		  to establish a floor for payment for mammography under the Medicare
		  Program.</official-title>

		<section id="HCE8D3CB067FA47188727CACDA5D3C91" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Assure
			 Access to Mammography Act of 2008</quote>.</text>
		</section><section id="HFCDA39DBF26344A9AA90C13837370018"><enum>2.</enum><header>Medicare payment
			 floor for mammography</header><text display-inline="no-display-inline">Section
			 1848(b) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-4">42 U.S.C. 1395w–4</external-xref>) is amended by adding at
			 the end the following new paragraph:</text>

				<paragraph id="HCCF70C8AAC5241DD9BC52C696BA0A9D8"><enum>(5)</enum><header>Payment floor
				for screening and diagnostic mammography</header>
					<subparagraph id="H57AAEF525D08470E9C921E6FC6ED4D8"><enum>(A)</enum><header>In
				general</header><text>In the case of mammography, whether screening or
				diagnostic, performed in a year beginning with 2009, the fee schedule amount
				shall not be less than the amount specified in subparagraph (B) for that year.
				Such amount shall be subject to geographic area adjustment in the same manner
				as for other physicians’ services under this section.</text>
					</subparagraph><subparagraph id="H2EB4E3C655344C449FFB6477CDD72B21"><enum>(B)</enum><header>Amount</header><text>The
				amount specified in this subparagraph—</text>
						<clause id="HA1BC91F4BAB64E18AEEEE0089188B33"><enum>(i)</enum><text>for
				2009 is 115 percent of the fee schedule amount under this section with respect
				to mammography for 2008, increased by the percentage increase in the MEI (as
				defined in section 1842(i)(3)) for 2008; and</text>
						</clause><clause id="HB1E9164CF46846F38E3CC5BAF14B3C8"><enum>(ii)</enum><text display-inline="yes-display-inline">for a subsequent year is the amount
				specified in this subparagraph for the previous year increased by the
				percentage increase in the MEI (as so defined) for such previous
				year.</text>
