		<official-title>To amend the Uniformed and Overseas Citizens Absentee
		  Voting Act to direct the Secretary of Defense to collect absentee ballots of
		  absent overseas uniformed services voters for elections for Federal office and
		  deliver the ballots to State election officials prior to the time established
		  for the closing of the polls on the date of the election, and for other
		  purposes.</official-title>

		<section id="H7D2A83EB96DC4223B24E2795B60258B9" section-type="section-one"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Military Voting Protection Act of
			 2008</short-title></quote>.</text>
		</section><section id="HAEC205C5B472430D9E101B1E8EFD5E10"><enum>2.</enum><header>Requiring
			 Collection and Delivery of Absentee Ballots of Absent Overseas Uniformed
			 Services Voters</header>
			<subsection id="HC37D99B898A54B589D20DC0040511187"><enum>(a)</enum><header>Requiring
			 Collection and Delivery by Secretary of Defense</header><text display-inline="yes-display-inline">The Uniformed and Overseas Citizens
			 Absentee Voting Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1973ff">42 U.S.C. 1973ff et seq.</external-xref>) is amended by inserting after
			 section 103 the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="H5B15502143A14122A2AFBF50A90C8DD" style="OLC">
					<section id="H13D6E669BAB84914B8D2CD007E00CBD1"><enum>103A.</enum><header>Collection and
				Delivery of Absentee Ballots of Absent Overseas Uniformed Services
				Voters</header>
						<subsection id="H1CF7C4D4E6674187007D6BD48B2FC5A"><enum>(a)</enum><header>Collection</header><text display-inline="yes-display-inline">The Presidential designee shall establish
				procedures for collecting absentee ballots of absent overseas uniformed
				services voters in elections for Federal office, including absentee ballots
				prepared by States and the Federal write-in absentee ballot prescribed under
				section 103, and for delivering the ballots to the appropriate State election
				officials.</text>
						</subsection><subsection id="H308FD3663E39405EA58D19B9C78173BF"><enum>(b)</enum><header>Ensuring
				Delivery Prior to Closing of Polls</header>
							<paragraph id="H5AD36B288362405FA2983F388FF9F0CD"><enum>(1)</enum><header>In
				general</header><text>Under the procedures established under this section, the
				Presidential designee shall ensure that any absentee ballot collected prior to
				the applicable deadline described in paragraph (2) is delivered to the
				appropriate State election official prior to the time established by the State
				for the closing of the polls on the date of the election.</text>
							</paragraph><paragraph id="H57632F4C8EF54482B9253E698E715CD3"><enum>(2)</enum><header>Applicable
				deadline</header><text>The applicable deadline described in this paragraph
				is—</text>
								<subparagraph id="HCDB045DB45D0489E88A81440261368EF"><enum>(A)</enum><text display-inline="yes-display-inline">noon (in the location in which the ballot
				is collected) on the last Friday that precedes the date of the election
				involved, in the case of a regularly scheduled general election for Federal
				office; or</text>
								</subparagraph><subparagraph id="HE5CAECA7AA264F6B91C569310091CCD6"><enum>(B)</enum><text>noon (in the
				location in which the ballot is collected) on the fourth day that immediately
				precedes the date of the election involved, in the case of any other election
				for Federal office.</text>
								</subparagraph></paragraph></subsection><subsection id="H29FFD879A4F84F0C8FBDC2F1A1008860"><enum>(c)</enum><header>Use of
				Contractors</header>
							<paragraph id="H1AEBD581D323401385A5FDEABEF701E6"><enum>(1)</enum><header>Use of
				contractor permitted</header><text>To the greatest extent practicable, the
				Presidential designee shall carry out this section by contract with a private
				provider of air transportation.</text>
							</paragraph><paragraph id="HA4E0E1F92ABF4B969E84E8AA5B002265"><enum>(2)</enum><header>Tracking
				mechanism</header><text display-inline="yes-display-inline">Any contract
				entered into pursuant to paragraph (1) shall include a requirement that the
				private provider of air transportation implement procedures to enable any
				individual whose absentee ballot is collected by the Presidential designee
				under the procedures established under this section to track the progress of
				the ballot using the Internet, an automated telephone system, or such other
				methods as may be provided under the contract.</text>
							</paragraph></subsection><subsection id="HCA9A9DB4310049D9ACF6200000601430"><enum>(d)</enum><header>Absent Overseas
				Uniformed Services Voter Defined</header><text>In this section, the term
				<term>absent overseas uniformed services voter</term> means an overseas voter
				described in section 107(5)(A).</text>
						</subsection><subsection id="H3429EB8493FF486B902F148B00BCB9F"><enum>(e)</enum><header>Authorization of
				Appropriations</header><text>There are authorized to be appropriated to the
				Presidential designee such sums as may be necessary to carry out this section.
