		  for a DSH redistribution pool from unexpended Medicaid DSH allotments in order
		  to increase Medicaid DSH allotments for low DSH States and to provide grants
		  for health access networks serving the uninsured.</official-title>

		<section id="H537AF7BF381145B894F4227C126D3D20" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Strengthening the Safety Net Act of
			 2008</short-title></quote>.</text>
		</section><section id="HE27B06C1C4D945448915A52532E4FB11"><enum>2.</enum><header>Application of
			 unexpended Medicaid DSH allotments for increased allotments for low DSH States
			 and for health network access grants</header>
			<subsection id="HF872514D318D449082EB92B974823EFC"><enum>(a)</enum><header>Establishment of
			 DSH redistribution pool from unexpended Medicaid DSH allotments</header><text display-inline="yes-display-inline">Subsection (f) of section 1923 of the
			 Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r-4">42 U.S.C. 1396r–4</external-xref>) is amended—</text>
				<paragraph id="HCFBA24D8A993476A905B14E4192E3C35"><enum>(1)</enum><text>by redesignating
			 paragraph (7) as paragraph (8); and</text>
				</paragraph><paragraph id="H3005E972CF4B42BC92FAC2B087E9315B"><enum>(2)</enum><text>by inserting after
			 paragraph (6) the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="H474D35EAFB634C22865F9CDEF638CEC2" style="OLC">
						<paragraph id="H358A89EEEF5B4B408909B92427A080A4"><enum>(7)</enum><header>DSH
				redistribution pool from portion of unexpended DSH allotments to fund increase
				in allotments for low DSH States and health network access grants</header>
							<subparagraph id="H485ABED8F377424492C30B2623ED1F"><enum>(A)</enum><header>Establishment</header><text>There
				is established a DSH redistribution pool in the amount provided under this
				paragraph. Such amount shall be determined by the Secretary at the beginning of
				each fiscal year and the Secretary may adjust such amount in subsequent fiscal
				years to take into account errors in estimates made for previous fiscal years.
				The amount in such pool shall be available for obligation and expenditure
				without fiscal year limitation.</text>
							</subparagraph><subparagraph id="H2D8E9E8E190C4279BA584EE39769EB91"><enum>(B)</enum><header>Addition of
				unexpended DSH allotments</header><text>At the beginning of each fiscal year
				(beginning with fiscal year 2009), there shall be added to the DSH
				redistribution pool an amount equal to the amount by which—</text>
								<clause id="H41EF11882C8F41BE89F131FC00F498ED"><enum>(i)</enum><text display-inline="yes-display-inline">the total of the DSH allotments for all
				States for the third preceding fiscal year; exceeded</text>
								</clause><clause id="HA99A3449FF654A29A595D765DF76B3AD"><enum>(ii)</enum><text>the total Federal
				financial participation under this title attributable to such allotments for
				such fiscal year.</text>
								</clause></subparagraph><subparagraph id="HB0EEEA54B0B44B488486613E47896BDE"><enum>(C)</enum><header>Reduction for
				expenditures resulting from increased allotments for low DSH States and for
				health network access grants</header><text display-inline="yes-display-inline">At the beginning of each fiscal year
				(beginning with fiscal year 2010), there shall be subtracted from the DSH
				redistribution pool an amount equal to the sum of—</text>
								<clause id="H7CF6143111D5489C96E4F7EF4F48FEA"><enum>(i)</enum><text>the
				aggregate increase in Federal financial participation under this title
				attributable to the amendments made by section 2(b) of the Strengthening the
				Safety Net Act of 2008 for the previous fiscal year; and</text>
								</clause><clause id="H2A396EBF150D467FB45EB354B2BE3D10"><enum>(ii)</enum><text>the amount
				obligated on grants under subsection (k) for such previous fiscal
				year.</text>
								</clause></subparagraph></paragraph><after-quoted-block>. </after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H109839C10368455FA152673086002BFF"><enum>(b)</enum><header>Increase in DSH
			 allotments for low DSH States; qualification of low DSH States based on fiscal
			 year 2004 data</header><text>Subsection (f)(5) of such section is
