			 subsequently determined by the Speaker, in each case for consideration of such
			 provisions as fall within the jurisdiction of the committee
			 concerned</action-desc>

		<official-title>To provide that 8 of the 12 weeks of parental leave made
		  available to a Federal employee shall be paid leave, and for other
		  purposes.</official-title>

		<section id="H2345B5A8F8DE433DB63170CF97F71DE5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Federal Employees Paid Parental Leave
			 Act of 2008</short-title></quote>.</text>
		</section><section id="H27EDA9F32D0E43B5AAEAAE98F1906E00"><enum>2.</enum><header>Paid parental
			 leave under title 5</header>
			<subsection id="H4A4AA65AFED24CA7A0C13EEED3DA2EA3"><enum>(a)</enum><header>Amendment to
			 title 5</header><text display-inline="yes-display-inline">Subsection (d) of
			 <external-xref legal-doc="usc" parsable-cite="usc/5/6382">section 6382</external-xref> of title 5, United States Code, is amended—</text>
				<paragraph id="H74E8930CC03745FCA503ACA3D78E8C76"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating such subsection as
			 subsection (d)(1);</text>
				</paragraph><paragraph id="H7A13D6C5475F44CFA7B21E745CB45F3F"><enum>(2)</enum><text>by striking
			 <quote>subparagraphs (A), (B), (C), and</quote> and inserting
			 <quote>subparagraphs (C) and</quote>; and</text>
				</paragraph><paragraph id="HB211BB3B0DCC47BC8DB7E0B366D1511B"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block id="HBEAB2CA60EBF4B2891D0235752751156" style="OLC">
						<paragraph id="H0547067EB2594D16B6DAED595E767EB" indent="up1"><enum>(2)</enum><text>An employee may elect to substitute
				for any leave without pay under subparagraph (A) or (B) of subsection (a)(1)
				any paid leave which is available to such employee for that purpose.</text>
						</paragraph><paragraph id="H1870121C84DE4DB8A5752DDA45F01FED" indent="up1"><enum>(3)</enum><text>The paid leave that is available to
				an employee for purposes of paragraph (2) is—</text>
							<subparagraph id="H91F3153D7093436FBFC0A4948FDD988B"><enum>(A)</enum><text>8 administrative workweeks of paid
				parental leave under this subparagraph in connection with the birth or
				placement involved; and</text>
							</subparagraph><subparagraph id="H54F4CF85B85149229FF24B549CE8669"><enum>(B)</enum><text>any annual or sick leave accrued or
				accumulated by such employee under subchapter I.</text>
							</subparagraph></paragraph><paragraph id="H51CCC5E7444D47E994CAD0B9F1C71DC" indent="up1"><enum>(4)</enum><text>Nothing in this subchapter shall be
				considered to require—</text>
							<subparagraph id="H952CE0040F80444187C331748F6BB81"><enum>(A)</enum><text>that an employing agency provide paid
				sick leave in any situation in which such employing agency would not normally
				be required to provide such leave; or</text>
							</subparagraph><subparagraph id="H43B6E7D51BED4C85BD9356798BF4CB9"><enum>(B)</enum><text>that an employee first use all or any
				portion of the leave described in subparagraph (B) of paragraph (3) before
				being allowed to use the paid parental leave described in subparagraph (A) of
				such subparagraph.</text>
							</subparagraph></paragraph><paragraph id="H6941731D2409496F86A600D913540000" indent="up1"><enum>(5)</enum><text>Paid parental leave under paragraph
				(3)(A)—</text>
							<subparagraph id="H8089ADBE250147EE987442E9A4FEDB54"><enum>(A)</enum><text>shall be payable from any
				appropriation or fund available for salaries or expenses for positions within
				the employing agency;</text>
							</subparagraph><subparagraph id="HF5CB115A403A483284C1AF7FADF0627C"><enum>(B)</enum><text>shall not be considered to be annual
				or vacation leave for purposes of section 5551 or 5552 or for any other
				purpose; and</text>
							</subparagraph><subparagraph id="H07153C336F714B490038A4ADC2CB20C7"><enum>(C)</enum><text>if not used by the employee before the
				end of the 12-month period (as referred to in subsection (a)(1)) to which it
