		<legis-type>A BILL</legis-type>
		<official-title>To amend the Internal Revenue Code of 1986 to allow a
		  $1,000 refundable credit for individuals who are bona fide volunteer members of
		  volunteer firefighting and emergency medical service
		  organizations.</official-title>

		<section id="HB69CCAEE92FD4CFB9646B9B504A8558C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Supporting Emergency Responders
			 Volunteer Efforts Act of 2008</short-title></quote> or the <quote><short-title>SERVE Act of 2008</short-title></quote>.</text>
		</section><section id="H1924516905294DEB0000EB05423F02C8"><enum>2.</enum><header>Refundable credit
			 for bona fide volunteer members of volunteer emergency response
			 organizations</header>
			<subsection id="HAC4657C8BAD94038AB2058E6F8D91BDF"><enum>(a)</enum><header>In
			 general</header><text>Subpart C of part IV of subchapter A of chapter 1 of the
			 Internal Revenue Code of 1986 (relating to refundable credits) is amended by
			 redesignating section 36 as section 37 and by inserting after section 35 the
			 following new section:</text>

					<section id="H274B3BD6315449BCABE864E65933C3DF"><enum>36.</enum><header>Bona fide
				volunteer members of volunteer emergency response organizations</header>
						<subsection id="H1B24D2F51FBF4ACEBE50B0A1FF517731"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">In the case of an
				individual who at any time during the taxable year is a bona fide volunteer
				member of a qualified volunteer emergency response organization, there shall be
				allowed as a credit against the tax imposed by this subtitle the amount of
				$1,000.</text>
						</subsection><subsection id="HD8A1AFEBFABA414AAE60F6C26E545D6D"><enum>(b)</enum><header>Part-Year active
				members</header><text display-inline="yes-display-inline">In the case of an
				individual who is a bona fide volunteer member of a qualified volunteer
				emergency response organizations for only a portion of a taxable year, the
				amount of the credit under subsection (a) for such taxable year shall be an
				amount which bears the same ratio to $1,000 as such portion bears to the entire
				taxable year.</text>
						</subsection><subsection id="HF8341625507D4BB3AEADE061CAF5FB5"><enum>(c)</enum><header>Definitions</header><text>For
				purposes of this section—</text>
							<paragraph id="H6CFB16347BF448EBA5F7EC0AE6F5208"><enum>(1)</enum><header>Bona fide
				volunteer member of a qualified volunteer emergency response
				organizations</header>
								<subparagraph id="H10F087FB47834679BB210593FECD9F00"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">An individual shall
				be treated as a bona fide volunteer of a qualified volunteer emergency response
				organizations for purposes of this section if—</text>
									<clause id="HFD429F8B61934A709164E9D2328B3F3E"><enum>(i)</enum><text>the only
				compensation received by such individual for performing qualified services is
				in the form of—</text>
										<subclause id="H5C4B02AA271E40C2A08B67012292F76"><enum>(I)</enum><text>reimbursement for
				(or a reasonable allowance for) reasonable expenses incurred in the performance
				of such services, or</text>
										</subclause><subclause id="H5D33EA53DABC47B7BA2C1EFCB810E902"><enum>(II)</enum><text>reasonable
				benefits (including length of service awards), and nominal fees for such
				services, customarily paid by eligible employers in connection with the
				performance of such services by volunteers, and</text>
										</subclause></clause><clause id="HB30ECD183F494C0F94EA41920091EA11"><enum>(ii)</enum><text>the aggregate
				amount of such compensation for the taxable year for providing qualified
				services does not exceed an amount equal to the annual limitation.</text>
									</clause></subparagraph><subparagraph id="H2405EFE0020F435AB672E7C2C6C703A2"><enum>(B)</enum><header>Annual
				limitation</header><text>For purposes of subparagraph (A), the annual
				limitation is an amount equal to the product of—</text>
									<clause id="H4D849B7AF75344E2B94E00E6A0C5A75"><enum>(i)</enum><text>the
				minimum wage in effect under section 6(a)(1) of the Fair Labor Standards Act of
				1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/206">29 U.S.C. 206(a)(1)</external-xref>) on the first day of the calendar year beginning in
				the taxable year, multiplied by</text>
									</clause><clause id="H01061F86125C4E0F83948B88B4230075"><enum>(ii)</enum><text>2,080
				hours.</text>
									</clause></subparagraph><subparagraph id="HF9C34161FDD64C34001E9FC2E0FECCD"><enum>(C)</enum><header>Coordination with
				exclusion</header><text>Amounts excluded from gross income under section 139B
				shall not be taken into account for purposes of subparagraph (A).</text>
								</subparagraph></paragraph><paragraph id="H2DE2D3C585AB479895D8F89316078477"><enum>(2)</enum><header>Qualified
				services</header><text>For purposes of this paragraph, the term
				<quote>qualified services</quote> means fire fighting and prevention services,
				emergency medical services, and ambulance services.</text>
							</paragraph><paragraph id="HBEDF98681DCA464396F3B5625FE99D5E"><enum>(3)</enum><header>Qualified
				volunteer emergency response organizations</header><text>The term
				<quote>qualified volunteer emergency response organizations</quote> has the
				meaning given such term by section
				139B(c)(3).</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HB483899523AF431FB5B1BA6DAFF1D7C"><enum>(b)</enum><header>Conforming
			 amendments</header>
				<paragraph id="HA746BA8663A64D11BA346E5F95A14582"><enum>(1)</enum><text>Paragraph (2) of
			 <external-xref legal-doc="usc" parsable-cite="usc/31/1324">section 1324(b)</external-xref> of title 31, United States Code, is amended by inserting
			 <quote>or 36</quote> after <quote>section 35</quote>.</text>
				</paragraph><paragraph id="H257CB3BA2405409CA864303E60903EEB"><enum>(2)</enum><text>The table of
			 sections for subpart C of part IV of subchapter A of chapter 1 of the Internal
			 Revenue Code of 1986 is amended by redesignating the item relating to section
			 36 as an item relating to section 37 and by inserting before the item relating
			 to section 37 the following new item:</text>

						</toc>
						<after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HCB62666DB55849218B5E05D68E94ACC9"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to taxable
			 years beginning after the date of the enactment of this Act.</text>