			 amended—</text>
				<paragraph id="H69D44DA40C224E7FA226A7D27BDADEC5"><enum>(1)</enum><text>in subparagraph
			 (B)—</text>
					<subparagraph id="HC75E6F0CCD39432BA6B641A7275F13CC"><enum>(A)</enum><text>by striking
			 <quote>and</quote> at the end of clause (ii);</text>
					</subparagraph><subparagraph id="HC6685074D70848618B0075F35A4ADD7"><enum>(B)</enum><text>in clause
			 (iii)—</text>
						<clause id="H50317E7FE43049E700F66F347700D037"><enum>(i)</enum><text>by
			 striking <quote>2009</quote> and inserting <quote>2014</quote>;</text>
						</clause><clause id="H5D5CD01D82F44D00AE9DCBB8ED0800B7"><enum>(ii)</enum><text>by
			 inserting <quote>, subject to subparagraph (D),</quote> after <quote>shall
			 be</quote>; and</text>
						</clause><clause id="H280E585F226940DDB54E21901D7816D3"><enum>(iii)</enum><text>by
			 redesignating such clause as clause (iv); and</text>
						</clause></subparagraph><subparagraph id="H43216933B54D4CAF9757F95920935922"><enum>(C)</enum><text>by inserting after
			 clause (ii) the following new clause:</text>
						<quoted-block display-inline="no-display-inline" id="H2DA1621919254D55B8A3416C5DB335D" style="OLC">
							<clause id="H35EC0CB0D5F14D4BA7811573F400FB2B"><enum>(iii)</enum><text display-inline="yes-display-inline">each succeeding fiscal year before fiscal
				year 2014 shall be, subject to subparagraph (D), the DSH allotment for the
				State for the previous fiscal year increased by 19.5 percent;
				and</text>
							</clause><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HC788EDB96C42499B92BD9526FA7D768D"><enum>(2)</enum><text>by adding at the
			 end the following new subparagraphs:</text>
					<quoted-block display-inline="no-display-inline" id="H4CBBE6FA4EBA4FE9B0D27B23A3E9DA83" style="OLC">
						<subparagraph id="HA0D9D44F9E07444E8B01A5D874087DE6"><enum>(C)</enum><header>Additional
				states covered for fiscal year 2009 and subsequent years</header><text display-inline="yes-display-inline">In the case of a State not described in
				subparagraph (B) in which the total expenditures under the State plan
				(including Federal and State shares) for disproportionate share hospital
				adjustments under this section for fiscal year 2004, as reported to the
				Administrator of the Centers for Medicare &amp; Medicaid Services as of August
				31, 2007, is greater than 0 but less than 3 percent of the State's total amount
				of expenditures under the State plan for medical assistance during the fiscal
				year, the DSH allotment for the State with respect to—</text>
							<clause id="H9A61295BF34242DBB9EAD580223C9952"><enum>(i)</enum><text display-inline="yes-display-inline">fiscal year 2009 and any succeeding fiscal
				year before fiscal year 2014 shall be, subject to subparagraph (D), the DSH
				allotment for the State for the previous fiscal year increased by 19.5 percent;
				and</text>
							</clause><clause id="H94681DFC2B99486AA3D9D66D00A76BBD"><enum>(ii)</enum><text display-inline="yes-display-inline">any subsequent fiscal year shall be,
				subject to subparagraph (D), the DSH allotment for the State for the previous
				fiscal year subject to an increase for inflation as provided in paragraph
				(3)(A).</text>
							</clause></subparagraph><subparagraph id="H710DA66E63FF4208BC5329C84EE4420"><enum>(D)</enum><header>Limitation on
				increases to amount available from DSH redistribution pool</header><text>If the
				Secretary estimates for a fiscal year (beginning with fiscal year 2009)
				that—</text>
							<clause id="H8E4F0DACFFD54275AA85F5644B8DBD1E"><enum>(i)</enum><text>the amount of
				additional expenditures in the fiscal year resulting from the application of an
				increase in DSH allotments under subparagraphs (B) and (C) beginning with
				fiscal year 2009 of 19.5 percent (instead of the application of an increase for
				inflation as provided in paragraph (3)(A)), exceeds</text>
							</clause><clause id="H8AA7E64B98B544B084EFF4664CC0EED6"><enum>(ii)</enum><text>the amount
				available for obligation from the DSH redistribution pool under paragraph (7)
				for the fiscal year,</text>
							</clause><continuation-text continuation-text-level="subparagraph">the
				Secretary shall reduce the increase in the DSH allotments otherwise provided