				relates, shall not accumulate for any subsequent use.</text>
							</subparagraph></paragraph><paragraph id="H7C0191B9BE484E36AE498000DBEEC403" indent="up1"><enum>(6)</enum><text>The Director of the Office shall
				prescribe any regulations necessary to carry out this subsection, including,
				subject to paragraph (4)(B), the manner in which an employee may designate any
				day or other period as to which such employee wishes to use paid parental leave
				described in paragraph
				(3)(A).</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HD70FE5D3A8474ECA8372DB5DAE258309"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by this section shall not be effective
			 with respect to any birth or placement occurring before the end of the 6-month
			 period beginning on the date of the enactment of this Act.</text>
			</subsection></section><section id="H11710A50682647FE821C52009E606C38"><enum>3.</enum><header>Paid parental
			 leave for Congressional employees</header>
			<subsection id="H3E30389A2A4F429FA90438DB60AEE229"><enum>(a)</enum><header>Amendment to
			 Congressional Accountability Act</header><text>Section 202 of the Congressional
			 Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1312">2 U.S.C. 1312</external-xref>) is amended—</text>
				<paragraph id="H35C7C630A32A4346A6F280D564E14501"><enum>(1)</enum><text>in subsection
			 (a)(1), by adding at the end the following: <quote>In applying section
			 102(a)(1)(A) and (B) to covered employees, subsection (d) shall
			 apply.</quote>;</text>
				</paragraph><paragraph id="H41B4E3F0A2C04C43AC10539BC00D088"><enum>(2)</enum><text>by
			 redesignating subsections (d) and (e) as subsections (e) and (f), respectively;
			 and</text>
				</paragraph><paragraph id="HAFCA4129CF0B42D49F195F89C35C7EDD"><enum>(3)</enum><text>by inserting after
			 subsection (c) the following:</text>
					<quoted-block display-inline="no-display-inline" id="HECC4E938141D4A03ACC9197BA9C13DAB" style="OLC">
						<subsection id="H78CCB8D46C9C4F8C8025FD0097C47BEB"><enum>(d)</enum><header>Special rule for
				paid parental leave for Congressional employees</header>
							<paragraph display-inline="no-display-inline" id="H2CCD5FB28AA040B5BDF914ED0090BF56"><enum>(1)</enum><header>Substitution of
				paid leave</header><text>A covered employee taking leave without pay under
				subparagraphs (A) or (B) of section 102(a)(1) of the Family and Medical Leave
				Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(a)(1)</external-xref>) may elect to substitute for any such leave
				any paid leave which is available to such employee for that purpose.</text>
							</paragraph><paragraph id="HFCC8DD8F6A26473482A489076C577093"><enum>(2)</enum><header>Amount of paid
				leave</header><text>The paid leave that is available to a covered employee for
				purposes of paragraph (1) is—</text>
								<subparagraph id="H9E077A671EF445179DD977969DF8095D"><enum>(A)</enum><text>8 workweeks of
				paid parental leave under this subparagraph in connection with the birth or
				placement involved; and</text>
								</subparagraph><subparagraph id="H3FFD576F090342FAA5A168AC3630C4B5"><enum>(B)</enum><text>any additional
				paid vacation or sick leave provided by the employing office to such
				employee.</text>
								</subparagraph></paragraph><paragraph id="H3075C65056014F27B5EAA2563E1C0298"><enum>(3)</enum><header>Limitation</header><text>Nothing
				in this section shall be considered to require—</text>
								<subparagraph id="H68A0A022A08B410A9FB9002184617BEE"><enum>(A)</enum><text>that an employing
				office provide paid sick leave in any situation in which such employing office
				would not normally be required to provide such leave; or</text>
								</subparagraph><subparagraph id="H4A05E82382DF468793B7748B27913552"><enum>(B)</enum><text>that a covered
				employee first use all or any portion of the leave described in subparagraph
				(B) of paragraph (2) before being allowed to use paid parental leave described
				in subparagraph (A) of such paragraph.</text>
