		<official-title>To amend the Federal Election Campaign Act of 1971 to
		  restrict political robocalls, and for other purposes.</official-title>

		<section id="H1A1870D261EF40B3B8FE76FF7674A5FA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Robocall Privacy Act of
			 2008</short-title></quote>.</text>
		</section><section id="HF6BC092FC7774BC2A57997F46CC352E" section-type="subsequent-section"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following
			 findings:</text>
			<paragraph id="H17BB7D67D73B495A8778D8C6F8183124"><enum>(1)</enum><text>Abusive political
			 robocalls harass voters and discourage them from participating in the political
			 process.</text>
			</paragraph><paragraph id="H9E056FA4A3C24273BB26CAE76EE92D60"><enum>(2)</enum><text>Abusive political
			 robocalls infringe on the privacy rights of individuals by disturbing them in
			 their homes.</text>
			</paragraph></section><section id="H80FD30BBFD7144D485371438BD2FE75"><enum>3.</enum><header>Regulation of
			 political robocalls</header><text display-inline="no-display-inline">Title III
			 of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/2/431">2 U.S.C. 431 et seq.</external-xref>) is amended
			 by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H5ADE1415DF66431B8C129ED9BB351D1B" style="traditional">
				<section id="H987F3DC28BE747DB8362D3DA5DC0FAE5"><enum>325.</enum><header>Regulation of Political Robocalls</header><subsection commented="no" display-inline="yes-display-inline" id="H55264B504693431A90E559DEC4066CAE"><enum>(a)</enum><header>Restrictions on Making
				Political Robocalls</header><text display-inline="yes-display-inline">It shall
				be unlawful for any person during the specified period to make a political
				robocall or to cause a political robocall to be made—</text>
						<paragraph id="H1B3150F20814404EAC0083591C7597AC"><enum>(1)</enum><text>to any person
				during the period beginning at 9 p.m. and ending at 8 a.m. in the place which
				the call is directed;</text>
						</paragraph><paragraph id="HA9D4063FB7934C718DC1AB9C3590B351"><enum>(2)</enum><text>to the same
				telephone number more than twice on the same day;</text>
						</paragraph><paragraph id="H78ACC9D60F2040149C944122107F5190"><enum>(3)</enum><text>without
				disclosing, at the beginning of the call—</text>
							<subparagraph id="H22DF1F1A3AD74700A1DE79B6C877685"><enum>(A)</enum><text>that the call is a
				recorded message; and</text>
							</subparagraph><subparagraph id="HF0090578A30749FA9DB01D8E10656D97"><enum>(B)</enum><text>the name of the
				sponsor or originator of the call; or</text>
							</subparagraph></paragraph><paragraph id="H46CA56418C864F73921377D5D6670035"><enum>(4)</enum><text>without
				transmitting the telephone number and the name of the person making the
				political robocall or causing the political robocall to be made to the caller
				identification service of the recipient.</text>
						</paragraph></subsection><subsection id="H75DCA668C87C4C4ABDA3C338F7E031D9"><enum>(b)</enum><header>Definitions</header><text>For
				purposes of this section, the following definitions apply:</text>
						<paragraph id="H81FC9178B61C4EF08CDC5DB410E8FB7"><enum>(1)</enum><header>Political
				robocall</header><text>The term <term>political robocall</term> means any
				outbound telephone call—</text>
							<subparagraph id="HB07B30792E1D4DFC88E34797EEDFC791"><enum>(A)</enum><text>in which a person
				is not available to speak with the person answering the call, and the call
				instead plays a recorded message; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3A4AD8DEB34643A8B9C4D8F85EE7D00"><enum>(B)</enum><text>which promotes,
				supports, attacks, or opposes a candidate for Federal office.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE74CC36963064F9999734F00DA8E16D2"><enum>(2)</enum><header>Specified
				period</header><text>The term <term>specified period</term> means, with respect
				to any candidate who is promoted, supported, attacked, or opposed in a
				political robocall—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="H8BBB1A629F8B482F84F57FF6AA30DAF"><enum>(A)</enum><text>the 60-day period
				ending on the date of any general, special, or run-off election for the office
				sought by such candidate; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H08D15103E4E24D2DB919828703276BA1"><enum>(B)</enum><text>the 30-day period
				ending on the date of any primary or preference election, or any convention or
				caucus of a political party that has authority to nominate a candidate, for the
				office sought by such
				candidate.</text>
							</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H7965D5C09908411A8D97EB2634ACE7BA"><enum>4.</enum><header>Enforcement</header>
			<subsection id="H55A01CCAD7D8414E953E36B90011A99E"><enum>(a)</enum><header>Special Rules
			 for Enforcement of Restrictions on Political Robocalls</header><text>Section
			 309(a) of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/2/437g">2 U.S.C. 437g(a)</external-xref>) is
			 amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HE31EA0373A8B43308953005F80693F00" style="traditional">
					<paragraph id="H8757DD90B12744FEAF2EE7A100195494" indent="up1"><enum>(13)</enum><text>In the case of any violation of
				section 325 (relating to making, or causing to be made, a political robocall),
				the amount of any civil penalty applicable under this section shall be not
				greater than $1,000 for each such violation, or not greater than 300 percent of
				such amount in the case of a knowing and willful
				violation.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HF4BC71F2EA244C4AAB5CDDDE989B25D3"><enum>(b)</enum><header>Conforming
			 Amendment</header><text>Section 307(e) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/2/437d">2 U.S.C. 437d(e)</external-xref>) is
			 amended by striking <quote>section 309(a)(8)</quote> and inserting
			 <quote>sections 309(a)(8) and (a)(13)</quote>.</text>
			</subsection></section><section id="HC6F0484F08E5405389ED5DAA45932840"><enum>5.</enum><header>Effective
			 Date</header><text display-inline="no-display-inline">The amendments made by
			 this Act shall take effect on the date of the enactment of this Act, except
			 that section 325 of the Federal Election Campaign Act of 1971 (as added by
			 section 3) shall not apply with respect to any political robocall described in
			 such section which is made or caused to be made prior to the date of the
			 enactment of this Act.</text>