				under such subparagraphs for the fiscal year in a pro-rata manner so that the
				amount of additional expenditures in the fiscal year resulting from the
				application of such subparagraphs is equal to the amount described in clause
				(ii) for the fiscal year. A reduction in a DSH allotment for a State under this
				subparagraph shall not affect the computation of the DSH allotment for the
				State under subparagraph (B) or (C) for the subsequent fiscal
				year.</continuation-text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H62AD8DCA297B4AFC90E28E9872BA18C"><enum>(c)</enum><header>Demonstration
			 grants to health access networks</header><text>Such section is further amended
			 by adding at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H2F1E6AF444AD42A093024B9BA668D4F3" style="OLC">
					<subsection id="HD89ACA0424404C97A01F23B4CBDB74BA"><enum>(k)</enum><header>Demonstration
				grants to health access networks</header>
						<paragraph id="HF7385BC904A74C2DAD2D6989A1C133C7"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">From the amount of
				funds made available under paragraph (6)(A) for a fiscal year, the Secretary
				shall award demonstration grants under this subsection to health access
				networks for such fiscal year for the purpose of improving access, quality, and
				continuity of care for uninsured individuals through better coordination of
				care by the network.</text>
						</paragraph><paragraph id="H407C803A7DAB400AA731F0D53F82C4C7"><enum>(2)</enum><header>Health access
				network defined</header>
							<subparagraph id="HA6D7A1A3316642DEBD5640E0786F4073"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">In this subsection,
				the term <term>health access network</term> means an entity representing a
				collection of safety net providers, including hospitals, community health
				centers, public health departments, physicians, safety net health plans,
				federally qualified health centers, or other recognized safety net providers,
				that—</text>
								<clause id="H73EC9DB6C3EF4884B9689969C2CECC00"><enum>(i)</enum><text>is
				organized for the purpose of restructuring and improving the access, quality,
				and continuity of care to the uninsured and underinsured; and</text>
								</clause><clause id="H36F72AA8215947808DB56FACE739056E"><enum>(ii)</enum><text>offers patients
				access to all levels of care, including primary, outpatient, specialty, certain
				ancillary services, and acute inpatient care, within a community or across a
				broad spectrum of providers across a service region or State.</text>
								</clause></subparagraph><subparagraph id="H56DE19770117404900C29DC7DF5711B9"><enum>(B)</enum><header>Inclusion of
				section 330 networks and plans</header><text display-inline="yes-display-inline">Such term includes networks and plans that
				meet the requirements for funding under section 330(e)(1)(C) of the Public
				Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/254b">42 U.S.C. 254b(e)(1)(C)</external-xref>).</text>
							</subparagraph><subparagraph id="HF9DD81B49C284870B45F611C546DA0E4"><enum>(C)</enum><header>Inclusion of
				integrated health care systems</header>
								<clause id="HD52D8C583D4C4CDF89324B6E7CF009CC"><enum>(i)</enum><header>In
				general</header><text>Such term also includes an integrated health care system
				(including a pediatric system).</text>
								</clause><clause id="H6B48F524602742E38B4EBB5FC9E8BA96"><enum>(ii)</enum><header>Definition</header><text display-inline="yes-display-inline">For purposes of this subparagraph, the term
				<term>integrated health care system (including a pediatric system)</term> means
				a health care provider that—</text>
									<subclause id="HFF3FE3E450A84C3A89D405212B4731F5"><enum>(I)</enum><text>is organized to
				provide care in a coordinated fashion; and</text>
									</subclause><subclause id="H578C4A845A0E456CAF40CEE400612FE5"><enum>(II)</enum><text>assures access to
				a full range of primary, specialty, and hospital care, to uninsured and
				under-insured individuals, as appropriate.</text>
									</subclause></clause></subparagraph></paragraph><paragraph id="HD421ED0211554511A0049D315C7330F9"><enum>(3)</enum><header>Application and
