	<legis-body id="H13A8E9A3695E4FA0A9E4CF00F55332B5" style="OLC">
		<section id="H25711CDF31904311868D43CDFE3876DF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>China
			 Democracy Act</quote>.</text>
		</section><section id="H6C5A9768EE784370A6EDC5AACBED1B6D"><enum>2.</enum><header>Restrictions on
			 trade with and investment in the People’s Republic of China</header>
			<subsection id="H0CA864C66B3142F5A2278E764E5F09A0"><enum>(a)</enum><header>Restrictions on
			 trade</header>
				<paragraph id="H0A17002CFC13440993B56FC422D56E9C"><enum>(1)</enum><header>In
			 general</header><text>Subject to paragraph (2), no article that is the product
			 of the People’s Republic of China may be imported into the United States, and
			 no goods or technology may be exported from any place in the United States to
			 the People’s Republic of China.</text>
				</paragraph><paragraph id="HABF87B138DBA47A8AECACEC8D57E61B8"><enum>(2)</enum><header>Exception</header><text>Paragraph
			 (1) shall not apply to—</text>
					<subparagraph id="HABEE4A5569E54FCC8239251DFB89A86F"><enum>(A)</enum><text>exports of food or
			 medicine to the People’s Republic of China; or</text>
					</subparagraph><subparagraph id="HB76CC4AA3E154B69B85ED5612190D893"><enum>(B)</enum><text>exports of items
			 that would be authorized for export to Cuba, except that such items shall be
			 subject to the same restrictions relating to licenses or other approval that
			 apply with respect to exports of such items to Cuba.</text>
					</subparagraph></paragraph></subsection><subsection id="HA8B2CCEC292A4D5CA622A593635299DA"><enum>(b)</enum><header>Restrictions on
			 investment in Chinese enterprises</header><text>No United States person may,
			 after the end of the 180-day period beginning on the date of the enactment of
			 this Act, make an investment in any enterprise in the People’s Republic of
			 China or in any enterprise that is owned or controlled by the Government of,
			 entities controlled by the Government of, or nationals of, the People’s
			 Republic of China.</text>
			</subsection><subsection id="HA7999AB5E9F44AB4891CBA5556CCC4A9"><enum>(c)</enum><header>Restrictions on
			 investment by Chinese nationals in U.S. persons</header><text display-inline="yes-display-inline">No United States person may, after the end
			 of the 180-day period beginning on the date of the enactment of this Act,
			 engage in any transaction the purpose of which is to secure an investment by a
			 Chinese national in any United States person or in any enterprise owned or
			 controlled by United States persons.</text>
			</subsection></section><section id="H4EDBA3E087464D7CBA7C4C009FB04DBB"><enum>3.</enum><header>Entry of vessels
			 engaged in trade with the People’s Republic of China</header>
			<subsection id="H13BC89072B584025A78C00832BEDE1C"><enum>(a)</enum><header>Prohibitions</header><text display-inline="yes-display-inline">Except as specifically authorized by the
			 President, by means of regulations, rulings, instructions, licenses, or
			 otherwise —</text>
				<paragraph id="HE1DF097FD2FA4199923BA477E1A1EA69"><enum>(1)</enum><text>no vessel that enters a port or place in the People’s Republic of China to
			 engage in the trade of goods or the purchase or provision of services, may
			 enter a port in the United States for the purpose of loading or unloading
			 freight for a period of 180 days after the date on which the vessel departed
			 from a port or place in the People’s Republic of China; and</text>
				</paragraph><paragraph id="H38DFA2CAA75A4C53B6605E9B331B004C"><enum>(2)</enum><text display-inline="yes-display-inline">no vessel carrying goods to or from the
			 People’s Republic of China or carrying goods in which the People’s Republic of
			 China or a national of the People’s Republic of China has an interest may enter
			 a port in the United States with such goods on board.</text>
				</paragraph></subsection><subsection id="H914BF55C0F5F42659D00006B2EC70931"><enum>(b)</enum><header>Exception</header><text display-inline="yes-display-inline">Subsection (a) shall not apply with respect
			 to exports of items permitted under section 1.</text>