								</subparagraph></paragraph><paragraph id="H5A5AEBF08ACF4BD1946715217106ED1D"><enum>(4)</enum><header>Additional
				rules</header><text>Paid parental leave under paragraph (2)(A)—</text>
								<subparagraph id="H5B2DC259BEC146E191F2C2C82588BB55"><enum>(A)</enum><text>shall be payable
				from any appropriation or fund available for salaries or expenses for positions
				within the employing office; and</text>
								</subparagraph><subparagraph id="H1B8DA48477644A31B8D1A23BDDA0CA28"><enum>(B)</enum><text display-inline="yes-display-inline">if not used by the covered employee before
				the end of the 12-month period (as referred to in section 102(a)(1) of the
				Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(a)(1)</external-xref>)) to which it
				relates, shall not accumulate for any subsequent
				use.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H4068010F7F934F86AE8600B9978DF337"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by this section shall not be effective
			 with respect to any birth or placement occurring before the end of the 6-month
			 period beginning on the date of the enactment of this Act.</text>
			</subsection></section><section id="H63D65F2D02BE40E0A82789E68D84E9FE"><enum>4.</enum><header>Conforming
			 amendment to Family and Medical Leave Act for GAO and Library of Congress
			 employees</header><text display-inline="no-display-inline">Section 102(d) of
			 the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(d)</external-xref>) is amended by
			 adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H51D282C59C1A432FA51EC3FC4CC93594" style="OLC">
				<paragraph id="H378EABBE2BCA4D35A1A3D9B1596BF5D2"><enum>(3)</enum><header>Special rule for
				GAO and Library of Congress employees</header>
					<subparagraph id="H8619E0B420B74AA385A639997BFE50E2"><enum>(A)</enum><header>Substitution of
				paid leave</header><text>An employee of an employer described in section
				101(4)(A)(iv) taking leave under subparagraphs (A) or (B) of subsection (a)(1)
				may elect to substitute for any such leave any paid leave which is available to
				such employee for that purpose.</text>
					</subparagraph><subparagraph id="H2791EA27D72B4069B5A707667F5E8712"><enum>(B)</enum><header>Amount of paid
				leave</header><text>The paid leave that is available to an employee of an
				employer described in section 101(4)(A)(iv) for purposes of paragraph (1)
				is—</text>
						<clause id="H3D6E7F03BE3542A6A6D89500F4128612"><enum>(i)</enum><text>8
				workweeks of paid parental leave under this clause in connection with the birth
				or placement involved; and</text>
						</clause><clause id="HAE12E88E44124434B101263BFD5B8310"><enum>(ii)</enum><text>any additional
				paid vacation or sick leave provided by such employer.</text>
						</clause></subparagraph><subparagraph id="H0660BA4AAE1D4720A081BAB0C3C63785"><enum>(C)</enum><header>Limitation</header><text display-inline="yes-display-inline">Nothing in this paragraph shall be
				considered to require—</text>
						<clause id="H8BF72B56D6B84E3C0069894EA1081521"><enum>(i)</enum><text display-inline="yes-display-inline">that an employer described in section
				101(4)(A)(iv) provide paid sick leave in any situation in which such employer
				would not normally be required to provide such leave; or</text>
						</clause><clause id="HFCEBC2D6BFD64101BC402E3BD819CA9"><enum>(ii)</enum><text>that an employee
				of such an employer first use all or any portion of the leave described in
				clause (ii) of subparagraph (B) before being allowed to use paid parental leave
				described in clause (i) of such subparagraph.</text>
						</clause></subparagraph><subparagraph id="HC5EE91349ACB4FB89D02750066378533"><enum>(D)</enum><header>Additional
				rules</header><text>Paid parental leave under subparagraph (B)(i)—</text>
						<clause id="H354ED7792E8E4834964EF9AE243C81C"><enum>(i)</enum><text display-inline="yes-display-inline">shall be payable from any appropriation or