				Any amounts appropriated pursuant to the authorization under this subsection
				shall remain available until expended without fiscal year
				limitation.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H307080658B60435BB5F6B7BDA17B38BD"><enum>(b)</enum><header>Conforming
			 Amendments</header>
				<paragraph id="HAEEAF504E27340DCA5CA55F869E0507E"><enum>(1)</enum><header>Federal
			 responsibilities</header><text>Section 101(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1973ff">42 U.S.C. 1973ff(b)</external-xref>)
			 is amended—</text>
					<subparagraph id="HBC2C30417B12418485EF5850D3944BE"><enum>(A)</enum><text>by striking
			 <quote>and</quote> at the end of paragraph (6);</text>
					</subparagraph><subparagraph id="HD84914BFF99F4C9BAFE8C432D7E2C6C4"><enum>(B)</enum><text>by striking the
			 period at the end of paragraph (7) and inserting <quote>; and</quote>;
			 and</text>
					</subparagraph><subparagraph id="HE1ADAC068C934CAD871E5E63F55EC46E"><enum>(C)</enum><text>by adding at the
			 end the following new paragraph:</text>
						<quoted-block display-inline="no-display-inline" id="H9C1C8D48A3754FCAA395FCE9D678F39" style="OLC">
							<paragraph id="H24B9BB2E23434FA5A3712E6284F000AC"><enum>(8)</enum><text display-inline="yes-display-inline">carry out section 103A with respect to the
				collection and delivery of absentee ballots of absent overseas uniformed
				services voters in elections for Federal
				office.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HC26A809B1C1D415ABB4789623E39D7C3"><enum>(2)</enum><header>State
			 responsibilities</header><text>Section 102(a) of such Act (42 U.S.C.
			 1973ff–1(a)) is amended—</text>
					<subparagraph id="HAA5C18EDFA7445DBAD4115C6D7EFA990"><enum>(A)</enum><text>by striking
			 <quote>and</quote> at the end of paragraph (4);</text>
					</subparagraph><subparagraph id="HDAF7BE93FDD0469DA2D2BE932323E3D1"><enum>(B)</enum><text>by striking the
			 period at the end of paragraph (5) and inserting <quote>; and</quote>;
			 and</text>
					</subparagraph><subparagraph id="H5D83D847F92C480496D000FBF61EC61B"><enum>(C)</enum><text>by adding at the
			 end the following new paragraph:</text>
						<quoted-block display-inline="no-display-inline" id="H39EC55299E734EB7006CBD12F9499DB9" style="OLC">
							<paragraph id="HC0A5267D7027414E8520AE3192FF19F8"><enum>(6)</enum><text display-inline="yes-display-inline">carry out section 103A(b)(2) with respect
				to the processing and acceptance of absentee ballots of absent overseas
				uniformed services
				voters.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="H83430B086AEB4653BE81CF9478BBE477"><enum>(c)</enum><header>Effective
			 Date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall apply with respect to the regularly scheduled general
			 election for Federal office held in November 2008 and each succeeding election
			 for Federal office.</text>
			</subsection></section><section id="HCCF437C297BA406AA6838FC50CC0104"><enum>3.</enum><header>Protecting Voter
			 Privacy and Secrecy of Absentee Ballots</header><text display-inline="no-display-inline">Section 101(b) of the Uniformed and Overseas
			 Citizens Absentee Voting Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1973ff">42 U.S.C. 1973ff(b)</external-xref>), as amended by section 2(b),
			 is amended—</text>
			<paragraph id="HF2353D51A7034C95B43C5D6BEFE51BBB"><enum>(1)</enum><text>by striking
			 <quote>and</quote> at the end of paragraph (7);</text>
			</paragraph><paragraph id="HDC8AE5AE08A54A438D7FAFCEA6CF97EF"><enum>(2)</enum><text>by striking the
			 period at the end of paragraph (8) and inserting <quote>; and</quote>;
			 and</text>
			</paragraph><paragraph id="H79DE4F7CEAFD4774B601E4B8B8B16F24"><enum>(3)</enum><text>by adding at the
			 end the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="H44354690C32B4E5383ED9E84501E5C40" style="OLC">
					<paragraph id="HDD98438003EE41BA9C2BB32493B24FDC"><enum>(9)</enum><text display-inline="yes-display-inline">take such actions as may be required to
				ensure that absent uniformed services voters are able to cast absentee ballots
				in a private and independent manner, and that the contents of absentee ballots
				of absent uniformed services voters and overseas voters will remain secret
				until tabulation by the appropriate State election
				official.</text>