			</subsection></section><section id="H26734DB4CDAA4F0786EA7450CECC91BE"><enum>4.</enum><header>Enforcement</header>
			<subsection id="HACDE6AD333314D61B02EE9C7002D172C"><enum>(a)</enum><header>Regulatory
			 authority</header><text display-inline="yes-display-inline">The President shall
			 issue such regulations, orders, and licenses as are necessary to carry out this
			 Act.</text>
			</subsection><subsection id="H47A10A54B76F4FE0AD1B00298D53A21C"><enum>(b)</enum><header>Exceptions from
			 prohibitions</header><text display-inline="yes-display-inline">The President
			 may provide for such exceptions from the prohibitions contained in this Act as
			 are consistent with the Cuban Assets Control Regulations under part 515 of
			 title 31, Code of Federal Regulations, as in effect on the date of the
			 enactment of this Act.</text>
			</subsection></section><section id="H4761CD707F5C443D95B4B1E9FD8DA76F"><enum>5.</enum><header>Penalties</header><text display-inline="no-display-inline">Any person or entity that violates this Act
			 or any regulation, license, or order issued under this Act shall be subject to
			 the penalties provided in section 206 of the International Emergency Economic
			 Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1705">50 U.S.C. 1705</external-xref>) for violations under that Act.</text>
		</section><section id="H6BCC27CE7D4B47E9A500912E06D03B5C"><enum>6.</enum><header>Suspension of
			 visas to Chinese nationals</header><text display-inline="no-display-inline">No
			 immigrant or nonimmigrant visa may be issued to any national of the People’s
			 Republic of China, and any such visa issued to a national of the People’s
			 Republic of China before the effective date of this Act may not be extended on
			 or after such effective date.</text>
		</section><section id="H3B04DFF6FDCE458BBAAC4164F124E0FE"><enum>7.</enum><header>Downgrading of
			 diplomatic relations</header><text display-inline="no-display-inline">The
			 President shall take the necessary steps to downgrade diplomatic relations with
			 the People’s Republic of China to that which existed before the United States
			 recognized the People’s Republic of China in 1979.</text>
		</section><section id="HFEB7AC785DED45E38E58B23C2C00187B"><enum>8.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H98FEA424E75340278561A30048A583F8"><enum>(1)</enum><header>Food</header><text display-inline="yes-display-inline">The term <quote>food</quote> means—</text>
				<subparagraph id="HBA3E57603EFF40E187C59874C2C072BE"><enum>(A)</enum><text>any article used
			 for food or drink for humans; and</text>
				</subparagraph><subparagraph id="H0387E67D4E9C4E13A5590064EC053BC8"><enum>(B)</enum><text>any article used
			 for a component of an article described in subparagraph (A).</text>
				</subparagraph></paragraph><paragraph id="H2C371E35419F400F00FFEC24D5007872"><enum>(2)</enum><header>Investment</header><text display-inline="yes-display-inline">The term <quote>investment</quote> means
			 any contribution or commitment of funds, commodities, services, patents,
			 processes, or techniques, in the form of—</text>
				<subparagraph id="H162F11EB6E674001A1E43284ED4B2D3B"><enum>(A)</enum><text>a loan,</text>
				</subparagraph><subparagraph id="H86CD78AA5F0D417AA9BA8297FBEE447"><enum>(B)</enum><text>the purchase of a
			 share of ownership,</text>
				</subparagraph><subparagraph id="H3206026D47A04D2582CC910000F55F48"><enum>(C)</enum><text>participation in
			 royalties, earnings, or profits,</text>
				</subparagraph><subparagraph id="HCF38D2F404404EE3AD15B7F230679CD7"><enum>(D)</enum><text>the furnishing of
			 commodities or services pursuant to a lease or other contract, or</text>
				</subparagraph><subparagraph id="HA3451194A54E452F9688FFC55B4C1BA7"><enum>(E)</enum><text>other
			 mechanism,</text>
				</subparagraph><continuation-text continuation-text-level="paragraph">that is made
			 for the production of income.</continuation-text></paragraph><paragraph id="HFFA642737F3642D79D00003CD1B3D93"><enum>(3)</enum><header>Medicine</header><text>The
			 term <quote>medicine</quote> has the meaning given the term <quote>drug</quote>
			 in section 201 of the Federal Food, Drug, and Cosmetic Act (21 U.S.C.
