<section id="HDC00A71D64F54A81B960AC4DAEFA83B2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veterans Disability Fairness Act</short-title></quote>.</text> </section>
<section id="H8330F3C67E8647F5BF7DF3DFFF1E61E8"><enum>2.</enum><header>Quality assurance relating to disability compensation under laws administered by Secretary of Veterans Affairs</header> 
<subsection id="H49E58440530F42999BA8D4F349AD416C"><enum>(a)</enum><header>Quality assurance requirements</header> 
<paragraph id="H21AE222FD98B4DB0BA14766043E9F7DD"><enum>(1)</enum><header>In general</header><text>Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/77">chapter 77</external-xref> of title 38, United States Code, is amended by adding at the end the following new section:</text> 
<quoted-block display-inline="no-display-inline" id="H66C2E2EC612045B2B0345FD095331584" style="USC"> 
<section id="HFB231226215C4FC200AF577C06988518"><enum>7735.</enum><header>Quality assurance relating to disability compensation</header> 
<subsection id="H1185B26DD5174CB6B25BE288463F3F"><enum>(a)</enum><header>Quality assurance</header><text display-inline="yes-display-inline">In order to carry out the quality assurance program under section 7731 of this title with respect to the administration of disability compensation, the Secretary shall ensure the accuracy and consistency across different offices within the Department of the treatment of claims for disability compensation, including determinations with respect to disability ratings and whether a disability is service-connected.</text> </subsection>
<subsection id="HAC73AD51FA5044FD9F23366ECF5F4500"><enum>(b)</enum><header>Treatment of data</header> 
<paragraph id="HF4E9B26B71E041BDAD1632DA41CC9B25"><enum>(1)</enum><header>Retention and monitoring</header><text>The Secretary shall retain, monitor, and store in an accessible format data described in paragraph (2).</text> </paragraph>
<paragraph id="HC5154BE693F4492C9F05F7DFAC9FF9EE"><enum>(2)</enum><header>Covered data</header><text>The data described in this paragraph includes the following:</text> 
<subparagraph id="H3539DA87FC0042F69E37FE4F9687D324"><enum>(A)</enum><text>For each claim for disability compensation under laws administered by the Secretary submitted by a claimant—</text> 
<clause id="HCD4525A122F0495CA52D498D9DC7034"><enum>(i)</enum><text>the State in which the claimant resided when the claim was submitted;</text> </clause>
<clause id="HF00F22CFA5A048C3A47ECB01A85891DE"><enum>(ii)</enum><text>the decision of the Secretary with respect to the claim;</text> </clause>
<clause id="H7300C4A955AC4CCAB44E8D8F9D77DBC2"><enum>(iii)</enum><text>the regional office and individual employee of the Department responsible for evaluating the claim; and</text> </clause>
<clause id="HF782A2BFA4194D7B9E05CD4CD4399508"><enum>(iv)</enum><text>if the claim was adjudicated, the results of such adjudication.</text> </clause></subparagraph>
<subparagraph id="H9D4E5BF5EC2A4C66B600D335AE944D6"><enum>(B)</enum><text>The State of the claimant’s residence.</text> </subparagraph>
<subparagraph id="HDE8C36D7FA7B4B8D8CE5864FA531CA1C"><enum>(C)</enum><text>Such other data as the Secretary determines is appropriate for monitoring the accuracy and consistency of decisions with respect to such claims.</text> </subparagraph></paragraph></subsection>
<subsection id="H06421E41B2684FD1BC6BA2966F7D96B6"><enum>(c)</enum><header>Reviews and audits</header>
<paragraph commented="no" display-inline="yes-display-inline" id="H22A89B381A6B4574ABC8387019F95FB3"><enum>(1)</enum><text>The Secretary shall conduct reviews and audits, at least annually, to identify and correct any inaccuracies or inconsistencies in disability ratings and the adjudication of claims for disability compensation under chapter 11 of this title. Such reviews and audits shall evaluate disability ratings and claims adjudication by regional office and by the employee responsible for each such rating or adjudication.</text> </paragraph>
<paragraph id="H215EF8ABDB51474A8CE9EC9100C80500" indent="up1"><enum>(2)</enum><text>In conducting reviews and audits under this subsection, the Secretary shall conduct a sufficient number of such reviews and audits to provide for statistically valid conclusions to be drawn.</text> </paragraph></subsection>
<subsection id="HAD1ED05CB62942ABA7F7444E1CA9794D"><enum>(d)</enum><header>Evaluation of employees</header><text>In evaluating an employee of the Department whose responsibilities include the rating of disabilities or the adjudication of claims for disability compensation under chapter 11 of this title, the Secretary shall consider factors relating to the accuracy and consistency with which such employee performs such responsibilities.</text> </subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph>
<paragraph id="HF58DA0E0CBC04DEC97FAB2C56CB24293"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by adding at the end of the items relating to subchapter II the following new item:</text>

<subsection id="HEE51ECE068D942B48DF3CE6CF2E7C3B"><enum>(b)</enum><header>Report to Congress</header><text>Not later than 60 days after the date of the enactment of this Act, the Secretary of Veterans Affairs shall submit to Congress a report on the implementation of <external-xref legal-doc="usc" parsable-cite="usc/38/7735">section 7735</external-xref> of title 38, United States Code, as added by subsection (a).</text> </subsection>
<subsection id="H6B5A2362536C447483C7EC806693C239"><enum>(c)</enum><header>Inclusion of information relating to consistency of decisions in annual report</header><text><external-xref legal-doc="usc" parsable-cite="usc/38/7734">Section 7734(2)</external-xref> of title 38, United States Code, is amended by inserting <quote>and consistency</quote> after <quote>accuracy</quote>.</text> </subsection></section>
