		<legis-type>A BILL</legis-type>
		<official-title>To direct the Federal Trade Commission to revise the
		  Telemarketing Sales Rule to explicitly prohibit the sending of a text message
		  containing an unsolicited advertisement to a cellular telephone number listed
		  on the national do-not-call registry.</official-title>

		<section id="H63A8A5F58CEC4344B0391F352C2F77B4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Stop M-Spam Abuse as a Sales industry
			 Habit Act of 2008</short-title></quote> or as the <quote><short-title>SMASH Act
			 of 2008</short-title></quote>.</text>
		</section><section id="H3546300B69024E8DBBA9FAAC9506743D" section-type="subsequent-section"><enum>2.</enum><header>Text messages
			 containing unsolicited advertisements sent to cellular telephones explicitly
			 prohibited</header>
			<subsection id="H086631C710F44768B0BAF372ECEA3C1"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than 180
			 days after the date of the enactment of this Act, the Federal Trade Commission
			 shall issue regulations to revise the Telemarketing Sales Rule to explicitly
			 prohibit, as an abusive telemarketing act or practice, the sending of any
			 electronic commercial message containing an unsolicited advertisement to a
			 telephone number that is—</text>
				<paragraph id="HC816272330874D228F5DF9E6C4BE6854"><enum>(1)</enum><text>assigned to a
			 commercial mobile service; and</text>
				</paragraph><paragraph id="HAD070393A8124CE9A75F6D0009D04811"><enum>(2)</enum><text>listed on the
			 <quote>do-not-call</quote> registry established by the Federal Trade Commission
			 pursuant to the Telemarketing Sales Rule (16 C.F.R. 310.4(b)(1)(iii)).</text>
				</paragraph></subsection><subsection id="H3F7C7996935044D7BBE38875E521F5A0"><enum>(b)</enum><header>Definitions</header><text>For
			 purposes of this section:</text>
				<paragraph id="H929D4418B5984CF4BE6558FB0674E9A2"><enum>(1)</enum><header>Electronic
			 commercial message</header><text>The term <term>electronic commercial
			 message</term> means any type of message, other than a mobile service
			 commercial message (as defined in section 14(d) of the CAN–SPAM Act of 2003 (15
			 U.S.C. 7712(d))), sent to a cellular telephone, including a text message,
			 multimedia message, or any successor type of message.</text>
				</paragraph><paragraph id="H49C6906FC9744CE5AFE2D2E16BC7811C"><enum>(2)</enum><header>Cellular
			 telephone</header><text>The term <term>cellular telephone</term> means any type
			 of wireless device used to access commercial mobile services.</text>
				</paragraph><paragraph id="H06394EEF23E44361A3CBBFEF6D4F7329"><enum>(3)</enum><header>Commercial
			 mobile service</header><text display-inline="yes-display-inline">The term
			 <term>commercial mobile service</term> has the meaning given in section 332(d)
			 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/332">47 U.S.C. 332(d)</external-xref>).</text>
				</paragraph><paragraph id="H5EBD246F12A44E6497E77E605BCB21BB"><enum>(4)</enum><header>Unsolicited
			 advertisement</header><text>The term <term>unsolicited adverstisement</term>
			 has the meaning given in section 227(a)(5) of the Communications Act of 1934
			 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(a)(5)</external-xref>).</text>
				</paragraph></subsection></section><section id="H6E430B8FA98948DC81DBBF306D9FB6D"><enum>3.</enum><header>Effect on other
			 laws</header><text display-inline="no-display-inline">Nothing in this Act shall
			 be interpreted to preclude or override the applicability of section 227 of the
			 Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227</external-xref>), section 14 of the CAN–SPAM Act of
			 2003 (<external-xref legal-doc="usc" parsable-cite="usc/15/7712">15 U.S.C. 7712</external-xref>), or the rules prescribed under section 3 of the
			 Telemarketing and Consumer Fraud and Abuse Prevention Act (15 U.S.C.
			 6102).</text>