				plan requirement</header>
							<subparagraph id="H0C926D91937E409090EA5320E269A365"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">In order to be
				eligible for a grant under this subsection, a health access network
				shall—</text>
								<clause id="H2B01A41ACE7A4F0D8899D5A890C6C38D"><enum>(i)</enum><text>submit an
				application, in such form and manner as the Secretary shall specify;</text>
								</clause><clause id="HA583C74755CA4AACAA7BEFA37DC5BCAE"><enum>(ii)</enum><text>submit with such
				application a plan that meets the requirements of subparagraph (B);</text>
								</clause><clause id="H16392982EA404FD5AFB2EACEA2CA4E8C"><enum>(iii)</enum><text display-inline="yes-display-inline">identify in such plan measurable
				performance targets for at least 3 of the goals described in subparagraph (B);
				and</text>
								</clause><clause id="H54706F2F773E4FEEB44796A3A1C014D"><enum>(iv)</enum><text>agree that a
				portion of the payment of grant funds for patient care services after the first
				year for which such payment is made shall be contingent upon the health access
				network demonstrating success in achieving such targets.</text>
								</clause></subparagraph><subparagraph id="H0B2C517B9A544DB392321F4635F01F73"><enum>(B)</enum><header>Plan
				requirements</header><text display-inline="yes-display-inline">A health access
				network that desires a grant under this subsection shall submit a plan to the
				Secretary that details how the network intends through the grant—</text>
								<clause id="H95F8BDF05C744812B7C472D706684DE0"><enum>(i)</enum><text display-inline="yes-display-inline">to manage costs associated with the
				provision of health care services to uninsured and underinsured individuals
				served by the network;</text>
								</clause><clause id="H844B863A6F6941DD9B4754E3D8FB430"><enum>(ii)</enum><text>to
				improve access to, and the availability of, health care services provided to
				uninsured and underinsured individuals served by the network;</text>
								</clause><clause id="HCC2B545F554C4F229F2300C2DFF0FB39"><enum>(iii)</enum><text>to enhance the
				quality and coordination of health care services provided to uninsured and
				underinsured individuals served by the network;</text>
								</clause><clause id="HF57FEA97D386418FBFBCDE1CE6A8F54F"><enum>(iv)</enum><text>to improve the
				health status of uninsured and underinsured individuals served by the network;
				and</text>
								</clause><clause id="HB3E6CD7C798448CB8921A02B090010B6"><enum>(v)</enum><text>to
				reduce health disparities in the population of uninsured and underinsured
				individuals served by the network.</text>
								</clause><continuation-text continuation-text-level="subparagraph">Nothing
				in this paragraph shall be construed as requiring a health access network
				operating in a State to operate on a Statewide basis or otherwise to serve all
				uninsured and underinsured individuals in area served.</continuation-text></subparagraph><subparagraph id="H6BEF63E9A93E44ED85449F5EF4F5005E"><enum>(C)</enum><header>Authority to
				limit number of grants</header><text display-inline="yes-display-inline">In
				awarding grants under this subsection, the Secretary may limit the grants in a
				manner so that each grantee is able to provide patient care services to the
				number of uninsured individuals specified by each network in its grant
				application.</text>
							</subparagraph></paragraph><paragraph id="H1CC73E8E47424AA584D87666A99FA7B7"><enum>(4)</enum><header>Use of
				funds</header>
							<subparagraph id="H25A233261C6C4F44AAE817918330715"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">A health access
				network that receives funds under a grant under this subsection shall expend an
				amount equal to at least 90 percent of such funds for the provision of (or
				payment for) direct patient care services.</text>
							</subparagraph><subparagraph id="H3DDD59BD66A34CC7B14CD99EA2938125"><enum>(B)</enum><header>Rule of
				construction regarding direct patient care services</header><text display-inline="yes-display-inline">For purposes of subparagraph (A), the term