				fund available for salaries or expenses for positions with employers described
				in section 101(4)(A)(iv); and</text>
						</clause><clause id="HDD2796FB51844C5FAAA56540E2602956"><enum>(ii)</enum><text>if not used by
				the employee of such employers before the end of the 12-month period (as
				referred to in subsection (a)(1)) to which it relates, shall not accumulate for
				any subsequent
				use.</text>
						</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H871D4D815C8944CF84C3ECF1DD003238"><enum>5.</enum><header>Study</header>
			<subsection id="H0700CCFF68EA4E379671ABD532386588"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than 12
			 months after the date of the enactment of this Act, the Government
			 Accountability Office shall study and submit to Congress a written report on
			 the feasibility and desirability of providing an insurance benefit to Federal
			 employees which affords partial or total wage replacement with respect to
			 periods of qualified leave.</text>
			</subsection><subsection id="HC41AF0A6187B4B9E97CF40C0E2FA987E"><enum>(b)</enum><header>Period of
			 qualified leave</header><text>For purposes of this section, the term
			 <term>period of qualified leave</term>, as used with respect to a Federal
			 employee, means any period of leave under <external-xref legal-doc="usc" parsable-cite="usc/5/6382">section 6382</external-xref> of title 5, United
			 States Code, which would otherwise be leave without pay, and which is available
			 by reason of—</text>
				<paragraph id="H009832824E7C4B35A2D500AC86CD2189"><enum>(1)</enum><text>the need to care
			 for the spouse or a son, daughter, or parent of the employee having a serious
			 health condition; or</text>
				</paragraph><paragraph id="HBF9D91E7A23B4AA394D6C9891DB059EF"><enum>(2)</enum><text>a
			 serious health condition affecting the employee that renders such employee
			 unable to perform the functions of the employee’s position.</text>
				</paragraph></subsection><subsection id="H2D2E0EBB6C88475584A9646E5F45CA03"><enum>(c)</enum><header>Matters for
			 inclusion</header><text>The report shall include, at a minimum, the
			 following:</text>
				<paragraph id="HBC3BD643DA3B427BAFA62E3C338CB8D0"><enum>(1)</enum><text>A
			 brief description of any plans or arrangements under which similar benefits are
			 currently provided to employees in this country (within the private sector or
			 State or local government) or in other countries.</text>
				</paragraph><paragraph id="H20F8746E61AE4FB792821B444B962769"><enum>(2)</enum><text>With respect to
			 any plans or arrangements under which such benefits are currently provided to
			 private or public sector employees in this country—</text>
					<subparagraph id="HAB143278555C494E94596EABD3256C51"><enum>(A)</enum><text>the portion or
			 percentage of wages typically replaced;</text>
					</subparagraph><subparagraph id="H2B8E56B5BADC4480B15F55EDB770B6D7"><enum>(B)</enum><text>how those benefits
			 are generally funded, including in terms of the employer and employee shares;</text>
					</subparagraph><subparagraph id="HFF2362423C9141CC8DF709001F764CCC"><enum>(C)</enum><text display-inline="yes-display-inline">whether employee coverage is optional or
			 automatic; and</text>
					</subparagraph><subparagraph id="H3B8D57E325FF4BFC8D94B5FE003300"><enum>(D)</enum><text>any waiting period
			 or other conditions which may apply.</text>
					</subparagraph></paragraph><paragraph id="HB2E9450D1C284BABAE61801319D539F"><enum>(3)</enum><text>Identification and
			 assessment of any plans or arrangements described under the preceding
			 provisions of this subsection (or any aspects thereof) which might be
			 particularly relevant to designing the insurance benefit (described in
			 subsection (a)) for Federal employees, including how such benefit might be
			 coordinated with annual leave, sick leave, or any other paid leave available to
			 an employee for the purpose involved.</text>
				</paragraph></subsection></section></legis-body>
