinical pharmacist practitioner services (as defined in section
			 1861(ddd)(1)), the amounts paid shall be 85 percent of the amounts provided for
			 such services under section 1834(n)(1);</quote>.</text>
					</subparagraph></paragraph><paragraph id="H612BF4B03D354F3C9992CE344FCCC7D0"><enum>(2)</enum><header>Establishment of
			 fee schedules</header><text>Section 1834 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m</external-xref>) is
			 amended by adding at the end the following new subsection:</text>
					<quoted-block id="HCEA313F62A7F42A9BD97D00D7006942" style="OLC">
						<subsection id="HC48DA4DD2A854C73858E035F3C1B18D7"><enum>(n)</enum><header>Fee Schedules
				for Clinical Pharmacist Practitioner Services</header>
							<paragraph id="HDD88F0D9F9B34D09BAAFD878F99520FC"><enum>(1)</enum><header>Development</header><text>The
				Secretary shall develop and implement, for services furnished not later than
				January 1, 2010—</text>
								<subparagraph id="HFB7F494DCE064CA4B6AB11FAA300B362"><enum>(A)</enum><text>a relative value
				scale to serve as the basis for the payment of clinical pharmacist practitioner
				services (as defined in section 1861(ddd)(1)) under this part; and</text>
								</subparagraph><subparagraph id="HFD0DABED110246D1AE95B5F0C9E82469"><enum>(B)</enum><text>using such scale
				and appropriate conversion factors, fee schedules (on a regional, statewide,
				locality, or carrier service area basis) for payment for clinical pharmacist
				practitioner services under this part.</text>
								</subparagraph></paragraph><paragraph id="HE57A5085E2A04DCB9DAD4FAA1D47564D"><enum>(2)</enum><header>Payments prior
				to implementation of fee schedules</header><text>In the case of clinical
				pharmacist practitioner services which are furnished before the implementation
				of fee schedules under paragraph (1)(B) and after January 1, 2009, the amount
				of payment made under this part shall be based on 85 percent of the fee
				schedule amount applicable under section 1848 if the services were furnished by
				a
				physician.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H307A833EAB044E929EB01E5DCBE3B71"><enum>(3)</enum><header>Report to
			 Congress</header><text>Not later than September 30, 2009, the Secretary of
			 Health and Human Services shall submit to Congress a report on the fee
			 schedules (including relative value scale and appropriate conversion factors)
			 developed pursuant to section 1834(n)(1) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (as added by paragraph (2))
			 for clinical pharmacist practitioner services under part B of title XVIII of
			 such Act.</text>
				</paragraph></subsection><subsection id="H72CC4EE6F4A946FD009F1D20EF1E6287"><enum>(d)</enum><header>Effective
			 Date</header><text>The amendments made by this section shall apply to services
			 furnished on or after January 1, 2009.</text>