				<term>direct patient care services</term> means, with respect to a health
				access network, services, such as specialty medical care and diagnostic
				services, that are not available or are insufficiently available through the
				network's providers other than under a grant under this subsection.</text>
							</subparagraph><subparagraph id="H970EA2323FF449109C80D60558EDA53F"><enum>(C)</enum><header>Preference for
				services through safety net providers</header><text>In purchasing direct
				patient care services for uninsured and underinsured individuals under a grant
				under this subsection, health access networks shall, to the maximum extent
				feasible, endeavor to purchase such services from safety net providers.</text>
							</subparagraph></paragraph><paragraph id="H8A50111CBF7A47C5A9C5C59E6CDCFEAD"><enum>(5)</enum><header>Supplement, not
				supplant</header><text display-inline="yes-display-inline">Funds paid to a
				health access network under a grant under this subsection shall supplement and
				not supplant, other Federal or State payments that are made to the network to
				support the provision of health care services to low-income or uninsured
				patients.</text>
						</paragraph><paragraph id="HC5AB00126AB04E409217746BD66DE003"><enum>(6)</enum><header>Funding</header>
							<subparagraph display-inline="no-display-inline" id="HAC2065BA9ECF4231ABB9B160AE523875"><enum>(A)</enum><header>Availability of
				funds from DSH redistribution pool</header><text display-inline="yes-display-inline">To carry out this subsection there is
				hereby made available for each fiscal year (beginning with fiscal year 2009 and
				ending with fiscal year 2013) and appropriated from the DSH redistribution pool
				established under subsection (d)(7), an amount equal to—</text>
								<clause id="H930CE339978B48248E00AB0049CB0067"><enum>(i)</enum><text>the amount
				available for obligation from such pool in such fiscal year, reduced by</text>
								</clause><clause id="H5E4AC7883E894B2998E9F5E4DBEAF600"><enum>(ii)</enum><text display-inline="yes-display-inline">the Secretary’s estimate of the aggregate
				increase in Federal financial participation under this title for the fiscal
				year that will be attributable to the amendments made by section 2(b) of the
				Strengthening the Safety Net Act of 2008.</text>
								</clause></subparagraph><subparagraph id="H043399CB2733410AAA9F5B00A165C3B5"><enum>(B)</enum><header>Treatment of
				grant funds</header><text display-inline="yes-display-inline">Payments to a
				health access network under a grant under this subsection shall not be treated
				as a disproportionate share hospital payment adjustments under this section and
				shall not be counted against the DSH allotment for any State.</text>
							</subparagraph><subparagraph id="HB37198BCDC02458300644E5B67F467B5"><enum>(C)</enum><header>No State
				matching required</header><text display-inline="yes-display-inline">Nothing in
				this subsection shall be construed as requiring a State to provide for any
				State matching funds to receive funds under this subsection.</text>
							</subparagraph><subparagraph id="H030C25CA7E504964BCE312874353CE04"><enum>(D)</enum><header>Availability</header><text display-inline="yes-display-inline">The amount of any grant to a health access
				network under this subsection shall remain available for expenditure under the
				grant through the end of the third fiscal year after the fiscal year in which
				the grant is
				made.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HF49AA051626D41E48508FE6CFFDE9F01"><enum>(d)</enum><header> Conforming date
			 of application of DSH hospital requirement to availability of funding for low
			 DSH States</header><text display-inline="yes-display-inline">Subsection
			 (d)(2)(A)(ii) of such section is amended by inserting before the period at the
			 end the following: (or, in the case of a low DSH State described in
			 subparagraph (B) or (C) of subsection (f)(5), the date of the enactment of the
			 Strengthening the Safety Net Act of 2008).</text>
			</subsection><subsection id="HEE1EFBD07A1E49D991A32500B075C7DE"><enum>(e)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply beginning
			 with fiscal year 2009.</text>
