<official-title>To amend the Small Business Act to improve the availability of disaster loans to individuals and businesses affected by catastrophic incidents.</official-title>

<section id="H6C40F8F8B3AC4C8ABF57640300D70077" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Small Business Disaster Loan Improvement Act of 2007</short-title></quote>.</text></section> 
<section id="H15E4662FBFFD4264A7DCA99E9511CEFF"><enum>2.</enum><header>Availability of disaster loans for catastrophic incidents</header><text display-inline="no-display-inline">Section 7 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636</external-xref>) is amended by adding at the end the following new subsection:</text> 
<quoted-block style="OLC" id="H3A181AA5604B435B8D5B8C4C08D0C626" display-inline="no-display-inline"> 
<subsection id="HD5FF1BB67095462F812259C31D3729A0"><enum>(o)</enum><header>Improvements to disaster loan program with respect to catastrophic incidents</header> 
<paragraph id="H45D6C33B96EB43B1994980D6D0BC00A9"><enum>(1)</enum><header>Definition</header><text display-inline="yes-display-inline">In this subsection, the term <quote>catastrophic incident</quote> means a disaster that—</text> 
<subparagraph id="HFADB2AD95DE04BA7AED520EAB500A262"><enum>(A)</enum><text>results in extraordinary levels of mass casualties, damage, or disruption severely affecting the population, infrastructure, environment, economy, national morale, or government functions;</text></subparagraph> 
<subparagraph id="H23949F2EE778489083DF58D746E1626F"><enum>(B)</enum><text>has the potential to result in sustained national impacts over a prolonged period of time;</text></subparagraph> 
<subparagraph id="HA8705975982E491888AE0053B9F0315"><enum>(C)</enum><text>almost immediately exceeds resources normally available to State, local, tribal, and private-sector authorities in the impacted area; and</text></subparagraph> 
<subparagraph id="HDFB483FAA2244E1B8C7625CCE7CB278"><enum>(D)</enum><text>significantly interrupts governmental operations and emergency services to such an extent that national security could be threatened.</text></subparagraph></paragraph> 
<paragraph id="H969E0F943AA94A87BCD30385773847E4"><enum>(2)</enum><header>Availability of disaster loans</header><text>In carrying out the disaster loan program under subsection (b) with respect to a catastrophic incident, the Administrator shall not, in determining whether a person is eligible for such a loan or in determining the amount of such a loan, consider the extent to which—</text> 
<subparagraph id="H9AE22245697A462D91116E55D79462A8"><enum>(A)</enum><text>the loss or damage or injury of the person is compensated for by insurance or otherwise; or</text></subparagraph> 
<subparagraph id="HD3112597B26D48B7A4C719C0B3EAFBA"><enum>(B)</enum><text>the person paid, voluntarily or involuntarily, insurance proceeds to a recorded lienholder.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section id="H798C767FFD444F9F9F73C8EB4050BE94"><enum>3.</enum><header>Retroactivity for victims of Hurricanes Katrina, Rita, and Wilma</header>
<subsection id="H07E66781E57C40F7AAED5CD06B08D8FA"><enum>(a)</enum><header>Retroactivity</header><text display-inline="yes-display-inline">Subsection (o) of the Small Business Act, as added by section 2 of this Act, applies to all catastrophic incidents occurring on or after August 29, 2005.</text></subsection>
<subsection id="H1AF44202FC6C49A3B62241DE2186C200"><enum>(b)</enum><header>Hurricanes Katrina, Rita, and Wilma</header><text>For purposes of subsection (o) of such Act, Hurricanes Katrina, Rita, and Wilma of 2005 are hereby deemed to be catastrophic incidents.</text></subsection>
<subsection id="H71E040D97AA84A1D8C5C58F0B1BF27F2"><enum>(c)</enum><header>Review and compliance</header><text>The Administrator of the Small Business Administration shall ensure that all applications, and all loans, under the disaster loan program before the date of the enactment of this Act are reviewed and brought into compliance with this section.</text> </subsection></section>