			 321).</text>
			</paragraph><paragraph id="H1AA77DFDF0784489A9DABC9FDA3B7892"><enum>(4)</enum><header>National of the
			 People’s Republic of China</header><text>The term <quote>national of the
			 People’s Republic of China</quote>—</text>
				<subparagraph id="H30B67301591B4757ABBEBB15CC222C17"><enum>(A)</enum><text>means—</text>
					<clause id="HC492D3DB1CCC40409CDD2CEFC7F3EAE"><enum>(i)</enum><text>a
			 citizen of or person owing allegiance to the People’s Republic of China;</text>
					</clause><clause id="H928CEE45486949E1B8F9905BE07CFE06"><enum>(ii)</enum><text display-inline="yes-display-inline">any corporation, partnership, or other
			 entity organized under the laws of the People’s Republic of China; and</text>
					</clause><clause id="H178AAC3CEF5E4FA68286CE33FC760390"><enum>(iii)</enum><text>any entity owned
			 or controlled by persons or entities described in clause (i) or (i); and</text>
					</clause></subparagraph><subparagraph id="H70D85D832BF043E4ACE5BC82A33C84C"><enum>(B)</enum><text display-inline="yes-display-inline">does not include any citizen or person
			 owing allegiance to Taiwan, the Pescadores, or any other island over which the
			 Taiwanese Government exercises control.</text>
				</subparagraph></paragraph><paragraph id="HAFD26DFC1B624941838B00945D08C850"><enum>(5)</enum><header>People’s
			 Republic of China</header><text display-inline="yes-display-inline">The term
			 <quote>People’s Republic of China</quote>—</text>
				<subparagraph id="H9D4A1034D2CE4716B2C03C6B5403F0BF"><enum>(A)</enum><text>includes mainland
			 China, Hong Kong, Macao, and any other territory or special administrative
			 region governed by the People’s Republic of China; and</text>
				</subparagraph><subparagraph id="HAEFD10E015584F26B29B03156D40E0B9"><enum>(B)</enum><text>does not include
			 Taiwan, the Pescadores, or any other island over which the Taiwanese Government
			 exercises control.</text>
				</subparagraph></paragraph><paragraph id="H658F4A665C654D5087EB92A51100F86C"><enum>(6)</enum><header>United
			 States</header><text display-inline="yes-display-inline">The term <quote>United
			 States</quote> includes any commonwealth, territory, or possession of the
			 United States, and the customs waters of the United States (as defined in
			 section 401 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1401">19 U.S.C. 1401</external-xref>)).</text>
			</paragraph><paragraph id="H280C7723CD5A4A7EA5005013E9D60011"><enum>(7)</enum><header>United States
			 person</header><text>The term <quote>United States person</quote> means—</text>
				<subparagraph id="H1E31C4C59BCD4EC7978447650422EAD0"><enum>(A)</enum><text>any United States
			 citizen or alien lawfully admitted for permanent residence to the United
			 States;</text>
				</subparagraph><subparagraph id="HE76807A472BA47B995797D8F99A60318"><enum>(B)</enum><text>any corporation,
			 partnership, or other entity organized under the laws of the United States;
			 and</text>
				</subparagraph><subparagraph id="H5EF079816DEF4B3CB8FAED81FEEE3DD4"><enum>(C)</enum><text>any person in the
			 United States.</text>
				</subparagraph></paragraph><paragraph id="H39216DF7F5CF428EA99EB3E39B7DAEF6"><enum>(8)</enum><header>Vessel</header><text>The
			 term <quote>vessel</quote> includes every description of water craft or other
			 contrivance used, or capable of being used, as a means of transportation in
			 water, but does not include aircraft.</text>
			</paragraph></section><section id="H7FC937AEBA7C481A84B925606C2621D2"><enum>9.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">This Act shall take
			 effect 180 days after the date of the enactment of this Act.</text>
		</section><section id="HD37D047DFDBC45EEBB15CE51F00614C"><enum>10.</enum><header>Termination</header><text display-inline="no-display-inline">This Act shall cease to be effective 30 days
			 after the date on which the President determines and certifies to the Congress
			 that the People’s Republic of China—</text>
			<paragraph id="HCA2B5E91E01247B8AE795D858EEF6BF2"><enum>(1)</enum><text display-inline="yes-display-inline">at the national, provincial, and local
			 levels, is governed by governments that are democratically elected from free
			 and fair elections—</text>
				<subparagraph id="HB16559276AF0450EB2DB3F3341F422ED"><enum>(A)</enum><text>conducted under
			 the supervision of internationally recognized observers; and</text>
				</subparagraph><subparagraph id="HC499B54A623B4CB59917BFE923CDF567"><enum>(B)</enum><text>in which—</text>
					<clause id="HE707BD66904449FA903BDDE24103F715"><enum>(i)</enum><text>opposition parties
			 were permitted ample time to organize and campaign for such elections; and</text>
					</clause><clause id="H290F06C4BF5E48F9879459004453B197"><enum>(ii)</enum><text>all
			 candidates were permitted full access to the media;</text>
					</clause></subparagraph></paragraph><paragraph id="HA6FAAD264A9444A1A448006E04A7A68D"><enum>(2)</enum><text>is showing respect
			 for the basic civil liberties and human rights of the citizens of the People’s
			 Republic of China;</text>
			</paragraph><paragraph id="H58E4624513024832A862DC4F374CD580"><enum>(3)</enum><text>has a
			 market-oriented economic system based on the right to own and enjoy property;</text>
			</paragraph><paragraph id="HCE7EE45465624028A3585137D81B7E51"><enum>(4)</enum><text>ensures regular
			 free and fair elections and the full enjoyment of basic civil liberties and
			 human rights by the citizens of the People’s Republic of China;</text>
			</paragraph><paragraph id="H433C5F4385E84CB28FFBA8A98BE01B1F"><enum>(5)</enum><text>has established an
			 independent judiciary; and</text>
			</paragraph><paragraph id="HBB5316712C9A4A5F000095506900EA93"><enum>(6)</enum><text display-inline="yes-display-inline">is no longer engaging in wide-scale
			 espionage activities directed against the United States.</text>
